It is justified, among other reasons, because several normative acts have been issued recently in Brazil authorizing the prorogation by public interest of many concession contracts, so that the theoretical and practical interest in the subject is very great in our Country, at this moment. Thus, this dissertation aims to verify whether the prorogation by public interest is compatible with the concept of prorogation constant of the Constitution of the Federative Republic of Brazil of 1988 ("CRFB/88") and, if so, to present its main aspects. The research hypothesis is that this spicies of prorogation is compatible with the Brazilian Constitution. The method of approach of the subject is the deductive, and the method of research, the bibliographic. Finally, the main conclusion of the present study is that the prorogation by public interest (common or anticipated, with or without premial character) is compatible with CRFB/88, being subject, however, to different requirements, conditions and limits to be fulfilled legitimately / A presente dissertação trata da prorrogação do prazo de vigência dos contratos de concessão de serviço público por razões de conveniência e oportunidade do Poder Concedente (ou, simplesmente, prorrogação por interesse público). Ela justifica-se, dentre outras razões, porque, recentemente, vários atos normativos foram editados no Brasil autorizando a prorrogação por interesse público de diversos contratos de concessão, de modo que o interesse teórico e prático sobre o tema é realmente muito grande em nosso País, neste momento. Assim sendo, a presente dissertação visa a verificar se a prorrogação por interesse público é, ou não, compatível com o conceito de prorrogação constante da Constituição da República Federativa do Brasil de 1988 (“CRFB/88”) e, em caso positivo, apresentar seus principais aspectos. A hipótese de pesquisa é que essa espécie de prorrogação é compatível com a Constituição brasileira. O método de abordagem do tema é o dedutivo, e o método de pesquisa, o bibliográfico. Esta pesquisa abordou a questão do desenvolvimento social e econômico do Parque Estadual Turístico do Alto Ribeira (PETAR), localizado no sul do estado de São Paulo, a partir de um estudo geográfico realizado sob a luz da tríade analítica GTP: Geossistema, Território e Paisagem. Partindo dessa análise geográfica, foi possível identificar como as potencialidades e fragilidades do meio físico influenciaram na territorialização da região onde hoje se encontra o parque, e como a paisagem cultural é construída sobre esta realidade. Com isso foi possível contrapor a interpretação dos dados levantados ao Plano de Manejo proposto para o PETAR em 2010, que se encontra, desde aquele ano, sob análise no Conselho Estadual do Meio Ambiente do estado de São Paulo. O documento apresenta contradições internas no que tange à exploração dos recursos minerais. Com a aprovação da Lei Estadual 16.260/2016, que concede 25 unidades de conservação para a exploração da iniciativa privada, é necessário que não restem pontos obscuros no Plano de Manejo, para que fique claro quais são os recursos que poderão ou não serem explorados. Há indícios de que neste processo os interesses econômicos se sobrepuseram tanto ao objetivo de preservação da área como ao do desenvolvimento socioeconômico. Com essa problemática em foco, discutimos como a Geografia e as ciências, de maneira geral, podem ser úteis ao processo civilizatório ao estabelecer critérios éticos de forma objetiva, apontando assim, as causas dos problemas regionais relacionados à territorialização, as contradições políticas deste processo e de que forma seria possível promover o desenvolvimento socioambiental na região. Um dos principais problemas que levantamos foi a questão das restrições às atividades econômicas impostas pela legislação ambiental. Tendo o turismo como única fonte de sustento possível, a região se tornou altamente dependente dos programas de transferência de renda que, nos últimos anos, provaram ser cruciais para a redução da pobreza extrema e evolução dos índices de desenvolvimento humano. Uma vez que uma flexibilização muito grande das restrições ambientais seria desaconselhável e, levando em consideração que a área do parque é ocupada, historicamente, por populações tradicionais, como comunidades quilombolas, concluímos que seria razoável demandar do estado alguma compensação financeira. Esta medida evitaria que recaíssem, exclusivamente sobre a população local, os custos de uma conservação ambiental que é de interesse do conjunto da sociedade. / This research addressed the issue of the social and economic development of the Upper Ribeira State Tourist Park (PETAR), in the state of São Paulo, Brazil, from a geographic study conducted under the light of the analytical triad GTL: Geosystem, Territory and Landscape. Based on this geographical analysis, it was possible to identify how the potentialities and fragilities of the physical environment influenced the territorialization of the region where the park is today, and how the cultural landscape is built on this reality. Thus, it was possible to counter the interpretation of the data collected with the proposed Management Plan for PETAR in 2010, which has been under analysis by the State Environmental Council of the state of São Paulo since that year. The document presents internal contradictions regarding the exploitation of mineral resources. With the approval of State Law 16.260 / 2016, which grants 25 conservation units for the exploitation of the private initiative, it is necessary that there are no obscure points in the Management Plan so it is clear which resources may or may not be exploited. There are indications that, in this process, economic interests overshadowed both the objective of preserving the area and that of socioeconomic development. With this problematic in focus, we discuss how Geography and the sciences, in general, can be useful to the civilizational process by establishing objective ethical criteria, thus pointing to the causes of regional problems related to territorialization, the political contradictions of this process and how it would be possible to promote socio-environmental development in the region. One of the main problems raised is the issue of the restrictions on economic activities imposed by the environmental legislation. With tourism as the only possible source of income, the region has become highly dependent on income transfer programs which, in recent years, have proved to be crucial for the reduction of extreme poverty and the improvement of the human development indexes in the area. Since a significant relaxation of environmental restrictions would be inadvisable, and considering that the area of the park has historically been occupied by traditional populations such as quilombola communities, we have concluded that it would be reasonable to demand financial compensation from the state. This would prevent the local population from paying, alone, for the costs of an environmental conservation, that is in the best interest of society, as a whole.

Esta tese tem por objeto a análise da concessão florestal, instrumento de outorga do uso de florestas públicas em caráter privativo ao particular. Por tratar-se de uma relação jurídica, a análise é detida nos seus elementos componentes, que são basicamente o objeto, partes e regramento jurídico específico, comparando-a com outras espécies de concessão, como a concessão de serviço público e a concessão de uso de bem público. Iniciando-se pelo estudo da tutela jurídica da floresta, uma vez que a concessão florestal também é instrumento de sua proteção, perpassa-se pelo delineamento da concessão e modelos de gestão de florestas públicas em outros países, para se alcançar o ponto principal que é a análise das regras da Lei nº 11.284, de 02 de março de 2006, marco regulatório da gestão de florestas públicas brasileiras. A conclusão procura realçar, dentre outros aspectos, a existência de uma efetiva política pública de gestão das florestas sob o domínio do poder público, erigida sobre o princípio constitucional do desenvolvimento sustentável do meio ambiente. / This thesis focuses on the analysis of the forest concession an instrument which grants the use of public forests for private use. From a legal perspective, the analysis is held in its component parts, which are basically the object, parties and specific legal rules, comparing it to other types of concessions, such as public service concession and authorization of use of public good. The study begins with the legal protection of the forest, given the forest concession is equally a tool of its own protection, and one goes by the concession outline and the management models of public forests in other countries, in order to achieve the main point, which is the analysis of the rules of Law No. 11,284, from 02 March 2006, reglementary limit of public forests management in Brazil. The conclusion seeks to highlight, among other aspects, the existence of an effective public policy for forest management under the control of government, built on the constitutional principle of sustainable development of the environment.

Economic Policy Implications of Port Concession in Nigeria

Previous research on privatization has focused on its effect on output, profitability, investment, and efficiency at the level of the firm, neglecting the economic growth and other impacts. Nigeria's port privatization through concession in 2006 covered virtually all the ports in the economy. However, the few studies on the subject neither factored in the complexity that characterize the multiple port system nor controlled for alternative explanations of the changes in the economy. This correlational study tested the property rights theory by investigating whether the changes in production efficiency at the ports following privatization are good predictors of economic growth in Nigeria. Eight years of existing panel data were collected from Nigerian ports, providing 160 observations on several selected variables. The analyses controlled for the influence of confounding or interacting variables and addressed the complexity of the port system using linear programming. The multiple regression analysis showed that privatization, deregulation, cargo increases, interest rate, and inflation rate accounted for high variations in short and long-term economic growth. Port privatization transmitted growth to the economy through cargo throughput increases. The Malmquist linear programming analysis revealed overall but modest improvements in production efficiency changes after the privatization. By isolating possible areas of efficiency improvements, this study may inform port managers in Nigeria on ways to improve overall competitiveness. The potential contribution of the research to social change lies in clearly identifying the critical variables to economic growth in Nigeria to aid economic planning, poverty alleviation and improving the quality of life.

O presente trabalho tem como objetivo explorar o instituto da reversão de bens no direito administrativo, realizando pesquisa teórica e legislativa para comparar o uso do instituto e pensar em suas possibilidades em outras áreas do direito administrativo. Para tanto serão adotados métodos de pesquisa qualitativa, dialética e crítica, de modo a obter uma reflexão sobre os usos e interpretações do instituto pelos mais diversos atores, assim como analisar a possibilidade ou impossibilidade de aplicação em outras áreas do direito administrativo. É necessário verificar se o conceito da reversão de bens está atualizado conforme a complexidade das relações jurídicas aplicáveis aos bens públicos e privados no Direito Administrativo na atualidade, pois assim será possível averiguar se o instituto atende aos princípios dessa área do direito, o que possibilitaria também o abarcamento de outras relações entre o setor público e o privado, especialmente aqueles identificados no \"Domínio Público Impróprio\" e se possível, pensar em uma teoria geral da reversão no direito administrativo. / The present work aims to explore the institute of reversal of assets in administrative law, carrying out theoretical and legislative research to compare the use of the institute and think about its possibilities in other areas of administrative law. For that, methods of qualitative, dialectical and critical research will be adopted, in order to obtain a reflection on the uses and interpretations of the institute by the most diverse actors, as well as to analyze the possibility or impossibility of application in other areas of administrative law. It is necessary to check whether the concept of reversal of assets is updated according to the complexity of the legal relations applicable to public and private assets in Administrative Law at the present time, since this will be possible to verify if the institute complies with the principles of this area of law, the coverage of other relations between the public and the private sector, especially those identified in the \"Inappropriate Public Domain\" and if possible, think of a general theory of reversion in administrative law.

Mineral Rights : Legal Systems Governing Exploration and Exploitation

The objective of this thesis is to examine the legal procedures and systems concerning granting or possessing mineral rights, and how such rights may be exercised, particularly given the diametric interests of land use, ownership and land tenure. The study, comparative in its nature, aims at highlighting the similarities and differences between the countries and states of comparison, and thereby identify interesting solutions of issues relating to the granting and exercising of mineral rights. The study examines mineral rights and different legal systems regulating mineral exploration and exploitation. The focus is on mining and mineral legislation and its application, including the exercise of mineral rights. The systems chosen are those of Sweden, Finland and the states of Ontario and Western Australia. The main result is generated by the comparison dealing with the application, granting and possession of mineral rights related to the development of a mine. Several processes are thereby identified. In addition, the content and extent of the different rights and obligations related to exploration and exploitation activities are examined, as well as land areas open or closed for the exercise of these rights. The legal processes concerning granting mineral rights are in fact complex as evidenced by this work, particularly when land-use and environmental legislation is taken into account. The perception of a good balance in legislation between diametric interests of land use, ownership and land tenure is heavily linked to the view of sustainable development. The difficulties of achieving this are confirmed by the countries and states compared. The continuous change of mineral legislation during the course of this study is an indication of the complexity of the topic. / QC20100723

Abstract Promotion of private participation is catalogized as concession model of construction means. The process is the authority to select the private sector that has the best professional knowledge and capability and to transfer the properties to the selected private sector and confer the private sector the concessionary. The private sector then is responsible to finance, construction, operation during the concessionary period. The revenue of the operation and the ancillary business that concessioned by the government will cover the cost of operations and construction. After the concession period, the rights and operations will be transferred to authority. The spirit of private participation is in the process of the private participation. The involvement of private sector injects the flexibility and energy that the government lack of. The private sector also shares the cost of construction that is some financial burden of the government. For this kind of approach, the private sector needs more flexibility and own operations freedom and shares most of the risks. As for the supervision of the government, in general, the less the better. Because the private sector makes its own construction and operations strategies and sales management. In other words, the private sector shall has the independence. The interference of the government shall be limited to minimum, even for the public interest, to prevent the incompatibility of the two sectors and the negative effect of the promotion of the public construction.. However, the supervision logic is excluding the cases that the government financing most of the cost and the interest of the public. This paper argues that the public construction with private participation approach shall be case dependent, from the administration point of view. For the high public interest and high financing project, The government based on his authority and responsibility shall be supervised intensively to ensure the quality and safety of the public construction. One of the issues that the paper raised is the supervision role of the authority. This paper argues how the authority to be a good supervisor. How the authority does his responsibility and accomplish his mission and take appropriate measures to ensure the good quality of the public service continuously. For research methodology, the reference analysis is adopted. The theory and system of private participation are discussed. As for case study, reference and interview are adopted. The supervision and management of private participation of Kaohsiung mass rapid transit by government is analysed to bridge the theory and practice. The characteristics of this project is low self-financing rate. The government financing the rest part of the cost, which is about 80%of the cost. In this project the government also guarantees the forced buy out price, which states clearly in the tri-party contract. This make the financial risk is all on government. The way of taking risk is more likely the OT approach. From the interview, the implementation of the project reveals that anti-supervision game, multi-supervision and management system. Also the different sectors has different understanding of the project. The legal position of the supervision role of the authority is the legitimate to supervise and take appropriate actions. The public sector acts according to laws and safeguards the public interest. The authority has the righteous to supervise, the legal stance. Another role of the authority is also the party of the contract to protect his interest in his investment, which is stemming from the contract, the legal rights from the private sector. During the construction and operations period, the authority shall review and supervised. The legal measures for authority includes the supervision of operations, the restrictions of concessionary, the dispositions of the assets of the construction and operations, The review of the operations fare and changes. The rights stemming from contracts includes setting the standards of the operations facility, the review of the design drawings and schedules and construction quality and subcontracting, the public tendering of parts of the governments financing. For the combinations of both supervision measures includes financial supervision and the acceptance of important contract subcontracting. If the delay of schedule, serious construction quality, serious operations problems, and breach of contract happens, the authority, for the public interest, shall coerce request the private sector to amend in due time, stop all or part of construction and operations abolish the permissions of construction and operations or coerce takeover operations or buyout to ensure the project. As for the rights stemming from contract includes risks sharing, the conditions that the intervention of the financing institutions, suspending all or part of the construction or operations, cease of contract, insurance and bond, mechanism of loyalty and fund. In this study, the legitimate of the supervision role of the authority is discussed and aims to have a robust structure of private participation of public construction system to achieve the goal of promoting public service standard and accelerating development of social economy when promoting privatization of public construction.

Utredning beträffande förutsättningar för sammankoppling över elnätsföretag / Investigation of conditions for interconnection of electrical grids across network companies

Det här examensarbetet har utförts på uppdrag åt Trollhättan Energi AB (TEAB). Examensarbetet är en utredning beträffande förutsättningar för sammankoppling av TEAB:s och Hjärtum Elförenings elnät. De nuvarande ledningsnäten har radialnät och det innebär att det endast har inmatning från ena ledningsänden. En sammankoppling skulle ge möjlighet till sektionerad drift vilket innebär inmatningsmöjligheter från båda ledningsändar. Det gör att ledningsnätet blir mer säkert, tillförlitligt och effektivt. Ett förslag på ett nytt ledningsnät där delar av TEAB:s och Hjärtum Elförenings ledningsnät är sammankopplade har tagits fram. Med det nya förslaget blir ledningsnätet mer driftsäkert och uppfyller lag- och myndighetskrav. Beräkningarna som ligger till grund för arbetet är teoretiskt utförda. Därför bör en fortsatt planering och undersökning inom ämnet utföras innan ledningsnäten sammankopplas. Budgetpriset för ombyggnationen i ledningsnätet har beräknats till cirka 700 000 kronor och investeringen anses nödvändig för att kunna utföra en sammankoppling utav elnäten. / This bachelor´s thesis is conducted on behalf of Trollhättan Energi AB (TEAB). The bachelor´s thesis is an investigation of conditions for interconnection of TEAB and Hjärtum Elförenings electrical grids. The current electrical grids are radial electrical grids and means that it can only be fed from one cable end. An interconnection would allow for sectional operation of the electrical grid. This means input opportunities from both cable ends and that the electrical grid becomes more safely, reliably and efficiently. Suggestion for new electrical grids which parts of TEAB and Hjärtum Elförenings electrical grids are interconnected has been developed. With the new suggestions becomes the electrical grid more reliable and complies with legal and regulatory requirements. The calculations that are underpinning the work is theoretical. Therefore, a continued planning and research in the subject should be performed before the electrical grids are interconnected. Budget price for the reconstruction of the electrical grids have been estimated to be about 700 000 SEK and the investment is considered essential for the interconnection.

It also provides guidance on the application of concessions in the field of road construction development. The first part of the theoretical analysis of the traditional and the modern public service delivery methods of theoretical aspects, particularly highlighting their specific features, pros and cons. The second section discusses the practical application of the concession road construction cases - Palanga and Vilnius bypasses.
