The Relationship between sense of coherence, learned resourcefulness and personality type among technical personnel

This research study determined the relationship between personality, as measured by the Myers and Briggs Type Indicator (MBTI) and sense of coherence and learned resourcefulness. The study was conducted among one hundred technical workers within the context of organizational transformation and the ability to cope with resulting stress. Data was collected by means of the Myers and Briggs Type Indicator (MBTI), the Orientation to Life Questionnaire (OLQ) and the Self-control Schedule (SCS). The research found that sense of coherence can be predicted at a 5% significance level, while learned resourcefulness cannot be predicted. Extraverts, sensers, thinkers and judgers seem to cope better with stress-provoking demands. The respective personality types probably make use of different coping mechanisms under the same circumstances. A presente obra é dedicada ao estudo dos novos mecanismos destinados a combater a morosidade do processo judicial, em especial a tutela de evidência. A pesquisa abrange a teoria da cognição, perpassando a função da verdade para o julgamento, analisando cada um dos graus de verossimilhança e a cognição de questões de direito. Em seguida, examinam-se os efeitos do tempo sobre o processo, objeto da dromologia processual. Considerando a mora como um fator de risco, são abordadas soluções teóricas para o seu adequado equacionamento, quando em confronto com o risco de erro judiciário. Um dos instrumentos para a gestão desses riscos, sempre presentes no curso processual, é a análise econômica do direito. Com vistas à formação de um prognóstico a respeito das chances de sucesso da tutela de evidência no Brasil, são explorados institutos correlatos no Direito Comparado, suas semelhanças e diferenças, bem como, sempre que possível, dados empíricos sobre os resultados obtidos nos respectivos países. Por fim, procede-se a uma análise crítica dos dispositivos do anteprojeto do novo Código de Processo Civil que versam sobre a tutela de evidência. / In a dynamic society, time is surely a kind of wealth. This is still true when it comes to litigation. Especially in civil law countries, plaintiffs are only granted what they pursue in court after a long judicial procedure that comprises the defendants hearing and the analysis of factual findings. However, it turns out that when the plaintiff proves his right at the very beginning of the trial, this time-consuming process is not only unfair to the plaintiff, but also inefficient to the Judiciary Branch as a whole. Thats mainly a result of defendants behaviors intended to protract the final resolution of the lawsuit, even when he knows that the other litigants claim is right. In those cases, preliminary injunctions not always suffice given the strict, urgency-related requirements they usually entail. In an attempt to properly address the issue, the draft of the new Brazilian Civil Procedure Code has provided for a new sort of injunction (tutela de evidência) meant to reasonably allocate the cost of time to each one of the parties. The underlining assumption is that in all judicial procedures there is a tradeoff between the risk of judgment error (due to the lack of information) and the risk of delaying justice (due to the time extent). Drawing on Law and Economics premises, this work sets forth some guidelines as to how to manage those risks fairly and efficiently.

La représentation du monde sans jugement : Réalisme et neutralité dans la dramaturgie moderne et contemporaine / Prejudice-free depictions of the world : Realism and neutrality in modern and contemporary theater

L’idée de « représentation du monde sans jugement », double visée du réel et du neutre, rassemble des œuvres qui aspirent à donner à voir le monde sans en orienter le commentaire et en débusquant le jugement dans nos représentations. En faisant l’hypothèse d’un « réalisme neutre », nous étudions les stratégies dramaturgiques de suspension du sens qui répondent à cette intention. Nous interrogeons l’existence d’une lignée de dramaturges qui, depuis le théâtre clinique de Tchekhov et à l’opposé du théâtre critique brechtien, conduit le spectateur à « l’étonnement d’un monde sans procès » (Barthes). En confrontant ces représentations du monde sans jugement au théâtre documentaire et au réalisme critique brechtien, nous analysons un changement de paradigme dans la représentation du réel, sa modélisation clarifiante et engagée laissant place à une expérience ouverte à l’interprétation. De Horváth aux auteurs quotidiennistes, en passant par Fleisser, Adamov, Kroetz et jusqu’à des réinventions contemporaines d’un théâtre « presque documentaire », comment ces esthétiques de la monstration échappent-elles à une simple symptomatologie superficielle du monde ainsi qu’aux malentendus induits par la délégation du jugement au spectateur ? Cette question oriente notre étude des décentrements dramaturgiques du réalisme, à travers lesquels s’affirment une autre pensée de la responsabilité critique du dramaturge et une dimension politique du neutre. Les œuvres et démarches de M. Vinaver, O. Hirata, J. Pommerat et L. Norén illustrent quatre modalités de ce « réalisme neutre », de l’exemption à la pluralisation du sens, en passant par le trouble, l’errance ou le saisissement du spectateur. / Prejudice-free depictions of the world are the aim both of reality and of any neutral approach. They bring together works of art that show the world without inducing any commentary while exposing our opinions in all representations. We will hypothesise the concept of “neutral realism” to analyse the strategies used by dramatic arts to produce suspension of meaning. We question the existence of a tradition of dramatic authors – ranging from Tchekhov’s “clinical theater” to Brecht’s “critical theater” – that lead spectators to what Barthes termed the “astonishment upon discovering a trial-free world”. We will weigh such prejudice-free representations of the world against documentary drama and against Brecht’s critical realism. Such a comparison will evidence a paradigm shift where an explicit, committed type of modelling seems to give way to a more open interpretative experience. From Horváth to daily-life authors and to Fleisser, Adamov, Kroetz and other contemporary re-inventors of “quasi- documentary-style” drama, the question can be thus articulated: how do such illustrative aesthetics succeed in circumventing both merely superficial symptomatology of the world and the misunderstandings that might arise from the decision of leaving the viewer to judge the work on their own? The answer to the question guides our analysis of the dramatic arts’ decentering of realism, through which another vision of the responsibility of the dramatic author emerges, as well as a new take on the political nature of a neutral approach. The works and reflections of M.Vinaver, O. Hirata, J. Pommerat and L. Norén evidence four aspects of this “neutral realism”, ranging from the cancellation of meaning to multifaceted meaning and to troubled, disconnected or awed spectators.

The relationship between personality types and psychological career resources of managers in the fast-food industry in the Western Cape

The objective of the study was to determine the relationship between personality preference types (as measured by the Myers-Briggs Type Indicator [MBTI]) Form M and psychological career resources (as measured by the Psychological Career Resource Inventory [PCRI]) of managers in the fast-food industry and whether groups from different races, ages and gender differ significantly regarding personality types and psychological career resources. A quantity survey was conducted on a sample (N = 81) of managers in the fast food industry in the Western Cape. The extraversion, sensing, feeling, judging (ESFJ) and the introversion, sensing, feeling, judging (ISFJ) personality types were the dominant ones in the study. Personality type preferences were significantly related to psychological career resources. The personality types differed significantly regarding the following PCRI variables: variety/creativity (career preference), growth/development (career value), self/other skills (career enabler) and social connectivity (career harmoniser). 財政援助をコントロールする仕組みは、国によって様々であり、立法的な統制、行政的な統制又は司法的な統制等があるが、本稿では、特に、裁判所による財政支出の統制に焦点を当て、アメリカ合衆国、スペイン及びメキシコ合衆国について検討する。本稿においては、主として、アメリカ合衆国、スペイン及びメキシコ合衆国の裁判所が、私企業に対する財政支出をどのような場合において違憲又は違法とするのか、又はどのような場合において合憲又は適法とするのかということを検討し、これらの国々の裁判所がその結論に到達するために、どのような要件又は判断基準に基づいて、財政支出を統制するのかということについて考察する。 / The mechanisms for controlling fiscal assistance vary from one country to another. Legislative, executive and judicial controls can be mentioned as broad examples of these mechanisms. This research will focus on the judicial control of fiscal expenditure in the United States of America, Spain and Mexico. It primarily examines in which cases financial expenditure on the private sector is declared unconstitutional or illegal and in which situations it is declared constitutional or legal by the American, Spanish and Mexican judiciary.
