This thesis investigates the changes and challenges technology has created in the field of technical illustration. Technical illustration includes the fields of technical drawing as well as scientific and medical illustration. Previously, technical illustrators learned and used traditional illustration methods, without the aid of computers. However, technology has rapidly entered the field and has changed the education, work environment, skills, and role of the technical illustrator. I note both the benefits and disadvantages that current technical illustrators are facing in their work. I explore both sides of the digital media and traditional art debate while focusing on the technical illustrator's role, tools and methods used in the illustration process, education, idea-generation, and the future of technical illustration. By emphasizing the issues associated with the incorporation of digital media into traditional methods, I hope to bring awareness to the transformation of technical illustration and the future of this discipline.

Ce mémoire traite des brevets d'invention. Le premier volet dresse un portrait global de
l'institution juridique du brevet, tout en en rappelant sommairement les fondements
économique et philosophique. Après une brève présentation des conditions préalables à
sa délivrance, nous discutons des composantes matérielles du brevet, soit la description de l’invention et les revendications. Une attention particulière est portée à la rédaction ainsi qu'à l'interprétation des revendications. Nous traitons ainsi de deux types de revendications spécialisées qui se sont développés avec l'usage, respectivement les
revendications de type Jepson et Markush, pour ensuite recenser les principes
d'interprétation des revendications que les tribunaux ont établis. Le deuxième volet traite de la validité et de la contrefaçon de brevet. Sur la question de la validité, nous abordons les principaux motifs pouvant entraîner l'invalidité du brevet, soit: l’ambiguïté, l'insuffisance de la divulgation, le double brevet, l'absence de nouveauté, l'évidence et l'absence d'utilité. Enfin, sur la question de la contrefaçon, nous examinons les
circonstances dans lesquelles les actes commis par les tiers portent atteinte au monopole du titulaire de brevet. Pour ce faire, nous nous attardons à la portée des droits exclusifs qui sont reconnus à ce dernier. Tant en ce qui a trait à la validité qu'à la contrefaçon, nous recourons à des illustrations jurisprudentielles permettant de constater les incidences
litigieuses afférentes, d'une part, aux motifs d'invalidité et, d'autre part, aux actes de contrefaçon. / This thesis pertains to patent law. The first part of the study is an overview of patents, where both economic and philosophical justifications for this legal regime are shortly addressed. After reviewing the requirements for the grant of a patent, we turn our attention to the main sections of a patent, namely the description of the invention and the claims. We then proceed to a thorough analysis of both the writing and construction of patent claims. More specifically, Jepson and Markush claims command our attention, having emerged as widespread methods for writing patent claims. Moreover, principles of claim construction, as devised by courts in the context of litigation, are also examined.
The second part of this study pertains to patent validity and infringement. Regarding
validity, we discuss a number of irregularities that may be cause for the invalidity of a patent, namely: ambiguity, insufficiency of the disclosure, double patenting, anticipation, obviousness and lack of utility. Lastly, with respect to infringement, we consider the circumstances from which it may arise, based on the actions of a third party alleged to be
in violation of the patentee’s monopoly. This is carried by way of appraising the extent of said patentee's exclusive rights. With respect to both validity and infringement, we discuss case law pertaining, in a first instance, to validity issues and, in a second instance, to infringement matters.

La thèse analyse le recours, en droit pénal, à la technique énumérative, particulièrement aux listes d'infractions. Cette figure légistique, jadis utilisée dans les conventions bilatérales d'extradition, est aujourd'hui fortement répandue pour délimiter le champ d'application de règles exceptionnelles. Le droit pénal international, le droit pénal français et le droit pénal italien sont simultanément interrogés sur leurs recours à la technique énumérative. L'intérêt de ce rapprochement est de fournir un corpus d'étude riche et varié mettant en jeu différents systèmes et ordres juridiques. La liste n'est pas considérée sous le seul aspect légistique ; sa fonction politique est également analysée. Opérant une sélection d'infractions soumises à un régime différencié, elle est au service d'une répression aggravée ou innovante.L'utilisation de cette technique législative est évaluée à l'aune des résultats escomptés d'une part et avérés d'autre part. On découvre que l'extension, qui est naturelle à toute énumération, appelle une appréciation tantôt critique, tantôt positive. On regrette la dénaturation des listes d'infractions par des rédacteurs qui en détournent la vocation première. L'évaluation se fonde sur les grands principes du droit pénal, à savoir les principes de légalité et de proportionnalité, dont le respect effectif constitue in fine le remède proposé à la dénaturation des listes d'infractions. / The thesis analyses the utilization of enumeration through the "listing of crimes" as a legislative technique in criminal law. Such a method of legislative drafting was used historically in bilateral conventions, specifically in the area of extradition, but nowadays it is heavily employed in criminal law to delimit the scope of application of exceptional rules. Aiming at providing a rich and solid base of knowledge in a domain that is rarely studied, this work reviews various systems and legal orders. As such, the resort to "listing of crimes" will be examined in international criminal law as well as in French and Italian criminal law. Being a tool to select a group of crimes in order to treat them differently than the common crimes, the listing technique serves the needs of aggravated or innovative repression. In that regard, the "listing" technique is not only considered as a means of legislative drafting, but its political function is also analyzed. The utilization of this technique is assessed in the light of the expected as well as the verified results. The extension of an existing "list of crimes", a normal consequence of resorting to enumeration, is found to be positive in some cases but more or less criticized in other cases where legislatures deviate from the original reason for which this drafting technique has been elaborated. Examined from the perspective of the fundamental principles of criminal law, namely the principle of legality and the principle of proportionality, the usage of this technique is appraised. The respect of these two primordial principles constitutes the ultimate solution proposed for any deviated resort to "listing of crimes" as a legislative tool.

Para justificar a pertinência e a utilidade de um guia prático abrangendo as principais orientações a serem observadas em cada um dos elementos que a cláusula compromissória pode conter, avalia-se a importância dos cuidados dispensados à redação de tais cláusulas a partir da apresentação de exemplos concretos dos vícios que possam estar presentes de modo a torná-las patológicas, bem como do tratamento jurídico dado às cláusulas defeituosas, tanto nas hipóteses de vícios sanáveis, em que se mostra necessária a prévia intervenção do Poder Judiciário a fim de viabilizar o início da arbitragem, quanto nos casos de vícios insanáveis, os quais tornam a cláusula inválida e insuscetível de cumprimento forçado. / The present work has as its central object the analysis of pathological arbitration clauses, in order to propose recommendations for the preparation of complete and fully effective arbitration clauses. To justify the pertinence and usefulness of a practical guide including the main recommendations to be observed in each of the elements that the arbitration clause can contain, it is analyzed the importance of care dismissed in drafting these clauses, starting from the presentation of concrete examples of the defects that can be present in the clauses in order to make them pathological as well as the legal treatment given to defective clauses, both in the cases of soluble vices, when it is necessary prior intervention by the Judiciary to enable the start of arbitration, as in the cases of defects which make the clause invalid and not enforceable.

Literacy, orality and recontextualization in the parliament of the Republic of South Africa : an ethnographic studySiebörger, Ian January 2012 (has links)
In parliaments, the tasks of drafting legislation and conducting oversight are accomplished by means of complex chains of spoken, written and multimodal texts. In these genre chains, information is recontextualized from one text to another before being debated in sittings of the houses of parliament. This study employs the point of view afforded by linguistic ethnography to investigate critically the ways in which meanings are recontextualized in one section of such a genre chain, namely the process by which committees of South Africa's National Assembly oversee the budgets of government departments and state-owned entities. It does this to identify possible sources of communication difficulties in this process and suggest ways in which these can be minimized. In so doing, it develops a theoretical model of the discursive effects of recontextualization informed by Latour's (1987) notion of black-boxing as well as Maton's (2011) Legitimation Code Theory. This model uses Interactional Sociolinguistics and elements of Systemic Functional Linguistics, including APPRAISAL and Transitivity as tools to describe the realization of these effects in language. This study finds that ideational and interpersonal meanings are condensed and decondensed at particular points in the genre chain in ways that lead to some MPs’ voices being recontextualized more accurately than others’. It also shows that common sources of communication difficulties in the committee process include differences in political background and understandings of committee procedure and participant roles. It recommends that representatives of departments and entities reporting to the committees should receive a fuller prebriefing on their roles; that MPs should receive training on asking clear, focused questions; and that the role of committee secretaries as procedural advisors should be strengthened.

This paper examines the impact of teachers' formative feedback on intermediate drafts on student writing development and its interrelationship with summative assessment. Formative feedback is advocated for its benefits on learners writing development; however, its usage in writing instruction at the upper-secondary level is met with frustrations from teachers and students alike. This paper endeavors to draw upon international research on the topic, synthesize the results and correlate it to the educational context of ESL teaching of writing in Swedish upper-secondary schools to elucidate what formative feedback practices are beneficial and how summative aspects can impact them. Research shows that feedback that is encouraging, investigative, and deals with global and local issues alike is more beneficial for facilitating writing development in a new genre. However, teachers should be mindful of overusing imperatives as they can act as demotivators, and they should also be mindful of the toll engaging with feedback takes on learners. Furthermore, teachers should not use grades to motivate feedback uptake, as it does not incentivize learners to do meaningful revisions. Lastly, more research should examine how formative feedback can illustrate students' writing standards without impeding benefits to writing development.

This is a study of computer technology's impact on the theatrical design process. The tools of communication provided by technology were studied, and an analysis was conducted in the classroom of Digital Rendering, Digital Rendering Videos, and 3d CADD. After-wards, these tools were applied to an actual production of West Side Story where, with the addition of 3d light simulation software, the tools were used to communicate the design ideas from the lighting designer to the director. The goal of this process was to provide a 'real to life' virtual representation of the show to the director with the least amount of confusion. An additional goal was to test the limits and functions of the software; trying to learn all the benefits that could be provided to the process of mounting a theatrical production.
