En jämförelse mellan den svenska fastighetsmäklaren och den latinska notarius i Federationen Bosnien och Hercegovina

Ändamålet med denna studie är att undersöka, jämföra och analysera vad skillnaderna respektive likheterna är mellan den svenska fastighetsmäklarens kontra den latinska notarien i Federationen Bosnien och Hervegovina gällande rådgivningsplikten. Studien kommer även att beröra delar av yrkenas kontraktskapande samt skyldigheten att agera opartiskt. Studien kommer att ge en tydligare bild på vad kan man förvänta sig få för juridiska råd vid en fastighetsöverlåtelse i respektive land. Likheterna mellan de två yrkena föreligger främst i: 1. fastställa viss fakta, 2) lämna relevant information, 3) att ge adekvat rådgivning, och 4) att upprätta nödvändiga handlingar på ett sätt som är anpassat till den enskilda transaktionen. Skyldigheten att vara opartisk och rådgivningsplikten utgör tillsammans en specifik funktion i fastighetsöverlåtelser, som i Sverige utövas av fastighetsmäklaren och Federationen Bosnien och Hercegovina av notarius: opartisk rådgivning. / The purpose of this study is to examine, compare, and analyze what the differences and similarities are between the Swedish real estate agent versus the Latin notary in the Federation of Bosnia and Herzegovina regarding the duty to give counsel. The study will also affect parts of the professions contractual creation and the duty to act impartially. The study will provide a clearer picture of what can be expected for legal advice on a property transfer in each country.The similarities between the two professions are mainly in: 1) to conduct verifications to ascertain facts, 2) to disclose relevant information, 3) to give adequate advice, and 4) to draw up all necessary deeds in a manner that is tailored to the instant transaction. The duty of impartiality and the duty to counsel constitutes to a specific function in real estate conveyances, common to both professions: impartial counsel.

This thesis explores the transformations of the Muslim community (current Bosniaks) of Bosnia and Herzegovina during the Austro-Hungarian occupation between 1878 and 1918. It examines the political, social and demographic changes in Muslim society - including the development of community life and religious, cultural and educational institutions - in the context of the formation of modern Central and South East European nations. Habsburg rule in the northernmost Ottoman province, in hindsight, stood at the beginning of a long, insecure and ambiguous but ultimately successful process of national self-awareness of the Slavic Muslim community of Bosnia and Herzegovina and the Sanjak. The various chapters of this thesis broadly follow the standard framework of analysis of national movements in Europe. This work is theoretically grounded in the modernist paradigm connecting the national idea to changes in social, economic and political circumstances, the onset of modernity, based on both constructivist and instrumentalist theories. The thesis is largely relied on secondary sources when discussing these subjects as well as newspaper articles, memoirs, biographical essays, declarations and political proclamations. Since the war´s end in the 1990s, Bosnia and Herzegovina, a young nation in the center of Europe, has struggled to establish a functional democratic system. In line with the Dayton Agreement, which ended the conflict, the nation was split up into two autonomous regions, one of which would belong to the Serbian population and the other to the Bosnian and Croatian populations. In addition to being a peace treaty, the Dayton Agreement would also serve as the nation´s constitution with the intention to construct a democratic government and society. Bosnia and Herzegovina have struggled to establish a fully democratic state of governance since the peace, because of the Dayton Agreement´s power-sharing model, which in practice has given room for the country´s rulers as well as international actors, to view the country as a surface where two independent parts meets, rather than a unified state. The aim of this study is to examine Bosnia and Herzegovina´s democratic constraints from 2018 to 2022 using Wolfgang Merkel´s theory of embedded and defective democracy. It also seeks to determine to what extent Bosnia and Herzegovina can be considered as a defective democracy, based on the theory´s premises. The outcome of this study, in short, implies that Bosnia and Herzegovina´s democratic constraints can be attributed to national political abuse of power, together with corruption, the absence of functioning state institutions and an undue reliance on international actors.

Sexual violence has long been portrayed as an inevitable side effect of warring. The phenomenon constitutes a complex dynamic of shifting power structures and arbitrary gender expectations. Conflict-related sexual violence operates within different social contexts where the female body becomes a battlefield where dominance and superiority are sought. The following paper is formulated as an interdisciplinary case study where a feminist framework and social constructivism are used to examine the multifaceted phenomenon of conflict-related sexual violence. The aim of the study has been to delve into underlying factors to its prevalence in the conflicts of Democratic Republic of Congo and Bosnia Herzegovina. Furthermore, the curtailed agency of women is elucidated when analyzing the repercussions of conflict-related sexual violence, which poses as the second question of the study. The result of the study reveals that the prevalence of sexual violence as a military strategy is not caused by single-issue factors, rather by interconnected elements such as patriarchal notions, power structures and gender normative behaviour. To conclude, the phenomenon has an extensive destructive capacity and affects several societal levels where the current study enhances previous research by its adoption of an interdisciplinary perspective that integrates the embedded practices of gender repression and military strategies.

Different cultures have legends which affect the people and societies in which these legends are traded. Most legends are ecotypified, but some legends can survive even when those who tell them move. The aim of this study is to identify some characteristic features of the legend tradition within the Bosnian diaspora in Sweden, and to identify which type of legends that live on in the Swedish environment. The study is conducted as an interview study and the results analyzed with a hermeneutic approach. The study identifies five different types of legends that are categorized into three different categories: erotic, trauma and fear. The results show a fear among the respondents that if the legends disappear, a loss of part of their Bosnian identity will follow. The conclusion show that the category of fear lives on in the Bosnian diaspora, whilst legends building on trauma and eroticism are at risk of disappearing in a Swedish environment.

The thesis focuses on freely available digital libraries in the field of science, research and education in the countries of former Yugoslavia. The work is divided into theoretical and practical part. The theoretical part introduces the basic terminology and the issue of freely available digital libraries. The main part of the thesis is based on the findings of freely available digital libraries in the countries of former Yugoslavia. Their structured overview is an annex to this thesis and a commentary on them is given in the practical part. The core of the thesis constitutes the results of analyzes of three digital libraries from the selected region. It aims to analyse, describe,compare and assess selected systems. The practical part presents the descriptions and analysys of the selected systems. Next chapter includes the comparison of their qualitative and quantitative parameters. The conclusion of the work brings final assessment of the knowledge.

Approved for public release; distribution is unlimited / This thesis presents a historical analysis of the evolution of US Army Special Forces operations from 1995 to 2004, focusing specifically on operations conducted in the Balkans (Bosnia and Kosovo), Afghanistan and Iraq, answering the research question: How have the operations conducted by US Army Special Forces evolved from the Balkans in 1995 through Operation Enduring Freedom (OEF) to Operation Iraqi Freedom (OIF)? The thesis examines the progression of Special Forces operations during each of the aforementioned campaigns, analyzing their evolution in the areas of intelligence operations, unconventional warfare and foreign internal defense, close air support, integration with conventional forces and the institutionalization of lessons learned. The thesis concludes by examining future roles of US Army Special Forces with respect to employment. Tracing the progression of Special Forces employment from the Balkans to OIF is critical to understanding the factors contributing to the success of Special Forces operations in both the decisive operations and stability and support (SASO) phases of OEF and OIF. / Major, United States Army
