Entre o legislador e o intérprete: o binômio método-mérito na ADPF 132/ADI 4277 do conflito institucional entre poder legislativo e poder judiciário

This is a recent phenomenon in brazilian reality, accompanied by a strong growth performance of the activist judiciary, and its widely discussed role. This attitude reaches consequences of different levels, and encompasses a variety of precepts from the structure of powers, institutional harmony, functional performance and social impact. Guided by an increasingly complex and pluralistic society, minority figures appear as vulnerable. The phenomenon of a disharmonious relationship between the institutions that hold power, more explicitly between the Legislature and the Judiciary, is based on this social and political context today. The method and the substance of the conflict resolution consist in a kind of analogy related to confrontation and interference to the prerogatives attributed mainly to parliamentarians and conflict resolution by the judiciary, highlighting the effective decision related to the merits, but illegitimate for this institution. In other words, questioning the need - over judicialization. This is a fundamental debate and has its great importance for the development of the democratic state with rule of law; the social reality and its relation to democracy. It leads to the understanding that this is a phenomenon that if not established with the required care and attention, may cause severe side effects and severe risks to the respect of the democratic ideal. This situation reveals the vulnerability and instability of society, especially the minorities in relation to the controversy of the judicial activism. A bibliographic research is used, qualitative with deductive method, seeking to understand the causes and consequences of the relation of minority groups, exemplified by the decision of the Supreme Court in ADPF132/ADI 4277, linked to the conflict between the legislator and the interpreter. / Este trabalho tem por estudo a relação entre o Legislador e o Intérprete, relacionando esse conflito de papéis nas instituições com a figura de grupos minoritários, utilizando-se da decisão da ADPF 132/ADI 4277 como exemplo desse enfrentamento. Dessa forma um fenômeno recente da realidade brasileira, acompanhado de um forte crescimento é o desempenho ativista do Poder Judiciário, o protagonismo exercido por este é amplamente discutido e polemizado. Essa postura alcança desdobramentos dos mais diversos níveis, e engloba variados preceitos desde a estrutura dos poderes; harmonia institucional; desempenho funcional e repercussão social. Pautada por uma sociedade cada vez mais complexa e plural a figura das minorias aparece como vulnerável. Nesse contexto social e político atualmente se baseia o fenômeno de uma relação desarmônica entre as instituições detentoras do poder, mais explicitamente entre o Poder Legislativo e o Poder Judiciário. O método e o mérito da resolução de conflitos consiste em uma espécie de analogia com relação ao enfrentamento e interferências nas prerrogativas essencialmente atribuídas aos parlamentares e a resolução de conflitos por parte do judiciário, realçando a eficaz decisão em relação ao mérito da questão, mas em conflito com a ilegitimidade do órgão que a exerceu. Ou seja, com o questionamento da necessidade- excesso de judicialização. Trata-se de um debate fundamental e de grandiosa importância para o desenrolar do Estado Democrático de Direito; a realidade social e a sua relação com a democracia. Leva- se ao entendimento que a postura é um fenômeno posto e se não estabelecido com o cuidado e merecedora atenção, pode ocasionar efeitos colaterais e riscos severos de entrave ao respeito do ideal democrático. Situação que revela a vulnerabilidade e instabilidade da sociedade e principalmente das minorias em relação aos poderes e a problemática e polêmica do ativismo judicial. Utiliza-se uma pesquisa bibliográfica, qualitativa com método dedutivo, para buscar compreender as causas e consequências da relação de grupos minoritários, exemplificados pela decisão do STF na ADPF132/ADI 4277, com a ligação do conflito entre o Legislador e o Intérprete.

Alignment of Gauteng Provincial Legislature oversight function with constitutional mandate and provincial priorities for service delivery

This study investigated the alignment of the oversight function conducted by the Gauteng Provincial Legislature (GPL) with the constitutional oversight mandate and with the service delivery priorities for Gauteng. The Gauteng Provincial Legislature adopts 5-year strategic plans at the beginning of each Political Term of Office to execute its mandates of oversight, law making, public participation and cooperative governance. Since all functions of the legislature emanate from these strategic planning documents, and if such 5-year strategic plans are aligned to the legislature’s mandate on oversight and to the provincial priorities for the province, it can be deduced that the resultant oversight function conducted by the legislature will similarly be aligned. This alignment between the oversight function of the legislature and the constitutional mandate on oversight, and between the oversight function of the legislature and the service delivery priorities for Gauteng is essential to promote implementation, performance and ultimately, the actual service delivery by the executive in a manner that is similarly aligned with the constitutional oversight mandate and the service delivery priorities for Gauteng. By using a qualitative approach, the study has shown that this alignment is inadequate. While there was sufficient alignment between the oversight conducted by the GPL and the Constitutional oversight mandate, there was inadequate alignment between the oversight conducted by the GPL and the service delivery priorities for Gauteng. The study has also identified challenges that relate to these inadequate alignments as well as recommendations for improvement. / Public Administration and Management / M. Admin. 1 Abstract This thesis investigates the problem of gambling in the Czech Republic. There are analyzed and discussed several aspects of gambling in relation to historical development, the existing legislative system or the specifics of interest and acting of participants by research questions. The offer of the gambling market is very wide. The work focuses mainly on gaming device with which the issue of pathological gambling is associated the most. The important methods, which are used, are pathological gambling analysis, analysis of the legal framework, the analysis of participants and analysis of relevant strategic documents. The thesis analyzes the current state of gambling in the Czech Republic, based on questionnaires addressed to the municipalities and structured interviews with other respondents. The thesis also presents specific measures that can be applied to solve the current problem of gambling in the Czech Republic. Evaluating the performance of the administration programme of the Northern Cape Provincial Legislature

Thesis (MPA)--Stellenbosch University, 2013. / ENGLISH ABSTRACT: In recent years scholars and researchers have been paying specific attention to the performance and results produced by government activities. This is seen as a direct consequence of trends in the public policy field, specifically the New Public Management (NPM) approach. The South African Government has demonstrated its commitment to the NPM approach by advocating the assessment of government’s performance and putting in place substantial guiding, policy and discussion documents that would promote the monitoring and evaluation of public outputs and outcomes. This research study takes its cue from the NPM approach and evidence-based public policy analyses as it sought to evaluate the performance of a government programme by considering reported performance outputs. The researcher evaluated the performance for the Northern Cape Provincial Legislature’s (NCPL) Administration programme over a 3-year period as a case study. The research methodology is evaluative in nature and the specific design employed is programme evaluation. To solicit data from respondents, an Organisational Profile Survey was conducted. The survey responses from participants were combined with a review of media reports and scrutiny of documented reports to provide comprehensive evidence about the performance of the NCPL Administration. The overall aim of the study was to evaluate performance with a view to the improvement of future performance. The findings of the thesis indicate that the planned services and activities of the NCPL Administration are not being implemented effectively and that the overall programme is not functioning effectively. The effectiveness of the NCPL Administration can be improved by means of the resolution of organisational challenges. Recommendations are made to address performance deficiencies and further research opportunities are also identified. / AFRIKAANSE OPSOMMING: Navorsers het oor die afgelope paar jaar spesifiek begin fokus op die prestasie en uitslae van regeringsaktiwiteite. Die onlangse tendens kom as ‘n direkte gevolg van huidige openbare hervorming, en meer spesifiek die Nuwe Openbare Bestuurs- (NOB) benadering. Die Suid-Afrikaanse regering demonstreer hul toewyding aan die NOB benadering deurdat die evaluasie van regerings prestasie voorgestaan word, asook deur die instelling van substansiële beleid-, leidings- en gespreksdokumente wat die monitering en evaluasie van publieke uitsette en uitkomste bevorder. Hierdie navorsingsstudie volg die NOB benadering en bewys-gebaseerde publieke beleidsontleding na. Dit is gemik daarop om die prestasie van ‘n regeringsprogram te evalueer deur die gerapporteerde prestasie uitsette in ag te neem. As deel van hierdie gevallestudie evalueer die navorser die prestasie van die Noord-Kaap Provinsiale Wetgewer (NKPW) se administrasie program oor ‘n drie jaar tydperk. Die studie se navorsingsmetodologie is waardeoordelend die spesifieke navorvingsontwerp wat gebruik word is Programevaluering. Om data van respondente te bekom was ‘n Organisasie Profiel Opname onderneem. Hierdie data was gekombineer met ‘n oorsig van koerant berigte en die noukeurige ondersoek van verslae met die oog daarop om omvattende bewyse te lewer oor die prestasie van die NKPW Administrasie. In geheel poog die studie om prestasie lewering te evalueer met die doel om toekomstige prestasie te verbeter. Die bevindinge van die tesis dui aan dat die implementering van beplande dienste en aktiwiteite van die NKPW Administrasie nie doeltreffend is nie en dat die program in geheel nie effektief is nie. Die prestasie van die NKPW Administrasie kan verbeter word deur die aanspreking van uitdagings wat in die organisasie ondervind word. Aanbevelings word gemaak om die prestasiegapings aan te spreek en verdere navorsinggeleenthede is ook geïdentifiseer.

Societal cleavages and institutional change in Canada : retention, reform and removal of nominee councils

En concevant que toute société a deux clivages dominants, l’un social et l’autre partisan, cette thèse développe une théorie sur le changement institutionnel. L’hypothèse initiale, selon laquelle les groupes sociaux créés par le premier clivage agiront pour restreindre le changement institutionnel et que le changement aura lieu lors de l’émergence d’un groupe partisan capable de croiser le clivage social, fut testée par les processus traçant les changements qui furent proposés et qui ont eu lieu au sein des conseils nominés en Amérique du Nord britannique. Ces conseils furent modifiés un bon nombre de fois, devenant les chambres secondaires de législatures provinciales avant d’être éventuellement abolies. La preuve supporte l’hypothèse, bien qu’il ne soit pas suffisant d’avoir un groupe partisan qui puisse croiser le clivage qui mène le changement : un débat partisan sur le changement est nécessaire. Ceci remet aussi en cause la théorie prédominante selon laquelle les clivages sociaux mènent à la formation de partis politiques, suggérant qu’il est plus bénéfique d’utiliser ces deux clivages pour l’étude des institutions. / By conceiving of any society as having two dominant cleavages, one ‘social’ and one ‘partisan’, this dissertation develops a theory on institutional change. The initial hypothesis that social groups created by the former will act to restrain institutional change and that change will occur when a partisan group emerges that can cross the social cleavage was tested by processes tracing the changes which were proposed and which occurred to the appointed councils established in British North America. These councils were modified a number of times, becoming second chambers in the provincial legislatures, and were eventually each abolished. The evidence found supports the hypothesis, though it is not sufficient to have a partisan group that can cross the cleavage drive change, a partisan debate over the change was necessary. This also challenges the prevailing theory that social cleavages lead to political party formation, suggesting the benefit of using these two cleavages for the study of institutions.

Límites constitucionales al contenido material de las leyes de presupuestos del Estado

El trabajo está montado como un intencionado diálogo con los criterios esgrimidos por el Tribunal Constitucional sobre esta materia (desbordamiento material de las leyes de presupuestos) en su ya dilatada jurisprudencia. Su autor defiende una concepción amplia del ámbito material de las leyes de presupuestos. Según esta posición, este tipo de ley debe incluir la materia presupuestaria, pero, como ley que es, puede cobijar otras materias, salvo prohibición constitucional clara al respecto. Esta posición es superadora de la concepción de la ley de presupuestos como ley meramente formal, de suerte que la concibe como una ley plena, emanada de la potestad legislativa del Parlamento, con la fuerza propia de la ley, esto es, no vinculada a la legislación previa y capaz (aunque no siempre idónea, desde la perspectiva de la técnica legislativa) de emprender innovaciones legales.Desde esa postura "amplia" el autor formula propuesta de solución o de mejora frente al desbordamiento material de las leyes de presupuestos. Asimismo tras analizar su problemática específica, plantea posibles soluciones en relación a la práctica de las leyes de acompañamiento. / El treball està muntat com un intencionat diàleg amb els criteris esgrimits pel Tribunal Constitucional sobre aquesta matèria (desbordament material de les lleis de pressupostos) en la seva ja dilatada jurisprudència. El seu autor defensa una concepció àmplia de l'àmbit material de les lleis de pressupostos. Segons aquesta posició, aquest tipus de llei ha d'incloure la matèria pressupostària però, com a llei que és pot acolir altres matèries, excepte prohibició constitucional clara al respecte. Aquesta posició és superadora de la concepció de la llei de pressupostos com a llei merament formal, de manera que la concep com una llei plena, emanada de la potestat legislativa del Parlament, amb la força pròpia de la llei, és a dir, no vinculada a la legislació prèvia i capaç (encara que no sempre idònia, des de la perspectiva de la tècnica legislativa) d'emprendre innovacions legals.Des d'aquesta postura àmplia, l'autor formula proposta de solució o de millora davant del desbordament material de les lleis de pressupostos.
