Article 27 of the International Covenant on Civil and Political Rights is a legally binding and justiciable minority protection provision. It stipulates, “In those States in which ethnic, religious or linguistic minorities exist, persons belonging to such minorities shall not be denied the right, in community with the other members of their group, to enjoy their own culture, to profess and practise their own religion, or to use their own lan-guage.” Perhaps due to its negative, weak and qualified terminology, too many legal scholars display a dismissive attitude toward this article suggesting that they deem it to be an inadequate measure of minority protection. This thesis seeks to address the question of whether article 27 is simply another inadequate measure or an underappreciated resource through analyses of four key questions: (i) the scope question, (ii) the definitional ques¬tion, (iii) the right-bearer question, and, (iv) the obligation question. Article 27’s cautious terminology has produced much confusion and controversy, but the United Nations Human Rights Com¬mittee’s practice has helped clarify many significant points of contention. Despite contesta¬tions to the contrary by many States parties, article 27 has a universal scope and applicability with only two minor, but significant, exceptions. The right-holder is a person belonging to a non-majority ethnic, national, indigenous, racial, religious or linguistic community, and she bears and exercises the rights protected by article 27 as an individual, even though she has a right to exercise them in concert with other members of her community. States parties are obligated to ensure that persons belonging to minority communities have these rights. Hence, I suggest that article 27 should be interpreted according to the following formulation:

The intention of this thesis in political science is to understand how the European Union fights and prevents discrimination against the Roma minorities in Sweden and Romania, and how the implementation works in reality. The study consists of defining what it means to be objectively discriminated, what ethnicity really means and how the implementation process consist of a comparison and statement has been made by the national governments and comparing how two socioeconomically different member states handle EU directives and implement them in Sweden and Romania. The main findings of this study was that EU policies lack the capital and explicitness that is needed for great results to be accomplished and that the governments in both countries have different issues with implementing the protection of the human rights and Roma culture, and that EU needs to be more practical and develop in a faster pace.

Fabricating Fidelity: Nation-building, International Law, and the Greek-Turkish Population ExchangeOzsu, Faik Umut 11 January 2012 (has links)
This dissertation concerns a crucial episode in the international legal history of nation-building: the Greek-Turkish population exchange. Supported by Athens and Ankara, and implemented largely by the League of Nations, the population exchange showcased the new pragmatism of the post-1919 order, an increased willingness to adapt legal doctrine to local conditions. It also exemplified a new mode of non-military nation-building, one initially designed for sovereign but politico-economically weak states on the semi-periphery of the international legal order. The chief aim here, I argue, was not to organize plebiscites, channel self-determination claims, or install protective mechanisms for vulnerable minorities – all familiar features of the Allied Powers’ management of imperial disintegration in central and eastern Europe after the First World War. Nor was the objective to restructure a given economy and society from top to bottom, generating an entirely new legal order in the process; this had often been the case with colonialism in Asia and Africa, and would characterize much of the mandates system throughout the interwar years. Instead, the goal was to deploy a unique mechanism – not entirely in conformity with European practice, but also distinct from non-European governance regimes – to reshape the demographic composition of Greece and Turkey.
I substantiate this argument by marshalling a range of material from international law, legal history, and historical sociology. I first examine minority protection’s development into an instrument of intra-European nation-building during the long nineteenth century, showing how population exchange emerged in the Near East in the 1910s as a radical alternative to minority protection. I then provide a close reading of the travaux préparatoires of the 1922-3 Conference of Lausanne, at which a peace settlement formalizing the exchange was concluded. Finally, I analyze the Permanent Court of International Justice’s 1925 opinion in Exchange of Greek and Turkish Populations, examining it from the standpoint of wide-ranging disputes concerning the place of religion and ethnicity in the exchange process. My aim throughout is to show that the Greek-Turkish exchange laid the groundwork for a mechanism of legal nation-building which would later come to be deployed in a variety of different contexts but whose precise status under international law would remain contested.

This can probably be ascribed to the acknowledgement of the fact that prejudicial conduct harms not only minority shareholders, but also the economy at large. Companies are governed by the principle of majority rule; consequently the
minority is subjected to the will of the majority. This often places the minority in an invidious position, especially when the majority use their power to further their own interests. The rule in Foss v Harbottle presents a stumbling block to minority shareholder action. Certain statutory measures have been introduced in an effort to counter defective minority protection. These statutory measures are evaluated in the light of a comparative study of several foreign jurisdictions, the most prominent of which are New Zealand and Canada, because of the innovative nature of the measures which they employ. The conclusion arrived at is that, for various reasons, the protection afforded minorities by the South African statutory measures is unsatisfactory. Firstly, the
wording of these measures is narrowly construed; this in turn results in a narrow field of application. Secondly, these measures are not in step with developments elsewhere in the world and with the changing circumstances and needs in practice. Thirdly, well-formulated remedies needed in order to supplement section 252 of the Act are non-existent. Previous issue date: 2012-06-14 / This work aims to analyze and explore the controversial aspects related to mandatory bid rule under Brazilian Corporate Law (Law 6,404/76), which extends to voting minority shareholders the right to sell their shares in case of a control transfer. Remedies for dissenting shareholders : a comparison of the current option of personal action and the proposed appraisal remedy under the companies bill of 2008Adebanjo, Adetoun Teslimat 11 1900 (has links)
Thesis / The Companies Bill B61-2008 proposes to introduce appraisal rights into South African law. Appraisal entitles a shareholder to demand payment from the corporate issuer of his shares at a fair cash value in certain instances where major transactions which would change the company's direction have been proposed. It allows a cash exit rather than being coerced into supporting the majority's decision. Arriving at a fair share value is a challenge to appraisal. Presently, under the Personal action, a shareholder who opines that the company's act or omission is unfairly prejudicial or that its affairs are conducted in an unfairly prejudicial manner, may apply to court for an appropriate order. It enables the minority to challenge the majority's decision. Both remedies will be available to dissenting shareholders under the new dispensation and a shareholder must decide which remedy best suits his purposes. Minority protection mechanisms in international law aim to guarantee certain individual rights to persons belonging to ethnic, religious or linguistic minorities, such as freedom of culture, religion and language. These rights can be considered to be of collective interest for minority group identity and therefore often require the possibility of collective enjoyment. In addition to general human rights and principles of non-discrimination, minority protection can alternately be ensured through minority specific rights. However, minority specific rights would not operate effectively without evolving a concept of collective (or group) rights in international law. Hence, while this kind of approach can provide legal methods for balancing the interests of individuals, groups and the state, it creates the possibility of conflicts with the international framework of individual rights. The ottoman millet system sets a historical example of minority protection instruments based on a collective concept of human rights. Furthermore, the ottoman history offers an illustration of what could go terribly wrong with a collective rights model. By analyzing the millet system and the ottoman legal reforms in the nineteenth century I will discuss reoccurring issues with collective rights. I will argue that incorporating collective rights within a structure founded on individual rights is a problematic way of protecting individuals belonging to minorities and other vulnerably ethnic groups. Looking through the historical development of universal human rights some important aspects of its main principles will be brought up in this paper.
