Impeachment v Evropě: ústavní modely a reálná praxe / Impeachment in Europe: constitutional models and practice

This thesis presents and analyses the process of impeachment relating to the Presidents of European Union Member States. The thesis presents and analyses individual constitutional models of impeachment across Member States based on the constitutional players involved in the impeachment process, who decides on the initiation of the whole process and how, under what conditions the impeachment process can be initiated, for what offences the President can be impeached, which authorities have the power to decide on the outcome of the complaint, what penalties the President faces and whether it is possible to reverse the decision of these authorities in some way. The thesis also analyses impeachment processes that have taken place against European Presidents thus far, namely, the impeachment of Lithuanian President Paksas, Romanian President Basescu and the only attempt at a constitutional complaint to date against Czech President Václav Klaus. Three main models of impeachment can be identified in the framework of European constitutions, depending on which authority has the power to remove the President from office. La présente thèse analyse les textes de fiction de l’écrivain berlinois Klaus Schlesinger sous l’angle de l’écriture de l’histoire. Né en 1937 à Berlin-Est, cet auteur important mais encore sous-estimé connaît cinq régimes différents au cours de son existence – l’Allemagne national-socialiste, l’Allemagne occupée, la RDA (de 1949 à1980), la RFA (de 1980 à 1989), l’Allemagne unifiée – et autant de ruptures majeures dont son œuvre rend compte : révélation de l’ampleur des crimes nazis, réorientations dans l’après-guerre et le socialisme en construction, instauration du Mur de Berlin, « dissidence » et passage à l’Ouest dans le sillage de l’affaire Biermann, puis chute du Mur, disparition de la RDA, réunification. Si un découpage en quatre grandes périodes d’écriture permet d’éclairer un itinéraire intellectuel et politique, l’analyse porte d’abord sur la façon dont Schlesinger représente ce demi-siècle d’histoire allemande, son impact sur les individus et les questions qu’il a soulevées (héritage du passé, place de l’individu dans le socialisme « réellement existant », les sociétés capitalistes ou la guerre froide, utopie, identité). Elle s’intéresse aux choix narratifs et formels opérés dans chaque texte et souligne les enjeux indissociablement historiographiques, moraux, politiques et identitaires dont ils ont été à chaque fois porteurs. Puisant à plusieurs sources théoriques (Ricœur, Foucault, de Certeau, Turner, Geertz), elle met en lumière la nature singulière des espaces souvent hétérotopiques ou liminaux où Schlesinger fait évoluer ses personnages et observe l’écriture de fiction comme un lieu privilégié d’appréhension et de construction de soi dans l’histoire. Centrée sur les textes de fiction, l’analyse exploite également les essais et les textes autobiographiques, ainsi que les archives du fonds Schlesinger de l’Akademie der Künste à Berlin (correspondance, ébauches et fragments, dossiers de surveillance de la Stasi, recensions et coupures de presse, entretiens). / This thesis analyses the fictional texts of Berlin author Klaus Schlesinger under the aspect of history-writing. Born in 1937 in East-Berlin, this important yet still under-estimated writer lived under five different regimes – national-socialist Germany, occupied Germany, the GDR (from 1949 to 1980), the FRG (from 1980 to 1989), unified Germany – and as many major changes that find reflection in his work: the revelation of the scope of Nazi crimes, the reorientations in the post-war era and under the socialist regime, the building of the Berlin Wall, political “dissidence” and exile in the West in the wake of the Biermann affair, then the fall of the Wall, the disappearance of the GDR and German unification. While the analysis falls into four chronological periods, thus allowing for an overview of his intellectual and political itinerary, the thesis primarily focuses on the way Schlesinger represented this half-century of German history, its impact on individuals and the questions that arose from it (the heritage of the past, the individual’s position in “real”-socialism, in capitalist societies or the Cold war, utopia, identity). It looks at the narrative and formal choices made in each text and underlines the historiographical, moral, political and personal-identity questions inextricably linked to them. Drawing from several theoretical sources (Ricœur, Foucault, de Certeau, Turner, Geertz), it underlines the specific nature of the often heterotopical or liminal spaces in which Schlesinger places his characters and interprets fictional writing as a privileged space of self-apprehension and self-construction in history. While focused on the fictional writings, the analyses also uses the author’s essays and autobiographical texts as well as the Klaus Schlesinger archives of the Akademie der Künste in Berlin (correspondence, first drafts, text fragments, Stasi surveillance files, reviews, interviews).

The aim of this thesis is to compare the concept of the civil society and the attitudes towards it, as understood by Vaclav Havel, Vaclav Klaus and Milos Zeman. Furthermore, the thesis examines the evolutions of their attitudes and their particular actions within the organized civil society. The comparison is carried out using available materials and relevant existing works by authors expertizing in the authors' political legacy. The first part introduces basic terms and three crucial phases in the development of Czech civil society. The second part critically analyses the authors' attitude to organized civil society. Comparison findings suggest that their concept of civil society does not concur: their attitude to influential organizations of civil society varies, yet a certain agreement is apparent in their support of voluntary activities of various interest groups.

[pt] Existem diversas formas de se conceber e perceber a arquitetura, entre tantas, porém, acredita-se que determinadas obras denotam silêncio, manifestação fenomênica que proporciona determinada mobilização empática. Sendo a arquitetura uma arte que envolve questões relacionadas ao espaço material no qual o homem habita, busca-se entender o que faz uma obra construída ser caracterizada essencialmente pelo silêncio e o que é necessário, em termos materiais, para que isso possa acontecer. Para tanto, esta pesquisa se apoia no conceito de tectônica que, de acordo com Kenneth Frampton (1995, 1998), consiste em uma das dimensões essenciais da arquitetura. Sendo assim, além de discussão relacionada ao conceito de tectônica, como referencial teórico-metodológico, mobiliza-se o termo silêncio, ideia intrínseca à pesquisa, com o objetivo de analisar certas expressões arquitetônicas que possibilitam o seu surgimento, percebível sinestesicamente, na arquitetura. Assim, foram selecionados três projetos para análise: a Casa Azuma, a Capela Bruder Klaus e o Museu Brasileiro da Escultura - MuBE. Obras onde o silêncio encontra-se em evidência e comprovam que, apesar do ruído sempre existir, é possível vivenciar o silêncio, por intermédio da arquitetura. / [en] There are several ways to conceive and perceive architecture, among many, however, it is believed that certain works denote silence, phenomenal manifestation that provides a certain empathic mobilization. Since architecture is an art that involves issues related to the material space in which man lives, the aim is to understand what makes a constructed work become essentially characterized by silence and what is necessary, in material terms, for this to happen. Therefore, this research is based on the concept of tectonics which, according to Frampton (1995, 1998), is one of the essential dimensions of architecture referring to constructive poetics. Thus, in addition to the discussion related to the concept of tectonics as a theoretical-methodological reference, the term silence, an idea intrinsic to the research, is mobilized, with the objective of analyzing certain architectural expressions that allow its emergence, synesthetically perceivable in architecture. Thus, three projects were selected for analysis: the Azuma House, the Bruder Klaus Chapel and the Brazilian Museum of Sculpture - MuBE; works where silence is in evidence, proving that, even though noise has always existed, it is possible to experience silence through architecture.

This thesis proposes to destabilize traditional dichotomies of the theory-practice and mind-body type that have been responsible for the longevity of some ontological metaphors such as the body-recipient and the body-instrument that have collaborated efficiently with the most traditional definition of body-technique, as well as the stereotypes of human nature (Pinker, 2004). In methodological terms, the thesis promotes the crossing of studies of different areas of knowledge such as ethnology (Mauss, 1934), the cognitive sciences (Berthoz, 1997, Noë, 2004), the theories of communication (Sodré, 2006, Greiner and Katz, 2005) and political philosophy (Agamben, 2009). The result of the study is the compartmentalization of questions raised by this range of authors and practical experiments, whose starting point is the Klauss Vianna technique, bearing in mind the particular way this technique deals with the body and its communicative processes, generating complex solutions of adaptation in diverse environments (bodies, cities, artistic spaces, etc.). In conclusion, the thesis proposes a political-cognitive redefinition that starts by seeing technique as a communicative operator and a tool of power that can both discipline the body and activate the strategies of political resistance. Everything depends on the processes of mediation that will be activated during the communicative experience between the body and its surroundings / A técnica corporal tem sido definida pelo senso comum ocidental como uma repetição mecânica que disciplina o corpo tendo em vista um fim específico. Esta tese propõe desestabilizar dicotomias tradicionais do tipo teoria-prática e mente-corpo, que tem sido responsáveis pela longevidade de algumas metáforas ontológicas como por exemplo, o corpo-recipiente e o corpo-instrumento que colaboraram de maneira eficiente com a definição mais tradicional da técnica corporal, assim como com os estereótipos da natureza humana (Pinker, 2004). Em termos metodológicos, a tese promove o cruzamento de estudos de diferentes áreas de conhecimento como a etnologia (Mauss, 1934), as ciências cognitivas (Berthoz, 1997, Noë, 2004), as teorias da comunicação (Sodré, 2006, Greiner e Katz, 2005) e a filosofia politica (Agamben, 2009). O resultado da pesquisa é o compartilhamento de questões levantadas por esta gama de autores e experimentos práticos, cujo ponto de partida é a técnica Klauss Vianna, tendo em vista a maneira peculiar como esta lida com o corpo e seus processos comunicacionais, gerando soluções adaptativas complexas em ambientes diversos (corpos, cidades, espaços artísticos, etc). Ähnlich wie in den Sozialwissenschaften blieben Männlichkeiten lange Zeit ein blinder Fleck innerhalb einer Gender-orientierten Literaturwissenschaft und die Konstruktionsmechanismen literarischer Männlichkeit im Dunklen. Erforscht wurden zunächst herausragende Modelle von Männlichkeit(en): einerseits dominante Leitbilder, andererseits deviante Alternativen, etwa der Dandy, der Homosexuelle, der Cross-Dresser. Mittlerweile liegt in nahezu allen Philologien eine Fülle von Einzelstudien zur Darstellung von Männlichkeit innerhalb bestimmter Epochen oder Autoren-Oeuvres vor, wiewohl der Stand der theoretischen Reflexion unterschiedlich ausgeprägt ist.
