(Un)exceptional Measures Against a Housing Crisis - A Study of Temporary Housing in Sweden

The lack of affordable housing has been a long-standing problem for many cities in Sweden, and the recent refugee crisis has only highlighted the difficulties for economically weaker constituencies to enter and sustain in the existing housing market. The pressing situation and a new law, obligating the municipalities to supply housing, forced the authorities to look for solutions. The thesis investigates the recent changes and use of one of these offered solutions – temporary housing permits. Using a qualitative approach, it tries to capture both the formative-discursive processes and the material outcomes of this measure, in order to understand what informs the decision and its possible implications. The study employs theoretical concepts from Giorgio Agamben’s theory on the ‘state of exception’, as I consider them important for the understanding of the processes. The interventions in the housing system are made possible only by declaring that the shortage of housing is in an ‘exceptional situation’, one that can only be resolved with irregular practices, exceptions from standard norm and regular procedures. A look into the legal-formative mechanisms and the materialization of the temporary housing permits is given. The thesis argues that a wider perspective is needed and tries to bring into the discussion the political and social aspects of using a measure like this one. Although conceptualized as a quick and temporary remedy, it is maintained that the utilization of temporary housing permits can potentially have harmful long-lasting effects on the understanding of housing provision, living standards, and planning processes. This suggests that authorities have to be careful when using exceptional measures and calls for a fundamental and systemic re-thinking of housing in general.

This research deals with the question of how detention of foreigners and the creation ofdifferent forms of detention centers have been rendered possible in the context ofSweden, from the early 1900s up until today. A qualitative content analysis is used toexplore four periods, in terms of the motivations and regulations that produce“detainable categories”, as well as the logic behind such practices of encampment.Drawing on the concept of the “state of exception”, and by using policy documents, thisresearch argues how the Government by gaining extended powers in different periods oftime justifies and regularizes the detention of foreigners. This has been done for thesake of security of the state, protecting the welfare and wellbeing of the nation. Thistells us that the creation and production of detainabilities is not only related toexceptional situations, but becomes the normal condition of the existence of the nationstate.

A Unifying Theory of Multi-Exit Programs

<p>Programs have multiple exits in the presence of certain control structures, e.g., exception handling and coroutines. These control structures offer flexible manipulations of control flow. However, their formalizations are overall specialized, which hinders reasoning about combinations of these control structures.</p> <p>In this thesis, we propose a unifying theory of multi-exit programs. We mechanically formalize the semantics of multi-exit programs as indexed predicate transformers, a generalization of predicate transformers by taking the tuple of postconditions on all exits as the parameter. We explore their algebraic properties and verification rules, then define a normal form for monotonic and for conjunctive indexed predicate transformers. We also propose a new notion of fail-safe correctness to model the category of programs that always maintain certain safe conditions when they fail, and a new notion of fail-safe refinement to express partiality in software development.</p> <p>For the indexed predicate transformer formalization, we illustrate its applications in three models of multi-exit control structures: the termination model of exception handling, the retry model of exception handling, and a coroutine model. Additionally, for the fail-safe correctness notion and the fail-safe refinement notion, we illustrate their applications in the termination model. Six design patterns in the termination model and one in the retry model are studied. All the verification rules and design patterns in the thesis have been formally checked by a verification tool.</p> / Doctor of Philosophy (PhD)

Combien d’enfants ont rêvé de devenir un jour footballeur professionnel, tennisman ou pilote de Formule 1 ? Combien étions-nous au soir de la finale de la Coupe du monde 1998 derrière les « Bleus » ? Magie, phénomène social, vecteur d’intégration… On pourrait disserter bien longtemps sur les vertus du sport. Toutefois, le revers de la médaille est beaucoup moins réjouissant, sauf pour le juriste. En effet, on assiste ces dernières années à un processus de prise en compte du sport par le droit étatique. Le sport ne peut plus rester hors du droit. Cette pénétration du droit a forcément des incidences sur les droits fondamentaux reconnus aux sportifs. Pourtant il semble que la doctrine ne se soit que très peu intéressée au sportif, « qui est un citoyen comme les autres avec des droits imprescriptibles ».Si le principe selon lequel le sportif dispose des mêmes droits fondamentaux que tout citoyen semble largement admis, il convient de ne pas rester imperméable à la revendication d’une exception sportive. En effet, le mouvement sportif vit comme une intrusion l’appréhension du sport par le droit étatique. L’opposition entre la Commission européenne et les instances du football, concernant le système des transferts, est une preuve récente de cette réticence. Ainsi une spécificité sportive empêcherait l’application normale de la règle de droit. Qu’en est-il du point de vue des droits fondamentaux du sportif ? Existe-t-il une exception sportive en matière de droits fondamentaux de sorte que reprenant une expression de Hauriou, on pourrait considérer les sportifs comme des « citoyens spéciaux » ? Plusieurs problèmes se posent. Tout d’abord, il conviendra de s’interroger sur l’existence d’une spécificité sportive dans la reconnaissance de droits au sportif. En effet, la question est celle de savoir si le sportif est titulaire des mêmes droits que tout citoyen. Une fois les droits du sportif déterminés, la question de l’effectivité de ses droits se posera. N’existe-t-il pas une particularité sportive dans l’exercice des droits fondamentaux, de sorte que si le sportif bénéficie en principe des mêmes droits que tout citoyen, il ne pourrait pas les exercer de la même manière ? Ainsi l’effectivité des droits du sportif serait atténuée.La mise en œuvre d’une spécificité d’application en matière de droits fondamentaux révèle une protection catégorielle qui rompt avec l’universalisme traditionnellement attaché aux droits de l'homme. La recherche de l’effectivité des droits des sportifs est pourtant pertinente. Mais elle conduit le juge à reconnaître le caractère fondamental d’un droit, indépendamment de la norme qui le supporte en fonction de l’importance qu’il revêt dans le cas d’espèce. La démarche du nouvel acteur de la scène sportive montre une remise en cause de l’acception formelle de la notion de fondamentalité au profit d’une acception matérielle. Sauf à reconnaître l’existence d’un droit au sport formellement fondamental. Car « il est plus intéressant de s’interroger sur l’existence du même droit, au niveau où sont normalement reconnus les droits fondamentaux, c'est à dire au niveau constitutionnel » ( ). Même si aucun texte à valeur suprême ne consacre un tel droit, « il ne faut pourtant pas s’en tenir à ce décevant constat » ( ). Car son émergence est perceptible. L’intérêt est considérable puisque le droit au sport recouvre la quasi-totalité de la nomenclature des droits de l'homme ( ). Sa mise en œuvre devient nécessaire à la prise en compte de la spécificité sportive. / How many children dreamed to become a day professional football player, a tennis player or a driver of Formula 1? How much were we in the evening of finale of the World cup 1998 behind the French Team ? Magic, social phenomenon, vector of integration … We could talk indeed for a long time about the virtues of the sport. However, the other side of medal is much less happy, safe for the jurist. Indeed, we attend these last years a process of consideration of the sport by the state law. The sport cannot stay any more outside the state law. This penetration of the law has necessarily incidences on the fundamental rights recognized by the sportsmen. Nevertheless it seems that the doctrine that is little interested in the sportsman, " who is a citizen as the others with inalienable rights ".If the principle according to which the sportsman arranges the same fundamental rights as every citizen seems widely admitted, it is advisable not to remain impervious to the demand of a sports exception. Indeed, the sports movement lives as an intervention the apprehension of the sport by the state law. The opposition between the European Commission and the authorities of the football, concerning the system of transfers, is a recent proof of this hesitation. So a sports specificity would prevent the normal application of the legal rule. What is it from the point of view of the fundamental rights of the sportsman? Is there a sports exception in fundamental rights so that taking back an expression of Hauriou, we could consider the sportsmen as " special citizens "? Several problems settle. First of all, it will be advisable to wonder about the existence of a sports specificity in the recognition of rights for the sportsman. Indeed, the question is the one to know if the sportsman is a holder of the same rights as every citizen. Once the rights of the sportsman were determined, the question of the effectiveness of its rights will settle. Is not there a sports peculiarity in the exercise of the fundamental rights, so that if the sportsman benefits as in principle from the same rights as every citizen, he could not exercise them in the same way? So the effectiveness of the rights of the sportsman would be eased.The operated of a specificity of application in fundamental rights reveals a category-specific protection which breaks with the universalism traditionally attached to human rights. The search for the effectiveness of the rights of the sportsmen is nevertheless relevant. But it leads the judge to recognize the fundamental character of a right, independently of the standard which supports it according to the importance which it takes on in the special case. The initiative of the new actor of the sports scene shows a questioning of the formal meaning of a word of the notion of fundamentality for the benefit of a material meaning of a word. So as to recognize the existence of a right by the formally fundamental sport. Because " it is more interesting to wonder about the existence of the same right, at the level where are normally recognized the fundamental rights, that is at the constitutional level ". Even if no text with supreme value dedicates such a right, " You should not nevertheless be held in it disappointing report ". Because its emergence is perceptible. The interest is considerable because the law for the sport recovers the quasi-totality of the nomenclature of human rights. Its stake in work becomes necessary for the consideration of the sports specificity.

Les attentats du 11 septembre 2001 ont provoqué une onde de choc aux États-Unis et dans le monde entier. Pour y faire face, le gouvernement a adopté des mesures exceptionnelles. Notre étude se penche sur la doctrine américaine. John Yoo, Professeur à l’Université de Berkeley, a joué un rôle de premier plan au sein de l’Office of Legal Counsel (OLC) au moment des attentats. Depuis cette période, il ne cesse de revenir sur la manière dont le gouvernement des États-Unis a réagi à la suite des évènements. Partant d’une perspective utilitariste, Éric Posner et Adrian Vermeule proposent quant à eux une théorie de l’exception qui renverse la plupart des opinions traditionnellement admises et défendues. La problématique essentielle qui scande l’ensemble de notre travail est de saisir, de l’intérieur, à partir d’une lecture des ouvrages des trois auteurs, les tensions fondamentales de l’approche retenue par le gouvernement des États-Unis, au regard de la tradition constitutionnelle du pays. / The attacks of September 11, 2001 caused a shock wave both in the United States and the wholeworld. In the aftermath, the government adopted extraordinary measures to address the threat. Our study focuses on contemporary American legal scholars. John Yoo, Professor at Berkeley University, played a significant role within the Office of Legal Counsel (OLC) at the time of the attacks. Since then, he has never stopped addressing how the United States government reacted in the wake of these events. Using a utilitarian perspective, Eric Posner and Adrian Vermeule, for their part, bring forward a state of exception theory which dismisses certain views that are commonly accepted and embraced. The main issue that guides the whole of our work is to try and comprehend – from within and through reading of the three authors’ writings – the fundamental tensions of the approach adopted by the United States government in view of the country’s constitutional tradition.

Les conventions franco-marocaines du 5 octobre 1957 et du 10 août 1981 constituent le socle de la coopération bilatérale entre les États français et marocain en matière familiale internationale. Négociées il y a plusieurs décennies, elles ont pour objectif de garantir aux ressortissants des deux États l’application de leur statut personnel sur le territoire de l’autre État et de mieux assurer la protection des enfants et des créanciers d’aliments. Ces conventions se sont toutefois heurtées à l’hétérogénéité des ordres juridiques français et marocains. L’européanisation croissante du droit international privé de la famille invite à s’interroger sur la place laissée par les droits européens aux conventions bilatérales franco-marocaines. L’applicabilité des conventions franco-marocaines est mise à l’épreuve par l’emprise croissante des règlements européens de droit international privé articulés aux conventions de La Haye. L’enchevêtrement des normes applicables conduit alors à examiner les solutions permettant d’articuler les sources entre elles. Dans les hypothèses où elles demeurent applicables, les conventions franco-marocaines sont là encore soumises aux droits européens. L’influence des droits européens peut alors servir les objectifs conventionnels et porter les conventions franco-marocaines vers plus d’efficacité, ou alors infléchir les obligations bilatérales lorsque les valeurs européennes se trouvent mise en cause. / The French-Moroccan agreements of October, 5th 1957 and August, 10th 1981 establish the base of the bilateral cooperation between French and Moroccan States in the field of private international family law. Negotiated several decades ago, they have for objective to guarantee to the nationals of both States the application of their personal status on the territory of the other State and to insure the protection of the children and the maintenance creditors. These conventions however came up against the differences existing between the French and Moroccan legal orders. The increasing Europeanisation of the private international family law invites to wonder about the place left by European laws for the application of the French-Moroccan bilateral agreements. The applicability of the French-Moroccan conventions is put to a test by the increasing influence of the European regulations articulated with the Hague Conference’s conventions. When they are applicable, the French-Moroccan agreements are submitted even there to European laws. Then, the influence of European law can serve the conventional objectives and carry the French-Moroccan agreements towards more efficiency, or bend the bilateral obligations when the European values are questioned.

Les faits justificatifs spéciaux ont été définis et identifiés, dans le cadre de ces travaux de recherche,comme des causes objectives d’irresponsabilité pénale affectées à une ou quelques infractions précises, et prévues – sauf pour les faits justificatifs spéciaux prétoriens – par un texte lui-même affecté à la fonction justificative. Face à cette tentative d’élaboration d’une définition et d’un régime cohérents, l’éclatement conceptuel et l’enchevêtrement normatif qui caractérisent le droit contemporain s’expriment toutefois avec une acuité troublante dans l’évolution de la justification spéciale. Parce qu’ils sont si discrets à l’échelle de la répression pénale, parce qu’ils n’ont pour garantir leur intégrité ou leur cohérence ni principe cardinal, ni institution dédiée, les faits justificatifs spéciaux ont été entraînés sans résistance parle courant puissant des faits divers, des aléas politiques, des réformes institutionnelles et des espoirs européens. Qu’ils pointent du doigt la jurisprudence ou le faiseur de lois, les faits justificatifs spéciaux trahissent par leur modestie et leur petitesse la démesure des ambitions des acteurs institutionnels du droit pénal. / In this work, special justifications have been defined as objective defenses assigned to one or very fewspecific crimes, and provided for – unless they are judge-made – by legal texts centered on their justificatory function. The attempt to construct an accurate definition and a coherent regime was complicated by the conceptual fragmentation and normative entanglement of contemporary French criminal law. Not only are special justifications very subtle mechanisms in the broad scheme of criminalliability, but they do not have, to guarantee their conceptual integrity, the shelter of a dedicated institution or core legal principle. Consequently, special justifications have been carried along by the steady stream of political change, current events, institutional reform and European ambitions. The study of special justifications allows us to reconsider jurisprudential debates regarding judicial (re)definition of crimes under the influence of the European Court of Human Rights. It also gives a new perspective on thewell-documented phenomenon of the “corruption” of criminal law caused by its instrumentalization. In a phenomenon some academics call “disciplinary” criminal law, other legal branches make use of criminallaw’s symbolic strength. In these respects, the subtlety of special justifications exposes the immodesty of judges and legislators with respect to their ambitions for criminal law.

The so-called Second Czechoslovak Republic (1938-1939) is used to be portrayed as the dark age, when obscure, fascist elements came to lights. This period is ussually put in opposition to the previous First Czechoslovak Republic (1918-1938). In this thesis the main argument consist of questioning the continuity between these two allegedly contradictory historical times through the analysis of special legislation - state of exception -, which was adopted in purpose to deal with defending the democracy in Czechoslovakia between 1933 and 1938. The State Protection Act (1936) implemented into legal discourse special term for potential - in the case of war - enemies of the state: "state unreliable persons". This category of "reliability" was understood as nationality and part of far more complex national consensus by all contemporary agents, which legitimizes the state intervention primarily into the economic sphere. In the centre of national consensus stood transformed labour: collective duty for the nation. Until 1938, among contemporary agents, exists strong notion that realization the state of exception in the case of war and therefore national consensus cannot be fully realized because of international minority laws. Towards the effective utilisation of trade-related aspects of intellectual property rights flexibilities to improve access to essential medicines in Ghana

Magister Legum - LLM / Access to medicines is an essential component of the basic human right to health and a key determinant of the importance attached to the health care system of a country. It essentially entails the availability and acceptability of the essential medicines on the market and the ability of patients to afford such medicines when needed. Globally, countries face access to medicine challenges partly because of patents which undoubtedly accounts for excessive pricing of medicine. As such, efforts have been made to ensure the accessibility of medicines through the Trade-Related Aspect of Intellectual Property Rights (TRIPS) flexibilities of the World Trade Organisation (WTO). Beyond these interventions, it is incumbent on Members of the WTO to domesticate the flexibilities of the TRIPS Agreement before their utilisation because by their very nature, they cannot be self-executed. With an estimated population of 29.6 million, about 310 000 people in Ghana are living with HIV. The country’s health facilities record 40 per cent of outpatient visits each year and about 14 550 per 100 000 of the population are infected with tuberculosis with cancer on the rise. These diseases require medicines which are mostly patented yet Ghana has access to medicine problems despite the existence of a national health insurance system. Ghana has however not fully incorporated the TRIPS flexibilities in its national legislations and therefore unable to fully utilise the flexibilities as an option to access essential medicines. Questions therefore remain as to why and how Ghana can utilise the flexibilities to improve access to medicines. Based on an examination of the WTO’s patent system and legislations of Ghana, this mini- thesis contends that, the extent of incorporation of the flexibilities are inadequate due to the existence of lacunas in the Ghanaian legislations. Furthermore, a comparative assessment with South Africa supports an understanding that conditions are not ripe for full utilisation of all the flexibilities. It further argues that the utilisation of the TRIPS flexibilities by Ghana has been rendered ineffective due to administrative, political, economic and social challenges which adversely affects the full utilisation of the flexibilities incorporated and those yet to be incorporated. It is therefore important that Ghana adopts holistic approaches taking into consideration best practices if the TRIPS flexibilities must be effectively utilised. This mini-thesis concludes that, the TRIPS flexibilities are necessary for accessing essential medicines in Ghana to promote the right to health and that a review of Ghana’s current legislations to fully incorporate the TRIPS flexibilities and addressing other non-legal challenges are the required linchpin for effective utilisation of the TRIPS flexibilities.
