Péče o zaměstnance / Care of employes

Aim of this thesis is to plot employee care in organizations and companies, that have a seat in Pelhřimov district. The thesis deals with employee relationships and employee care, where participate working hours and work regime, work enviroment, personal development of employees, services provided to employees by employer, employee benefits, work safety and protection of their health and their motivation and stimulation as well. The first step during processing of this thesis was studying the special literature; making of questionaries was directly connected with it. The questionary was essintial for following survey and the survey took four months. Then, acquired information were processed and incuded into graphs and charts and annotated. The result of the thesis is an undestandable picture of employee care in Pelhřimov district and discovery of the greatest problems and the most problematic branches of the national economy.

La situation juridique du télétravailleur / Teleworker's legal position

Le télétravail vient de faire son entrée dans le code du travail par la loi n°2012-387 du 22 mars 2012. Si au regard de la loi, le télétravailleur est considéré comme un salarié à part entière titulaire d’un contrat de travail et subordonné à l’employeur, il accompli cependant ses tâches hors les locaux de l’entreprise en utilisant les technologies de l’information et de la communication. Il en découle que si le travail à distance génère pour le télétravailleur une situation qui se caractérise par une certaine indépendance et une « relative autonomie dans la subordination », il n’en demeure pas moins qu’il reste placé dans une situation de subordination inhérente au contrat de travail. La position singulière du télétravailleur vient ainsi bouleverser le droit des relations individuelles et collectives de travail. Etudier la situation juridique du télétravailleur supposera de se « focaliser » sur la personne en situation de télétravail pour se demander comment sa position singulière peut à la fois le placer dans les liens du salariat, qui suppose l’exercice des droits de tout salarié, mais aussi déterminer les éléments spécifiques de sa situation. / Telework has been introduced in the Labor Code by the Law N° 2012-387 dated march 22d 2012. By law, the teleworker is considered a full-fledged employee holding an employment contract by which he is subordinate to his employer. Yet, thanks to the use of information and communication technologies he performs his labour outside of the company’s premises. It follows that, even though distance working will afford the teleworker a certain degree of independence and “autonomy within his subordination”, he remains nevertheless placed within the state of subordination characteristic of an employment contract. The teleworker’s peculiar situation therefore disrupts the traditional balance of individual and collective rights afforded to employees. Analysing the legal status of the teleworker will involve “focusing” our attention on the person placed within a telework environment to figure out how this singular situation can place him/her both within the employment relationship, which implies enjoying the rights of traditional employees, while still pinpointing elements that are specific to his situation.

The aim of this thesis is to gather data within the harmonization proces between work and family life at addressed families where is the woman´s role either an employee or businesswoman. The theoretical part deals with aspects which help women with easier harmonization between two lifes areas - work and family. Specifically, this part deals with various forms of child care and types of financial support provided by the state. The thesis also solves the forms of flexible working hours, with emphasis on their current use across the European Union countries. The practical part is focused on mapping strategies in addressed families with a woman who is in labour-law relation and families with a businesswoman. For these purposes were chosen families (men and women) with which we were making inteviews and questionnaires focused on the time allocated to various tasks in one day.

Syftet med denna studie var att analysera förändringsprocesserna i samband med de nya bestämmelserna för dygns- och veckovila samt att se hur detta har påverkat medarbetarnas arbetssituation och deras syn på sitt arbete i de aktuella LLS-organisationerna. Inledningsvis presenterar vi en inledning till ämnet och studiens bakgrund. Därefter presenteras studiens syfte, frågeställningar, avgränsning och disposition. Vidare presenteras de teorier som använts som verktyg för att analysera det empiriska materialet. Dessa är motstånd, vårt offentliga etos, förändringsprocesser och förändringsagenter. Studiens metodologi beskrivs sedan tillsammans med insamlingen av empirin genom semistrukturerade intervjuer med de tolv intervjupersonerna. Därefter presenteras analysen och resultatet av empirin, som visar att genomförandet skett på ett sätt som inte fullt ut har skapat en känsla av delaktighet och förståelse hos medarbetarna. Detta har lett till konflikter kopplat till deras offentliga etos och ansvar som tjänstemän gentemot organisationen, kollegorna och brukarna som yttrar sig iform av olika typer av motstånd. Avslutningsvis presenteras studiens slutsats tillsammans med en reflektion samt förslag på fortsatt forskning. / The purpose of this study was to analyze the change processes in connection with the new regulations for 24-hour and weekly rest and how this has affected the employees' work situation and their view of their work in the LSS-organizations in question. Initially, we present an introduction to the subject and the background of the study. Then the study's purpose, questions, delimitation and outline are presented. Furthermore, the theories used as tools to analyze the empirical material are presented. These are resistance, our public ethos, change processes and change agents. The study's methodology is then described together with the collection of empirical evidence through semi-structured interviews with the twelve interviewees. Then the analysis and the results of the empirical work are presented, which show that the implementation took place in a way that has not fully created a feeling of participation and understanding among the employees. This has led to conflicts linked to their public ethos and responsibilities as officials towards the organization, colleagues and users who express themselves in the form of various types of resistance. Finally, the study's conclusion is presented together with a reflection and suggestions for further research.

This work deals with issues of business trips in primary schools that are provided by municipality in relation to the law No. 365/2011 Sb., that changes law No. 262/2006 Sb., Labour code, as amended and other related laws valid since January 1st 2012 that says empoyees cannot give up on their rights in advance. Based on assumption that travel expenses that must have been paid to employees in full are huge burden on school budgets. All the travelling with pupils becomes very expensive. According to connection between theory and practical use, all activities cannot be provided only at school and it's necessary that teachers travel with children to learn away from school. This work summaries the rules for reimbursement of travel expenses and reflects the views of headmasters at issues of business trips in primary schools. L'opera esamina l'intervento pubblico nella gestione del rapporto di lavoro sotto il profilo storico e giuridico nelle tre fasi d'instaurazione, gestione e cessazione del rapporto. Si valorizza anche il ruolo specifico dei tre poteri legislativo, esecutivo e giudiziario, con particolare riguardo all'analisi sistematica del diritto amministrativo del lavoro. L'opera intende porre in luce gli elementi logici, giuridici ed assiologici di questo ramo del diritto del lavoro, per ricondurne le fattispecie esaminate ad un sistema coerente e razionale e per suggerirne sia un metodo d'analisi de iure condito sia una prospettiva per una lettura ed una proposta de iure condendo. / This work analyses how public powers affects labour relationships both from the historical and the juridical points of view. The three main phases of labour relationships beginning, management and end are examined separately. The specific contributions by the three public powers legislative, administrative and judiciary especially by the public administration, are also dealt with. The goal is to illustrate the logical, juridical and ethical elements of this branch of the labour law, in order to build a rational system for both the analysis de iure condito and the debate de iure condendo.
