Institut autorizovaného inspektora v judikatuře českých soudů / The institution of an authorized inspector (surveyor) in case law of Czech courts

This diploma thesis concentrates on approved inspector's activities and protection of the concerned persons' rights especially from the perspective of jurisprudence. Original intention of the legislator was to unburden the builders and building Authorities by introducing the possibility to use the authorised persons' services. That person was located on the border of private and public law. This status was not defined correctly by the lawmaker and it resulted in many legal disputes. It was necessary to react by adoption of the complex amendment. Aim of the thesis is to analyze the legislation and to pronounce if the original intention of the legislator was fulfilled. Also to proposese changes for the future legislation.

Postavení a činnost autorizovaného inspektora podle stavebního zákona / The position and activities of an authorized inspector under the Building Act

Presented thesis deals with approved inspector as a major entity of simplified procedure. It is focused on the origin of his function, internal organization and impact of his functioning. Author brings comprehensive view of current problems, primarily from point of view of judicature, specialized literature and comparison with foreign legislation. Author considers a possibility of amendment of the act besides an analysis of current legislation. Grammatical or teleological interpretation of the provisions governing the simplified procedure doesn't bring a satisfactory answer to the question of whether the legislation intended for governing bodies applies on the activity of authorized inspector. Whether through negligence or intent the legislature concerning authorized inspector is conceptual hybrid. In an attempt to clarify its functioning and to define it either a subject of public or private law, concept of simplified procedure deforms to disadvantage of different group of subjects and loses partly its original meaning. The only way out of this confusing situation is amendment of Building Act in favor of unambiquous concept of simplified procedure. Analýza a vyhodnocení povolování staveb dle stavebního zákona / Analysis and Assessment of Construction Permits under the Building Act

This master´s thesis deals with a methods of construction permits under the Building Act. In the first part defines the basic terms related. The second part deals with the permitting proces in the life cycle of construction. In the third part discusses the decisive authorities and the general procedures. The following parts deal with specific methods of permits under the Building Act. This is the definition of construction without the need for permits and construction requiring only notification. The next part deals with the proces of building permit and permitting of construction through a public law contract or a certificate of an authorized inspector. In the last part assessed and summarized the opinions of employees building authority, which were obtained through a questionnaire.

The abstract Introducing part of the work is focused on development of literary genre noir in Italian context, especially on ca. last twenty years, introduces its authors in the area of Emilia- Romagna and Bologna as a city of crime. In the analytic part, the two of Lucarelli's noir series with commissioner Coliandro and inspector Negro are comparatively analised from following chosen aspects: the character of protagonist, the character of criminal, the type of a crime, investigative methods, settings, and in the end language, expression means and role of the narrator. In conclusion, the specifics of literary genre noir in settings of Bologna are described, including the relation between fiction and reality in Lucarelli's writings and the constants of the author's poetic are outlined on the basis of comparative analysis of the series.

English abstract: In this my master thesis I attempt to depicture comprehensively the life-work of Viktor Barvitius (1834 - 1902), one of the Czech Pioneers of Modern Realism. Tracing the fates and influences that had formed the oeuvre of this fancier of urban turmoil helps us to figure out his positron within the kontext of period art. Barvitiuses creation embraces all main domains of painting of the time: portrayals, historical painting, genre; it has reached its peak during his stay in France between 1865 and 1867. For his immediate reaction to the French Modern Realism and together with Karel Purkyně and Soběslav Pinkas, Barvitius represents one of the prophets of the Czech Programme Realism. In 1877, Barvitius got a commission as an inspector of the SVPU Art Gallery; Czech museum culture is a great deal due to his activity on the field. Barvitiuses whole life artistic work, both theoric and practical, make him an important figure of Czech cultural history. Hooked illustration and period and later reviews make an integral part of my thesis. It also includes the list of Barvitiuses art pieces owned by Czech museums and galleries, Czech National Gallery in Prague, the art pieces that were the subjects of auction-sale and the inventory of his art work.

The presented dissertation is concerned with the ethic features of the quality of the social services inspectors professional behaviour in the residental facilities. This dissertation is divided into two main parts. The first part comprises theoretical bases related to given problems with the analysis of the relevant professional literature. The other part comprises with the actual research, the aim of which was finding ethical contexts of the inspection performance, inspector's education in the ethics, ethic code of the inspectors, the inspector profession and the value preferences of the inspectors. The main target is to analyze the ethical connections during the ispection performance in chosen residential facilities of the social services. In the research the quantitative and qualitative methods, the questionnaire survey and structural interviews were used. Based on the synthesis of the acquired knowledge the dissertation presents a view of the ethics application in professional activities of the inspectors. Key words: social services, quailty standards, quality inspections, values, ethics, the ethic code, career of the inspector, residential social services.

Vliv nových institutů na kulturu řízení stavebního podniku / The Impact of New Institutions on the Culture of Managing Construction Enterprise

The dissertation deals with the management culture of a construction company in connection with the new roles that are introduced in the Czech Republic (CR), especially after it became a member state of the European Union. In the introduction to the dissertation, two hypotheses are proposed. In the following theoretical part, it deals with the first general definition of corporate culture and ethics linked to the quality of work and new roles. In order to understand these difficult times, which are characterized by various types of crises, an analysis of the construction industry is made. Next, a description of the legislative developments in the CR is made and the influence of computer technology in construction management is marginally mentioned. It’s implementing the new technology that has an increasing impact on the organization and quality of work. The ability to use computer technology has in essence become a measure of the level of development of the management culture in the given construction company. The main theoretical part defines the roles in question, including their historical development, origin and the cause of their occurrence in both the CR and the neighboring countries.

Indiana University-Purdue University Indianapolis (IUPUI) Indiana University School of Dentistry Master Degree Thesis. / Detection of caries at an early stage is unequivocally essential for early preventive intervention. Longitudinal assessment of caries lesions, especially under the opaque preventive sealant, would be of utmost importance to the dental community. OBJECTIVES: The aim of this two-part in-vitro study is to evaluate the performance of multiple detection methods: The International Caries Detection and Assessment System (ICDAS); two quantitative light-induced fluorescence systems QLF; Inspektor™ Pro and QLF-D Biluminator™2 (Inspektor Research Systems B.V.; Amsterdam, The Netherlands); and photothermal radiometry and modulated luminescence (PTR/LUM) of The Canary System® (Quantum Dental Technologies; Toronto, Canada). All these are to be evaluated on their detection of caries on posterior human permanent teeth for 1) of primary occlusal lesions, and 2) under the sealant of primary occlusal lesions. METHODS: One hundred and twenty (N = 120) human posterior permanent teeth, selected in compliance with IU-IRB “Institutional Review Board” standards, with non-cavitated occlusal lesions ICDAS (scores 0 to 4) were divided into two equal groups. The second group (N = 60) received an opaque resin dental sealant (Delton® Light-Curing Pit and Fissure Sealant Opaque, Dentsply, York, PA). All lesions were assessed with each detection method twice in a random order except for ICDAS, which was not used following the placement of the sealant. Histological validation was used to compare methods in regard to sensitivity, specificity, % correct, and the area under receiver- operating characteristic curve (AUC). Intra-examiner repeatability and inter-examiner agreement were measured using intraclass correlation coefficient (ICC). RESULTS: 1) Of primary occlusal lesions, sensitivity, specificity, and AUC values were respectively: 0.82, 0.86 and 0.87 (ICDAS); 0.89, 0.60 and 0.90 (Inspektor Pro); 0.96, 0.57 and 0.94 (QLF-D Biluminator 2); and 0.85, 0.43 and 0.79 (The Canary System). Intra-examiner repeatability and inter-examiner agreement were respectively: 0.81 to 0.87: 0.72 (ICDAS); 0.49 to 0.97: 0.73 (Inspektor Pro); 0.96 to 0.99: 0.96 (QLF-D Biluminator 2); and 0.33 to 0.63: 0.48 (The Canary System). 2) Of primary occlusal lesions under the opaque dental sealants, sensitivity, specificity, and AUC values were respectively: 0.99, 0.03 and 0.67 (Inspektor Pro); 1.00, 0.00 and 0.70 (QLF-D Biluminator 2); and 0.54, 0.50 and 0.58 (The Canary System). Intra-examiner repeatability and inter-examiner agreement were respectively: 0.24 to 0.37: 0.29 (Inspektor Pro); 0.80 to 0.84: 0.74 (QLF-D Biluminator 2); and 0.22 to 0.47: 0.01 (The Canary System). CONCLUSION: Limited to these in-vitro conditions, 1) ICDAS remains the method of choice for detection of early caries lesion due to its adequately high accuracy and repeatability. QLF systems demonstrate potential in longitudinal monitoring due to an almost perfect repeatability of QLF-D Biluminator 2. The Canary System performance and repeatability were not acceptable as a valid method of early caries detection. 2) None of the methods demonstrated acceptable ability in detecting of occlusal caries under the opaque sealant. However, QLF-D Biluminator 2, with limitation to these in-vitro conditions and Delton opaque sealant, demonstrated a fair accuracy AUC (0.70) in detecting of caries under sealants at an experimental threshold of 12.5% ΔF.

Smålands nations inspektorsporträtt : en undersökning av samlingens tillstånd och funktion

Denna uppsats undersöker hur Smålands studentnation i Uppsala använder och förmedlar sin samling av inspektorsporträtt. Samlingen består av tjugofyra porträtt med motiv utförda i matchande kompositioner. Porträtten undersöks både utifrån sina fysiska och immateriella värden, vilket har varit viktigt för att förstå samlingen som helhet. Samlingens fysiska skick fastslås genom en tillståndsbedömning, vilken visade att majoriteten av porträtten har allvarliga skador i form av revor, sprickor och utbuktningar. Vidare dokumenteras porträttens motiv och historiska bakgrund i en katalog. Dokumenteringen av porträtten visade att det bara var sexton av tjugofyra porträtt som föreställde faktiska inspektorer. De övriga åtta porträtten föreställde istället kända smålänningar och meriterade förebilder. Uppsatsen har vidare undersökt samlingen som ett kommunikationsverktyg mellan nationen och dess besökare, vilket visade att inspektorsporträtten kommunicerade budskap om makt och identitet genom utvalda symboler, attribut och kompositioner. / This essay examines how the studentnation Smålands nation in Uppsals uses and conveys it’s collection of inspector portraits. The collection consists of twentyfour portraits with matching motives,. The portraits are examined based on both their physical and immaterial values, which has been important to understand the portraits as a collection. The physical condition of the collection was determined through a condition assessment, which showed that a majority of the portraits have serious damages in the form of tears, cracks and bulges.  The motifs and historical backgrounds have been cataloged due to a stocktaking., wich showed that only sixteen portraits actually depicted inspectors. The other eight portraits depicted instead well-known Småland-residents and meritorius role models. The essay also examined the collection as a tool for communication between the nation and it’s visitors, showing that the inspector portraits communicated messages of power and identity through  well-selected symbols, attributes and compositions.
