La construction collective de l'action publique en faveur de la langue dans un cadre transfrontalier au Pays Basque et en Catalogne / The collective action of public policy in favor of a language in a cross-border frame in the Basque Country and Catalonia

Beaucoup ont qualifié la construction de mouvements identitaires à base linguistique de Nouveaux Mouvement Sociaux dans les années 70. S’il est vrai qu’en France ils se sont fait connaitre à ce moment-là, en réapparaissant sous de nouvelles formes, il n’en demeure pas moins qu’ils puisent leurs racines dans une opposition historique aux Etats modernes européens. La longévité et la structuration des réseaux militants des langues basque et catalane, tant en France qu’en Espagne, en sont la preuve. Ainsi, outre les grands cycles de protestation, ce sont surtout les nouvelles formes de l’action publique locale et de la construction européenne qui vont permettre une prise en compte et une mise en œuvre de politiques linguistiques en Pays Basque et en Catalogne. La construction collective de manière transfrontalière des politiques linguistiques de la langue montre combien les acteurs collectifs deviennent des acteurs essentiels à la mise en œuvre de politiques publiques contemporaines. Et ce, non seulement en les cadrant lors des luttes politiques et lors de leurs élaborations mais également en étant des acteurs essentiels à l’expertise et à la mise en œuvre, puisqu’ils en sont la cause et les bénéficiaires à part entière. Finalement, les réseaux d’action politique en faveur de la langue se transforment, une fois la langue devenue enjeu et objectif de politique publique, en réseaux d’action publique local ouvrant ainsi un nouveau cycle d’action. / The construction of language-based identity movements was called New Social Movements in the 70’s. If in France, they make themselves known at that time, reappearing under new forms, the fact remains that they originate from an historical opposition with the Europeans Modern States. The longevity and the structuration of the language-based militant networks of basque and catalonian languages, both in the Basque country and in Catalonia, are the proof. Besides the larges protest cycles, it is above all the new forms of local public policy and of European construction which will permit consideration and implementation of language policies in the Basque country and in Catalonia. The collective construction and across borders of language policies shows how collective actors become key players in the implementation of contemporary public policy, not only framing politics and policy making but also being essentials in the expertise and implementation because they are the cause and the beneficiaries. Finally, policy networks based on language turn, once the language become issue and target of public policy, on local public networks opening a new cycle of action.

核能安全緊急應變宣導政策網絡中里長的角色分析 / The Role Analysis of the Chief of Village in Policy Advocacy Network of the Nuclear Safety Emergency Response

網絡是一個依據人與人之間的互動關係所建構出來的,它即是形成我們日常生活中的一部分,而政策網絡則是從網絡的生活環境概念化,進而系統化的分析方法,是較傳統分析方法更有彈性的分析架構。在現在的社會中,想要製造對立的關係很容易,想要挑出他人的問題也是容易的,但是如何促使人們溝通呢?在這個民眾對政府信任低落的時代,社會上的急需解決的公共議題卻未見減少,若里長能發揮一個更作為連結政府和民眾之間溝通的良好媒介,發揮其作為中介樞紐的功能。本研究更期許里長在核子事故緊急應變的政策宣導中,是一個能讓民眾和政府之間的溝通更為順暢的角色。透過政策網絡中的社會網絡分析方法,嘗試去解析在核二廠周遭地區的里長,他們在緊急應變網絡中所擁有的角色、地位及其對網絡的影響,並進一步提出改善當前緊急應變宣導僵化的困境。 本研究透過社會網絡分析的中介性分析結果,發現雖然在緊急應變宣導的政策網絡中,里長確實擁有強大的動員能量,更在網絡中有無法抹煞的影響力,但里長卻並非網絡的單一中介核心,在地方上的緊急應變宣導網絡中,形成了多元的中介核心,這些網絡參與者或因為公務上的正式關係,或因為掌握核能的專業知識,因此,各自在網絡中占有重要的地位,但是若核子事故發生時,這些參與者又會形成環環相扣的宣導和疏散系統,缺一不可。故本研究認為里長的角色,確實會對緊急應變宣導產生不同層面的影響,里長在網絡中也具有相當深厚的稟賦,但更多時候里長只是消極的在執行。 最後本研究彙整出不同受訪者的意見,歸納出了兩個方向性不同的建議,期望負責緊急應變宣導的單位能重新省思這些根本性的問題:第一,只有讓民眾真正的體驗過,體驗才會轉換成有價值的經驗和記憶;第二,對於緊急應變宣導的結構性省思,政府擁有的人力、資源和時間有限,政府官員相較於民眾是否是更需要宣導的群體?

The study was guided by the initial assumption that networks can provide better results for the public administration, compared to those that would occur through single organizations. The literature on the subject shows that, among other advantages, networks may be more appropriate to overcome complex problems, providing more flexibility than hierarchies, complementarity in the actions and encouraging collaboration. On the other hand, they point out limitations of managerial nature or related to accountability, legal and cultural issues, conflicts of interest and power. To obtain empirical data, we interviewed Federal Chief Police Officers, Federal Criminal Experts, Federal External Control Auditors, Financial and Control Analysts and Prosecutors, all holders of management function. By categorizing the testimonies collected in the field research it was possible to synthesize the perception of respondents, which revealed that, corroborating the attributes identified in the literature, there are several benefits of working in networks. But in the same way as seen in the literature, respondents also pointed out that networks present many challenges and limitations. / Este trabalho investiga as contribuições da interação entre os órgãos públicos para a efetividade do Sistema de Justiça Criminal, à luz dos atores envolvidos e tendo como arcabouço conceitual as teorias de redes interorganizacionais, notadamente redes de políticas públicas. O estudo foi orientado pela suposição inicial de que a atuação em rede pode proporcionar melhores resultados para a administração pública, comparativamente àqueles obtidos com as instituições trabalhando isoladamente. A literatura sobre o tema apresenta que, dentre outras vantagens, redes podem ser mais apropriadas para lidar com problemas complexos, proporcionando mais flexibilidade que as hierarquias, complementaridade nas ações e incentivo à colaboração. Por outro lado, aponta limitações de ordem gerencial ou relacionadas a prestação de contas e responsabilização, a questões legais e culturais, a conflitos de interesses e ao poder. Para a obtenção de dados empíricos, foram entrevistados Delegados de Polícia Federal, Peritos Criminais Federais, Auditores Federais de Controle Externo, Analistas de Finanças e Controle e Procuradores da República, todos detentores de função de gestão. Mediante a categorização dos depoimentos colhidos na pesquisa de campo foi possível sintetizar a percepção dos entrevistados, o que revelou que, corroborando os atributos identificados na literatura, vários são os benefícios da atuação em rede. Mas, do mesmo modo que verificado na literatura, os entrevistados igualmente destacaram que redes apresentam muitos desafios e limitações.

Olga Davidová - Abstrakt DP - AJ Abstract Diploma thesis "Globalization and Health - access to health care for children of foreigners in the Czech Republic" addresses the issue of availability of health care for children of foreigners in the Czech Republic as development of legal framework in the Czech Republic and human rights issues. The main objective of this work is a critical reflection on the cause of discrimination against children of foreigners from third world countries (non-EU countries) in their access to health care. This is a retrospective case study which is selected by the institutional analysis of the key events of public policy focusing on the development of health insurance legislation. There are different mechanisms of protection of human rights at local, national, and international level in the availability of health care for children of foreign nationals from third world countries; unfortunately national legislation is not fully in line with international requirements in the area of health law. Although international documents are binding for the Czech Republic, they are not sufficiently applied in the Czech constitutional right to prevent violations of human rights.

Foi realizado um estudo de caso conjugado com pesquisa de campo, bibliográfica e documental, na busca de descrever a intervenção da Câmara de Resolução de Litígios de Saúde e do Núcleo de Assessoria Técnica da Justiça Federal do Rio de Janeiro, no contexto da vida real em que atuam, ou seja, a judicialização de políticas públicas de saúde na cidade do Rio de Janeiro. The theoretical framework was based on interorganizational network theories and, more specifically, on public policy network theories. The main focus of the research was therefore to study relations of collaboration and cooperation that transcend organizacional boundaries and provide more flexibility and greater scope to the process of constructing public policies. The empirical context chosen for discussion was the relationship between brazilian institutions that work together in anti-money laundering efforts. This context has been chosen by the perception that the practice of financial crimes bring huge losses to countries that need to overcome economic and social inequalities. The construction of public policies that are relevant and effective in the prevention and punishment of money laundering crimes can be translated into benefits for the entire economy of a nation. The reflexive methodology proved to be the most suitable for achieving the goals of this research. From the construction of empirical data, it was possible to create constructs that sintetize benefits and challanges of public policy networks. The following interpretative conections reinforce the idea that the external network performance will be perceived by society as more effective the better the internal network performance. If internal network performance improves, it becomes possible to overcome endogeous and exogenous barriers to the network, what improves the results of interaction among participants, leading to more effective results for society. / O objetivo desta pesquisa foi compreender de que modo a emergência de estilos de gestão pública baseados em rede pode contribuir para a construção de políticas públicas relacionadas à prevenção e repressão à lavagem de dinheiro. O arcabouço teórico fundamentou-se nas teorias de redes interorganizacionais, mais especificamente, nas redes de políticas públicas. Foram estudadas relações de colaboração e cooperação que, por transcenderem os limites organizacionais, garantem maior flexibilidade e abrangência ao processo de construção de políticas públicas. As reflexões sobre estas teorias foram realizadas a partir de um contexto empírico específico: o da articulação entre instituições brasileiras que atuam na prevenção e repressão à lavagem de dinheiro. Este contexto foi escolhido pela percepção de que a prática de ilícitos financeiros traz enormes prejuízos a nações que precisam superar desigualdades econômicas e sociais. A escolha metodológica foi motivada por questões ontológicas e epistemológicas que apontaram a metodologia reflexiva como a mais adequada para o alcance dos objetivos propostos na pesquisa. A partir da construção dos dados empíricos foi possível criar construtos que sintetizam os benefícios e desafios da constituição de redes de políticas públicas. As conexões interpretativas subsequentes reforçam a ideia de que os espíritos democrático, republicano e de cooperação devem nortear os valores compartilhados na rede. Assim, se a atuação interna da rede se aprimora, torna-se possível superar entraves endógenos (foco apenas na boa reputação externa) e exógenos (pressão das elites corruptas) à rede, o que resulta em uma melhor interação entre os participantes, gerando resultados mais efetivos para a sociedade.

Kateřina Merklová The Master thesis Advisory Bodies and Expertise in the Czech Politics - Epistemic Communities and the Influence on the Reforms of Higher Education and Pension System concerns with the relation between politics and expertise. So-called epistemic community represents the knowledge interpreter that we consider an independent actor in the political process. In the theoretical part of the text, we have explained the original definition of the concept as well as its critics and case studies that cover various contexts. Following most of the authors, we have applied a looser definition of the concept and deconstructed its rigid criteria. The empirical part of the thesis presents a case study (N=4) based on comparative methods that analyzes variable influence of four particular epistemic communities (the authors of the White Paper on Tertiary Education, Bezdek's Committee, Bezdek's Committee II, and the National Economic Council) on policy-making process and its sources. Up until today, nearly all Swedish regions have decided to set up an EU office in Brussels. However, earlier research on the subject shows that there are big differences concerning what the regions are trying to achieve with their EU office. The aim for this study was therefore to analyse Swedish subnational actors’ EU work within three different arenas and dimensions: at the Brussel arena (upload), at home ground (download) and lastly, the coordination between these two arenas (crossload). To achieve this, an extensively material on the subject was gathered by interviewing key persons from both Brussels and the subnational actors’ home organizations. In order to analyse the material, the theoretical framework multi-level governance was put into practice. The theoretical framework offered a definition on how the regions interact within the EU, and it also provided the framework for the analyses.  The study was able to unpack three Swedish subnational actors’ EU approaches and their different forms of organization regarding their work with EU. In addition, the study could for each explored arena set up a collection of criteria’s that Swedish subnational actors must achieve in order to succeed with their strategic work with EU. Those criteria’s, with numerous important subheadings, were categorised as effectiveness, legitimacy, and strategical selection.

Transnational Private Authority in Education Policy: A Case Study of Microsoft Corporation in Jordan and South Africa

This thesis presents a case study of Microsoft Corporation’s Partners in Learning (PiL) program, an example of transnational policy authority in education, with two embedded case studies of PiL in Jordan and South Africa. The constructivist and rationalist approaches highlight the changing nature of governance through the cultural and strategic shifts that led to Microsoft’s policy role in education. Microsoft’s strategic profit interests and its corporate-social-responsibility aspiration to play a policy role in education influenced its educational footprint. From a top-down perspective, Microsoft used supranational forms of power by implementing its global PiL blueprint through similar PiL programs worldwide. From a bottom-up perspective, Microsoft used “localization practices” by engaging different subnational agents and used different strategies to gain footholds in two very different political and policy contexts. Microsoft’s top-down and bottom-up approaches link the supranational policy arena to the subnational or subgovernmental. Microsoft’s economic power and strategic engagement gave it entry into education. It gained expert authority from its extensive history and experience in education. Its expert authority was experessed through strategic relationship building through diplomacy and partnerships, policy networks, and the sharing of best practices. The company was however not able to claim absolute legitimacy because of resistance in both countries. This thesis highlights that at the governmental level, sovereignty does not disappear when transnational corporations become involved in education at the national level. Instead, nation- states become strategic sites for the restructuring of global policy roles. The Jordanian government became a public facilitator, by working with Microsoft to implement a stand-alone PiL program. The South African government became a public integrator, by implementing the PiL program within government policies and programs. Power was also redistributed within both countries, moving away from government education officials towards the monarchy in Jordan and the presidency in South Africa. The findings of the study highlight the need for corporations engaged in public education to be governed within instituted accountability measures, for appropriate partnership frameworks, and for governance tools that can both effectively engage companies in education and ensure that they work within common goals and values set out by international education organizations.
