Links between international child abduction and relocation: moving towards likemindedness in relocation disputes internationally - Is it time for a protocol regulating international relocation disputes

<p>This by implication would mean that the best way to prevent child abduction is to desist from international marriages and moving abroad.The modern reality is that&nbsp / relationships are being formed internationally. In the same breath, relationships are easily un-formed and the family fractured. The emotional impact of any breakup is usually&nbsp / tense, and it follows by implication that this will be exacerbated if a child is involved. For reasons that will be expounded on in the thesis, many caregivers, usually mothers have&nbsp / opted to abduct their children. Some have opted to apply formally to relocate. Relocation disputes are widely regarded as one of the most controversial and difficult issues in&nbsp / family law internationally. These disputes usually arise pursuant to a relational breakdown, when the resident parent (usually the mother) seeks to relocate with the children&nbsp / either&nbsp / domestically or internationally. This causes a significant impact&nbsp / on contact arrangements with the other parent (usually the father). Depending on the country in which they find themselves and the laws applicable to relocation with the child, mothers are faced with the decision to remove the child either lawfully or wrongfully. International family law&nbsp / jurisprudence has been developed over time to assist with custody and relocation disputes. &lsquo / Much has been written on the Hague Convention &ndash / its flaws and its successes, its&nbsp / effectiveness and utilization. This thesis aims to look specifically at relocation disputes within the context of international parental child abduction / more specifically, it sets out to&nbsp / explore whether there is a link between those phenomena, and whether the Hague Convention is sufficient for dealing with relocation disputes. I hope to make a convincing&nbsp / argument that if there were an international instrument regulating relocation, there would be uniformity and consistency. People&rsquo / s confidence in the legal processes would be&nbsp / restored, motivating them to apply formally to relocate and, in doing so, the incidence of child abductions would be reduced.</p>

La légende urbaine des snuff movies : histoire, théorie, esthétiques, technologies

La présente étude propose une analyse historique de la légende urbaine des snuff movies. En premier lieu, elle se penche sur l’émergence de cette rumeur dans le paysage médiatique américain des années 70 tout en focalisant sur certains objets filmiques l’ayant crédibilisée, principalement les stag et les mondo movies. Ce mémoire analyse par la suite l’influence majeure de deux événements sur l’implantation de la légende urbaine dans l’imaginaire collectif, soit l’assassinat de Sharon Tate et la circulation du film de Zapruder. Après avoir étudié la persistance de la rumeur, cet essai focalise sur la promotion et l’exploitation de Snuff (1976) en plus de proposer une analyse de ce long métrage. Ensuite, il se penche sur deux types de représentations du snuff dans le cinéma de fiction ainsi que leurs impacts sur l’authentification de la légende urbaine. Il est d’abord question des mises en scène du snuff dans le cinéma populaire qui s’inspirent de la rumeur pour ensuite l’actualiser. Sont ensuite étudiées les représentations du snuff à titre de faux documents, soit ces œuvres qui tentent par divers procédés de se faire passer pour de véritables films clandestins et, de ce fait, authentifient l’objet auquel ils se réfèrent. Puisque cette étude analyse l’évolution médiatique de la légende urbaine, elle se conclut sur son déplacement du cinéma vers Internet et de sa nouvelle crédibilisation grâce aux vidéos macabres, à la pornographie juvénile et au récent cas Magnotta. / The following study proposes a historical analysis of the urban legend of snuff movies. First, it examines the emergence of this rumor in the American media landscape of the 1970s, while focusing on the cinematic objects having reinforced its credibility, mainly stag and mondo movies. This memoir subsequently analyzes the major influence two events had towards implementing this urban legend into the collective imaginary, namely the assassination of Sharon Tate and the circulation of the Zapruder film. After studying the persistence of the rumor, this essay focuses on the promotion and exploitation of Snuff (1976), offering, in addition, an analysis of this feature film. Following this, this essay addresses two types of snuff representation in fiction film, as well as their impact on the authentication of the urban legend. First, there is the issue of the staging of snuff in popular cinema, taking inspiration from the rumor in order to update it in return. Secondly, is studied the representations of snuff as fake documents, namely the works attempting, through various processes, to pass for genuinely illegal films, thus authenticating the objects they are a reference to. Because this study analyzes the evolution of the media surrounding the urban legend, it concludes on its displacement from the cinema to the Internet, and the new credibility allowed by macabre videos, child pornography and the recent Magnotta case.

As theoretical methodological references we adopted the Latin American theory of multiple mediations, the integral audience focus, cultural studies and theories of modes of address and of media representations. We investigate the cultural consumption of the Brazilian televised drama Malhação, by 5th 8th grade adolescents from a public and others from a private school, in the municipality of Florianópolis. The methodology used a questionnaire and collective interviews and supplied data that allow us to conclude that television is still one of the main sources of leisure and information for adolescents of different social classes; television dramas are among the favorite programs for this age group; Malhação produces modes of address focused on the public that it wants to reach and in fact reaches them through a socially compelling media representation of an adolescent model; and that the school is a very important space for sociability and education, above all for youth in the less favored social classes / Nesta pesquisa investigamos como as representações midiáticas de jovem e de escola produzem endereçamentos e interferem no consumo cultural de programas da rede aberta de televisão brasileira, destinados aos adolescentes e como este público, proveniente de diferentes classes e contextos sociais, consome e ressignifica suas mensagens. Como referencial teórico-metodológico adotamos a teoria latino-americana das múltiplas mediações e o enfoque integral da audiência, os estudos culturais, a teoria dos modos de endereçamento e das representações midiáticas. Investigamos o consumo cultural da telenovela Malhação, junto a adolescentes de 5ª a 8ª séries que freqüentam uma escola pública e outra privada, no município de Florianópolis. A metodologia utilizada, questionário e entrevistas coletivas, forneceu dados que nos permitem concluir que: a televisão permanece como uma das principais fontes de lazer e informação para adolescentes de diferentes classes sociais; as telenovelas figuram entre os programas prediletos para esta faixa etária; Malhação produz endereçamentos focados no público que deseja atingir e de fato o interpela a partir de uma representação midiática socialmente valorizada de um adolescente modelo; e que a escola é um espaço muito importante de sociabilidade e formação, sobretudo para jovens de classes sociais menos favorecidas

To delimit the discursive impoverishment was defined the concept of unmusicalization of television media. This work, of theoretical nature, aims to point out that the television media has a key role and important part of the responsibility for the impoverishment of discourse in the construction of Brazilian popular music. To do so, first, by analyzing poetic-aesthetic structural elements of musical and literary language of a popular song, was delimited the kind of structured musical work with poetic concern, that imparts an aesthetic standard of excellence. These songs were offered by the Television in the 60s and 70s, today no more. Afterwards, through research literature, documentary and empirical, describes analytical and interpretative way the historical period in which occurred the unmusicalization of television media. Finally, it is concluded that from the popularization of the Internet and the proliferation of various media that allow the access, storage, sharing musical repertoires and, above all, the listening on the move, the mass popular brazilian song, composed with concern poetic no more be longer present in Television and went on to appear in several other media. This broad presence of music in digital media was defined by the concept of hyper-mediatization of music, that would be a component of the unmusicalization of television media / O trabalho aborda o empobrecimento estético-discursivo da canção popular massiva exposta na mídia televisiva brasileira, na comparação entre o contexto histórico-midiático-musical das décadas de 1960 e 1970 e o contexto da primeira metade da segunda década do século XXI. Para definir tal empobrecimento discursivo encontrou-se o conceito de desmusicalização da mídia televisiva . O trabalho, de natureza teórica, tem como objetivo apontar que a mídia televisiva tem papel preponderante e parte importante da responsabilidade pelo empobrecimento na construção do discurso da música popular brasileira. Para tanto, primeiramente, por meio da análise poético-estética dos elementos estruturais das linguagens musical e literária de uma canção popular, delimitou-se a espécie de obra musical estruturada com acuro poético, que a ela empresta um padrão estético de excelência. Tais canções tinham espaços de veiculação nas grades de programação da mídia televisiva de outrora e nos dias atuais não mais os têm. Em seguida, por meio de pesquisas bibliográfica, documental e empírica, descreve-se de modo analítico-interpretativo o período histórico em que ocorreu essa desmusicalização da mídia. Por fim, constata-se que a partir da popularização da Internet e da proliferação de diversas mídias que permitem ao ouvinte o acesso, o armazenamento, o compartilhamento de repertórios musicais e, sobretudo, a audição em movimento, a canção popular massiva pautada pelo acuro poético deixou de estar presente na mídia televisiva e passou a figurar em outras diversas mídias. Essa ampla presença da Música nas mídias digitais definiu-se pelo conceito de hipermidiatização da música, que seria um dos componentes da desmusicalização da mídia televisiva.

Quando isso não ocorre, o poder é corrompido, fetichizado. A ética apresenta os fundamentos ideais para a estrutura política. A estrutura política, por sua vez, ocorre na tensão entre dois conceitos basilares para a Filosofia da Libertação: a Potentia e a Potestas. Nesse sentido, este trabalho possui como objetivo analisar estes dois conceitos a fim de compreender de que maneira interligam os campos da ética, pedagógica e política de uma arquitetônica transmoderna. Os princípios éticos, a formação do homem político, a democracia enquanto instrumento do critério de factibilidade, as possibilidades de violência e de consenso, a questão do método, dentre outros, são hipóteses enfrentadas no intuito de esclarecer a constituição do poder em Enrique Dussel.

Notre étude démontre que les sujets dépressifs unipolaires et bipolaires, présentent une difficulté de régulation des flux excitatifs découlant de la défaillance de la fonction pare-excitative, nommée dans notre travail, « défaillance du contenant psychique ». Nous la mettons en relief à partir de la cotation de trente protocoles de Rorschach à l’aide d’un indice de régression, élaboré pour notre recherche. Nous réalisons, en complément, une étude prospective des notes T à trente échelles et sous-échelles du MMPI-2 de ces mêmes sujets. Nous y relevons certaines constantes en note T, caractérisant en fréquence cette population dépressive, dont une constante en note basse à l’échelle Force du Moi. Nous utilisons ces résultats cliniques pour argumenter l’intérêt d’une prise en charge thérapeutique à partir d’un dispositif basé sur un tissage de médiations groupales, comme voie de restauration du contenant psychique internalisé et de sa fonction pare-excitative. / Our study demonstrates that unipolar and bipolar depressed subjects present a difficulty of excitement flows regulation, arising from the failure of the pare-excitations function, named in our research: "psychic container failure". We highlight this malfunction by the cotation of thirty Rorschach protocols, using a regression index, developed for our research. We carry out a prospective study in complementary from the notes of the scales and subscales of the Minnesota Multiphasic Personality Inventory 2 of these subjects. We identify the constants, low notes, and elevations, appearing frequently and significantly in this population, which is a constant low note to Ego Strength Scale. We use these results to point out the value of therapeutic support based on groupal mediations as way to restore the internalized psychic protective shield.

Le propos contenu dans cette recherche concerne les plateformes interactives et réticulaires peuplant désormais notre quotidien, et qui se présentent d’abord à nous sous la forme d'objets techniques, mais dont les usages construisent des représentations sociales. Des médiations informationnelles s’y développent que nous avons voulu étudier en capturant celle du français dans le contexte de ses apprenants thaïlandais à l’Université, pour une langue réputée difficile, non apparentée et distante. Une double analyse quantitative et qualitative menée en partie avec le logiciel NVivo nous a permis de mettre à jour le fait que, sous certains aspects et dans certains environnements, un réseau socio-numérique comme Facebook pouvait faciliter un apprentissage informel participant à une économie de la connaissance. Nous avons identifié des usages et des pratiques spécifiques qui ne sont pas ceux d’une plateforme d’enseignement à distance conçue comme telle. Ainsi, une certaine créativité s’y exercerait dans la construction de documents scripto-audio-visuels sur des dispositifs techniques médiateurs et multiplateformes où l’autonomie de l’usager y serait culturellement et socialement située par les identités, appartenances, perceptions, habitus et autres dispositions qui structurent sa relation au monde et vont conditionner son envie, sa manière ainsi que sa capacité pratique à s’approprier des éléments d’apprentissage de la langue. / The subject of this research concerns the interactive and reticulated pattern platforms that now populate our daily lives, and which first appear to us in the form of technical objects, but whose uses build social representations. We studied Informational mediations developed there by focusing on French in the context of its Thai students at the University, since French is a language deemed difficult, unrelated and distant. A double quantitative and qualitative analysis conducted in part with the NVivo software allowed us to update the fact that, in certain aspects and in certain environments, a digital social network like Facebook could facilitate informal apprenticeship participating in an economy of knowledge. We have identified specific uses and practices that are not those of a distance education platform designed as such. Thus, a certain creativity would be exercised in the construction of scripted audio-visual documents on mediating and multiplatform technical operational systems where the autonomy of the user would be culturally and socially situated according to identities, group memberships, perceptions, habits and other factors that structure its relationship to the world and will condition its desire, its manner and its practical ability to appropriate elements of language learning.

¿Quién dió la orden? Mediations for social change, affects and digital media / ¿Quién dió la orden? Mediaciones para el cambio social, afectos y medios digitales

In 2019,  Movice and CT created a mural that depicts faces of  high-ranking military officers who were in command when more than 6.000 civilians were killed by soldiers and were presented as guerilla members. After being censored by the military, the mural was reproduced on hundreds of walls in Colombia and other cities such as  New York, Berlin, Paris. On Twitter, the hashtag was used at least three times a day for two years.  Then, how could the contents of ¿Quién dio la orden? (Who gave the order? - WGO)  contribute to social change in the digital society while others go unnoticed? Through in-depth interviews and online participant observation, the organisational practices that produced WGO and the practices of social appropriation are analysed. In particular, the role played by affects and connective action. The research approach is from a non-media-centric perspective, a holistic view of the online/offline communication process of meaning-making. The study relies on the Latin American Theory of Mediations with some components from the theories of Collective Action, Connective Action and Affective Intensity. The findings mainly show that, first, the production of WGO was a permanent negotiation of collective meanings to reach the common goal. Second, WGO was appropriate when the citizens participated in the production of WGO and were able to  identify themselves subjectively. Third, the production of WGO increased affective intensities that triggered exchanges of discourse and action between diverse groups of social actors. In terms of social change, the alternative narrative of WGO was partially legitimised for Colombian society, turning it into a collective referent that challenged the hegemonic narrative of “rotten apples”. / En 2019, Movice y la Campaña por la Verdad crearon un mural que muestra los rostros de militares de alto rango que estaban al mando en el periodo en el que más de 6.000 civiles fueron asesinados y presentados como miembros de la guerrilla. El enfoque de la investigación toma una perspectiva no mediático-céntrica, una visión holística del proceso de comunicación online/offline de producción de sentido. El estudio se basa en la Teoría Latinoamericana de las Mediaciones con algunos componentes de las teorías de la Acción Colectiva, la Acción Conectiva y la Intensidad Afectiva. Los resultados muestran principalmente que, en primer lugar, la producción de QDO fue una negociación permanente de significados colectivos para alcanzar el objetivo común. En segundo lugar, QDO fue apropiado desde la participación de los ciudadanos en la producción y cuando éstos lograron identificarse subjetivamente. Tercero, la producción de QDO aumentó las intensidades afectivas que desencadenaron intercambios de discurso y acción entre diversos grupos de actores sociales. En términos de cambio social, la narrativa alternativa de QDO fue parcialmente legitimada por la sociedad colombiana, convirtiéndose en un referente colectivo que desafió la narrativa hegemónica de las "manzanas podridas".
