A função jurisdicional ordinária e o estado democrático de direito um enfoque institucional

O Estado Democrático de Direito pressupõe uma relação harmoniosa e contínua entre Ética, Política e Direito. É com base nessa premissa que devem ser identificadas as funções estatais, as quais estão relacionadas a determinados planos de fins específicos e convergentes: o nível dos fins últimos (consenso), o nível dos fins intermediários (deliberação) e nível dos fins imediatos (execução). A estrutura da ordem jurídica também observa esses níveis, que podem ser ligados, respectivamente, à função jurisdicional constitucional, à função legislativa e à função jurisdicional ordinária. Essa última função tem o objetivo de aplicar o Direito, de modo imparcial, mediando a generalidade das leis com as particularidades dos casos concretos. O alcance de tal objetivo depende da organização institucional do Estado, pois são as instituições que permitem a adequação de cada função à sua finalidade precípua. No Brasil, o arranjo institucional tem prejudicado a atuação da justiça ordinária, com prejuízo também para o Estado Democrático de Direito. / The Rule of law assumes a harmonious and continuous relationship amongst the Ethics, the Politics and the Law. It is based on this premise that the state functions must be identified, functions which are related to certain levels of specific and convergent ends: the level of final ends (consensus), the level of intermediary ends (deliberation) and the level of immediate ends (execution). The structure of legal order also observes these levels, which may be connected, respectively, to the function of constitutional jurisdiction, to the legislative function and to the function of ordinary jurisdiction. This last function aims to apply the Law, impartially, mediating the generality of the statutes with the particularities of concrete cases. The reach of such objective depends on the institutional organization of the state, because it is the institutions that allow the adequacy of each function to its main purpose. In Brazil, the institutional arrangement has undermined the performance of the ordinary Courts, with loss also to the Rule of Law.

Para isto, aliamos a teoria de controladores fuzzy com métodos numéricos tradicionais. A partir de teoremas clássicos de continuidade e estudos sobre aproximação, vimos que, para alguns casos, as soluções aqui produzidas aproximam-se das teóricas. Fazemos uso da metodologia aqui proposta para analisar modelos de crescimento populacional de espécie isolada e também modelos que envolvem várias espécies. Finalmente, indicamos essa metodologia como uma ferramenta auxiliar para obtenção de parâmetros de equações diferenciais determinísticas / Abstract: In this work we propose a metodology to study Ordinary Differential Equations supposing the direction field is partially known. We join theory of Fuzzy Controlers and traditional numerical methods to develop this study. Using classical theorems of continuity and aproximation theory we saw that, for some cases, the solutions we present here estimate the theorical ones. We'll use the metodology proposed here to analyse unidimensional models of populational growth and models that envolves many species. In this general picture, this work proposes the modelling of the evolutive behavior of pollutants on the water surface of rivers, focusing upon the Rio Balsas, in southern Maranhão State. A presente pesquisa propõe o estudo do fenômeno jogo para além de seu aspecto fundamentalmente humano, instituição do nosso mundo, tal qual a cultura e a sociedade. A hipótese orientadora do trabalho acena para a possibilidade de ser ele, o jogo, na forma do seu aparecimento, modo de acesso a questões cruciais da nossa existência. Prevê, ainda, a Capoeira Angola como manifestação que fornece, particularmente, um denso repertório de significações, uma cosmogonia que nos permite pensar o cosmos em sua essência, sem desprezo do que é subjetivo, o ser-no-mundo que não escapa à influência da experiência estética. Para tanto, as especulações orbitam ao redor do capoeira Geraldo, principal interlocutor do estudo reunido nas páginas seguintes. Seguindo as picadas por ele abertas, transmitidas no cotidiano vivido desde seus antepassados, apresentamos uma leitura específica de alguns dos que poderiam ser chamados fundamentos epistemológicos da Capoeira Angola. Aqueles fundamentos sobremaneira ancorados no corpo, no gesto e na experiência estética culminam com um projeto particular de entendimento do cosmos e da relação do jogador consigo mesmo e com o mundo, a partir do jogo que o joga. Do ponto de vista metodológico, dedicamos as primeiras seções da dissertação à criação de uma ambiência especulativa dentro da qual nossa hipótese é desdobrada. O exame da forma como são registrados os construtos acadêmicos ergue importantes balizas para a circunscrição do que é nomeado, também aqui, conhecimento comum. Se considerássemos lícito, apenas, o conjunto normativo das ciências humanas que, em alguma medida, reproduz aqueles das ciências duras, nosso juízo sobre a cosmogonia da Capoeira Angola fracassaria antes da demonstração dos resultados. Cientes de que nossas considerações repercutem, em igual monta, o pensamento de autores já consagrados no círculo acadêmico, fizemos reunir suas contribuições, e propusemos um espaço de desestabilização epistemológico e metodológico; uma modalidade de compreensão sensível e capaz de colocar a Capoeira Angola e autores da filosofia continental em franco debate, iguais as condições àquelas produzidas no que se quer uma produção partilhada do conhecimento, desde Geraldo, em consonância com a pesquisa há muito colocada em curso por Sérgio Bairon. / This research proposes the study of the play phenomenon beyond its fundamentally human aspect, an institution of our world, as are culture and society. The guiding hypothesis of the work beckons to the possibility of being it, the play, in the form of its appearance, a mode of access to crucial questions of our existence. It also foresees Capoeira Angola as a manifestation, which provides in particular, a dense repertoire of meanings, a cosmogony that allows us to think about the cosmos in its essence, without contempt for what is subjective and the being-in-the-world that doesn\'t escape the influence of aesthetic experience. Therefore, speculations orbit around the capoeira Geraldo, main interlocutor of the study gathered on the following pages. Following the paths opened by him, transmitted on daily life since his ancestors, we present a specific interpretation of some of what could be called the epistemological foundations of Capoeira Angola. Those foundations particularly anchored in the body, gesture and aesthetic experience culminate with a particular project of understanding the cosmos and the player\'s relationship with himself and with the world, from the game that is played. From a methodological point of view, we dedicated the first sections of the dissertation to the creation of a speculative ambience within which our hypothesis is deployed. The examination of the way in which the academic constructs are recorded raises important beacons for the constituency of what is named, also here, \"ordinary knowledge\". If considered lawful, just the normative set of Humanities that, to some extent, reproduces those of hard sciences, our judgment on the cosmogony of the Capoeira Angola would fail before the income statement. Aware that our considerations resonate, in equal mounts, the thought of established authors in the academic circle, we assembled their contributions and proposed a space of epistemological and methodological destabilization; a sensitive understanding that is able to put Capoeira Angola and authors of continental philosophy in an honest debate, in equal conditions to those produced in either a shared production of knowledge, since Geraldo, in line with the long placed in course research by Sérgio Bairon.

Friends, family or foe? : fostering good relationships between lay leaders and the newly appointed ordained leaders of Anglican congregations

Traditional patterns of leadership in the Church of England are changing. The demands of mission in post-Christendom, and renewed attention to the theology of social trinitarianism have focussed attention on the health of the local congregation as the place where the future of the church will be determined. Aware of the damage that disharmony can cause, the Diocese of Chelmsford has supported this research which examines how good relationships between lay and ordained leaders may be fostered, as a contribution to the equipping of congregations for mission. A process of facilitated conversations was held with lay and ordained leaders at the end of a ministerial vacancy, after an appointment had been made. These were analysed in the light of both theological and sociological perspectives on the nature of priesthood and of the local church, and of my own experience as a parish priest and training officer in the church. The process of facilitated conversations enabled differences of attitude and understanding to be articulated. Of particular note was a strong preference for, or reaction against, the use of familial language to describe the local congregation. These differences could be categorised as a contrast between the views held by those who had received no academic training in theology and those who had. A revised pattern of meetings is proposed in the light of these results and the feedback received. The conclusion is that relationships between the lay leaders and the newly appointed priest will benefit from facilitated conversations at the outset of this new period of ministry about the nature of the priestly role and the local church. A good relationship, marked by improved mutual understanding and respect between leaders, will better enable the parishes of the Diocese of Chelmsford to re-envision the missionary task.

"Hej, är det du som ska vara här idag?" : En kvalitativ intervjustudie om förskolevikariers upplevelser av hur det är att komma in i en redan etablerad arbetsgrupp

The research field for this study was the working environment in preschools with the purpose of highlighting the substitute teacher’s experiences of how to enter an already established workgroup in pre-school. How do substitute teachers perceive the treatment when being met by ordinary staff? Do they feel that they are included or excluded from the workgroup? In order to answer these questions, qualitative interviews were conducted with six preschool substitute teachers. Hermeneutics is used as a methodological approach to increase the ability of creating a good understanding of the preschool substitute teacher´s experiences. The results showed that substitute teachers generally are well treated by ordinary staff, however there are exceptions. Two key factors for the substitute teachers to experience inclusion are that they have received good information and that the ordinary staff treated them well. The preschool substitute teachers had also experienced exclusion in the form of inadequate information, which in some cases happened due to stigmatization and domination techniques. The conclusion of this study is that the preschool substitute teachers have experienced varied responses as well as they generally received good treatment by the ordinary staff. Two important factors in experiencing inclusion are that they received the necessary information and got the opportunity to be included in conversations with the ordinary staff. Whereas factors for exclusion are inadequate information and that ordinary staff do not show any interest in them. / Forskningsfältet för denna studie var arbetsmiljö där syftet är att belysa vikariens upplevelser av hur det är att komma in i en redan etablerad arbetsgrupp inom förskoleverksamhet. Hur upplever vikarier att de bemöts av den ordinarie personalen? Upplever vikarier att de är inkluderade eller exkluderade i arbetsgruppen? För att besvara dessa frågor gjordes kvalitativa intervjuer med sex vikarier. För att skapa god förståelse för vikariers upplevelser används hermeneutiken som metodologisk riktning. Resultatet visade att vikarierna generellt blir bra bemötta av ordinarie personal men att det finns undantag. Två centrala faktorer till att vikarierna upplever inkludering beror på att de får bra information och där personalen är trevlig. Vikarier hade även upplevt exkludering i form av bristfällig information samt i vissa fall på grund av stigmatisering och härskartekniker. Slutsatsen är att vikarier har upplevt varierande bemötanden samt att de generellt blir bra bemötta. Två viktiga faktorer till att de upplever inkludering är att de får ta del av information och blir delaktiga i samtal, faktorer till exkludering är bristfällig information och att ordinarie personal inte visar något intresse för dem.

Le rôle de l'alexithymie dans l'étiopathogénie de la psychose non décompensée / The rule of alexithymia in pathogenesis of non decompensated psychosis

Cette étude démontre que l’alexithymie primaire nous oriente vers la présence de troubles schizophréniques. Comme hypothèse, nous formulons que : «l’alexithymie est un trait de personnalité dans la schizophrénie responsable de la toxicomanie et du recours aux traitements méthadone. La méthadone est une suppléance dans la psychose». L’intérêt de cette recherche est double : sur le plan clinique, elle souligne l’importance du repérage des troubles émotionnels et de la personnalité en addictologie. Elle précise que la TAS-20 et MMPI-2 sont des outils d’aide au diagnostic de la schizophrénie ; sur le plan thérapeutique, le repérage de ces affections permettra de traiter simultanément les comorbidités associées et de guider la prise en charge. L’approche de la schizophrénie à partir du concept d’alexithymie nous inscrits dans une approche intégrative(neuropsychatrique et psychodynamique). Dans un premier volet, nous avons réalisé une étude longitudinale avec suivi de 6 mois chez des toxicomanes sous TSO, admis au CSAPA de Montpellier. Le groupe contrôle est composé 28 toxicomanes sans trouble avéré. Six mois après, 15 usagers ont mené l’étude à son terme (âge=35ans ; ET=6,43). 11 toxicomanes atteints de troubles(âge= 39 ans ; ET= 6,9) constituent le groupe expérimental. La procédure consistait à diagnostiquer les troubles de la personnalité dans le groupe contrôle ; à évaluer la dépendance aux drogues et le niveau d’alexithymie au sein des groupes. Nous avons eu recours à : le MMPI-2 pour le diagnostic des troubles ; la DAST-20 pour le repérage de la dépendance (DSM-IV) et la TAS-20 pour la mesure de l’alexithymie. La TAS-20 a été administrée pendant le traitement et six mois après. Les résultats au MMPI-2 décrivent une prévalence de troubles schizophréniques 33% et de protocoles invalides 20%. La DAST-20 présente un faible niveau de dépendance dans le groupe contrôle 1.93 et expérimental 1.49. Dans le groupe contrôle, les scores d’alexithymie et ses sous-dimensions augmentent six mois après le traitement. L’alexithymie est un trait (z=.21 ; p=.834) et un état de la personnalité (r=.621*; p=.013). Dans le groupe expérimental, la TAS-TOT confirme une diminution des scores, mais l’analyse des sous-dimensions admet que cette baisse est non significative. L’alexithymie est un trait de la personnalité (z=.4 ; p=.689).Des hauts scores d’alexithymie sont observés chez les toxicomanes diagnostiqués schizophrènes des deux groupes. L’alexithymie est un trait (z=1.21 ; p=.225) et un état (r=.90* ; p=.015) de la personnalité chez les schizophrènes du groupe contrôle. En ce qui concerne les schizophrènes du groupe expérimental, la diminution des scores TASTOT 63% et 57% invalide sa dimension primaire. Dans le second volet, l’analyse du discours a permis de déceler des unités signifiantes spécifiques à l’alexithymie et à la psychose. La méthodologie est centrée sur des cas cliniques. Des entretiens semi-directifs avec pour support un guide d’entretien ont été réalisés chez des toxicomanes sans trouble de la personnalité (groupe contrôle). Ils ont été retranscrits sur papier selon la méthode analytique. Nous avons recours aux paradigmes psychanalytique, phénoménologique et psychosomatique. La description narrative s’est élaborée sur quatre temps : le contexte anamnestique, l’expression des sentiments, l’entrée dans la toxicomanie et au Programme Méthadone. L’analyse des récits atteste un ensemble de signes cliniques qui résultent de la non extraction de l’objet a, prototype de la psychose. L’alexithymie se traduit sur le plan clinique par relation la blanche. En définitive, les résultats de l’analyse mixte admettent que l’alexithymie est présente dans la toxicomanie et dans la schizophrénie. Chez le toxicomane, le score élevé d’alexithymie est un indice diagnostic de schizophrénie, indépendamment de sa nature primaire ou secondaire.Mots clés: schizophrénie-alexithymie-toxicomanie-méthadone-buprénorphine-suppléance. / As hypothesis, we propose that alexithymie is a personality trait of schizophrenia responsible of the drug addiction and the use of methadone treatment. Methadone is an antipsychotic. Clinically, this study stresses the importance of the diagnosis of emotional disorders and personality. It demonstrates that TAS-20 and MMPI-2 are disposal tools for diagnosis of schizophrenia. Therapeutically, the importance of diagnosis is to treat comorbidities and to orientate the care. The approach of schizophrenia from the concept of alexithymia enrolled us in an integrative approach, which takes into consideration the neuropsychiatric and psychodynamic concepts.In the first part, we conducted a longitudinal study with follow-up 6 months with drug addict on methadone or buprenorphine, admitted to CSAPA-UTTD Montpellier. The control group includes 28 addicts out without disorder. Six months later, 15 users conducted the study to completion (age = 35 years, SD = 6.43). 11 addicts with schizophrenia, depression and anxiety (age = 39 years, SD = 6.9) constitute the experimental group. The procedure was to diagnose personality disorders in the control group; to evaluate drug dependence and the level of alexithymia in the groups. We used : the MMPI-2 for the diagnosis of personality disorders; DAST-20 for evaluate dependence according to DSM-IV and the TAS-20 to measure alexithymia. The TAS-20 was administered during treatment and six months after. The results MMPI-2 describe a prevalence of schizophrenic 33% and 20% invalid protocols. The DAST-20 has a low level of dependence in the control group and 1.93 1.49 experimental. In the control group, the scores of alexithymia and its sub-dimensions increase six months after treatment TAS-TOT 52.88% and 55.2%; DIF 19.54 et19.9; DDF 14.87% and 15.57%; EOT 18.47% and 19.73%. Alexithymia is a trait (z = .21, p = .834) and a state of personality (r = .621 *; p = .013). In the experimental group, the TAS-TOT confirms lower scores, but the analysis of sub-dimensions admits that this decrease is not significant TAS-TOT 56% and 54.36%; DDF 17% and 16.36%; DIF 18.45% and 18.18%; EOT 20.55% and 19.82%. Alexithymia is a personality trait (z = .4, p = .689). High alexithymia scores were observed among addicts diagnosed with schizophrenia in both groups. In the TAS-TOT control group 59% and 65.2%; DIF 19.53% and 19.9%; DDF 14.87% and 15.57%; EOT 18.47% and 19.73%. In the10experimental group TAS-TOT 63% and 57%; DIF 21% and 18%; DDF 24% and 21%; EOT 18% and 18%. Alexithymia is a trait (z = 1.21, p = .225) and a state (r = .90 * P = .015) personality in schizophrenics control group. Regarding schizophrenia in the experimental group, lower TASTOT scores 63% and 57% alexithymia is a state.In the second part, discourse analysis detected specific signifying units of alexithymia and psychosis. The methodology focuses on clinical cases. We use semi-structured interview with addicts without personality disorder. They were transcribed on paper according to the analytical method. We use psychoanalytic paradigms, phenomenological and psychosomatic. The narrative description shall include four stages: the anamnesis, the expression of feelings, entry into drug addiction and Methadone Program. The analysis of stories attests a set of clinical signs resulting from the non-extraction of the object, prototype of psychosis. Alexithymia translates clinically by white relationship.Ultimately, the results of the joint analysis recognize that alexithymia is present in drug addiction and schizophrenia. Among drug users, high alexithymia scores are diagnoses of schizophrenia indications, regardless of primary or secondary in nature. Prediction of combination efficacy in cancer therapy

The cell cycle is an essential process in all living organisms that must be carefully regulated to ensure successful cell growth and division. Disregulation of the cell cycle is a key contributing factor towards the formation of cancerous cells. Understanding events at a cellular level is the first step towards comprehending how cancer manifests at an organismal level. Mathematical modelling can be used as a means of formalising and predicting the behaviour of the biological systems involved in cancer. In response, cell cycle models have been constructed to simulate and predict what happens to the mammalian cell over a time course in response to variable parameters.Current cell cycle models rarely account for certain precursors of cell growth such as energy usage and the need for non-essential amino acids as fundamental building blocks of macromolecules. Normal and cancer cell metabolism differ in the way they derive energy from glucose. In addition, normal and cancer cells also demonstrate different levels of gene expression. Two versions of a mammalian cell cycle and metabolism model, based on ordinary differential equations (ODEs) that respond to fluctuations in glucose concentration levels, have been developed here for the normal and cancer cell scenarios. Sensitivity analysis is performed for both normal and cancer cells using these cell cycle and metabolism models to investigate which kinetic reaction steps have a greater effect over the cell cycle period. Detailed analysis of the models and quantitatively assessing metabolite levels at various stages of the cell cycle may offer novel insights into how the glycolytic rate varies during the cell cycle for both normal and cancer cells.The results of the sensitivity analysis are used to identify potential drug targets in cancer therapy. Combinations of these individual targets are also investigated to compare the different effects of single and multiple drug compounds on the time it takes to complete a cell division cycle.

The Incentive to Kill: An Examination of the Motivations for German Perpetrators During World War II

Why do ordinary individuals participate in mass violence perpetrated against civilians? That is the question I will attempt to answer in the following paper. I consider these men ordinary to the extent that the majority was not socially deviant. Looking at the case of Nazi Germany, two groups stand out as good case studies: the SS Einsatzgruppen and the SS cadres in the Death camps. The following analysis will focus on the motivations of these men to commit mass murder. I argue for a causal sequence of action, beginning with the onset of Nazi ideology, further followed by the dehumanization of the victim and the brutalization of the perpetrator. I will demonstrate how the ideology present during German interwar society influenced these men into participation. Dehumanization and brutalization are complimentary factors that push these men into action.

In contrast to the numerous studies of social elites’ Occidentalism, this study shifts the attention to ordinary people’s perceptions in a fast changing Chinese society. From an interpretive perspective, we conducted semi-structured interviews with 16 participants living in a coastal city in Mainland China. The key findings suggest that the Chinese public has its own way of perceiving and presenting the Western Other. Also, this Other, being defined in an on-going process of intercultural interaction, connotes a wider meaning – a unity of opposition and complementarity, exclusion and inclusion. Thus this study has deepened our understanding of the Chinese construction of the Western Other. The findings can be used in developing intercultural communication training programs to facilitate deeper contact and better dialogue between the Chinese and Westerners.
