This paper assesses U.S. national security policies in surveillance, detention, interrogation and torture, and targeted killing to determine whether they comport with international human rights law and international humanitarian law. The U.S. is responsible for adhering to the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, and the Geneva Conventions. These human rights law documents can be understood through court decisions, congressional statutes, and widely accepted interpretations from organizations such as the International Committee of the Red Cross, and the UN Human Rights Council. Further, this paper offers prescriptions on how international human rights law and international humanitarian law can be updated to better deal with the current war on terror. / text

This study utilizes a national survey to measure the job satisfaction of juvenile facility directors. The prior literature has focused on the experiences of line personnel within the adult correctional system, and this research serves to provide new information regarding this specific population. The current study will address the predictors and correlates of a director's job satisfaction. It is hypothesized that specific characteristics within the organization will predict job satisfaction. Issues regarding staff within an institution and their effect on a director's job satisfaction are the focus. Results indicate
that staff issues significantly contribute to the job satisfaction of a director. Specifically, this research can be used to understand facility director retention, staff and juvenile related issues, and the effect of job satisfaction on criminal justice policy issues.

Ce mémoire a comme objectif d’analyser le vécu des justiciables placés en détention avant jugement. Plus précisément, cette étude se veut préciser ce vécu sur les volets judiciaire et carcéral impliqués dans une mise en détention provisoire. Nous voulons de plus dégager les sentiments issus d’un tel placement. Enfin, nous souhaitions réfléchir sur le recours à la détention avant jugement à travers la perspective d’un modèle de justice basé sur la gestion des risques et sur une logique d’efficience, d’efficacité et de responsabilisation. Pour ce faire, nous avons utilisé l’approche qualitative pour mener vingt-trois entrevues auprès d’hommes et de femmes incarcérés en attente de leur jugement dans quatre établissements de détention du Québec. De ces entretiens, deux thèmes centraux sont ressortis, soit le Vécus carcéral et judiciaire du prévenu, marqué par l’incertitude, l’incompréhension, l’impuissance, la dépendance, les conditions difficiles de détention, les pertes ainsi que l’attente et les Sentiments issus d’une mise en détention provisoire, marqué par la souffrance, l’injustice et l’urgence de sortir de cette situation provisoire. Il ressort de nos analyses que la façon dont est administré le système de justice, l’opinion du public ainsi que les politiques en vigueur ont un impact sur la façon de gérer le recours à la détention provisoire en favorisant tout le contraire de sa mission initiale. Ainsi, la mesure s’en trouve conduite au détriment de l’acteur principal : le prévenu. / This thesis aim to understand and analyze the experiences of individuals placed in
pretrial detention. More specifically, this study aims to clarify that lived on the judicial
and prison components involved in a remand. We want more free from the felling of
such an investment. Finally, we wanted to reflect on the use of pretrial detention from
the perspective of justice based on risk management and on the logic of efficiency,
effectiveness and accountability. To do this, we used a qualitative approach to conduct
our twenty-three interviews with men and women incarcerated awaiting trial in four
detention facilities in Quebec. From these interviews, two main themes emerged,
namely The judicial and prison experiences of the accused, marked by uncertainty,
incomprehension, helplessness, dependency, difficult conditions of detention, losses
and expectation and Sentiments from a remand, marked by suffering, injustice and the
urgency out of this temporary situation. It is clear from our analysis that the way the
system is administered justice, public opinion and the policies in effect have an impact
on how to manage the use of remand in promoting the opposite of its original. Thus,
the measurement is to be conducted at the expense of the main actor: the accused.

La détention provisoire au Québec : portrait de l’évolution d’une mesure sur une décennie et de la population qui en est l’objet en 2011-2012Dupré, Sophie 12 1900 (has links)
L’objectif de ce mémoire est de dresser un portrait de l’évolution du recours à la détention provisoire au Québec depuis 2002 jusqu’à 2012, pour ensuite préciser les caractéristiques des personnes prévenues en comparaison à celles détenues tel qu’elles se dessinent en 2012, pour la population générale en détention dans les institutions carcérales de juridiction provinciale au Québec, et pour les populations spécifiques que forment les femmes et les personnes autochtones en regard de leur proportion dans la population générale.
Pour ce faire, les tendances actuelles en matière de recours à la détention provisoire sont établies et comparées à celle de 2002. Aussi, un portrait des personnes en détention provisoire au Québec en 2011-2012 est dressé à partir de certaines caractéristiques sociodémographiques et criminelles liées à la détention provisoire selon les écrits précédents sur la question. Ce portrait est comparé à celui des personnes incarcérées dans les mêmes institutions suite à une condamnation à une peine de prison de deux ans moins un jour ou moins.
Par la suite, des analyses bivariées sont effectuées dans le but de comprendre la relation entre la détention provisoire et l’issue du processus pénal, qui consiste, dans la présente étude, à la condamnation à une sentence de détention ou une sentence autre des personnes admises en détention provisoire dans un premier temps. Des analyses de régression logistiques viennent préciser quelles variables permettent le plus clairement de prédire l’imposition d’une sentence de détention aux personnes prévenues dans les institutions carcérales provinciales, au Québec en 2012.
Les résultats de nos analyses indiquent qu’il y a une surreprésentation des hommes et des Autochtones en détention provisoire au Québec. De plus, certaines caractéristiques sociodémographiques et criminelles se révèlent significativement liées à la condamnation à la détention comme le fait d’être un prévenu d’origine autochtone, de posséder des antécédents judiciaires, d’avoir commis un ou des délits de système et de faire partie d’un groupe criminel. Il s’agit du même coup de bons prédicteurs de l’imposition d’une sentence de prison suivant la détention provisoire. Lorsqu’un individu cumule ces caractéristiques, il fera face à une sentence d’incarcération dans le trois quarts des cas.
Finalement, il apparaît que malgré la volonté exprimée de longue date et reprise à l’entrée en vigueur de la Loi C-25 de faire de la détention provisoire une mesure de dernier recours, le recours à cette mesure ne cesse de croître, alors même que la détention découlant d’une condamnation paraît diminuer, ce qui se traduit par un rapport de plus en plus disproportionné entre personnes prévenues et personnes condamnées au sein des prisons du Québec, le ratio jouant en défaveur des personnes prévenues. / The objective of this thesis is to trace a portrait of the evolution of recourse to pretrial detention in Québec from 2002 to 2012, then to specify the characteristics of the defendants in comparison to defendants who are detained as they emerge in 2012, for the general population incarcerated in Québec penal institutions under provincial jurisdiction, for specific populations comprised of women and native peoples in regard to their proportion in the general population.
To achieve this, the present tendencies of recourse for pretrial detention are established and compared to those of 2002. Also, a portrayal of detainees awaiting trial in Québec in 2011-2012 is prepared according to certain socio-demographic and criminal characteristics in relation to pretrial detention according to previous written works on the subject. This portrayal is compared to persons incarcerated in the same institutions following a conviction of a prison sentence of two years minus one day or less.
Next, bivariate analyses are carried out to further understand the connection between pretrial detention and the outcome of the penal process, which consists, in the present study, of a conviction to a sentence of incarceration or other sentence of persons in pretrial detention at the onset. Analyses of logistic regression help pinpoint which variables allow us to most clearly predict the imposition of a sentence of incarceration to persons detained in provincial penal institutions in Québec for 2012.
The results of our analyses indicate that there is an over-representation of men and native peoples in pretrial detention. We also note that certain socio-demographic and criminal characteristics reveal significant connections to a conviction of incarceration, such as being a defendant of native origin, having previous criminal history, having committed one or many systemic offenses, as well as belonging to a criminal group. This is also a good predicative of imposition of a prison sentence following pretrial detention. When an individual accrues these characteristics, he will face a sentence of incarceration in at least three-quarters of cases.
Finally, it appears that despite long-standing will expressed and resumption of discussions when Law C-25 came into force to make pretrial detention a last resort measure, recourse to this measure keeps rising, whereas incarcerations resulting from convictions seem to be diminishing. This translates to a report that is more and more disproportionate between persons who are convicted within Québec prisons, the ratio being to the disadvantage of the person being detained in pretrial detention.

This dissertation focuses on the issue of health care provision without the consent of a patient within the system of intensive care provision. Situations when its possible to hospitalize a patient without his or her consent are defined in § 38 ZZS (Health Services and Terms and Conditions of Health Service Provision Act as amended). In the intensive care unit we are very often faced with patients that need to be urgently treated without their consent. Also very frequently a treatment is provided to patients that are under the influence of addictive substances therefore are dangerous to themselves and to others. Health of these patients is damaged and even their lives are at risk. A treatment without a patient's consent is debatable from the ethical point of view. A conflict occurs between the fundamental ethical principles (benefit principle and principle of autonomy) because it is not entirely clear which one of the two principles should be prioritize during the treatment. Work and moral obligation of every medical personnel is to provide a medical treatment in accordance with the law and ethical principles. Face au recours croissant à la prison soit au titre des peines, soit comme lieu de garde des personnes en attente de jugement, il convient de s’interroger sur les effets de l’incarcération sur la condition juridique des personnes détenues. Longtemps considérée comme étrangère au droit, la prison s’est progressivement dotée d’un corpus de règles que l’on désigne sous le vocable de droit pénitentiaire. Cette recherche vise à interroger les rapports qu’entretiennent le droit de l’institution pénitentiaire et le droit de la société libre afin de préciser les conséquences de l’incarcération sur la vie civile du détenu.De construction récente, le droit pénitentiaire s’est progressivement autonomisé, à tel point qu’il doit être considéré aujourd’hui comme une véritable branche du droit. En cela, il révèle que la prison constitue une microsociété avec ses propres logiques et son propre droit. Véritable décalque de la société civile, la prison évolue dans une orientation toujours plus intrusive dans la vie des personnes qu’elle a sous sa garde.Pourtant, la société civile semble manifester un intérêt croissant pour ses prisons. Prognóza vývoje velikosti a struktury vězeňské populace v ČR / Forecast of the size and structure of the prison population in the CRKoňařík, Martin January 2013 (has links)
Forecast of the size and structure of the prison population in the CR Abstract: Forecasting of prison population in the Czech Republic is almost an unexplored topic. To the whole prison system as a topic is also devoted little space in the literature. The most advanced methods of forecasting of prison populations cannot be used to the Czech data, which are used in countries with a long tradition of it. The data are not connected between Ministry of Justice and the Ministry of Interior, and also differ in their definitions. It is therefore necessary to use a simplified method, which correspond to the data sources. The process is also interfered with unexpected external factors such as the amnesty of the President of the Republic on the 1 January 2013. Models for convicted expected forecast decline in their number by the end of 2013 to 12 to 19 thousands. Models further assume that a decline in 2013 would take place, even if there were no amnesty. Models for the accused assume their fluctuation around the same values. Follow-up calculations show that the state would save significantly by the projection models variants and also the burden on prison officers in correctional facilities would be reduced to 2.1 to 3.2 prisoners per guard from the current 3.5 prisoners per guard. Comparative Critical Discourse Analysis of CNN and Fox News Headlines: A Case of Immigration Detention in the USMaruri Ramos, Catalina January 2019 (has links)
Immigration policies and border control in the US were hardened significantly more ever since the new government’s immigration executive order in 2017. A series of massive raids and immigrant detentions were carried out which got the attention of both human rights activists and the news media. How these immigration detention events are portrayed in the news media reflect, moreover, a series of discourses which seem to attract audiences from either left-wing or right-wing political ideologies, specifically to read CNN and Fox news respectively, according to previous survey-based research. This paper aims to identify through Critical Discourse Analysis (CDA) how those in detention are represented in the news headlines of Fox News and CNN, and secondly, identify what possible left-wing and right-wing political ideologies about immigration are expressed in the news outlets. Reference strategies and transitivity will encompass the micro-level analysis, which focuses on language construction. For the macro-level analysis, on the one hand, discourse practices like process of production and consumption will be considered, and on the other hand, American foreign policy viewed from the left-wing and right-wing perspectives will be discussed to consider differences in style, tone, and perspective in CNN and Fox News’ headlines in relation to immigration detention events. Results show that CNN, tied to left-wing audiences, portray the immigration detention events from the perspective of immigrants who are in a vulnerable position since they are detained with their families. Moreover, Fox News, tied to right-wing audiences, show the events more from the viewpoint of the government and the public entities in charge of the immigration policies, who are in need to restrain, detain, and deport immigrants for the sake of the country’s security. This paper aims to contribute further to the research on political ideologies as a relevant factor to understand differences in discourse in the news media for future research.

O problema de pesquisa que orientou o desenvolvimento deste trabalho foi compreender o que sustenta a racionalidade prática do isolamento institucional como medida para adolescentes autores de atos infracionais. Para investigação do problema proposto, o objeto de pesquisa são as teorias nativas sobre o ato infracional e sobre a medida socioeducativa elaboradas no raciocínio prático dos atores responsáveis pela execução da medida de internação. Adotando a etnometodologia como principal referencial teórico-metodológico, o objetivo é compreender quais os procedimentos interpretativos envolvidos no emprego das teorias nativas pelos atores na produção da relatabilidade racional de suas atividades. A análise envolve interpretações sobre as informações coletadas em uma pesquisa empírica realizada nas organizações responsáveis pela execução da medida de internação em São Paulo: o Fórum Brás e a Fundação CASA. Como forma de acessar as teorias nativas produzidas nos raciocínios práticos dos atores responsáveis pela execução da internação, o material coletado consiste principalmente em entrevistas e documentos institucionais. As interpretações elaboradas sobre as informações coletadas indicam que a racionalidade prática do isolamento institucional é sustentada por procedimentos interpretativos, empregados de maneira análoga pelos juízes e pelos funcionários das unidades de internação, que transformam fatores estruturais, externos à ação elaborados nas teorias nativas como causas do ato infracional , em características individuais transformáveis pela ação institucional e pela vontade do adolescente. No caso dos juízes, o emprego do critério da crítica do adolescente para decidir sobre o término da internação torna o isolamento institucional plausível como resposta ao ato infracional porque essa medida irá transformar e avaliar ao longo do tempo o desenvolvimento desse atributo individual e moral, expressão do pertencimento social do adolescente e tido como determinante da prática infracional. No caso dos funcionários da Fundação CASA, esse procedimento interpretativo se manifesta na operação de interpretar o comportamento do adolescente na unidade como índice de sua transformação para fora da instituição. Ao estabelecer continuidade entre dentro e fora, esse procedimento torna possível sustentar o raciocínio de que quanto mais submetido o adolescente está à instituição, mas preparado ele está para sair dela. Durante o processo de execução da medida, o principal meio de objetivação desses procedimentos são os relatórios elaborados pelas equipes das unidades de internação e utilizados pelos juízes, na grande maioria dos casos, como fundamento exclusivo para formação da decisão sobre o término da medida. Os relatórios são o produto da construção narrativa do fato da transformação do adolescente como efeito da medida, trabalho que envolve, como elemento central, a avalição da crítica do adolescente e de sua estruturação infracional. / The development of this work was guided by the following research question: What upholds the practical rationality of the institutional isolation as an intervention for young offenders? To carry out this investigation, the object of inquiry were the folk theories about delinquency and about punishment employed in the practical reasoning of the actors responsible for the detention of young offenders. From an ethnomethodological perspective, the objective is to understand which interpretive procedures are involved in the actors use of folk theories as means to produce the rational accountability of their activities. The empirical research was conducted at the organizations responsible for the implementation of the institutional isolation in Sao Paulo. In order to access the folk theories, the empirical data consists mostly of interviews and institutional documents. The result of the analysis is that the practical rationality of the institutional isolation of delinquents is sustained by interpretive procedures adopted analogously by both the judges and the detention centers staff. These interpretive procedures transforms structural attributes, external to action formulated as causes of the offense in the folk theories into individual characteristics that can be changed by the institutional action and by the adolescents will. On the one hand, the judges use of the adolescents criticism (showing repentance and empathy for the victim) as a criteria for deciding when to release them from detention, makes the institutional isolation reasonable since it will act upon and evaluate over time the development of this individual and moral attribute, the lack of which is seen as a consequence of the adolescents social background and the cause of the offense. On the other hand, the detention center staff interpret the adolescents behavior in the institution as an index of their transformation for the life outside the institution. By establishing a continuity between inside and outside, they make it possible to sustain the logic that the more submitted the adolescent is to the institution, more prepared he is to leave it. During the implementation of the institutional isolation, the main resource used to objectify these procedures are the reports produced by the staff and used as grounds for the judicial decision to end the detention. The reports are the product of the narrative construction of the fact of the adolescents transformation as a consequence of the detention.
