A hip?tese inicial lan?ada pela pesquisa ? a da exist?ncia de uma ordem espacial pr?pria. Mas tamb?m procurar compreender quais s?o as determinantes para o desenho da ocupa??o e do espa?o da moradia; qual ? a rela??o que ele estabelece com o arranjo familiar, com a legisla??o, com o imagin?rio que se constr?i a partir das refer?ncias dos grupos que se estabeleceram nestes territ?rios. Destarte, a utiliza??o de instrumentos jur?dicos sofisticados, fruto de uma adequada estrutura??o do crescimento pol?tico-econ?mico nacional, ? essencial para conceder ao Estado meios adequados para a promo??o do homem, conforme seus valores b?sicos de ser humano digno e necess?ria interpreta??o constitucional de um sistema jur?dico, em determinado tempo e lugar. Com esta premissa, - e a necess?ria interpreta??o conforme os valores constitucionais - elege-se o instituto jur?dico do controle da regula??o econ?mica dos servi?os p?blicos pelo Estado, com fins de prote??o ao cidad?o, para an?lise desta ordem estatal ideal. Assim, o primeiro capitulo deste texto trata do principio fundamental da inafastabilidade da presta??o da tutela jurisdicional pelo Estado, apontando sua origem e aplicabilidade. Ap?s, apresentar-se o objeto do controle ora estudado: a regula??o econ?mica. Analyses of global production networks and value chains have focused mainly on companies, without considering the role of work and institutions indirectly linked to the means of production. The most widely used theoretical scope to address the issue of including local producers in global supply chains is the Global Value Chain. Some authors may argue that the GVC is not a theory but an analytical framework, that can be used within different theoretical approaches. However, to evaluate social up/downgrading, it was necessary that the initial analytical framework was complemented by a social network approach, in order to understand the interrelationship between all parts that influence the organization of local production, including issues related to legislation, trade unions and social protection. This research project aims to contribute to the understanding issues applied to the agricultural sector, investigating the relationship between firm economic upgrading and social upgrading regarding rural workers and small farmers, based on the assumption that economic upgrading does not necessarily lead to social upgrading. The study object is the productive organization of the irrigated region Petrolina / Juazeiro, which includes large commercial farms, large, medium and small farmers, multinational businesses and has its production focused on domestic and international markets. It was found that the inclusion of a productive region in global supply chains through value-added activities, obtains through technical capacity and standards aiming the international market, can benefit large and medium producers, but usually leads to exclusion of small farmers with low investment capacity, mainly family holders. On the other hand, the achievement of economic upgrading does not immediately imply in social upgrading to rural workers and small farmers, nor is guaranteed by the influence of the leading firms at the global supply chain. Obtaining social upgrading it is strongly related to the existence of an institutional and legal framework, that ensures voice and bargaining power by workers. This arrangement is highly influenced by the presence of a public administration with a focus on the pursuit of social equity and by de convergence of domestic and international markets. / O maior desafio para promover condi??es decentes de trabalho (segundo a organiza??o Mundial do Trabalho) associados a cadeias de produ??o integradas com mercados globais ? gerar ganhos que beneficiem tanto empresas quanto trabalhadores. As an?lises de redes de produ??o global e cadeias de valores t?m focado principalmente em empresas, sem considerar o papel do trabalho e de institui??es indiretamente ligadas ao meio de produ??o. O escopo te?rico mais utilizado para tratar a quest?o de inser??o de produtores em cadeias de suprimento globalizadas ? o Global Value Chain, que, recentemente, sofreu uma amplia??o para dar conta n?o apenas de quest?es econ?micas, mas tamb?m de quest?es sociais. Alguns autores argumentam que o GVC n?o ? um referencial te?rico e sim uma abordagem anal?tica que pode ser usada dentro de diversos enfoques te?ricos. No entanto, para dar conta da avalia??o de ganhos/perdas sociais foi necess?rio que o referencial anal?tico inicial fosse complementado por uma abordagem de rede social de forma a perceber o inter-relacionamento entre todos os atores que influenciam na organiza??o da produ??o local, incluindo quest?es relacionadas ? legisla??o, sindicalismo e prote??o social. Este projeto de pesquisa visa contribuir para a compreens?o de um quadro anal?tico aplicado ao setor agr?cola, que possa investigar o relacionamento entre as melhorias econ?micas obtidas por empresas e melhorias sociais dos trabalhadores rurais e pequenos produtores, partindo da suposi??o de que melhorias econ?micas n?o necessariamente levam a melhorias sociais. O objeto de estudo ser? a organiza??o produtiva da fruticultura no Brasil, atrav?s de pesquisas de campo conduzidas nos per?metros irrigados de Petrolina/Juazeiro, que comporta grandes fazendas comerciais, grandes, m?dios e pequenos produtores rurais, multinacionais e que tem sua produ??o voltada tanto aos mercados dom?sticos como internacionais. Responsiones Vadstenenses : Perspectives on the Birgittine Rule in Two Texts from Vadstena and Syon Abbey. A Critical Edition with Translation and Introduction

Syon Abbey, established as the first Birgittine monastery in England in 1415, quite soon became a powerful institution within the order. Although often asserting their own conceptions of the Rule, the English Birgittines still sought the advice of Vadstena, their mother house, when it came to certain important matters concerning monastic life. The present work contains editions of two Latin texts: Responsiones, a document consisting of 175 questions and answers on the Birgittine Rule and daily life in the monastery, and Collacio, a sermon reflecting similar matters. The first part of the Responsiones consists of answers to five questions, sent from Syon to Sweden by letter. An important issue concerns the leadership in the monastery and the role of the Birgittine brothers. Were they to be seen as monks, living in their own monastery, or as religious assistans to the sisters? The second part was written as a direct result of two English brothers visiting Vadstena in 1427 and contains 170 questions and answers dealing with various matters of importance: how to interpret certain Birgittine texts, regulations on food, silence and speech as well as questions on preaching, liturgy and introduction into the monastery. The Collacio, in the manuscript said to have been presented to the Swedish community, was probably written by Syon’s conservator, the Benedictine abbot John Whethamstede of St Albans. Written in a highly metaphorical language rich in references to the Bible and Classical authors, the message to the Birgittine order is clear: first, it is wrong to have two leaders (confessor general as well as abbess) in one community; second, the Birgittines should strive to dispose of later additions and explanations and seek the original and true intentions of the foundress, Saint Birgitta. The thesis contains an introduction, editions with translations, glossary, indices, bibliography and plates.

This deep change in the legal regime of oil sector brought the possibility of entrance to small and medium size producers in this industry, especially through the production activities developed in mature and marginal fields of oil, which are located mainly in northeast region of Brazil. Considering that the intervention of state over the economy finds its guidelines and limits in Federal Constitution disposals, the present work investigated in which way states regulation, mainly through taxation rules, has obeyed the constitutional regime in force, and specially, the reduction of regional inequalities principle. By mean, firstly, of an analysis of central concepts (mature fields, marginal fields, small and medium size producers) we observed that the imprecision over the conceptual aspect has constituted an obstacle to a specific states‟ regulation, directed to this newborn class of producers, whose growth has been pursuit by the state. That is verified in the case of concession procedures, and also, concerning the taxation system applied to small and medium size producers. Examining the main constitutional principles related to this universe which are the legality, equality, privileged treatment to small enterprises, contributive capacity, and reduction of regional inequalities we conclude that it is legally possible, a truly specific regulation, including a special taxation regime, to the small and medium size producers whose activities are concentrate over mature-marginal fields, aiming the concretization of the Brazilian state main goals / No contexto de desestatiza??o que permeou a economia brasileira na d?cada de 1990, surgiu a Emenda Constitucional 9/95, que deu contornos mais flex?veis ao monop?lio da Uni?o sobre o petr?leo. Tal modifica??o no regime jur?dico do setor petrol?fero trouxe a possibilidade de inser??o de pequenos e m?dios produtores, sobretudo no ?mbito da produ??o em campos maduros e marginais de petr?leo, os quais se situam majoritariamente na regi?o Nordeste. Considerando que a interven??o do Estado sobre o dom?nio econ?mico encontra diretrizes e limites postos pela Constitui??o Federal, o presente trabalho investiga de que forma a atividade regulat?ria do Estado, principalmente por interm?dio de normas tribut?rias, tem se conformado ao regime constitucional vigente e, em especial, ao princ?pio da redu??o das desigualdades regionais. For in such a way, it was done a retrospect on the evolution of the system of road transport in Brazil, having started to briefly analyze the urbanization process that if after accented in the capitals of the Brazilian States the decade of 1950, relating these subjects with the growth of the sector of fuel resale. After that, it was transferred boarding of the defense of the national environment to the light of ambient principles constitutional. In the sequence, a boarding on the ambient guardianship in the Federal Constitution of 1988 was made, treating basically specifies and on the national urban politics and the national politics of the environment, with its instruments. In the sequence, it was transferred the analysis of the abilities and attributions of the National Advice of the Environment (CONAMA) and its Resolutions, for then only enter in the most important part of this work: an analysis of the environmental licensing of ranks of fuel resale, in the reality of the City of Natal/RN. Before this specific boarding, it was proceeded specifically a survey and communication from the applicable norms to such establishments (Resolutions of the CONAMA and norms of the ABNT), for after that carrying through an geo-ambient characterization of the City of Natal/RN. Finally, a reflection was made on the possibility of magnifying of the state activity, in terms of guarantees for the responsible members for the environmental policy and of administrative efficiency, through the idea of the ambient regulation. For the accomplishment of this study, it was proceeded research in diverse sources such as books, magazines, sites of the Internet, periodicals, thesis and dissertations, among others material, beyond visits the agencies that direct or indirectly act with the ambient defense and as fuel resale, such as Secretariat of Environment and Urbanism of the City of Natal (SEMURB), Institute of Economic Development and Environment of RN (IDEMA), Brazilian Institute of the Environment and the Natural resources You renewed, Executive Management of RN (IBAMA/RN), Public prosecutor's office of the Environment of Natal (Public prosecution service of the RN), National Agency of Oil (ANP) and Union of the Retailing of Derivatives of Oil of the RN, among others. To the end, satiated regulation is observed that although on the substance of the ambient licensing in ranks of fuel resale, also with federal, state and municipal norms, the municipal Public Power is very far from the fulfilment of its institutional functions, in the question environmental policy of these establishments, a time that few are the permitted ranks of resale in the city of Natal/RN / Esta disserta??o aborda a quest?o do procedimento administrativo do licenciamento ambiental de postos de revenda de combust?veis, tomando-se como base um estudo de caso da realidade do Munic?pio de Natal/RN. Para tanto, partiu-se de um retrospecto sobre a evolu??o do sistema de transporte rodovi?rio no Brasil, passando a analisar brevemente o processo de urbaniza??o que se acentuou nas capitais dos Estados brasileiros ap?s a d?cada de 1950, relacionando estes temas com o crescimento do setor de revenda de combust?veis. Em seguida, passou-se a abordagem da defesa do meio ambiente nacional ? luz de princ?pios constitucionais ambientais. Na seq??ncia, foi feita uma abordagem sobre a tutela ambiental na Constitui??o Federal de 1988, tratando especifica e basicamente sobre a pol?tica urbana nacional e a pol?tica nacional do meio ambiente, com seus instrumentos. Na seq??ncia, passou-se ? an?lise das compet?ncias e atribui??es do Conselho Nacional do Meio Ambiente (CONAMA) e de suas Resolu??es, para s? ent?o adentrar na parte mais importante do trabalho: uma an?lise do licenciamento ambiental de postos de revenda de combust?veis, na realidade do Munic?pio de Natal/RN. Antes desta abordagem espec?fica, procedeu-se a um levantamento e explana??o das normas aplic?veis especificamente a tais estabelecimentos (Resolu??es do CONAMA e normas da ABNT), para em seguida realizar uma caracteriza??o geo-ambiental do Munic?pio de Natal/RN. Brevard Childs : the logic of scripture's textual authority

Brevard Childs argues for the inner logic of scripture’s textual authority as an historical reality that gives rise to the material condition by which the church apprehends and experiences God in Christ. The church’s use of (or by) scripture thus has a larger interiority: the shaped canon of scripture, Old and New Testaments, is a rule of faith which accrues authority in the church, through the vehicle of the sensus literalis. Childs’ work has been misplaced, however. Part one locates it internationally, attending to the way it has been read in English and German and finding that it has enjoyed a more patient reception in Europe than in Britain or North America. To illustrate, Childs’ definition of biblical theology is contrasted with that of James Barr. Their differences over gesamtbiblische theology involve opposite turns toward and away from Barthian dogma in biblical inquiry. Part two examines Childs on biblical reference, introducing why intertextuality is not midrashic but deictic—pointing to the res. This coincides with an understanding of the formation of biblical literature. Childs’ argument for canonical shaping is juxtaposed with Hermann Gunkel on tradition history, showing “final form” to be a deliberate inversion of form critical principles. Childs’ interest in the Bible as religious literature is then set alongside his studious confrontation of Judaism, with implications for inter-religious dialogue. Barr and Childs are compared again in part three, which frames their respective senses of indirect and direct biblical reference in terms of allegory. Both see allegory at work in the modern world under certain rules (either biblical criticism or the regula fidei). Their rules affect their articulations of trinitarian dogma. Finally, Psalm102 highlights divergences between modern and pre-modern interpreters. If scripture comprehends the present immediately, some postures of the church toward the synagogue may be excluded.

States have left the direct coordination of these markets (chiefly public utility sector in the form of monopolies), introducing regulation in order to promote competition. These changes have affected natural gas industry by promoting competition as a key factor to the development and the increase of firms in this market. The regulatory reform of natural gas industry ocurred in EUA and Europe Union and it has produced its first results. In Brazilian context, Constitutional Amendment nbr. 09 and Federal Law nbr. 9.478/97 ( Petroleum Law ) opened the natural gas market to a broad range of private economic agents and they finished the monopoly over the industry before managed by Petrobras. The new regulatory framework of Brazilian natural gas industry has designed competition as a central element to the new form of managment of business and contractual relationships of this industry. Among the regulatory instruments, open access regulation in natural gas pipelines is directed to promote competition. The questions arised about its implementation in Brazilian context are studied in the present work, in which it is discussed the constitutional rules and principles are to be applied to the open access regulation within the theme of statal regulation of economy present in constitutional economic order / No movimento de mudan?as sociais capitaneados pelo capitalismo global e pelo discurso neoliberal, t?m sido promovidas no mundo reformas nos chamados setores de infra-estrutura (antes geralmente geridos de forma direta pelo Estado sob a forma de monop?lios) no sentido de se introduzir uma regula??o que promova a concorr?ncia. Desses setores a industria do g?s natural vem sofrendo reformas institucionais relevantes que procuram retirar-lhe caracter?sticas monopol?sticas e permitir, dessa maneira, o aumento dos agentes nesse mercado. Em alguns paises essas transforma??es na industria do g?s natural encontram j? seus resultados (EUA e Uni?o Europ?ia). O Brasil tem promovido reformas no setor de g?s desde a Emenda Constitucional n? 09 e a Lei 9.478/97, abrindo as portas do mercado brasileiro de petr?leo e g?s para os investimentos privados, criando um cen?rio onde a Petrobr?s n?o est? mais sozinha na execu??o de atividades da cadeia do petr?leo e g?s natural. La règle d'Augustin : parole rassemblante? (354-397)

Bien des études ont été faites sur Augustin et pour cause. La vie et l'œuvre de ce grand et saint Père de l'Église est si riche et si dense qu'il est encore possible aujourd'hui d'étudier chez celui-ci des aspects nouveaux. Nous connaissions Augustin comme un homme qui avait à plusieurs reprises contribué à la résolution de crises secouant l'Église. Ses interventions dans les crise arienne, pélagienne et donatiste ont été très bien étudiées quantitativement et qualitativement. Mais curieusement les experts ont peu étudié la première intervention majeure d'Augustin dans la période critique qu'a vécue le monachisme en Occident dans la seconde moitié du IVe siècle. Beaucoup étudiée dans son contenu, la Règle de saint Augustin n'a pas bénéficié de la même attention quant au contexte historique qui l'a vu naître et quant à ce qu'elle peut nous apprendre sur l'homme qui en est l'auteur. Cette «heureuse» carence nous a motivé à y remédier en rappelant l'histoire qui a conduit Augustin à écrire cette Regulce. Il fallait donc raconter, en sélectionnant les événements-repères de la deuxième moitié du IVe siècle (356-397), l'évolution critique du monachisme occidental, de même que l'histoire propre d'Augustin de sa naissance (354) à la rédaction de sa Règle (397). Comme nous partagions la thèse voulant que la Règle soit bien d'Augustin et sa date de publication aux alentours de 397, nous nous sommes interrogés sur la nature de cette intervention augustinienne. En d'autres mots, comment peut-on qualifier cette œuvre majeure d'Augustin au terme d'une étude du contexte particulier et général qui l'a vu naître? Pourrait-on parler d'une parole rassemblante? Par l'étude du contexte historique de la Règle, de manière à montrer les influences qui ont abouti à sa rédaction, et par l'analyse de passages de la Règle, la réponse à cette question est positive. C'est ce que s'attachera à démontrer la conclusion finale.
