An evaluation of the effectiveness of training in syndromic management of sexually transmitted diseases

This study is about evaluating the effectiveness of training in syndromic management ofSTDs. The purpose of this study was to fmd out to what extent the STD training programme had been implemented. A stratified sample of twenty-two primary health care clinics in the Port Shepstone region was used. Twenty-two professional nurses rendering STD management in the clinics were observed. Data-gathering was done through a clinic inventory obtained by interviewing the sister-incharge, observation of professional nurses providing treatment to STD patients, interviews with professional nurses to assess their knowledge of the syndromic approach, and exit interviews with patients treated at the clinic. The fmdings suggest that certain areas in the STD training need to be emphasized, such as vaginal speculum and bi-manual examinations. It is recommended that certain negative aspects which hinder effective STD management, like staff shortages and lack of equipment be given attention. / Health Studies / M.A. (Health Studies)

In my thesis first of all I describe historical progress of trade business in the Czech Republic from it's beginning: the developement of guilds, manufactures, damping during the Second World War and developement after 1989 up to actual legal regulation. I will describe trade administration and its developemnet from 1992, when Trade Licensing Offices started up, and the position of Trade Licensing Offices in the public administration. I will describe the basic terms like trade, trade licence, its beginning, expiration and authentication, trading inspection and administrative penalization. I will describe Trades Register, its connection to other registers of public administratin and the activity of Central registration points. Currently a big amendment to the trade law legislation is being prepared. This amendment is about to reduce administrative burden of entrepreneures greatly and allows the enterpreneurs to start their businesses easily. In my thesis I try to describe the most essential changes which this amendment to the trade law brings.

La protection des données personnelles sensibles consistait, jusqu'au RGPD, en un contrôle préalable réalisé par une autorité indépendante, malgré l’obstacle posé à la libre circulation. Cette protection renforcée est aujourd'hui remplacée par l’obligation du responsable de traitement d’élaborer une étude d’impact. Une telle mutation implique un risque de pré-légitimation des traitements et peut être favorable au responsable de traitement. Or, est-elle conforme au droit fondamental à la protection des données personnelles ? La thèse interroge le contenu de ce droit et la validité du RGPD. À partir d'une étude comparative allant des années 1970 à nos jours, entre quatre pays et l’Union européenne, les données personnelles sensibles sont choisies comme moyen d'analyse en raison de la protection particulière dont elles font l’objet. Il est démontré qu’en termes juridiques, la conception préventive fait partie de l’histoire de la protection européenne des données et peut donner un sens à la protection et à son seul bénéficiaire, l’individu.Un tel sens serait d’ailleurs conforme aux Constitutions nationales qui garantissent aussi l’individu malgré leurs variations. Cependant, cette conception n’est pas forcement compatible avec l’art. 8 de la Charte des droits fondamentaux de l’UE. La thèse explique que cette disposition contient la garantie d’une conciliation (entre les libertés de l’UE et celles des individus) qui peut impliquer une réduction de la protection de ces dernières. Or, il revient à la CJUE, désormais seule compétente pour son interprétation, de dégager le contenu essentiel de ce droit ; objectif auquel la thèse pourrait contribuer. / Before the GDPR, protection of sensitive personal data consisted of a prior check by an independent authority despite limiting their free movement. This has been replaced by the obligation of the controller to prepare a privacy impact assessment. With this modification, one can assume a risk of pre-legitimization of data processing, putting the controller at an advantage. Is that compatible with the fundamental right to the protectionof personal data ? This thesis questions the content of this right and the validity of the GDPR. It is based on a comparative study from 1970s until present day between four European countries and the European Union, in which sensitive data are chosen as a meanto the analysis due to their particular protection. Research shows that in legal termsthe preventive conception is a part of the history of protection in the European Union. By limiting freedom of processing it gives meaning to protection and its only subject,the individual. Such an interpretation is compatible with National Constitutions despite their variations. However, the preventive conception of data protection is not so easily compatible with article 8 of the European Charter of Fundamental Rights. The thesis puts forward that this article contains the safeguard of a balancing, between EU liberties and individuals’ freedoms, which implicates reduced protection. It is up to the European Court of Justice to identify the essence of this right, an aim to which this thesis could contribute.

Access to finance is often a vital tool for a company to make investments which in turn leads to increased generation of income. In 2022, the amount of lending to non-financial companies increased by around 13 %. Banks' traditional lending channels have recently been challenged by DeFi. Within DeFi, no central intermediary is used, the security provided is cryptocurrencies and the transaction history is public. The most common cryptocurrency used in DeFi is bitcoin. At the time of writing, bitcoin has a market capitalization of approximately $521 million. The use of DeFi has grown rapidly in 2022 as cryptocurrencies worth just under $110 billion were pledged in DeFi as collateral for credit. The EBA has previously warned about the risks of cryptocurrencies. Despite warnings, neither case law nor any clear legislation regarding cryptocurrencies and creditors protection has thus been created. Though, there is a proposal from EU that will create a uniform regulation for cryptocurrencies that are not currently covered by the EU's existing regulatory framework for financial services, the so-called MiCA regulation. In Swedish legislation, there is an ongoing investigation on how to handle cryptocurrencies. However, neither the proposals at EU-level nor national level deal with substantive legal aspects such as creditors protection. The purpose of the thesis is to present a proposal for what bitcoin as property is classified as according to Swedish law and to identify the most appropriate legal aspect when bitcoins are used within DeFi. Based on the purpose, the following questions arise (i) What type of property should the cryptocurrency bitcoin be legally classified as? (ii) How can creditor protection be achieved when a transaction with bitcoin is made? (iii) How can creditor protection be achieved when bitcoin is used as collateral? In this thesis, the legal dogmatic method and law analogies will be used to answer the questions. The conclusions are that bitcoin should first be seen as a financial instrument according to MiFID II and creditor protection in the case of acquired ownership of bitcoins can basically never be achieved. Creditor protection in case of retained ownership can be achieved with analogous application of RVL and using registration as an element of property rights. When bitcoin is used as collateral, creditor protection can be achieved through the property right element of registration or tradition. In the case of three-party escrow, notification of transfer of claim must be made to the person who holds the pledged property in accordance with the 1936 Pawn Law.

Yes / With the aim of targeting high-risk hidden heterosexual young people for Chlamydia trachomatis (CT) testing, an innovative web-based screening strategy using Respondent Driven Sampling (RDS) and home-based CT testing, was developed, piloted and evaluated. Two STI clinic nurses encouraged 37 CT positive heterosexual young people (aged 16-25 years), called index clients, to recruit peers from their social and sexual networks using the web-based screening strategy. Eligible peers (young, living in the study area) could request a home-based CT test and recruit other peers. Twelve (40%) index clients recruited 35 peers. Two of these peers recruited other peers (n = 7). In total, 35 recruited peers were eligible for participation; ten of them (29%) requested a test and eight tested. Seven tested for the first time and one (13%) was positive. Most peers were female friends (80%). Nurses were positive about using the strategy. The screening strategy is feasible for targeting the hidden social network. However, uptake among men and recruitment of sex-partners is low and RDS stopped early. Future studies are needed to explore the sustainability, cost-effectiveness, and impact of strategies that target people at risk who are not effectively reached by regular health care.

SKV and Tullverket have several important tools and methods available in each activity to ensure that taxes and fees are paid and charged rightfully. Among other things they use tax or customs surcharges, targeted and general third party injunctions or targeted and general third party audits. The targeted controls, ergo targeted injunctions and audits, are targeted towards specific persons or documents while during the general controls these are not specified. The methods have repeatedly been the subject of discussions and attempts to simplify the tax procedure and increase the Rule of Law for the individual. The government appointed a commission on March 8 of the year 2012 with the assignment to prepare proposals to increase the Rule of Law in the tax procedure. The assignment was therefore to analyze the areas of tax and customs injunctions, reimbursement because of expenses and agents and also third party controls. This study was delimited, partly due to space considerations, to examine the commission's proposals to increase the Rule of Law regarding third party controls as well as to SKV as the investigating authority. Consideration will therefore not be given to Tullverket as the investigating authority. The system concerning third party controls has repeatedly over the years been the subject of criticism and debate. Not least because of that the general third party controls are indistinct due to the fact that the person who is the subject of the control is not aware of the control and that the procedure is considered to contravene the protection of privacy in the RF and the right to private and family life of the ECHR. It has hence been considered that there is a need for change. The commission would thus investigate and make proposals to increase the Rule of Law but given the precondition that third party control, including general controls, would still remain as control methods. Therefore the commission had to consider a proportionality assessment between the protection of individual privacy and SKV:s control effectiveness. In this study focus was on SOU 2013:62 and the consultation bodies’ responses received on account of the proposals. The commission proposed that the decision making on general third party controls will stay with SKV as the decision making authority and that it should be clarified in the legislative text that SKV has to relate to the principle of proportionality when deciding on general third party controls. The commission also proposed that it should be clarified in the legislative text that SKV only may search for documents and information covered by the decision but that surplus information that was discovered spontaneously also may be used. The commission held that there is no need for clarification of the legislative texts regarding that SKV shall take into account the proportionality principle in the choice of method and choice of control object. The commission also held that there is no need to legislate any imposes for SKV towards the subject of control to inform about the control if the information gathered nevertheless is intended to be the basis for decisions on taxation. Furthermore it was proposed an imposition of legislative texts regarding that the controlled, in connection with the information about the control, should be given the opportunity to request documents and information excluded from the basis for decisions on taxation. That is, after the control is carried out and provided that the information will be added basis for decisions on taxation. The majority of the consultation bodies felt that the commission was inadequate, that the proposals did not add anything new on the merits and that a new commission should be appointed with the mission to increase the Rule of Law in the tax procedure. The studies’ concluding parts contain a pro et contra analysis of the proposals on the basis of the consultation bodies’ responses, my own conclusions and general concluding comments. In these parts my own proposals are submitted for improvement to further enhance the Rule of Law in tax procedures. My own proposals are due to that the commission in my opinion may be deemed deficient in several aspects. / SKV och Tullverket har flera viktiga metoder att tillgå i respektive verksamhet för att säkerställa att skatter och avgifter lämnas och tas ut rätteligen. Bland annat så kan kontrollmyndigheterna använda skatte- eller tulltillägg, riktade och generella tredjemansförelägganden eller riktade och generella tredjemansrevisioner. Vid riktade kontroller, ergo riktade förelägganden och riktade revisioner, är kontrollerna riktade mot specificerade personer eller handlingar och vid generella kontroller är dessa inte specificerade. Metoderna har upprepade gånger varit föremål för diskussioner och försök att förenkla skatteförfarandet och öka rättssäkerheten för den enskilde. Regeringen tillsatte den 8 mars år 2012 en utredning med uppgiften att framställa förslag för en ökad rättssäkerhet i skatteförfarandet. Uppdraget var att undersöka områdena skatte- och tulltillägg, ersättning för kostnader och ombud samt tredjemanskontroller. Denna studie har bland annat på grund av utrymmesskäl avgränsats till att undersöka utredningens förslag som avser ökad rättssäkerhet vid tredjemanskontroller samt till SKV som kontrollerande myndighet. Hänsyn kommer således inte tas till Tullverket som kontrollerande myndighet. Tredjemanskontrollförfarandet har upprepade gånger genom åren varit föremål för kritik och diskussioner. Inte minst för att generella tredjemanskontroller ansetts olämpliga på grund av att den kontrollerade inte har vetskap om att denna är eller har varit föremål för kontroll samt att förfarandet ansetts strida mot integritetsskyddet i RF och rätten till privat- och familjeliv i EKMR. Det har därav ansetts att behov av förändring föreligger. Utredningen skulle således undersöka och lämna förslag för att öka rättssäkerheten för den enskilde men med hänsyn till att tredjemanskontroller, i dessa inbegripet generella tredjemanskontroller, alltjämt skulle kvarstå som metod i SKV:s kontrollverksamhet. Det fordrades följaktligen av utredningen att genomföra en proportionalitetsavvägning mellan skyddet för den enskildes integritet och SKV:s kontrolleffektivitet. I denna studie har fokus lagts på SOU 2013:62 och de remissyttranden som inkommit med anledning av förslagen. Utredningen föreslog att beslutsordningen vid generella tredjemanskontroller ska stå oförändrad med SKV som beslutsfattande instans och att det ska förtydligas i lagtext att SKV ska förhålla sig till proportionalitetsprincipen vid beslut om generella tredjemanskontroller. Utredningen föreslog även att det ska förtydligas i lagtext att SKV endast får eftersöka handlingar och uppgifter som omfattas av beslutet men att överskottsinformation som anträffats spontant får användas. Vidare angav utredningen att det inte behövs något förtydligande i lagtext avseende att SKV ska beakta proportionalitetsprincipen vid val av metod och val av kontrollobjekt. Utredningen angav även att det inte behöver införas någon underrättelseskyldighet för SKV gentemot den kontrollerade om informationen som inhämtats ändå inte är avsedd att läggas till grund för beslut om beskattning. Vidare föreslogs ett införande i lagtext avseende att den kontrollerade ska ges möjlighet att begära handlingar och uppgifter undantagna från att läggas till grund för beslut om beskattning i samband med en underrättelse, det vill säga efter att kontrollen ägt rum och under förutsättning att informationen kommer läggas till grund för beslut om beskattning. Flertalet remissinstanser ansåg att utredningen var bristfällig, att förslagen inte innebar någonting nytt i sak samt att en ny utredning bör tillsättas med uppdrag att öka rättssäkerheten i skatteförfarandet. I studiens avslutande delar redovisas en pro et contra-analys av förslagen med utgångspunkt i remissyttrandena, egna slutsatser avseende förslagen samt allmänna avslutande kommentarer. I dessa delar lämnas egna förbättringsförslag för att ytterligare öka rättssäkerheten, eftersom utredningen enligt min mening får anses bristfällig i flera avseenden.
