Le contentieux précontractuel des marchés publics en France et en Roumanie est une étude comparative qui a comme objet l’analyse synthétique et pragmatique des mécanismes nationaux français et roumains destinés à assurer la protection des opérateurs économiques contre les éventuels manquements aux principes de transparence et de mise en concurrence. La comparaison des deux ordres juridiques est initiée à partir de la présentation du droit européen du contentieux des marchés publics qui a influencé de manière substantielle les systèmes juridiques nationaux. Cette influence sera le point central de l’étude et elle facilitera une comparaison indirecte entre le droit français et le droit roumain qui ont réagi de façon similaire et différente à la fois face à la primauté du droit européen. Ainsi, forte de sa tradition historique en matière de contentieux administratif, la France a été plus réticente à intégrer les règles européennes et a dû accepter quelques compromis qui ont sensiblement bouleversé ses coutumes, notamment en ce qui concerne les pouvoirs du juge. Le système juridique roumain, plus jeune et moins encré dans des règles traditionnelles, a été plus ouvert aux attraits du droit européen à tel point qu’il a innové en créant un organisme administratif-juridictionnel spécialisé, plus adapté aux exigences de rapidité et d’efficacité imposées par les directives européennes. L’évolution de sa jurisprudence riche mais changeante et sa comparaison avec la jurisprudence du juge administratif français nous permettra de nous interroger sur le compromis nécessaire entre la légalité et la sécurité juridique dans la passation des marchés publics. / The precontractual disputes within the public procurement procedures in France and Romania represents a comparative study whose object is to synthetically and pragmatically analyse the national French and Romanian mechanisms aimed to ensure the protection of the economic operators against the eventual infringements of the transparency and competition principles. The comparison between the two legislative frameworks is initiated by the presentation of the European law of the disputes within the public procurement procedures, which significantly influenced the national legal systems. This influence shall be the study’s central point, which shall facilitate an indirect comparison between the French and Romanian law that have both similarly and differently reacted to the priority of the European law.Thus, based on its powerful historical tradition in the field of the disputes of the public procurement law, France was more reluctant to integrate the European rules and had to admit some compromise which had sensibly disturbed its tradition, especially with respect to the powers of the judge.The Romanian legal system, younger and less pegged in the traditional rules, was more opened to the attractions of the European law to such a point that it innovated by creating a specialised administrative-jurisdictional organism, more adapted to the celerity and efficiency exigencies imposed by the European Directives. The evolution of its jurisprudence, rich but inconstant and its comparison to the jurisprudence of the French administrative judge will allow an interrogation of the necessary compromise between the legalism and the legal security in the awarding of the public contracts procedures.

Exploring consumers' experiential responses and shopping intentions toward visual user-generated content in online shopping environments

The purpose of this study is to explore online consumers' experiential response towards visual user-generated content in online shopping environments for fashion online shopping. The Stimulus-Organism-Response (S-O-R) framework has been widely used in online shopping environment studies to examine the effect of website attributes on online shoppers' internal affective and cognitive states, and shopping behaviour (Kawaf and Tagg, 2012). Recent literature in the field proposes a more holistic approach towards online experiences (e.g., Pentina, Amialchuk, and Taylor, 2011) which is conceptualise to mediate the relationship between website attributes and behavioural responses. Consumer experiences are considered to be a critical concept in consumer behaviour and marketing for understanding consumers and to create competitive advantage in online retailing (Schmitt, 2010). Building on existing online shopping environment research, the study conceptualises online experiences for fashion online. This study seeks to investigate online consumers' experiential responses (aesthetics, relational, emotional, Flow experience and interactivity) towards two visual user-generated stimulus: (1) Looks - photographs of individuals modelling their own fashion, and (2) Outfits - digital collages displaying an assortment of products centred around a theme. They are both features which have been created by community members in an online social shopping community, ASOS Fashion Finder. The context of this study was exploratory and utilised a mixed methods approach where 13 photo-elicited interviews (PEI) with female online shoppers of ASOS, aged 18-34, were conducted to identify and understand consumers' online experiential responses and online shopping intentions towards the two visual stimulus. Using the same sample criteria, an online survey with 555 responses was also conducted to measure and test relationships between consumers' experiential responses and shopping intentions. The results of this study provides insight to the experiential states of fashion online consumers for online retail marketing, and contributes knowledge to research literature and theory on online shopping environments and customer experiences.

Appendage development and early distal-less regulation in arthropods : a study of the chelicerate Tetranychus urticae (Acarida)

A major goal of evolutionary developmental biology is to explore mechanisms and events underlying evolution of the myriad body plan morphologies expressed both genetically and phenotypically within the animal kingdom. Arthropods exhibit an astounding array of morphological diversity both within and between representative sub-phyla, thus providing an ideal phylum through which to address questions of body plan innovation and diversification. Major arthropod groups are recognised and defined by the distinct form and number of articulated appendages present along the antero-posterior axis of their segmented bodies. A great deal is known about the developmental genetics of limb development in the model insect Drosophila melanogaster, added to which, much comparative gene expression data and a growing body of functional genetic data is emerging for other arthropod species. Arthropod limb primordia are consistently marked by expression of the homeobox gene Distal-less (Dll), and the focus of this thesis is to compare signalling mediated by early Dll regulatory genes activity along antero-posterior and dorso-ventral embryonic axes during limb specification in Drosophila, with the activity of their orthologs in the widely disparate chelicerate, the spider mite Tetranychus urticae - interpreting new data with that available for other arthropods. Having made a detailed study of spider mite embryonic (and post-embryonic) development, to provide a basis for understanding mRNA transcription and protein activity patterns, I confirmed typical expression of Tetranychus Dll in prosomal limb primordia. I obtained limited results for the candidate antero-posterior positioning genes wingless and engrailed, although one of the two engrailed paralogs I identified is reportedly expressed in posterior segmental compartments, consistent with possible conservation of Engrailed-Wingless interactions in metameric patterning and positive regulation of Dll in arthropod limb specification. In Drosophila, wingless-dependent Dll transcription is restricted along the dorso-ventral axis by dorsal Dpp-mediated and ventral EGFR-mediated signalling gradients. Based on data from Tetranychus and other arthropods, neither dorsal nor ventral signalling regimes appear conserved outside the Drosophila system. Dll suppression in fly abdominal segments occurs due to powerful Hox (Ubx/AbdA) repression of the early Dll cis-regulatory element; this is discussed in relation to the independently evolved limbless chelicerate opisthosoma, informed by hypothetical scenarios of cis (regulatory DNA) and trans (coding sequence) evolution. Given practical difficulties and limitations encountered while working with spider mites, I offer a final assessment of the place of Tetranychus urticae as a non-model, and yet still valuable chelicerate species to consider carrying into the exciting future of evolutionary developmental biology.

Title: Comparison of the physiological response rate of the organism using different one-rope ascent techniques Objectives: The aim of this study was to compare the rate of the physiological response of the organism using 3 different one-rope ascent techniques during constant speed. Methods: It was an empirically based study of experimental character (quasi-experiment). The measured research group (n = 12) consisted of the military students (21 ± 1.1 years; 183 ± 4.9 cm; 80.6 ± 7.8 kg) of full-time study at the Faculty of Physical Education and Sport of Charles University (VO FTVS UK). The physiological response rate was measured with the Cortex Metamax 3b and Polar sporttester during one-rope ascending techniques ("using Prusik knot" = P", "using jümar = B", "using Garda knot = G") at a constant speed of 3 m·min-1 for 7 minutes. The rating of the perceived exertion was also recorded on the Borg RPE scale. The data were comparatively analyzed in the SPSS statistic program, furthermore the analysis of variance (ANOVA) was also employed. Results: The study demonstrated statistical differences (p ≤ 0.05) between techniques: while B is the easiest, the greatest differences were observed between technique B, P and G. In this work we focused on the application of physical activity, which aimed to reduce the negative impact of physical deprivation and associated functional and structural changes in the musculoskeletal system. The principal criterion was the diagnosis of the organ systems of the locomotor system, focusing on the muscular system. The subsequent application of appropriate forms of exercise intervention was designed to mitigate the effects of the aging process and functional changes in the body of the senior individual. Finally, we wanted to assess the impact of changes in body composition in its own self- sufficiency and independence of older people and the quality of life of older people in terms of physical and psychosocial aspects. The most significant is the loss of muscle mass, sarcopenia development, increase fat mass with frequent reductions in body weight. The focus of our work and its specific purpose is to clarify the influence of the applied physical interventions. To assess changes in body composition are needed for our work used the method of multi Bioanalysis. 印刷業的業態可歸類為製造業及服務業二者的綜合體,從客戶接單開始到生產製造出印刷完成品送至客戶端這中間流程的複雜度及變化度,對於個案公司日常營運的管理能力及製程能力都深具考驗。本論文以PWIO模式為架構,個案公司為主體,分析及呈現企業內部流程實作,了解其可強化改善之處,提出具體建議以供個案公司目標修正之參考。本論文同時結合品質成本管理分析與PWIO模式,辨識改善品質成本目標所闗聯之價值流程,以供個案公司未來進行流程改善及設定績效管理,達到目標設定之品質成本結構,以強化個案公司之競爭力,降低成本增加獲利。 本研究針對個案公司,透過PWIO模式及品質成本管理分析之結合應用,所得具體結論及建議包括: 一、就銷售及收款、付款循環而言: 1. 縮短應收帳款與沖帳作業的催帳時間,調整逾齡帳款處置時間與設定停止交易日,避免時間拖延而提高產生壞帳的風險。 2. 建立客戶信用評等機制,降低客戶倒帳風險。 二、生產作業偱環: 3. 排單作業應由印刷廠務純人工作業改為由行政系統改版加入自動篩選建議功能, 以提昇印刷廠務排單的精確度及自動化,增加生產效率。 4. 建立一套庫存管理稽核制度及領料制度,以確保原物料的持續供應,亦可較精確地估算每批印件的生產成本,業務人員在估算價格及利潤時能更精確的掌握。 5. 重新檢討個案公司目前之品檢制度及人力配置,設置廠內品管人員改善廠內生產不良品比率,以減少時常要插單補印壞品數量賠償。 三、品質成本管理: 個案公司之品質成本結構中,內部失敗成本加上外部失敗成本相對於品質成本的比例高於70%,預防成本比例低於10%,可以得知個案公司在品質成本管理上,可加強預防成本及鑑定成本的投資及改善,以降低品質成本。 / Using a case study methodology, this research studies subject company which operates in the printing business that focuses on printings and packing products. Due to the job or customer-tailored, and the artistic characteristics of the printings, the ability of management to deal with the complexity of production process is critical for business success. The research uses PWIO approach to analyze and display the subject company’s operation process, as the basis for improvement suggestions. In addition, a combination of PWIO and concepts of quality cost management, this study is able to form the foundation of future improvement and the framework for performance evaluation and management. In summary, the major conclusions and suggestions found in this study are as follows: 1. Sales aspect: Setting a credit policy for clients in order to control the exposure of credit risk. 2. Payment term: In order to reduce the risk of bad debts, we suggest a more rigid review of accounts receivables turnover rate, overdue accounts, and the allowance for uncollectible accounts 3. Production aspect: 1. We suggest Production schedule should be arranged by automatic system instead of manual operation so as to improve production efficiency and maximize outputs. 2. Establish a stock management system in order to assure the supply of raw materials and compute the production cost more accurately. 3. Review the current human resource deployment and the rules of quality management. We suggest that more QA personnel should be staffed to make sure the consistence of product quality. 4. Quality cost management: The research finds that the ratio of internal and external failure costs to total quality cost is greater than 70% for subject company, while the ratio of prevent cost to total quality cost is less than 10%. A further review of stuffs’ skill and training programs are therefore suggested.

Ocean acidification effects on marine organisms : a study of Littorina littorea and Balanus improvisus

The world’s oceans are becoming more acid in a process called ocean acidification. The pH of the ocean have already decreased by 0.1 units from pre-industrial time until today. Scientists predict that by the year of 2100 the pH will decrease by as much as 0.4 units. This is a big potential problem to many marine species, because they have developed in such a stable environment that has not changed for millions of years. It is difficult to predict how they might be affected by such a decrease in pH during a relatively short time period. Several studies have been made on marine species exposed to decreased pH-levels, the results showed changes in their physiology but it is hard to predict how these changes will affect the organism in a long-term scale and if this might change ecosystem dynamics. Our study measured the activity of Littorina littorea and Balanus improvisus when exposed to lower pH, the results of our study showed an increase in activity for the lower pH (pH 6.0-7.5) when compared to the control (~pH8). The area of ocean acidification is a field that requires further studies to fully understand its effects on the marine ecosystems and the species within it.
