The miners, the just wage and the mining company : perpectives of an Ubuntu reponse to the Marikana killings

Text in English / This research focuses upon the killing on 16 August 2012, by the South African Police Service, of miners working in Marikana, in the North West Province, in their struggle for a just wage. This experience highlighted the ethical question of the relationship between the employee and the employer. This research investigates this question by reference to the evolution of the doctrine of the “just wage” and the “just price” in Western moral philosophy. The investigation shows that this Western doctrine is a significant basis for an ethical evaluation of the relationship between employee and the employer. However, the doctrine does require expansion by taking the woman as an indispensable factor in labour relations. Also, it requires deepening by engaging in dialogue with other philosophies of the world, in this particular case, the philosophy of Ubuntu. The dialogue with Ubuntu is justified by the fact that the majority of the miners, the actual diggers of the mineral wealth, are born into and nurtured through the philosophy of Ubuntu, even if some may have reservations about it. The dialogue reveals a specific philosophical issue, namely, a clash of the epistemological and moral paradigms. The Ubuntu epistemological-ethical maxim of feta kgomo o tshware motho (if and when one must choose between the continual accumulation of wealth and the preservation of human life then one ought to opt for the latter) is fundamentally at odds with capitalism, an economic system that elevates wealth and money to the status of a deity. Poverty, violence, unemployment, the high rate of HIV/Aids and a lack of resources are some of the issues the South African government is currently trying to address. Victims of crime and violence have special needs that require early intervention. Studies show that if left unattended, victims may show maladjustment in their social, marital and work environments; receiving assistance and support following victimisation therefore holds many benefits for the victim. The Victim Empowerment Programme (VEP) announced by government as part of the National Crime Prevention Strategy is meant to address these needs. The VEP is a comprehensive, multifaceted, intersectoral model that brings together integrated service delivery for victims of crime and violence. One of the mandates of the Department of Social Development as the lead department of the VEP is to provide services that empower and meet the needs of communities and individuals who are considered victims. This study seeks to justify why it is beneficial to use a participatory learning approach when designing and conducting „in-service‟ continuing professional development training courses for state-appointed social workers working within the field of victim empowerment (VE) in South Africa. It also advocates for the theoretical approaches of experiential problem-based learning and psychosocial empowerment, and discusses the use of a crossover of theories from the different disciplines of mainstream psychology, community psychology and social work. The vision of a new South Africa based on post-1994 ANC government policies is outlined and the history of the field of socio-economic development and community development is discussed. Mainstream psychology‟s contribution to community development, and the tenets of community psychology, participation and empowerment, are applied in the design of an „in-service‟ short course. The primary focus of the study is on the range of skills and abilities needed to initiate and maintain successful VE services. These include the following: skills in group process facilitation; skills in intersectoral collaboration (referral and networking) with other governmental departments and other healthcare professionals; knowing how to establish and maintain forums; an understanding of the principles and tools of participatory learning and action; skills required for designing, organising and presenting workshops; project management, and the monitoring and evaluation of VE projects. This study elucidates how critical the „in-service‟ training of VE social workers is within the new social development paradigm in South Africa, and offers key considerations and recommendations regarding future „in-service‟ training programmes/short courses for state-employed social workers involved in VE services. / Psychology / D. Die aanvaarding van die ekonomiese model van neo-liberale kapitalisme is egter problematies in soverre dit betekenisvol misluk het om na-apartheid Suid-Afrika se mees fundamentele moreel-polities-ekonomiese uitdaging, naamlik armoede, aan te spreek en te oorkom. Hierdie tesis bied ʼn alternatiewe ekonomiese model aan, naamlik uitgebreide korporatisme. Terwyl die neo-liberale ekonomiese model individuele belange beklemtoon (gebaseer op die filosofiese beginsel van outonomie in die ekonomiese sfeer), beklemtoon die korporatistiese model, daarenteen, kollektiewe belange (gebaseer op die filosofiese beginsel van kollektiewe eienaarskap en verantwoordelikheid). In konklusie, die aanvaarding van uitgebreide korporatisme in Suid-Afrika sal verseker dat die staat, kapitaal en arbeid saamwerk en dat ekonomiese geregtigheid en harmonie sal seëvier. / In its haste to be integrated into the global economy, following many years of political-economic isolation – and thus assume full membership in the international community – the post-apartheid state adopted the economic framework of the free market system, based on the principles of neoliberal capitalism as its normative foundation for addressing the “legacy of apartheid”. The adoption of the economic model of neoliberal capitalism has, however, proved to be problematic insofar as it has failed significantly to address and thus overcome post-apartheid South Africa‟s most fundamental moral-political-economic challenge, namely poverty. This thesis offers an alternative economic model, namely extended corporatism. While the neoliberal economic model emphasises individual interest (based on the philosophical principle of autonomy in the economic sphere), the corporatist model, in contrast, emphasises collective interest (based on the philosophical principle of collective ownership and responsibility). The advocacy of extended corporativism is based on the following key claims: 1. The free market system must be retained, but some form of strategic intervention is necessary so that certain socio-political and economic results can be achieved. 2. The current form of corporatism in South Africa is in fact tripartism (a weak form of corporatism). An extended corporatist political economy can by brought about by the implementation of corporations, the establishment of an economic legislative body, labour courts and centralised wage bargaining. 3. Extended corporatism can address South Africa‟s socio-economic problems. Transformation can be promoted by a paradigm shift away from liberal capitalism, a power shift away from the white capitalist enclave and a distribution shift in favour of the black impoverished lower classes. 4. All economic sectors as well as private industries and businesses must be brought under the control of corporations. The state and labour must become partners in private industries and businesses. In the same way capital must become a partner in state enterprises. The harmonisation of good faith and ubuntu in the South African common law of contract

The legal historical development of fairness in the South African common law of contract is investigated in the context of the political, social and economic developments of the last four centuries. It emerges that the common law of contract is still dominated by the ideologies of individualism and economic liberalism which were imported from English law during the nineteenth century. Together with the theories of legal positivism and formalism which are closely related to parliamentary sovereignty and the classical rule of law, these ideals were transposed into the common law of contract through the classical model of contract law which emphasises freedom and sanctity of contract and promotes legal certainty. This approach resulted in the negation of the court’s equitable discretion and the limitation of good faith which sustain the social and economic inequalities that were created under colonialism and exacerbated under apartheid rule. In stark contrast, the modern human rights culture grounded in human dignity and aimed at the promotion of substantive equality led to the introduction of modern contract theory in other parts of the world. The introduction of the Constitution as grounded in human dignity and aimed at the achievement of substantive equality has resulted in a sophisticated jurisprudence on human dignity that reflects a harmonisation between its Western conception as based on Kantian dignity and ubuntu which provides an African understanding thereof. In this respect, ubuntu plays an important role in infusing the common law of contract with African values and in promoting substantive equality between contracting parties in line with modern contract theory. It is submitted that this approach to human dignity should result in the development of good faith into a substantive rule of the common law of contract which can be used to set aside an unfair contract term or the unfair enforcement thereof. / Private Law / LL. Inom nätverkstekniken och datakommunikationen råder idag en tro på tekniken nätverkscache som kan spara data för att senare kunna hämta hem det snabbare. Tekniken har genom åren visat att den effektivt kan skicka den önskade data till sina klienter. Det finns flera cache-tjänster som använder tekniken för Windows-uppdateringar. Bland dessa finns Windows Server Update Services (WSUS) och LanCache. På uppdrag från företaget TNS Gaming AB jämförs dessa tjänster med varandra under examensarbetet. Nätverkscache är ett intressant forskningsområde för framtida kommunikationssystem och nätverk tack vare sina fördelar. Likaså är uppgiften om att jämföra cache-tjänsterna WSUS och LanCache intressant i och med det öppnar upp insikt om vilken tjänst är bättre för företaget eller andra intressenter. Både forskningsområdet och uppgiften är viktiga och intressanta när användare vill effektivisera användningen av internetanslutningen och bespara nätverksresurser. Därmed kan tekniken minska nedladdningstiden. Till det här arbetet besvaras frågor om vilken nätverksprestanda, resursanvändning och administrationstid respektive cache-tjänst har, och vilken cache-tjänst som lämpar sig bättre för företagets behov. I arbetet genomförs experiment, som omfattar tre huvudmättningar, och följs av en enfallstudie. Syftet med arbetet är att med hjälp av experimentets mätningar få en jämförelse mellan WSUS och LanCache. Resultatet av arbetet utgör sedan ett underlag för det framtida lösningsvalet. Resultaten består av två delar. Den första visar att båda cache-tjänsterna bidrar till kortare nedladdningstider. Den andra är att LanCache är bättre än WSUS när det gäller nätverksprestanda och resursanvändning, samt mindre administrationstid jämfört med WSUS. Givet resultat dras slutsatsen att LanCache är cache-tjänsten som är mest lämpad i det här fallet. / In the field of network technology and data communication, there is a current belief in the technology of network caching, which can store data to later retrieve it more quickly. Over the years, this technology has proven its ability to efficiently deliver the desired data to its clients. There are several caching services that utilize this technology for Windows updates, among them are Windows Server Update Services (WSUS) and LanCache. On behalf of the company TNS Gaming AB, these services are compared to each other in this thesis. Network caching is an interesting area of research for future communication systems and networks due to its benefits. Likewise, the task of comparing the cache services WSUS and LanCache is interesting as it provides insights into which service is better suited for the company or other stakeholders. Both the research area and the task are important and intriguing when users seek to streamline the use of their internet connection and conserve network resources. Thus, the technology can reduce download times. For this work, questions about the network performance, resource usage, and administration time of each cache service are answered, as well as which cache service that is better suited to the company's needs. The work involves conducting experiments, including three main measurements, followed by a single case study. The purpose of the work is to compare WSUS and LanCache using the measurements from the experiment. The outcome of the work then forms a basis for future solution choice. The results consist of two parts. The first shows that both cache services contribute to shorter download times. The second is that LanCache outperforms WSUS in terms of network performance and resource usage, and also requires less administration time than WSUS. Given the results, the conclusion is drawn that LanCache is the most suitable caching service in this case.

Xenophobia as a response to foreigners in post-apartheid South Africa and post-exilic Israel: a comparative critique in the light of the gospel and Ubuntu ethical principles

Blaming those who are different from us because of skin colour, nationality and language when things do not go right during the process of reconstruction is common among those who are faced with such a task. This assertion is confirmed by our examination and evaluation of xenophobia in post-apartheid South Africa and post-exilic Israel. In South Africa socio-economic and political reasons are cited for the rejection of African immigrants by some South Africans. The Jews in the post exilic period understood their religious, social and economic problems to be caused by others. What is more disturbing is that the Jews understood their xenophobia to be demanded or legitimised by God. These reasons for them necessitated hatred, isolation, stigmatisation and sometimes negative actions against foreigners. When we compare xenophobia in both post-apartheid South Africa and post-exilic Israel in this study, we find that factors such as identity, notion of superiority, negative perception of those who are different and use of power, play a major role in the exacerbation of xenophobia. In evaluating both situations, using the African principle of Ubuntu and Christian moral values, we are able to demonstrate that xenophobia as found in both situations is morally wrong since it is inhuman, selfish, racist/ethnocentric, discriminatory and often violent. Ubuntu and Christian values and principles such as human dignity, human rights, reciprocity, love, compassion, forgiveness, hospitality and community were sacrificed by South Africans and Jews in their dealings with foreigners in their respective situations. It is argued here that among other things in the case of South Africa, the reduction of inflammatory statements by government representatives and the media, education of the unemployed, the youth and workers; and the meeting of spiritual, material, humanitarian and moral needs by the Church, will help sensitise South Africans to the plight of African immigrants and migrants and will further deepen the ubuntu and Christian values. / Religious Studies and Arabic / D.Th.(Theological Ethics)
