The Conceptual Structure of Object Control and Exceptional Case Marking in English

Within the framework of Jackendoff’s conceptual semantics, this study investigates the semantic properties that govern the distribution of object control (such as John persuaded Mary to help Sally) and exceptional case marking (such as John wanted Mary to help Sally) in English. In contrast to Jackendoff’s approach to control, one central idea here is that the to-infinitive complements under discussion should receive a uniform semantic analysis, and thus that control behaviour cannot be explained in terms of semantic argument type of the complement clause. In order to arrive at such an analysis of these to-infinitival complements, they are taken to constitute Situations in conceptual structure, and clauses (TPs) in syntax. It is argued here that it is indeed possible to establish the character of the semantic properties that govern the two constructions OC and ECM. Not only does the semantic type of the governing predicate play a role—attitude predicates, as opposed to force dynamic predicates, are exclusively coded as ECM in syntax—but also the realisation of the semantic argument position that corresponds to the Patient/Beneficiary role in conceptual structure. With force dynamic predicates, OC will arise when this argument position is filled with an explicit argument. When it is empty, or left implicit, however, the result will be ECM in syntactic structure.

Esta dissertação analisa a técnica de julgamento de recursos repetitivos pelo Supremo Tribunal Federal (STF) e Superior Tribunal de Justiça (STJ) técnica de julgamento por amostragem , instituída no direito brasileiro pelas Leis federais ns. 11.418/2006 e 11.672/2008, que respectivamente incluíram no Código de Processo Civil os artigos 543-B e 543-C. Na primeira parte do trabalho, são abordados temas correlatos, relativos à tendência de valorização da jurisprudência no direito brasileiro, bem como às funções, importância e admissibilidade dos recursos extraordinários e especiais. Na segunda parte, são analisadas as justificativas de criação da técnica, relacionadas ao equacionamento do problema do excesso de recursos repetitivos no STF e no STJ. Além disso, são traçados os aspectos gerais do instituto, analisando-se a sua inspiração em procedimentos de julgamento por amostragem do direito estrangeiro, a sua caracterização como técnica de ampliação da eficácia persuasiva dos precedentes do STF e do STJ e suas diferenças e semelhanças com a repercussão geral. São também enfrentadas as questões relativas à constitucionalidade do julgamento por amostragem, apresentando-se um olhar crítico sobre a jurisprudência do STF e do STJ, que vêm interpretando suas regras de forma excessivamente restritiva ao direito das partes. A terceira e última parte é dedicada ao exame do funcionamento da técnica de julgamento de recursos repetitivos, enfrentando-se as diversas questões relativas às várias fases de seu procedimento, tais como os requisitos para instauração, competência, sobrestamento de recursos repetitivos, participação de terceiros e efeitos do julgamento. São também analisados os resultados práticos, principalmente à luz das estatísticas do STF e STJ, após a sua positivação, bem como as modificações previstas na versão atual do projeto de novo CPC. Trata-se de um legítimo e eficiente instrumento de potencialização dos precedentes do STF e do STJ que, sem prejuízo de necessários aperfeiçoamentos, bem como da sua adequada interpretação e aplicação à luz dos princípios constitucionais, mostra-se teoricamente adequado para conciliar a atual realidade dos problemas gerados pelos recursos repetitivos com a verdadeira função dos recursos excepcionais, de proteção e unificação do direito federal constitucional e infraconstitucional. / This Masters Dissertation analyzes the technical of judgment of recursos repetitivos [repetitive appeals, as a free translation] by Superior Court of Justice (STJ) and Federal Supreme Court (STF) technical of julgamento por amostragem [judgment by sampling, as a free translation] established in Brazilian legal system by the Brazilian Federal Laws Ns. 11.418/2006 and 11.672/2008, which respectively included in the Code of Civil Procedure the Articles 543-B and 543-C. In the first part of this work, correlated themes are addressed, related to the trend of appreciation of the jurisprudence in Brazilian law, as well as the functions, importance and acceptability of extraordinary and special appeals. In the second part, this work analyzes the reasons for the creation of the technique related to solution of the problem of excessive repetitive appeals on Federal Supreme Court (STF) and Superior Court of Justice (STJ). Furthermore, the general aspects on this matter are plotted by the analyze of its inspiration in trial procedures by sampling of foreign law, its characterization as a technique of enlargement of the persuasive effectiveness of precedents of Supreme Court (STF) and of Superior Court of Justice (STJ) and its differences and similarities with the repercussão geral [general impact, as a free translation]. This work also challenges the questions related to the constitutionality of the judgment by sampling presenting a critical vision at the jurisprudence of the Supreme Court (STF) and of Superior Court of Justice (STJ) that have been interpreting the rules of the judgment by sampling excessively restrictive to the right of the parties. The third and last part of this work deals with the examination of the operation of the technique of repetitive appeals trial, facing up of several questions relating to the various stages of its procedure, such as conditions of filing, jurisdiction, halting of repetitive appeals, third parties participation and effects of the judgment. This work also analyzes the practical results, particularly in light of the statistics of Supreme Court (STF) and of Superior Court of Justice (STJ), after the legalization of the repetitive appeals as well as the changes planned in the current draft version of the new CPC. It is a legitimate and efficient instrument of potentiation of the precedents of the STF and STJ, which, notwithstanding necessary improvements, as well as their adequate interpretation and application in the light of the constitutional principles proves to be adequate to conciliate the current reality of the problems caused by repetitive appeals with the true function of the of exceptional appeals, to protect and to unify the constitutional and infra-constitutional federal law.

Estas instituições atendem pessoas com deficiência intelectual, e oferecem atendimentos em várias áreas da educação e saúde, dentre essas a Terapia Ocupacional que está presente na maioria dos planos terapêuticos e educacionais dos usuários. A pesquisa seguiu uma abordagem predominantemente qualitativa, utilizaram-se entrevistas semiestruturadas, gravadas com 06 terapeutas ocupacionais que atuaram ou atuam em APAES do estado de São Paulo. Inicialmente buscou-se resgatar alguns aspectos históricos da profissão e das instituições no Brasil. Em seguida considerando a analise do material, procurou-se destacar os aspectos relativos ao papel do profissional de terapia ocupacional nas décadas de 80, 90 e 2000 e suas bases teórico-metodológicas de atuação sendo possível refletir sobre as perspectivas atuais e futuras de participação deste profissional nas instituições. The research followed a predominantly qualitative approach, we used semi-structured interviews, recorded with 06 occupational therapists who worked together in APAES the state of São Paulo. Initially we attempted to rescue some historical aspects of the profession and institutions in Brazil. After considering the analysis of the material sought to highlight those aspects of the role of occupational therapy professional in the 80, 90 and 2000 and its theoretical and methodological bases of operation being possible to reflect on the current and future prospects of participation of professional institutions. Les mécanismes de flexibilité du droit de l'OMC / The flexibility mechanisms of the WTO law

Orienté vers le libre-échange, le droit de l’Organisation Mondiale du Commerce est basé sur plusieurs principes fondamentaux : la non-discrimination, la réciprocité et la réduction progressive des obstacles au commerce. Il existe des mécanismes répondant à l’impératif d’adaptabilité nécessaires aux membres pour faire face à des situations exceptionnelles afin d’intégrer de la souplesse dans l’application du droit de l’OMC et de déroger aux principes et règles régissant le commerce international. Cela vaut aussi bien en période de crise qu’indépendamment de l’environnement économique général, dès lors que les conditions sont réunies pour que les membres les mettent en œuvre. La crise économique de 2008 a fait craindre un recours accru, voire abusif, à ces instruments d’exception, de dérogation, de sauvegarde, ce qui signifierait un retour à des pratiques protectionnistes. La réflexion sur l’utilisation de ces outils permet la mise en évidence des instruments proposés par le droit de l'OMC pour faire face à des situations qui nécessitent un frein au libre-échange. Elle précise également les pratiques des Membres, la logique générale de ces mécanismes de flexibilité et l’équilibre entre les principes orientés vers le libre-échange et les exceptions qui supposent des restrictions au commerce. Les questions qui se posent doivent conduire à étudier l’ensemble de ces instruments de flexibilité, l’articulation entre ces instruments et ceux des autres organisations internationales en lien avec l’OMC, le rôle du juge de l’OMC dans les différends liés à l’utilisation de ces mécanismes et les perspectives d’évolution ou de réformes des instruments de flexibilité du droit de l’OMC / Oriented toward free trade, the World Trade Organization law is based on several fundamental principles: non-discrimination, reciprocity and the gradual reduction of trade barriers. There are mechanisms that respond to the need for adaptability necessary for Members to deal with exceptional situations in order to incorporate flexibility in the application of WTO law and depart from the principles and rules governing international trade. This applies both in times of crisis, and irrespective of the general economic environment, as soon as the conditions seem to require Members to implement them. The economic crisis of 2008 has raised fears of increased use or abuse of these instruments of exception, derogation (waivers), or safeguard, all of them constituting actions that would mean a return to protectionist practices. Reflection on the use of these tools allows the identification of instruments proposed by the WTO law to deal with crisis and more generally to situations that require a barrier to free trade. But beyond that, it specifies the practices of Members in the use of these tools, the general logic of these mechanisms for flexibility and the balance between the free-trade oriented principles and the exceptions that involve restrictions on trade. The questions then raised should lead to consider all of these instruments of flexibility, the articulation between these instruments and those of other international organizations in connection with the WTO, the judge's role in WTO disputes related to the use of these mechanisms, and the prospects of change or reform of flexibility instruments WTO law

Les microorganismes du domaine du vivant Archaea sont très divers sur le plan biologique et sont présents dans de nombreux types d'écosystèmes. Ils sont majoritaires dans les environnements dits extrêmes. Parmi les virus d'archées, ceux infectant les espèces d'un phylum majeur des archées, Crenarchaeota, constitué d'hyperthermophiles, forment un groupe exceptionnel. En effet, leurs morphotypes sont uniques, variés, et complexes. Le contenu de leur génome est également unique. Enfin, la plupart de ces virus se maintiennent dans la cellule hôte en état porteur, une relation chronique qui permet un équilibre entre production de virions et division cellulaire. J'ai d'abord démontré que le virus de crenarchée Sulfolobus islandicus rod-shaped virus 2 est un virus virulent, et non chronique comme il avait été suggéré. Un mécanisme de lyse unique a été découvert. La paroi cellulaire est modifiée en plusieurs points, avec l'apparition de structures pyramidales saillantes. Celles-ci s'ouvrent en fin de cycle infectieux, permettant aux virions, assemblés auparavant dans le cytoplasme, de quitter la cellule. Puis j'ai travaillé sur des échantillons de sources géothermiques de la péninsule de Kamchatka (Russie) et contribué à l'isolement et la caractérisation d'un virus de morphotype filamenteux. Des protéines structurales supplémentaires ont ainsi été identifiées. Enfin, des mots courts exceptionnels ont été identifiés dans un grand nombre de génomes d'archées et de leurs éléments extra-chromosomiques. Ce sont potentiellement des motifs fonctionnels non-codants, impliqués dans des mécanismes biologiques importants. Typiquement, les motifs palindromiques sont évités dans les génomes / The microorganisms from the Archaea domain are very diverse at the biological level and they are present in many types of ecosystems. They are dominant in the so-called extreme environments. Among their viruses, those infecting species of the Crenarchaeota phylum, a major archaeal phylum comprising hyperthermophiles, form an exceptional group. Indeed, their morphotypes are unique, diverse, and complex. Their genome content is also unique. Finally, most of these viruses persist in the host cell in a carrier state, a chronic relationship allowing an equilibrium between virion production and cell division. I first proved that Sulfolobus islandicus rod-shaped virus 2 is a virulent virus, and not chronic, as had previously been suggested. A unique lysis mechanism was discovered. The cell wall is modified in several locations, with the appearance of pyramidal prominent structures. Those burst open at the end of the infection cycle, allowing the virions, previously assembled in the cytoplasm, to leave the cell. Then, I worked on environmental samples from geothermal springs of the Kamchatka peninsula (Russia) and contributed to the isolation and characterization of a virus of filamentous morphotype. Additional structural proteins were in particular identified. Finally, short exceptional words were identified in a great number of genomes from archaea and their extra-chromosomal elements. These are potentially functional non-coding motifs involved in important biological mechanisms. Typically, palindromic motifs are avoided in the genomes

Vista por este ângulo, o empreendimento investigativo por mim realizado se divide em três eixos analíticos. No primeiro eixo busco reconstituir a disputa conceitual sobre os termos "deficiência" e "deficiência intelectual". A proposta é pensar os deslizamentos semânticos do conceito e as implicações políticas dessas transformações. No segundo eixo procuro analisar os discursos dos professores, técnicos especialistas e funcionários da APAE de Vila de Santa Rita, bem como os prontuários de atendimento dos matriculados. O Objetivo é compreender como é formulada a noção de "deficiência" e de "deficiência intelectual", a fim de reconhecer quais categorias operam e como elas ganham significado na instituição. Ainda são analisadas as implicações dessas categorias no modo como é entendida, mas também como é tratada, a sexualidade dos alunos matriculados na APAE. No terceiro eixo o intuito é evidenciar como a "deficiência intelectual" é percebida pelos alunos da APAE e quais as categorias operam na construção do desejo afetivo e sexual destes. Dessa maneira, proponho descontruir tanto a imagem de sujeito anormal como a imagem de uma sexualidade descontrolada associada aos alunos com deficiência intelectual / Abstract: Disabled or not the body carries social and cultural brands seized in interaction processes. Viewed from this angle, this investigative project I conducted is divided into three analytical axes. In the first point I seek to reconstruct the conceptual dispute over the terms "disability" and "intellectual disability". The proposal is to think the semantic slips of the concept and policy implications of these transformations. In the second axis I analyze the discourses of teachers, technical specialists and employees of APAE in Vila de Santa Rita, as well as the medical charts of the enrolled. The goal is to understand how it is formulated the concept of "disability" and "intellectual disability" in order to recognize which categories they operate and how they acquire meaning in the institution. Are further analyzed the implications of these categories in the way it is understood, but also how it is treated, the sexuality of students enrolled in APAE. The third axis the intent is to show how "intellectual disability" is perceived by students of APAE and which categories operate in the construction of these affective and sexual desire. A questionnaire was administered to Masters of Social Workers (MSWs) employed by the Department of Children's Services, San Bernardino, California to test the hypothesis that Master of Social Work (MSW) workers attitudes towards children with Attention Deficit Disorders (ADD/ADHD) are affected by the perceived cause of the disorders.

This Diploma thesis deals with creating the Plan of Measures in Case of Exceptional Incidents on manufacture Premises. The first part of thesis is dedicated to description of Exceptional Incidents, primarily accidents with leak of hazardous chemical substances, legislation background of Exceptional Incidents and Emergency planning, Civil Protection, as a complex within Czech Republic and then individual measures (the plan are assembled of) are descripted. The Plan of Measures, as such itself, is created on the basis of processed analysis of hazardous properties connected with chemical substances, used in McBride, a.s., mainly the Acids and mixtures of alcohol. The leak of this compounds was simulated in software ALOHA, which gives information about degree of threat to inhabitants of this area. Suggested Measures are created to be practicable in particular situation in surroundings of McBride, a.s. Aim of this Diploma thesis is not just to create a particular Plan, but integrally describe the issues of Emergency planning especially for smaller subjects within municipality, that do not come under the scope of law n. 59/2006 Sb., and to create a tool, that can help to other creators of similar Plans of Measures to understand to partial relations.
