The moderating role of graduate skills and attributes in relation to the employability and retention of graduates in a retail organisationMulaudzi, Livhuwani Ronnie 06 1900 (has links)
The general aim of the study was to assess the relationship between the graduateness, employability and satisfaction with retention factors of individuals and whether graduateness moderates the relationship between employability and satisfaction. The study used a quantitative, cross-sectional research design on a purposive, non-probability sample (N = 100) of predominant black (93%), male (49%) and female (51%) trainees between the ages of 17-29 years (early career). Presenting/applying information skills significantly and negatively predicted compensation while ethical/responsible behaviour significantly and positively predicted satisfaction with job characteristics and organisational commitment. Graduateness related positively to self-perceived general employability. General employability did not significantly predict the participants’ satisfaction with retention factors. Graduate skills and attributes did not significantly moderate the relationship between self-perceived employability and satisfaction with retention factors. Males had significantly stronger perceptions of employability compared to females while females had higher levels of work–life balance satisfaction compared to males. Overall, the results suggest that general self-perceived employability is more a function of graduateness than of retention, while graduateness positively relates to retention factors. / Industrial and Organisational Psychology / M. The FTI (Flight Test Installation) designed for A320, A340, A380 and A350 programs include acquisition system, recorder, data processing, visualisation, Flight Test Engineer Station and optional functionalities (video acquisition, DGPS, telemetry ...) In the past, these test means were specific for each test aircraft. Due to the large number of Aircraft development in parallel Airbus has designed and standardized new tests means for development and production aircraft. The first goal is to generate significant benefits regarding time and costs savings by simplifying installation and reusing all the test installations components. This paper shows the opportunities and challenges of these new concepts.

Why βίοϛ? : on the relationship between gospel genre and implied audienceSmith, Justin M. January 2011 (has links)
This thesis addresses the gap in the scholarly record pertaining to the explicit relationship between gospel genre and implied audience. This thesis challenges the consensus that the canonical gospels were written to/for individual communities/churches and that these documents (gospels) address the specific historical/social circumstances of each community. It is argued in the thesis that the Evangelists chose the genre of biography because it was the genre that was best suited to present the words and deeds of Jesus to the largest possible audience. The central thesis is supported by four lines of evidence: two external and two internal (Chapters 3-6). Furthermore, the thesis is bolstered by a new typology for Greco-Roman biography that arranges the biographical examples within a relational matrix. Chapter 2 is integral to the main thesis of this dissertation in that it proposes nuanced language capable of being applied to specific kinds of biographies with the emphasis on the relationship to implied audience. Chapter 2 sets the boundaries of the discussion of genre as a vital factor in potentially determining audience as well as raising the important consideration that genres are representative of authorial choice and intent. Chapters 3 and 4 take up the discussion of the two lines of external evidence pertinent to placing the Gospels within the relational typology proposed in chapter 2. Chapter 3 supports the main argument of the thesis in that it demonstrates that the earliest Christian interpreters of the Gospels did not understand them to be sectarian documents written specifically to and/or for specific sectarian Christian communities. The second line of external evidence, taken up in chapter 4, deals with the wider context of Jesus literature in the second/third century. We argue that these texts, if any of them are indeed biographies, were part of the wider Christian practice of writing and disseminating literary presentations of Jesus and Jesus traditions. Chapters 5 and 6 address the lines of internal evidence and chapter 5 deals specifically with the difficulty in reconstructing the various gospel communities that might lie behind the gospel texts. It is argued that the genre of biography does not allow us to reconstruct these communities with any detail. Finally, chapter 6 is concerned with the ‘all nations’ motif present in all four of the canonical gospels. The ‘all nations’ and ‘sending’ motifs in the Gospels suggest an evangelistic tone for the Gospels and further suggest an ideal secondary audience beyond those who could be identified as Christian.

專利權具有獨占性,對一國產業發展具有重要影響,為了平衡該權利,各國專利法在給予發明人專利權的同時也加諸某些限制,以我國為例,於專利法第五十七條第一項列舉專利權效力所不及之情形有:(一)為研究、教學或試驗,實施其發明,而無營利行為者。此即所謂之「實驗例外」 (experimental use exception)條款。
實驗例外條款在各國司法實務運作上,最常被引起爭論者向來集中在處方藥市場中專利藥廠與學名藥廠間之競爭議題。因為學名藥廠為了能夠盡早進入市場,不免須在專利期間屆滿前實施原廠專利進行必要之研究、試驗,以符合各國對於藥物上市管理法令之要求。
雖然我國專利法與其他國家一樣也有試驗例外條款,但其中要件嚴格限定為「非營利行為」,從比較法之方式分析,該規定係受美國普通法之影響。美國普通法關於試驗例外係採取嚴格路線,必須行為人之試驗係出於非營利目的,單純追求真相、探求知識理論,或為滿足好奇心,才可主張普通法上之實驗例外,即始係不具營利色彩之公家機關、學術單位從事之試驗,只要背後具有實質的商業目的亦不得主張試驗例外。如此造成要成功適用試驗例外是愈來愈不可能。
國際間對於試驗例外之立法,除美國外,尚存在許多形式值得我國借鏡,以歐洲共同體專利規則草案(Proposal for a Council Regulation on a Community Patent)為例,其區分「私人且非商業性目的之行為」,以及「為試驗目的之行為」,後者要求必須係針對系爭專利技術本身所進行之試驗始非專利權效力所及,若係將該專利技術作為研究工具之用,仍非法之所許。這種區分方法不僅層次分明、無觀念上混淆之虞,判斷上也較具有可預測性。
美國於1984年通過Hatch-Waxman 法案鼓勵學名藥之發展,對於為滿足主管機關關於醫藥品上市要求之試驗,在專利法271(e)(1)明文規定排除在專利權效力之外,即所謂之「Bolar例外」。我國於九十四年二月五日亦增訂藥事法第四十條之二第五項:「新藥專利權不及於藥商申請查驗登記前所進行之研究、教學或試驗」關於Bolar例外之規定。惟或因立法匆促,致法條要件不符合實際狀況,例如限定「申請查驗登記前」之行為,實際上藥廠於提出查驗登記之申請後,往往在主管機關之要求下須進行其他試驗,這些行為均在立法者原欲保護之範圍內,僅因立法用語之不當,造成實務運用之困擾。
筆者最後從法律及商業管理觀點著眼,對國內立法提出下列修法建議,作為本研究之最終成果:
壹、對於專利法第五十七條第一項第一款修法之建議
一、刪除「教學」之行為態樣
二、刪除「而無營利行為」之要件
三、增列關於研究工具之專利則無本條之適用
四、放寬適用範圍為符合主管機關法規要求而實施他人專利亦有實驗例外之適用。
贰、對於藥事法修法之建議
一、刪除「申請查驗登記前」之要件,改以行為目的來限定範圍,即「為通過藥品查驗登記所進行之研究或試驗」,始有本款之適用。
二、明定「物品專利」及「方法專利」均有本條之適用

歐美葡萄酒貿易協定於2006年3月10日經歐美雙方簽署後,對於延宕多年之數項關於雙方葡萄酒貿易上之爭議,達成了一定程度之妥協。然雙方所妥協之內容均與WTO協定之規範有衝突之處;然從另一方面觀之,該協定卻有助於美國在其葡萄酒產品使用歐盟地理標示之爭議上,朝向與TRIPS協定較為合致之方向去修正。
歐美葡萄酒貿易協定最主要之爭議可分為兩大部分,一為歐盟關於葡萄酒釀造製程上之規範;另一是美國葡萄酒產品使用歐盟地理標示,本文主要將針對此二議題與WTO協定間之合致性進行探討,以了解該協定所妥協之部分與WTO協定間之合致性。由於歐盟與美國係為WTO內最具影響力之兩大會員,本文最後將探討該協定對於WTO多邊架構以及爭端解決機制上之所衝擊與影響。 / The EU-US agreement on trade in wine was signed on March 10, 2006, marking the end of a first phase in wine trading discussions began in 1983. The Agreement addresses several key issues, such as oenological practices, import certification, the use of European geographical indication on the wine label which produced in US and other labeling issues. This thesis is to analyze the most controversial parts of this agreement.
This agreement compromises 17 provisions, there are two parts most controversial: one is the mutual acceptance of the EU-US oenological practice regulations, which would facilitate the trading of wine between the two parties. And the other is that finally U.S. agreed to prohibit new brands from using these names on non-European wine and grandfather those existing uses.
The oenological regulation of EU is more strictly and conservative compare to the related international standard. Moreover, EU ban the import of wine which is not conform with its oenological regulation unless the exporting country meet the Derogation requirement to allow the wine to be imported and circulated in the territory of EU. This article is to analyses the consistency of the EU oenological regulation with the TBT agreement, and the MFN treatment with this derogation.
And the U.S. had allowed the use of specific EU geographical indications, which is called semi-generic names in U.S. regulation, on the wine label for the wine producing in the U.S in its labeling regulation. According to the TRIPS Agreement, the use of EU’s GI is in a continuous matter before 1994 can be excepted from the regulation of additional for GI. This thesis would like to clarify which part of the use of those semi-generic names may or may not except from the context of TRIPS agreement about GI.
Since the wine agreement settle down several issues which violate the WTO agreement, this thesis would like to discuss the impact of the wine agreement to the WTO multilateral system.

Théorie KAM faible et instabilité pour familles d'hamiltoniens / Weak KAM theory and instability for families of HamiltoniansMandorino, Vito 11 March 2013 (has links)
Dans cette thèse nous étudions la dynamique engendrée par une famille de flots Hamiltoniens. Un tel système dynamique à plusieurs générateurs est aussi appelé ‘polysystème’. Motivés par des questions liées au phénomène de la diffusion d’Arnold, notre objectif est de construire des trajectoires du polysystème qui relient deux régions lointaines de l’espace des phases. La thèse est divisée en trois parties.Dans la première partie, nous considérons le polysystème engendré par les flots discrétisés d’une famille d’Hamiltoniens Tonelli. En utilisant une approche variationnelle issue de la théorie KAM faible, nous donnons des conditions suffisantes pour l’existence des trajectoires souhaitées.Dans la deuxième partie, nous traitons le cas d’un polysystème engendré par un couple de flots Hamiltoniens à temps continu, dont l’étude rentre dans le cadre de la théorie géométrique du contrôle. Dans ce contexte, nous montrons dans certains cas la transitivité d’un polysystème générique, à l’aide du théorème de transversalité de Thom.La dernière partie de la thèse est dédiée à obtenir une nouvelle version du théorème de transversalité de Thom s’exprimant en termes d’ensembles rectifiables de codimension positive. Dans cette partie il n’est pas question de polysystèmes, ni d’Hamiltoniens. Néanmoins, les résultats obtenus ici sont utilisés dans la deuxième partie de la thèse / In this thesis we study the dynamics generated by a family of Hamiltonian flows. Such a dynamical system with several generators is also called ‘polysystem’.Motivated by some questions related to the phenomenon of Arnold diffusion, our aim is to construct trajectories of the polysystem which connect two far-apart regions of the phase space.The thesis is divided into three parts.In the first part, we consider the polysystem generated by the time-onemaps of a family of Tonelli Hamiltonians. By using a variational approach falling within the framework of weak KAM theory, we give sufficient conditions for the existence of the desired trajectories.In the second part, we address the case of a polysystem generated by twocontinuous-time Hamiltonian flows. This problem fits into the framework of geometriccontrol theory. In this context, we show in some cases the transitivity of a generic polysystem, by means of Thom’s transversality theorem.The third and last part of the thesis is devoted to the proof of a newversion of Thom’s transversality theorem, formulated in terms of rectifiable sets of positive codimension. Neither polysystems nor Hamiltonians are explicitly involved in this part. However, the results obtained here are used in the second part of the thesis.

Un réseau de cellules est un graphe orienté dont chaque sommet (aussi appelé cellule) représente un ensemble de variables et dont les arcs symbolisent les interactions entre ces variables. Les réseaux de cellules jouent un rôle important dans la modélisation de phénomènes neurologiques, de systèmes économiques ou biologiques, etc.. Soit G un graphe orienté possédant N sommets, on dit qu'une application f=(f_1,...,f_N) de X=X_1×...×X_N dans X (où X_j=R^dj) est admissible, si pour tout sommet j, f_j(x) dépend de x_i seulement si i->j est un arc de G. Dans cette thèse nous montrons que si G est fortement connecté et auto-dépendant, génériquement par rapport à f appartenant à l'ensemble des applications admissibles de classe C¹, le système dynamique engendré par l'équation différentielle x'(t)=f(x(t)) vérifie la propriété de Kupka-Smale, c'est-à-dire tous les éléments critiques (points d'équilibre et orbites périodiques) sont hyperboliques et les variétés stable et instable des éléments critiques s'intersectent transversalement. Ainsi, pour un ensemble dense d'applications admissibles, le système dynamique est au moins localement stable par perturbation (admissible ou non). Nous considérons également l'ensemble des applications « dissipatives » f de classe C¹ dont la différentielle Df(x) est une matrice de Jacobi cyclique positive en tout point x. De telles applications définissent un système coopératif. Nous montrons que le système dynamique engendré par l'équation x'(t)=f(x(t)) vérifie génériquement la propriété de Morse-Smale par rapport à de telles applications f, c'est-à-dire le système vérifie la propriété de Kupka-Smale, les éléments critiques sont en nombre fini et l'ensemble des points non-errants est égal à l'ensemble des éléments critiques. Cette propriété entraîne la stabilité structurelle du système dynamique. Finalement, dans cette thèse nous étudions aussi des réseaux de cellules satisfaisant des contraintes de symétrie locale. Pour de tels systèmes, nous montrons tout d'abord des résultats génériques d'observation à symétrie près, de synchronisation et de décalage de phase. Nous utilisons ces résultats pour montrer la généricité de l'hyperbolicité des points d'équilibre ainsi qu'un lemme d'injectivité pour les trajectoires. Les résultats de généricité de cette thèse sont obtenus à l'aide de théorèmes de transversalité de type Sard-Smale. / A coupled cell network consists in a directed graph, with each node (also called cell) representing a set of variables and with each arrow representing the interaction between these variables. Coupled cell networks play an important role in the modeling of phenomena in neurology, economics or biology, etc.. Let G be a directed graph with N nodes. A mapping f=(f_1,...,f_N) of X=X_1×...×X_N to X (where X_j=R^dj) is admissible, if for each node j, f_j(x) depends on x_i only if i->j is an arrow of G. In this thesis, we show that if the graph G is strongly connected and self-dependant, generically with respect to f in the class of admissible C¹-functions, the dynamical system generated by the differential equation x'(t)=f(x(t)) satisfies the Kupka-Smale property, that is all the critical elements (i.e. the equilibria and periodic orbits) are hyperbolic and the stable and unstable manifolds of these critical elements intersect transversally. As a consequence, for a dense set of admissible functions, the dynamical system is locally stable with respect of small perturbations (admissible or not). We also consider the set of "dissipative" mappings f of class C¹, the differential Df (x) of which is a positive cyclic Jacobi matrix at any point x. Such maps define a cooperative system. We show that the dynamical system generated by the equation x'(t)=f(x(t)) is generically Morse-Smale with respect to such mappings f, that is the system is Kupka-Smale, the critical elements are in finite number and the non-wandering set is equal to the set of critical elements. This property implies the structural stability of the dynamical system. Finally, in this thesis we also study coupled cell networks satisfying local symmetry constraints. For such systems, we first show generic results of observation, synchronization and phase shift. We use these properties to show the genericity of hyperbolicity of equilibrium points and an injectivity lemma for trajectories. In the proof of these genericity results, we use different Sard-Smale type theorems.

In this thesis, the expression variation problem in two-dimensional (2D) and three-dimensional (3D) face recognition is tackled. While discriminant analysis (DA) methods are effective solutions for recognizing expression-variant 2D face images, they are not directly applicable when only a single sample image per subject is available. This problem is addressed in this thesis by introducing expression subspaces which can be used for synthesizing new expression images from subjects with only one sample image. It is proposed that by augmenting a generic training set with the gallery and their synthesized new expression images, and then training DA methods using this new set, the face recognition performance can be significantly improved. An important advantage of the proposed method is its simplicity; the expression of an image is transformed simply by projecting it into another subspace. The above proposed solution can also be used in general pattern recognition applications.
The above method can also be used in 3D face recognition where expression variation is a more serious issue. However, DA methods cannot be readily applied to 3D faces because of the lack of a proper alignment method for 3D faces. To solve this issue, a method is proposed for sampling the points of the face that correspond to the same facial features across all faces, denoted as the closest-normal points (CNPs). It is shown that the performance of the linear discriminant analysis (LDA) method, applied to such an aligned representation of 3D faces, is significantly better than the performance of the state-of-the-art methods which, rely on one-by-one registration of the probe faces to every gallery face. Furthermore, as an important finding, it is shown that the surface normal vectors of the face provide a higher level of discriminatory information rather than the coordinates of the points.
In addition, the expression subspace approach is used for the recognition of 3D faces from single sample. By constructing expression subspaces from the surface normal vectors at the CNPs, the surface normal vectors of a 3D face with single sample can be synthesized under other expressions. As a result, by improving the estimation of the within-class scatter matrix using the synthesized samples, a significant improvement in the recognition performance is achieved.
