The results of the analysis are organized into two parts. The first one ( The Kulina s madija collectives ), some configuration aspects of the madija collectives are presented within the Arawan context from the available litera-ture, and in the specific context of madija collectives in the lower Juruá. The second part ( The Kulina rituals in the lower Juruá ) discusses the ethnography of Rami, Tocorime and Ajie rituals. The description of Rami and Tocorime rituals addresses the features of similarity and contrast in relation to the Ajie ritual. As the purpose in not to reify the madija collectives, but describing the relationship model of madija which moves the human and non-human so-ciality, the ethnography of Ajie projects this ritual as instance that creates humanity and re-stores the model of madija relationship: the fragmentation, where shamanism is the main mechanism. / Esta pesquisa tem como objetivo abordar os coletivos madija dos Kulina no baixo Ju-ruá, focando no contexto específico do ritual do Ajie. Os resultados da análise estão organiza-dos em duas partes. Na primeira ( Os coletivos madija dos Kulina ) são apresentados aspectos da configuração dos coletivos madija dentro do contexto arawa a partir da bibliografia existen-te, bem como o contexto dos coletivos madija dos Kulina no baixo Juruá. A segunda parte ( Os rituais kulina no baixo Juruá ) é dedicada a uma etnografia dos rituais do Rami, do Toco-rime e do Ajie. A descrição dos rituais do Rami e do Tocorime aborda os elementos de seme-lhança e de contraste em relação ao ritual do Ajie. Dado que o propósito não é reificar os cole-tivos madija, mas descrever o modelo de relação dos madija que movimenta a socialidade humana e não-humana, a etnografia do Ajie projeta este ritual como instância que cria huma-nidade e que reestabelece o modelo de relação madija: a fragmentação, onde o xamanismo é o mecanismo principal.

Cette thèse analyse la rencontre entre l'émergence du phénomène migratoire en Sicile, la naissance d’un réseau local de militants « pro immigration » connectés à l’échelle nationale et européenne, et la recomposition de l'action publique qui repose sur la délégation, aux collectivités territoriales et aux acteurs non-étatiques, des compétences dans le domaine socio-sanitaire et migratoire. Basée sur un terrain réalisé en Sicile, cette recherche mobilise des outils conceptuels issus des études migratoires, des recherches sur les mobilisations collectives et des politiques publiques et des travaux sur le secteur associatif. Les mobilisations collectives en Sicile entre 1986 et 2012 sont étudiées : l’émergence, la structuration et l’évolution des réseaux militants sont étudiés, à partir d’une perspective socio-historique et d’une analyse en termes de carrière. Ce réseau militant s’insère dans les logiques de redéploiement des dispositifs étatiques qui nous permettent d’examiner les multiples relations entre la multitude d’acteurs étatiques et non-étatiques impliqués dans le la prise en charge des étrangers. / This thesis analyses the confluence of the migration phenomenon as it emerges in Sicily, the birth of a local network of “pro immigration” activists, connected to the national and European levels, and the reorganiation of public action, based on the delegation of responsibilities in the healthcare and migration sectors to local authorities and non-state actors. Based on fieldwork carried out in Sicily, this research uses conceptual tools taken from migration studies, research on collective mobilisations, public policy and the nonprofit sector. Collective mobilisations in Sicily between 1986 and 2012 are studied: the emergence, structuration and evolution of activist networks are studied, from a socio-historical perspective and an analysis of career trajectories. This activist network works within a larger logic of redeployment of state arrangements, which enables us to examine the multiple relationships that exist between the multitude of state and non-state actors involved in the governance of foreigners in Sicily.

Les LBO en droit français : contribution à l'étude de la réception des innovations financières par le droit / LBO in French law : contribution to the study of the receipt of financial innovations through Law

Face à une technique financière novatrice, le droit peut adopter trois postures. Il peut d'abord prévoir, a priori, un cadre juridique spécialement dédié. Il peut aussi la laisser se développer, puis intervenir a posteriori afin de l'encadrer. Il peut enfin choisir de ne lui consacrer aucun cadre particulier, laissant aux règles existantes le soin de la régir. C'est conformément à cette troisième méthode que les Leveraged Buy-Out (LBO), qui consistent pour un repreneur à prendre le contrôle d'une société par l'intermédiaire d'une holding interposée et par recours à l'endettement, ont été accueillis par le droit français. Reposant sur une instrumentalisation de la règle de droit, et étant risquée par nature car fondée sur l'endettement, l'emploi de cette méthode à l'endroit des LBO suscite forcément des questionnements. En tout état de cause, l'absence de cadre réglementaire particulier signifie, dans un regime de liberté, que le droit accepte par principe cette modalité de prise de contrôle. Néanmoins, les risques dont ils sont porteurs pouvant survenir lors de l'exercice du contrôle, le droit aura alors tendance à intervenir plus activement afin de l'encadrer. Un travail de recherche portant sur le LBO, sous le prisme du mode de réception adopté par le droit pour l'accueillir, doit permettre, d'une part, de cerner les singularités de son régime juridique dans le contexte français, et d'autre part, d'évaluer la pertinence et les effets de la méthode qui consiste à laisser une figure financière originale être appréhendée par les normes existantes. / Faced with an innovative financial technique, the law can adopt three postures. First, the law can provide, upstream, a specially dedicated legal framework. Secondly, the law can, also, let it develop, and then, act retrospectively to frame it. Finally, the law can also choose not to devote any particular framework, and let the operation be governed by existing rules. French law used this third method to welcome the Leveraged Buy-Out (LBO), which consist for a buyer to take control of a company using debt and through a Special Purpose Vehicle. Based on a manipulation of the rules of law, and risky because based on debt, the use of that method for the LBOs inevitably raises questions. In any case, the absence of specific regulatory framework mean, in a regime of liberty, that the law accepts, in principle, this particular type of acquisition of a company. However, because the risks they carry can occur during the exercise of control on the acquired company, the existing laws will intervene more actively to frame it. Research work on the LBO, from the perspective of the receiving mode adopted by the legal system to receive it, must, firstly, permit to identify the peculiarities of its legal status in the French context, and on the other hand, to assess the relevance and impact of the method which consist in leaving an original financial operation be governed by the existing standards.

Essais sur la négociation sectorielle / Essays on sectoral-level wage bargaining

Dans le premier chapitre, après une présentation des institutions responsables des négociations salariales en France, je me penche sur l'utilisation, par les grandes entreprises, des salaires planchers pour évincer la concurrence. En effet, les salaires négociés au niveau de l'industrie s'appliquent à l'ensemble des entreprises, qu'elles soient présentent lors des négociations ou non. Ce chapitre possède une partie théorique où il est montré que les plus grosses entreprises ont un intérêt à augmenter les salaires planchers, pour réduire le profit des plus petites entreprises, et ainsi récupérer leurs parts de marché. Par conséquent, plus les syndicats patronaux représentent les intérêts des grandes entreprises, plus le salaire négocié au niveau sectoriel est important. Cette prédiction est testée en utilisant des données françaises. L'utilisation d'une stratégie instrumentale permet de montrer que plus les entreprises négociant les salaires planchers sont grosses par rapport à la moyenne de l'industrie concernée, plus le salaire négocié est important.Dans le second chapitre, je regarde l'effet des négociations sectorielles sur l'innovation. J'utilise un modèle avec compétition monopolistique. Je trouve que, dans le cas d'une négociation salariale au niveau de l'industrie, les parties à la négociation prennent en compte le fait que l'augmentation du coût du travail va diminuer les investissements, de leurs concurrents. En effet, avec la négociation sectorielle, l'augmentation du salaire plancher implique que les revenus tirés d'une innovation diminuent. Cette baisse des investissements permet aux entreprises dominantes de sécuriser leur place, ce qui possède un effet négatif sur l'innovation et la croissance.Dans le dernier chapitre, je trouve que la compétition internationale réduit l'importance des effets mis en avant précédemment. En effet, les négociations sectorielles permettent aux entreprises dominantes de former des accords collusifs. Cependant, les entreprises étrangères du même secteur ne sont pas sujettes à ces accords salariaux. Cela vient donc empêcher la mise en place de ces effets de cartel. Ce chapitre est basé sur un modèle de type Melitz. De plus, des donnés sur les salaires négociés en France sont utilisées. L'augmentation des échanges avec la Chine est utilisée comme un choc exogène. Il est prouvé que cela réduit la rente extraite lors des accords de branche. / In the first chapter, after a presentation of institutional settings, I will focus on the use of sector-level agreements by large firms to reduce competition. Indeed, wage floors are binding for all firms of the industry, whether they sit at the negotiating table or not. This chapter provides a theoretical framework showing that such agreements can be used by dominant firms to reduce competition. In this framework, the higher the over-representation of large firms in employers' federations, the larger the bargained wage floors. This leads to the eviction of small firms. This prediction is tested on French administrative data. I document the domination of large firms within federations and devise an instrumental strategy to show that when the bargaining firms are relatively large compared to the industry standard - ie the lower the federation's representativeness, the higher are wage floors.In the second chapter, I look at the effect of sector-level agreements on innovation. It is based on a model with monopolistic competition between products of an industry on the one hand, and between industries on the other hand. First, I find that when the bargaining process occurs at the industry level, negotiating parties take into account that a wage increase will deter investments of competitors. Indeed, when the wage negotiated at the industry-level increases, the labor cost increase implies that the reward for innovations decrease. As this will reduce the probability to be outperformed, this will generate a wage surplus when the bargaining takes place at the industry-level, reducing both production and employment. Furthermore, it will decrease the research effort of the industry reducing the productivity growth.In the final chapter, I find that international competition mitigates the previous effects. Indeed, collective wage bargaining allows firms of a given industry to coordinate. However, international competition makes this collusive equilibrium unsustainable. Indeed, domestic firms face competition from foreign competitors which are not bound by those agreements. To support this argument, a Melitz-type model is developed and its implications tested on French data using the China Shock as a source of exogenous variation. The rent extracted during sector-level agreements no longer exist when domestic firms face Chinese competition.

Wages and the bargaining regimes in corporatists countries: a series of empirical essays

In the first chapter,a harmonised linked employer-employee dataset is used to study the impact of firm-level agreements on the wage structure in the manufacturing sector in Belgium, Denmark and Spain. To our knowledge, this is one of the first cross-country studies that examines the impact of firm-level bargaining on the wage structure in European countries. We find that firm-level agreements have a positive effect both on wage levels and on wage dispersion in Belgium and Denmark. In Spain, firm also increase wage levels but reduce wage dispersion. Our interpretation is that in Belgium and Denmark, where firm-level bargaining greatly expanded since the 1980s on the initiative of the employers and the governments, firm-level bargaining is mainly used to adapt pay to the specific needs of the firm. In Spain, the structure of collective bargaining has not changed very much since the Franco period where firm agreements were used as a tool for worker mobilisation and for political struggle. Therefore, firm-level bargaining in Spain is still mainly used by trade unions in order to reduce the wage dispersion. <p>In the second chapter, we analyse the impact of the bargaining level and of the degree of centralisation of wage bargaining on rent-sharing in Belgium. To the best of our knowledge, this is the first study that considers simultaneously both dimensions of collective bargaining. This is also one of the first papers that looks at the impact of wage bargaining institutions on rent-sharing in European countries. This question is important because if wage bargaining decentralisation increases the link between wages and firm specific profits, it may prevent an efficient allocation of labour across firms, increase wage inequality, lead to smaller employment adjustments, and affect the division of surplus between capital and labour (Bryson et al. 2006). Controlling for the endogeneity of profits, for heterogeneity among workers and firms and for differences in characteristics between bargaining regimes, we find that wages depend substantially more on firm specific profits in decentralised than in centralised industries ,irrespective of the presence of a formal firm collective agreement. In addition, the impact of the presence of a formal firm collective agreement on the wage-profit elasticity depends on the degree of centralisation of the industry. In centralised industries, profits influence wages only when a firm collective agreement is present. This result is not surprising since industry agreements do not take into account firm-specific characteristics. Within decentralised industries, firms share their profits with their workers even if they are not covered by a formal firm collective agreement. This is probably because, in those industries, workers only covered by an industry agreement (i.e. not covered by a formal firm agreement) receive wage supplements that are paid unilaterally by their employer. The fact that those workers also benefit from rent-sharing implies that pay-setting does not need to be collective to generate rent-sharing, which is in line with the Anglo-American literature that shows that rent-sharing is not a particularity of the unionised sector. <p>In the first two chapters, we have shown that, in Belgium, firm-level bargaining is used by firms to adapt pay to the specific characteristics of the firm, including firm’s profits. In the third and final chapter, it is shown that firm-level bargaining also allows wages to adapt to the local environment that the company may face. This aspect is of particular importance in the debate about a potential regionalisation of wage bargaining in Belgium. This debate is, however, not specific to Belgium. Indeed, the potential failure of national industry agreements to take into account the productivity levels of the least productive regions has been considered as one of the causes of regional unemployment in European countries (Davies and Hallet, 2001; OECD, 2006). Two kinds of solutions are generally proposed to solve this problem. The first, encouraged by the European Commission and the OECD, consists in decentralising wage bargaining toward the firm level (Davies and Hallet, 2001; OECD, 2006). The second solution, the regionalisation of wage bargaining, is frequently mentioned in Belgium or in Italy where regional unemployment differentials are high. In this chapter we show that, in Belgium, regional wage differentials and regional productivity differentials within joint committees are positively correlated. Moreover, this relation is stronger (i) for joint committees where firm-level bargaining is relatively frequent and (ii) for joint committees already sub-divided along a local line. We conclude that the present Belgian wage bargaining system which combines interprofessional, industry and firm bargaining, already includes the mechanisms that allow regional productivity to be taken into account in wage formation. La doctrine internationaliste a accordé une attention notable au dommage depuis l'apparition de la responsabilité internationale en tant que discipline au sein du droit des gens. Toutefois, depuis plusieurs décennies, elle a délaissé les analyses transversales pour se concentrer sur des dommages précis subis soit par l’État, soit par les particuliers. Ce clivage a laissé subsister un angle mort dans l'analyse de la pratique internationale : l'étude des lésions dont la victime n'est ni une personne publique ni une personne privée, mais une entité collective composée par les unes et/ou par les autres et qui ne peut être réduite à l'addition de ses composantes. La prise en compte des lésions dont peuvent être victimes des entités comme la famille, les peuples, l'humanité ou la communauté internationale est l'un des principaux défis auxquels sera confrontée la responsabilité internationale à l'avenir. Afin de proposer une catégorie qui rende possible une analyse d'ensemble de ces atteintes, il est indispensable de clarifier le cadre conceptuel des lésions prises en compte par la responsabilité internationale. Cette réflexion conduit à constater qu'en plus du dommage, celle-ci tient compte d'une deuxième forme de lésion, purement juridique et inhérente au fait internationalement illicite. Les dommages et lésions juridiques peuvent être regroupés dans la catégorie des «lésions collectives» lorsqu'ils portent atteinte à des droits, des intérêts ou des biens collectifs. Des conséquences particulières découlent des lésions collectives ainsi définies dans le cadre de la responsabilité internationale. Elles se manifestent notamment au regard de son invocation et de son contenu. / The emergence of international responsibility as an autonomous field of study in International Law has compelled the international legal doctrine to devote considerable attention to damage and injury. However, during the last decades, scholars have progressively abandoned the cross-sectional analysis of these concepts in order to further focus on specific injuries and damages suffered by States or individuals. This rift has thus Ieft a blind spot in the analysis of international practice: the study of injury and damage whose victim is neither a public nor a private person, but rather a "collective entity" integrated by either, or both, public and private actors; an entity which cannot be simply reduced to the addition of its components. To take into account the injury and the damage -suffered by entities such as the family, peoples, humanity or the international community - is indeed one of the main challenges that faces international responsibility in the near future. In order to suggest a new category which allows for an overall analysis of such injuries and damages, it is necessary to clarify the conceptual framework of both, injury and damage, within the framework of international responsibility. This clarification leads to the conclusion that, in addition to damage, international responsibility also takes into consideration a purely legal injury which is inherent to the internationally wrongful act. Damage and legal injury can be qualified as "collective whenever they infringe collective rights, interests or goods. Specific effects result from this kind of injuries and damages in particular with regard to the invocation as well as to the legal consequences which arises from international responsibility.

En période de crise économique, la question de la garantie de paiement du salaire se pose avec acuité en cas d’insolvabilité de l’employeur. En France, cette protection est assurée par un fonds de garantie géré par l’association pour la gestion du régime de garantie des créances des salariés Depuis sa création en 1974, l’AGS a subi d’importantes mutations : initialement conçue pour pallier les insuffisances d’une protection bâtie sur un système de privilèges, elle est désormais un « amortisseur social » pour les salariés de l’entreprise en difficulté. Paradoxalement, cette évolution est également source d’interrogations sur le devenir du fonds en raison de la différence considérable relevée entre le montant des avances consenties aux salariés et celui des remboursements. Le législateur et le juge ont contribué à la dégradation de sa situation en accréditant l’idée que l’AGS constitue un « employeur de substitution », et en suscitant, chez les salariés, le sentiment qu’elle n’est qu’un simple guichet de paiement des salaires. Assurer la pérennité du système de garantie des créances salariales, technique sui generis participant de l’intérêt général, est nécessaire mais risque, au fil des ans, de se révéler de plus en plus difficile si des mesures énergiques ne sont pas rapidement prises. / In times of economic crises, guaranteeing the payment of wages in the event of insolvency on the part of an employer is a cructical issue. In France, this protection is provided by a national insolvency fund, the Association pour la Gestion du régime des garanties des créances des Salariés. Since its creation in 1974, the AGS has undergone significant changes. While it was originally designed to compensate the deficiencies of a protection built on a system of privileges, it has now become a “social buffer” against a payment default on wages for the employees of a company in difficulty. Paradoxically, this evolution has ushered in further questioning with regards to the future of the fund, due to the considerable disparity between the amounts of the advances granted to the employees and those amounts reimbursed to the fund. The legislator and the courts have both contributed to the degradation of its situation by giving credence to the idea that the AGS is a “substitute employer”, which yielded the impression, for the employees, that it was a mere cash-teller for the payment of salaries. Although it is necessary to ensure the durability of this protective system, as a sui generis contribution to the common good, it might prove more and more difficult, if drastic measures are not taken promptly to fix the system.

Processus de reconnaissance : de la prévention d'un risque psychosocial à la construction de la santé au travail / The process of recognition : from psychosocial risks prevention to occupational health enhancement

La présente recherche étudie le rôle de la reconnaissance comme ressource et levier pour la construction de la santé et le développement des capacités des employés. Elle analyse également la place des ressources individuelles, collectives et organisationnelles dans le cadre des démarches de prévention des risques psychosociaux au travail et la contribution de la reconnaissance dans le processus de construction de la santé au travail. Dans le cadre de cette thèse nous avons analysé 16 démarches de prévention des risques psychosociaux, ainsi que des documents significatifs par rapport à notre problématique. Nous avons également réalisé 147 entretiens individuels et trois entretiens collectifs. Les résultats ont mis en évidence le fait que la reconnaissance joue un rôle important pour la santé et que les pratiques de reconnaissance doivent se matérialiser en lien avec quatre sources : l’institution, le collectif, l’activité de travail et l’autrui significatif. De plus, nos résultats ont mis en évidence une tridimensionnalité du concept de reconnaissance. Ainsi, cette thèse apporte une contribution théorique et pratique sur le thème de la reconnaissance au travail. Elle permet de préciser le cadre conceptuel et méthodologique à mobiliser pour analyser la reconnaissance et mettre en place de pratiques qui favorisent la santé. / This research studies the role of recognition as a resource for health enhancement and for employees’ capability development. Furthermore, it analyses the role of individual, collective and organizational resources in preventing psychosocial risks in the workplace. This research discusses also the contribution of recognition in the process of occupational health enhancement. In the first study we analysed 16 programs of psychosocial risks prevention as well as important documents for this issue. For the second and the third study we interviewed 147 persons individually, and we conducted three focus group interviews. The results have shown that recognition plays an important role for health and that recognition practices must come from four sources: the organization, the work team, the work activity and the “significant others”. Our results have also shown that the concept of recognition has three main dimensions. Therefore, this research makes a theoretical and practical contribution to the issue of recognition in the workplace. It helps clarifying the conceptual and methodological framework needed to analyse recognition and implement actions that protect, enhance and promote employees’ health.
