The research addresses secondary victimization of women reporting abuse at the Lenasia Police Station and reasons why it occurs. In addition, the research also determines if the expectations of the survivors of abuse about the police when reporting abuse are in line with what the Domestic Violence Act stipulates as their duties. To determine this, a sample of survivors reporting abuse was used. A qualitative and quantitative approach to the research was used. Two questionnaires were used for the sample of survivors and for service provides, with an opinion survey with knowledgeable people and a focus group discussion with police. It was found that some women were experiencing victimization by the police and that the survivors' expectations of the police were as stipulated in the Domestic Violence Act. Services provided by service providers were outlined and obstacles preventing police to provide a good service were identified. Recommendations were made. / Social work / MA(SS) (SOCIAL WORK)

Problematika sexuálního zneužívání v dětství / Problems of Sexual Abuse in Childhood

The thesis concentrates on the issue of sexual abuse in childhood. The work is divided into four main chapters. The first and second chapter characterizes the development of a role of child from past to the present, particularly in legal terms. The author's focus is dedicated to the term definition of sexual child abuse, data and incidence of sexual abuse in context with other countries. Supported by viewpoint of other authors, a description of different views on sexual abuse of children is presented with specific forms of abuse (contact and non-contact). The third chapter deals with specific risk factors, related to children, the perpetrators (aggressors) and families. Autor´s focus is on the offender (deviant and non-deviant) and their degree of threat. The data is supported by research results published in the Czech Republic and statistical data from OSPOD MLSA. The last, fourth chapter is considered by the author to be of a great importance as it discusses the implications derived from sexual abuse in childhood. This traumatic experience may have crucial impact on further development and quality of life of the victim. The work is concluded with offers of preventative methods and the role of social worker in the process of uncovering a case of sexual abuse of a child.

La limitation des droits fondamentaux constitutionnels par l’ordre public / The limitation to fundamental constitutional rights by considerations of public order

La dialectique de l’ordre public et des libertés sillonne la pensée juridique depuis le XVIIIème siècle. Généré par de nouvelles formes de délinquance et de criminalité, le renforcement des exigences de l’ordre public impose de s’interroger sur la limitation des droits fondamentaux constitutionnels. En dépit de la place névralgique qu’il occupe entre ordre public et libertés, le processus de limitation demeure indéterminé en droit français. Cette recherche, organisée autour de la détermination des limites aux droits garantis, de l’identification des « limites aux limites » aux droits fondamentaux, puis de la redéfinition des droits fondamentaux par les limites, permet de préciser ce mécanisme, mais aussi de cerner les restrictions apportées à l’exercice des droits et libertés. L’autolimitation du Conseil constitutionnel marque un infléchissement progressif de la protection des droits fondamentaux. Ce constat invite à réfléchir sur l’encadrement supra-législatif de la limitation des droits garantis, et conduit à se positionner en faveur de l’insertion d’une clause de limitation des droits fondamentaux dans la Constitution. / The dialectics of public order and freedoms has been traveling throughout legal thought since the 18th century. Sparked by new forms of delinquency and criminality, the strengthening of public order requirements leads to questioning the limitation of fundamental constitutional rights. Despite its crucible place between public order and freedoms, the limitation process remains undetermined in French law. This research, which aims at determining the limitations to protected rights, identifying the limitations to those limitations themselves, and then redefining fundamental rights through those limitations, not only helps to specify this mechanism, but also to identify the restrictions brought to the enjoyment of rights and freedoms. The Conseil constitutionnel self-restraint reveals a gradual shift in the protection of fundamental rights. Acknowledging the former leads to considering a supra legislative framework to the limitations to protected rights, and advocating in favor of the constitutional entrenchment of such a clause.

Livestock theft : a criminological assessment and sample-specific profile of the perpetrators

This qualitative research and case study analysis resulted from the dearth of information on livestock theft and the livestock theft perpetrators. The purpose of this study was to explore, describe and explain the criminal behaviour associated with livestock theft from a criminological point of view by compiling a sample-specific profile of the perpetrators. Interviews were conducted with 35 offenders, 28 case dockets were analysed and additional interviews were conducted with the SAPS STU members and victims to determine the modus operandi, motives and causes of the crimes. Criminological theories were applied to explain the offending behaviour. The findings of this study revealed that the livestock theft perpetrators come from diverse backgrounds regarding age, qualification status and socio-economic class. The purpose of this study was to explore the experiences of School Management Teams (SMTs) in implementing and managing anti-bullying policies in public high schools in the Tshwane South District of the Gauteng Province. This study was prompted by the global concern about bullying in schools and the need for schools to create safe spaces for learning. While the literature regarding bullying is substantial and much literature points to the need for sound anti-bullying policies to curb bullying, bullying is still rampant in many South African Schools. In this study, a qualitative approach was taken to explore SMTs implementation and management of anti-bullying policies in high schools in the Tshwane South District. Interview schedules and a measurement rubric were used as research tools for gathering data to analyse the experiences of the SMTs in managing bullying through anti-bullying policies. / Educational Management and Leadership / M.
