The topic of the thesis are CILFIT criterions. These criterions were established by the Court of Justice of the European Union as conditions for application of the acte clair doctrine by national courts of last resort. The conditions determine situations in which such a court does not have an obligation under Article 267/3 to bring a matter before the Court of Justice. First of all, thesis describes the historical circumstances, which gave rise to the CILFIT case as well as the facts of that issue. Then it analyses one by one CILFIT criterions and also current procedure of submitting preliminary questions as a whole. As a part of the analysis, it focuses on the practical application of the abovementioned conditions by the courts of the Member States. It targets purely theoretical ideas too. The thesis, further, identifies certain problematic aspects of the CILFIT conditions. Subsequently, some possible solutions are being suggested and their effectiveness and appropriateness are being examined.

Sveriges inträde i EU 1995 har lett till många förändringar i det svenska rättssystemet. Svenska domstolar har därmed fått en ny arbetssituation och nya skyldigheter. Flera förändringar har skett i svensk processrätt, och grundläggande EU-rättsliga principer som de om direkt effekt och EU-rättens företräde framför nationell rätt, har ställt de nationella domstolarna inför flera utmaningar. Den mest grundläggande skyldigheten de svenska domstolarna har gentemot EU är förpliktelsen att inhämta förhandsavgörande från EU-domstolen. Sistainstansrätterna är skyldiga att göra detta närhelst de är osäkra på tolkningen och/eller tillämpningen av en EU-rättslig bestämmelse. Detta är en långtgående förpliktelse som endast har två undantag: det första är i de fall EU-domstolen redan dömt i ett identiskt fall (acte éclairé); det andra är då den nationella domstolen anser att den EU-rättsliga bestämmelsen är tillräckligt klar och tydligt för att den självständigt ska kunna tillämpa den (acte clair). Dessa skyldigheter har lett till ett flertal problem för de svenska domstolarna. Sverige har fått skarp kritik från Kommissionen för sistainstansrätternas obenägenhet att inhämta förhandsavgörande. This has led to several new obligations for the Swedish courts. There have been a number of changes in Swedish law of procedure, and fundamental principles of law set down by EU, like the principle of direct effect of EU law and its precedence over national law, has presented many challenges before the national courts. The most fundamental obligation of the Swedish courts to EU is the duty to make a reference for a preliminary ruling to the European Court of Justice (ECJ). The courts of last instance are obligated to do this in any case where they are insecure of the appropriate application of EU-law. There are only two exceptions to this rule, namely when the ECJ already has ruled in an identical matter (acte éclairé) and in cases where the national court feels that the correct interpretation of the rule of law in question is obvious (acte clair). These obligations have lead to a number of problems for the Swedish courts. The Commission has criticized Sweden because of the national courts of last instance unwillingness to request preliminary rulings. Whether EU should toughen up and take action against the national courts disobedience or if the criteria for when an obligation to make a reference for a preliminary ruling should get more flexible is constantly discussed at this time. There are several things that speaks for both of these developments and that makes this a very interesting topic to study.

Les industries lithiques taillées du site de Proskynas, Grèce Centrale (Néolithique Récent / Bronze Ancien) : caractérisation et contexte régional / Non communiquéManos, Ioannis 14 December 2011 (has links)
L’objectif de cette thèse est la caractérisation technologique et typologique des industries lithiques du site de Proskynas en Grèce Centrale durant le Néolithique Récent (NR) et le Bronze Ancien (BA). En comparant ce corpus avec les industries lithiques régionales publiées jusqu’à présent et en contrôlant les techniques par l’expérimentation archéologique, cette étude révèle la contribution de l’industrie lithique dans la compréhension de la transition du Néolithique Récent au Bronze Ancien. L’approche méthodologique envisage une description analytique de tous les objets débités. L’analyse de la base de données ainsi constituée se fonde sur l’étude technologique et typologique approfondie par matière : obsidienne, silex chocolat et silex brun clair. Cette méthode permet de reconstituer mentalement les chaînes opératoires mises en œuvre et de reconnaître les gestes techniques appliqués. La composition des descripteurs analytiques et le croisement multi varié intra-situ et inter-situ des résultats obtenus révèlent une production de lames et d’éclats sur matières locales et importées. La variabilité régionale des chaînes opératoires et des supports débités caractérise le NR. Le BA affiche une grande homogénéité dans les conceptions opératoires et une remarquable standardisation des lames débitées surtout sur obsidienne. L’analyse typologique privilégie la description détaillée des produits confectionnés en outils (supports et retouche). La typologie des outils retouchés, la morphométrie des produits exploités bruts de débitage et sans traces d’utilisation macroscopiques sont des facteurs qui varient aussi bien entre les trois matières principales qu’entre les deux périodes (NR et BA). / The objective of this thesis is the technological and typological characterization of the lithic industries at the site of Proskynas in Central Greece during the Late Neolithic (LN) and the Early Bronze Age (EBA). By comparing this corpus with the regional lithic industries published to date and by verifying manufacturing techniques through archaeological experimentation, this study elucidates the contribution of the stone industry to the understanding of the transition from the Late Neolithic to Early Bronze Age.The methodological approach envisages an analytical description of all the produced objects. The analysis of the database so constituted is based on the technological and typological study deepened by material: obsidian, chocolate silex and light brown silex. This method allows to reconstitute mentally the chains operating implemented and to recognize technical gestures applied. The composition of the analytical descriptors and the intersection multi-varied intra-situ and inter-situ of the obtained results reveal a production of blades and flakes on local and imported materials. The regional variability of operating chains and of debited supports characterizes the LN. The EBA shows a great homogeneity in the operational conceptions and a remarkable standardization of blades produced especially on obsidian. The typological analysis emphasizes the detailed description of tools manufactured (supports and retouch). The typology of the retouched tools, the morphometrie of the products exploited raw debited and without macroscopic traces of use are factors which vary between the three major materials and the two periods (LN and EBA).

Peintre à la cour du duc René II en 1506 et actif à Strasbourg jusqu’à la fin de la deuxième décennie du XVIe siècle, Hans Wechtlin n’a plus fait l’objet d’une monographie depuis 1907. Il s'agit de combler cette lacune dans la perspective d’une connaissance renouvelée de la production artistique en Lorraine et dans l’aire germanique méridionale, ainsi que des comportements en matière de commandes de peintures, de vitraux et de gravures sur bois à la veille de la Réforme. En partant d’une nouvelle forme de contextualisation artistique, l’étude entend donc questionner l’itinéraire de ce peintre, connu uniquement à travers son œuvre gravé, afin de mettre en lumière les relations qu’il a pu entretenir avec d’autres artistes et imprimeurs. Au terme de ce parcours, l’établissement d’un catalogue raisonné de ses œuvres permet de mieux cerner l’étendue et l’impact des productions de ce représentant de l’art graphique rhénan. / A court painter to Duke of Lorraine René II in 1506 and an artist active in Strasbourg until the end of the second decade of the 16th century, Hans Wechtlin has yet not been the subject of any monograph since 1907. The present work therefore aims at filling the gap by renewing the knowledge of artistic production in Lorraine and in the southern Germanic area, as well as customs regarding commissioned paintings, stained-glass windows andwoodcuts on the eve of Reformation.Based on a new form of artistic contextualization, this study questions the itinerary of a painter of whom everything but his legacy remains unknown until this day, in order to bring his relationships to other artists and printers into light. Finally, a comprehensive, annotated listing of his complete works reveals the extend and impact of the productions of a major figure of Rhenish graphic arts.

The Master thesis has for its objective mapping of destiny of czech comunity in Paris from sixties to eighties. Its purpose is not to get a complete list of all artists, who came to Paris. It's just a sellection of those important persons, who broke through Paris. The personal interviews play an important part of the sources. The thesis is not structured in medallion-biography way, but it is lined up in a thematic way. Most of the artists handled in their new home country withe similar problems and situations. First theoretical part characterise the period, the environment, the czech-french relations and the general phenomena of emigration in the czech historical memory. In sixties the czech-french relations started to be reanimated and many french art critics visited Czechoslovakia and they wrote about czech art. Beside France, the czech emigration refuged in sixties largely to West Germany, United States of America, Canada, austrian Wien, Swiss and nordic countries. Individuals art centres were connected to others by friendships and artists visited themselves. Second and more extensive part of the thesis works with the oral and witten interviews. The respondent artists are Miloš Cvach, Roman Kameš, Karel Machálek-Zlín, Miloslav Moucha, Vladimír Škoda, Ivan Theimer and art historian Jana Claverie....

Iraq, 2003 : une coalition menée par les États-Unis et le Royaume-Uni engagea une action militaire juridiquement fondée sur une autorisation de recourir à la force implicitement contenue dans la résolution 1441 (2002) du Conseil de sécurité. Ce fondement fut également mis en avant au Kosovo (1999) ou encore au Liberia (1992).Ces trois cas illustrent l'application d'une pratique qualifiée d'autorisation implicite en matière de recours à la force. Alors que l'autorisation de recourir à la force doit résulter d'une mention explicite du Conseil de sécurité, l'autorisation implicite repose sur une interprétation entre les lignes des résolutions du Conseil afin d'y mettre en évidence une telle autorisation. Les États qui y recourent n'ont guère manqué de préciser qu'un précédent ne saurait se révéler de cette pratique en marge de la légalité internationale. Malgré son caractère controversé, ce moyen juridique tend cependant à devenir le support privilégié des États en l'absence d'une autorisation explicite.D'où, un paradoxe de l'autorisation implicite dont il nous reviendra d'en évaluer la légalité en examinant les modalités de son élaboration et de son application. Les difficultés à trancher la question de sa validité en droit international nous amèneront notamment à dépasser ce standard de légalité pour lui substituer celui de conformité, plus souple, dans un cadre juridique original : la légalité d'exception. Nous verrons enfin que l'approche téléologique de l'autorisation implicite souffre de lacunes substantielles au point de réaffirmer la double exigence du mandat clair ainsi que du contrôle des résolutions du Conseil de sécurité autorisant le recours à la force. / Iraq 2003: a coalition led by the United States and the United Kingdom undertook military action based on a legal authorization to use force implicitly contained in Security Council Resolution 1441 (2002). This argument was also highlighted in Kosovo (1999), and Liberia (1992).These three cases illustrate the application of a practice known as the implied authorization for use of force. While the authorization for use of military force must result from explicit Security Council Resolution, the implied authorization is based on an interprÉtation between the lines of Security Council Resolutions in order to highlight such an authorization. The States that had recourse to it made it abundantly clear that a precedent cannot result of this practice on the sidelines of international legality. However, despite its controversial nature, it tends to become the privileged support of the State in the absence of an explicit authorization.Hence a paradox of the implied authorization which we will assess the legality, by examining the modalities of its elaboration and its application. The difficulties by resolving the question of its validity under international law will lead us to overcome this particular standard of legality by substituting it for that of conformity, more flexible, in an original legal framework: the legality of exception. We shall finally see that the teleological approach of the implied authorization suffers substantial gaps so that we will reaffirm the dual requirement of the clear mandate and the control within the Security Council Resolutions authorizing use of force.
