Darbe norima atskleisti teroro akto sudėties požymius, nustatyti atskyrimo nuo kitų nusikalstamų veikų galimybes. Keliama hipotezė, kad Lietuvos Respublikos baudžiamajame kodekse teroro akto sudėties požymiai nėra pakankamai apibrėžti. Akcentuojama teroro, teroro akto ir terorizmo sampratų atskyrimo problema. Autorė pastebi, kad atsiranda vis daugiau mokslinių darbų terorizmo tematika, daugeliu atvejų tai politologinio ar istorinio pobūdžio darbai, daugiau analizuojantys terorizmo padarinius, terorizmo paplitimą ar teroristinių organizacijų veiklą, mažai dėmesio skiriant teroro aktų, kurie yra priemonė teroristinei ideologijai sklisti, sudėties analizei, kurios požymiai nepakankamai reglamentuoti ir Lietuvos Respublikos baudžiamajame kodekse. Darbe siekiama terorizmą ir teroro aktus atskirti, teroro aktą apibrėžiant kaip nusikalstamą veiką, individualią, nepakartojamą, neatsiejamą nuo konkrečių asmenų – teroro aktus realizuojančių asmenų ir jų aukų. Darbe atskleidžiamas ir teroro, kaip iracionalios baimės kūrėjo, vaidmuo teroro akte. Remiantis Lietuvos Aukščiausiojo Teismo sprendimais, tarptautinės teisės aktais, kitais moksliniais darbais, magistro darbe formuluojamos teroro akto sudėtyje minimos sąvokos. Pabrėžiama visuomenės saugumo, kaip baudžiamojo įstatymo saugomos vertybės, į kurią kėsinamasi teroro aktu, svarba. [toliau žr. visą tekstą] / In this work the author is trying to describe the features of terror act, identify possibilities of delimitation from other criminal acts. There is created a hypothesis, that in the Penal code of Lithuania Republic the features of terror acts’ consist are not clearly defined. There is emphasized the problem of differentiation of terror, terror act and terrorism concepts. The author is noticing that there are more studies about terrorism, in many cases they are of political or historical character, more analyzing the issues of terrorism, its’ spread ant the activity of terrorist organizations, paying less attention for the analysis of terror acts, that are means for spreading terrorist ideology. In this work there is trying to distinguish terrorism and terror act, describing as criminal act, individual, unrepeatable, concurrent from concrete person, who realize these terror acts and its’ victims. In this work also is revealed terror’s, as creator of irrational fair, role in terror act. Following the decisions of Lithuania High Court, international juridical acts, other research work, in this master work are formulated concepts concerning the consist of terror act. Die verhouding tussen verhaal en metafoor in Agaat (Marlene van Niekerk) / Hester Elzebet Venter

The novel Agaat by Marlene van Niekerk is a highly complex text. One of the most compelling aspects of the novel is the way in which the author constructs an underlying metaphorical grid which determines the composition of the novel. The motives in the novel cannot be regarded merely as motives because specific prominent and powerful metaphors are continually exploited by variation and extension. The complicated relationship between narrative and metaphor on different levels is of great importance in the interpretation of the novel. Due to the complexity of the text, the dominant metaphors cannot be analyzed in the traditional manner. In this study I want to demonstrate that conceptual blending theory, which can be regarded as a branch of conceptual metaphor theory, offers a theoretical framework that can be used to understand the underlying cognitive functioning of the interaction between author, text and reader. This dissertation will examine the processes of blending shaped from the mottos posted at the beginning of the novel. The three mottos, the music motto, the embroidery motto and the farming motto, act throughout the novel as a backdrop against which events in the novel can be interpreted. The blending formed from these mottos merge with other metaphors in the novel in order to generate meaning. The three mottos were taken from the introductions of the FAKVolksangbundel, the embroidery book Borduur so and the Hulpboek vir boere in Suid-Afrika. The three books are used by Milla to educate and teach Agaat. She uses the books to "create" Agaat and to mould her into the person that Milla wants her to be. The mottos stress the uplifting of the people and the creation of a true Afrikaner identity. Agaat accomplishes everything that the books require of her, she becomes an expert in the areas that determine the Afrikaner identity. However, as a brown woman, she is still not considered a member of community or as a fully acceptable civilized woman. The meanings of the other important metaphor in the novel, the mirror metaphor, are also investigated extensively. The mirror plays an important role in the relationship between Milla and Agaat. The mirror is also important in Milla's confrontation with herself, especially in her experience of her illness and her acceptance of her imminent death. The mirror is also used in the depiction of the relationship between characters and the experience of each other as the "Other". The blending of the mirror metaphor and the link that can be established with the theories of Lacan are part of one of the main blendings formed from the mirror metaphor. This metaphor also interacts with the embroidery metaphor. The mirror reflects images to the characters and via the characters to the readers which enforce moral judgments about perceptions and practices. The final part of the dissertation analyses how the dominant metaphors, namely music, embroidery, farming and the mirror, blend in multiple ways in the text to create new domains of meaning. The four main metaphors also blend with secondary metaphors in the novel in order to generate meaning. One of the important secondary metaphors is the "waterhondjies". The "waterhondjies" blend with Guido Gezelle's poem "Het Schrijverke". There is also emphasis on the relationship between writing and the "waterhondjies". The blending of the caeser butterfly plays an important role in the novel as well. In the final chapter the statement is made that the metaphors and symbols in Agaat cannot merely be regarded and interpreted as traditional motives, but rather as examples of cognitive blending. The types of blending in the novel require the cooperation of the reader in all cases. The reader must, in some cases, as with the mirror metaphor and the metaphor of the "waterhondjies", identify and activate the second domain of the blend. In the case of the mottos the different domains of the blend are activated by the author and the reader only needs to provide an interpretation. The wide variety of magazines in the South African market and the economic relapse that has been experienc,e d worldwide has given rise to the increasing competition for higher circulation figures and advertising income. This phenomenon especially occurs between publications competing for the same target audience, such as the women's magazines SARIE and rooi rose, competitors over many years in the Afrikaans magazine market. Magazine covers play a critical role in this rivalry due to the direct connection between the popularity of the cover and circulation figures. The more popular the cover of a publication, the higher the sales, circulation and potential profitability will be. Thus it is of the utmost importance for any publication to make the suitable cover selections, considering that the wrong choices can contribute towards a decrease in circulation and eventually fatal consequences for the publication. This study endeavours to determine which requirements magazine covers should meet to be successful and also which tendencies can be identified in the cover choices of SARIE and rooi rose and how these tendencies can be explained. In literature it was found that there are several requirements and directions to which magazine covers should account to be able to be achieving success. It was also found that magazine covers consist of several elements, such as the logo (master-head), cover-girl/-photo, background colours, text and also competitions (announced on the cover). SARIE and rooi rose's covers were analysed in accordance with the requirements for magazine covers. It was found that these magazine covers complied with the formal requirements formulated in the literature consulted. It also appeared that the success of every cover and edition is determined by the cover elements as a whole and not only the popularity of the "cover-girl" only. Several aspects should thus be taken into account when planning the magazine cover. Examining software architecture evolution using change-sets

A significant challenge in understanding the evolution of a software system is coping with the huge amounts of data left behind during the evolution. One strategy for summarizing this data is to visualize its effect on the system’s architecture. Existing tools that implement this strategy often provide mechanisms to filter the data under consideration. However, this filtering is generally limited to showing the evolution over some unbroken sequence of time, for example the changes over the last six months. In this work we present an alternative approach designed to provide a method for examining the net effect of any set of changes on a systems architecture. We also present Motive, a prototype tool that implements this approach, and demonstrate how it can be used to answer questions about software evolution by describing case studies we conducted on two Java systems.

Motivace pracovníků ve vybraném podniku / Employees motivation in selected company

I have concentrated my diploma work to the system of motivation and stimulation. As a subject of my study I chose the company AISIN EUROPE MANUFACTURING CZECH s.r.o. that currently employs 270 people. Its motivation and stimulation system has got very sofisticated structure for motivation and stimulation of the employees. As a method of my work I have chosen investigation by questionnaire, interview and observation. The questionnaire that became a starting point of my study was based on theoretical knowledge and features important for evaluation. The goal of the investigation was to analyze attitude of the employees to the individual motives and motivators and herewith to find out how they perceive fulfilment of those factors by the company. Answers to each question are displayed in a graph and a chart which are accompanied by the results and discussion. Inquired group of employees covered all the departments in the company. Getting to know the wide range of motivation and stimulation means in the company, I found out that the company AISIN EUROPE MANUFACTURING CZECH s.r.o. prefers material remuneration and offering benefits to the employees. Regarding remuneration, I would propose to apply flexible component of the salary that a manager could use to valuate a subordinate more often, respectively in one month period. Regarding communication and information flow, I would recommend to install digital mean of sharing information and also to place it close to the employee entrance in order to announce the changes to the employees as soon as they enter the plant. Another proposal for improvement is to start operation of company buses for the employees. Thereby the company might recruit qualified manpower also from locations close to premises of the company but currently without good trasportation service.

Therefore it is a research on the conceptions and motivations of Geography teachers. 14 (Fourteen) teachers, graduated in Geography, from the municipal schools of the south region of Goiânia, participated on this study on the first stage, answering a questionnaire in order to understand their conception of motivation, and then five among these teachers were selected to participate on the second stage, which is a semi-structured interview that aims to investigate their motivations during their classes. At a first moment, a bibliographic review was done on motivation as a current issue among Geography teachers, being the basis to the research Vigotsky and his followers. At second, a bibliographic review was taken from the main issues of the teachers who responded the questionnaire and were interviewed, such as The Geography Education, the current contributions of the Practice of Teaching, the identity of teachers, as well as their continued education and the motivation contributions for the teaching practice. At third, a brief presentation of the South Region of Goiânia was done with the intent to better comprehend the reality where the participant teachers act, and then the answers to the questionnaire are discussed in relation to their conceptions of motivation. And at forth, in order to approach the theory of motivation or non motivation of the Geography teacher, their motivations were analyzed. This work highlights the need for the increase of the value of the Geography teacher motivation during their practice as the public institution’s concern, the University’s and all its own components of the school context. Therefore to reach a better comprehension of Goiania’s formal education current context it is essential that the teachers’ motivations be considered. The better the understanding of the emotions of the educators, the bigger is the unveiling of the fan of human possibilities during the teaching-learning process. / O presente trabalho tem por objetivo compreender a concepção dos professores de Geografia das escolas municipais da região sul de Goiânia da motivação, bem como a compreensão de suas motivações durante a prática docente. Portanto trata-se de uma investigação das concepções e motivações dos Professores de Geografia. Participaram do estudo na primeira etapa 14 (quatorze) professores Geografia, com formação em Geografia, de Escolas Municipais da Região Sul de Goiânia, os quais responderam a um questionário que buscou investigar as suas concepções acerca de motivação, e dentre esses, foram selecionados 5 (cinco) professores que se consideram motivados para participar da segunda etapa da pesquisa, uma entrevista semi-estruturada, cujo objetivo é investigar suas motivações na prática docente. Num primeiro momento fez-se uma revisão bibliográfica da motivação como uma problemática no cotidiano dos professores de Geografia, o que buscou como base para análise as contribuições de Vigotski e de seus sucessores. Num segundo momento realizou-se uma breve revisão bibliográfica das principais temáticas levantadas pelos professores que responderam o questionário e a entrevista semi-estruturada, como a Educação Geográfica, as contribuições atuais da Didática para a prática do professor, o processo identitário dos professores, sua formação continuada e as contribuições da motivação para a prática docente. Num terceiro momento fez-se uma breve apresentação da Região Sul de Goiânia, com o intuito de uma melhor compreensão da realidade onde atuam os professores participantes da pesquisa, e em seguida são discutidas as respostas contidas nos questionários em relação às suas concepções sobre motivação. E num quarto momento, com o intuito de abordar a problemática da (des) motivação do professor de Geografia, analisaram-se as motivações que estão presentes na prática destes docentes. Esse trabalho destaca a necessidade da valorização da motivação do professor de Geografia durante sua prática docente, por parte do poder público, da Universidade e pelos próprios componentes do ambiente escolar. Portanto, para que ocorra um melhor entendimento da realidade atual da educação formal goianiense é fundamental que as motivações dos professores sejam consideradas e valorizadas. Quanto maior o entendimento das emoções dos sujeitos formadores, maior o descortinar de um leque de possibilidades humanas durante o processo de ensino-aprendizagem.

La présente recherche propose une réflexion sur les possibilités de concevoir un langage analytique approprié aux musiques du ţba‛ et traîte essenciellement deux ţbū‛ tunisiens: le nūā et le mħaīyar sika à travers le répertoire de la nūba. La problématique consiste à différencier deux ţbū‛ ayants en commun certains éléments de leurs échelles. L’analyse de ces deux ţbū‛ est basée sur la méthode paradigmatique avec une conception motivique ainsi que sur un travail de réduction inspiré de l’approche Schenkérienne. Cette recherche est composée de trois parties principales : La première porte sur l’analyse comparative des motifs principaux de fin. La deuxième consiste à analyser et comparer les motifs secondaires de fin et la troisième partie traite les motifs de début. La recherche s’achève par une conclusion répartie en deux; la première relève et commente les résultats de l’analyse; quant à la seconde, elle discute l’efficacité des procédures analytiques adoptées. / This research proposes a reflection on the possibilities to conceive an analytical procedure adapted to musical works based on the system of ţba‛; it deals mainly with two Tunisian ţbū‛, nūā and mħaīyar sika, considered through the nūba repertody. The aim is to differentiate two ţbū‛ sharing some elements of their scale. The analysis of these ţbū‛ is based on the paradigmatic method, envisaged in a motivic conception, and on a procedure of musical reduction inspired by Schenkerian theory. The research consists in three main parts: the first devoted to a comparative analysis of the main final motives; the second analyses and compares secondary final motives, and the third deals with initial motives.The thesis concludes in two parts: the first synthesizes and comments the results of the analysis, and the second discusses the validity of the analytical procedures.

Motiv spravedlnosti a jeho sociálně-psychologické koreláty / The motive of justice and its social psychological correlates

The thesis aims at social psychological aspects of the justice motive. Its purpose is to outline the links between justice motivation and social context, primarily to socioeconomic status, social identity and culture. Major differences between implicit and explicit justice motives are presented, the focus is mainly on the belief in a just world as an important indicator of the justice motive. Distributive and procedural norms of justice are described considering their social dependences. The justice motive and evaluation are viewed from the perspectives of theory of social exchange and equity, social identity theory and theory of system justification. In the empirical part the relation between SES and BJW in Czech society is tested in two studies. The analysis results of the quota public opinion survey (Aktér 2015, N = 926) indicate that people of high SES believe explicitly in a just world more than people of low SES. The estimated contradictions to the results of studies carried out in American context are discussed. The findings from the Czech survey may be relevant especially in the context of less socially differentiated societies. The Third Place in Lynchville

Der Artikel untersucht einen Werbespot von David Lynch für die Playstation 2 und ordnet ihn in das Universum der Lynch’schen Texte, das Lynchville, ein. Zunächst werden dazu einige regelmäßig wiederkehrende Motive aus dem Werk Lynchs vorgestellt. Es folgt eine eingehende Analyse des Werbespots, in der zahlreiche Parallelen zu den bekannten Filmen des Œuvres aufgezeigt werden. Abschließend wird kurz der Frage nachgegangen, inwiefern der Begriff „auteur“ in dieser wohl kommerziellsten aller filmischen Ausdrucksformen überhaupt anwendbar ist. Der Artikel kommt zu dem Ergebnis, dass es Lynch in diesem Werbespot gelingt, eine persönliche Visiondurchscheinen zu lassen – und dass die Karte des Lynchville deshalb um einen neuen Ort ergänzt werden muss. / The article analyzes a television-commercial, which David Lynch shot for the launch of Playstation 2. It tries to introduce that commercial into the universe of well known Lynch-Movies, the Lynchville. At first, some of the recurrent motives in Lynch’s work will be discussed. Then the commercial will be analyzed, especially regarding any parallels to Lynch’s Œuvre. Finally, the question will shortly be discussed whether in this most commercial form of filmmaking the term “auteur” can still apply. The article comes to the conclusion, that Lynch succeeds in maintaining his personal vision – and that therefore the map of Lynchville has to be expanded.
