Influence des concentrations sur l'achèvement et le fonctionnement de marché intérieur de l'énergie / Influence of concentrations on the completion and operation of the internal energy market

La réalisation du marché intérieur de l’énergie constitue le moyen de diminuer le coût de l’énergie pour les consommateurs tout en assurant d’autres objectifs tels que la sécurité d’approvisionnement. Toutefois, les marchés européens du gaz et de l’électricité connaissent de nombreuses défaillances identifiées par la Commission dans son rapport résultant d’une enquête sectorielle lancée en 2005. Les directives de libéralisation ne suffisant pas, elle prône une application renforcée du droit de la concurrence, en particulier du droit du contrôle des concentrations. L’objet de cette étude est dès lors d’analyser l’utilisation de ces règles dans le cadre du processus de libéralisation des marchés énergétiques en Europe.Après une explication de la vague de concentrations ayant eu lieu dans le secteur énergétique sous l’impact de la libéralisation et du contexte qui l’entoure, on s’intéresse à l’utilisation des règles du contrôle des concentrations. Cette étude tente de mettre en exergue l’utilisation orientée de ses règles. Les Etats membres tout d’abord tendent à favoriser les opérations de concentrations se produisant entre des entreprises nationales tout en posant des obstacles aux opérations impliquant l’entrée sur leurs territoires d’acteurs étrangers.La Commission quant à elle favorise les concentrations de nature transfrontalière afin d’aider à la réalisation du marché intérieur et au développement de l’aspect concurrentiel de ce marché. Pour ce faire, elle a recours à un outil particulier : les remèdes. De tels rapprochements entre entreprises favorisant le marché intérieur, il n’est pas dans l’intérêt de la Commission de les interdire. Les remèdes permettent d’éliminer les effets négatifs qui pourraient résulter d’une opération de concentration. Cette étude propose une analyse des différents remèdes ayant été acceptés par la Commission afin de résoudre un problème de concurrence. / The completion of the internal energy market is the way to reduce energy costs forconsumers while providing other objectives such as security of supply. However,European gas and electricity markets are experiencing many failures identified by theCommission in its report published in 2007. The Commission advocates a strongerapplication of competition law, in particular the rules of merger control because theliberalization directives was not enough. Therefore the purpose of this study istherefore to analyze the application of those rules in the process of liberalization ofenergy markets in Europe.After an explanation of the merger wave that occurred in the energy sector under theimpact of liberalization and the environment that surrounds it, we are interested in theapplication of the rules of merger control.In this scope we will see that the Commission encourages the concentration of crossbordernature to help build the internal market and to develop the competition. Torealize this objective, the Commission uses a particular tool: the remedies. Theremedies can eliminate the negative effects that could result from a merger. Thisstudy provides an analysis of the various remedies that have been accepted by theCommission to resolve the problems of competition.

Incarceration and Reintegration: How It Impacts Mental Health

ABSTRACT Background: Previous criminal justice policies have been non-effective leading to overpopulated prisons and unsuccessful reintegration. There is a lack of effective supportive and/or rehabilitative services resulting in high rates of recidivism and mental health implications. Objective: This study investigated the perceived impact that incarceration and reintegration with little to no supportive and/or rehabilitative services has on the mental health status of an individual. The emphasis was on participant perception and not on professional reports because of underreporting and lack of attention to mental health in the criminal justice system. Methods: Focus groups in the Inland Empire and Coachella Valley were held to gather preliminary data used to develop the survey for this study. The survey was distributed to 88 male and female ex-offenders over the age of 18 who were no longer on probation or parole. Secondary data from United Way 211 and California State Reentry Initiative was collected to report current trends of supportive and/or rehabilitative services. Results: Incarceration was found to negatively impact perceived mental health status, but reintegration was not. Supportive and/or rehabilitative services continue to be rarely offered and accessed, but when accessed, perceived mental health status is better. Supportive and/or rehabilitative services are more readily available. People who are using these services are improving their quality of life, becoming productive members of society, and preventing recidivism. Conclusions: A paradigm shift is currently under way to reduce recidivism by improving supportive and/or rehabilitative services during incarceration and reintegration. Many offenders are receiving services as an alternative to incarceration, recidivism rates are being reduced, and ex-offenders are becoming productive members of society. The field of social work is an integral part of reentry services and should continue advocating for policies and services that support reintegration efforts at the micro and macro level.

La riduzione delle barriere tariffarie ha spostato il dibattito tra gli esperti di commercio internazionale sulle misure protezionistiche alternative (regole d'origine, proprietà intellettuale etc.). inoltre durante gli ultimi dieci anni la proliferazione degli accordi commerciali regionali ha acuito i timori di coloro che ritengono che la strada verso la liberalizzazione dei flussi commerciali internazionali debba passare attraverso l'OMC. questa tesi analizza il nesso tra i rimedi di difesa commerciale, le barriere tecniche al commercio e gli accordi commerciali regionali mediante un esercizio di mappatura di 53 accordi. tale mappatura è sviluppata mediante l'impiego di tabelle che riassumono il contenuto di ogni accordo per quanto concerne le barriere tecniche al commercio e i rimedi di difesa commerciale. Inoltre il presente lavoro effettua una ricognizione della letteratura empirica e teorica sull'argomento fornendo infine un contributo originale mediante l'utilizzo di un modello probit per l'analisi dei dati raccolti. i risultati ottenuti in parte confermano ed in parte smentiscono, a volte anche in maniera contro-intuitiva, alcuni fatti stilizzati dalla letteratura. / The reduction of tariff duties at multilateral and regional level has shifted the focus of international trade debate to other beyond-the-border protectionist measures (i.e. rules of origin, intellectual property, trade remedies etc.). Further during the last ten years the proliferation of regionalism has increased more and more the concern in the supporters of multilateral trading system. This thesis explores the linkages among trade remedies, technical barriers to trade and regional trade agreements. This analysis is performed through the creation of 4 benchmarking exercises (templates) mapping the provisions relevant to antidumping measures, countervailing duties, safeguards measures and technical barriers to trade included in 53 regional trade agreements. The aim of this thesis is to overview both theoretically and empirically the existing relevant literature in order to supply an original contribution to the understanding of the subject. The collection and the processing of the data offer some insight and, sometimes, counterintuitive findings about the modelling of trade remedies and technical barriers provisions in the regional trade agreements.

In the first part of the article, a development for the concepts of provisional remedies and real or personal property bond and covering loss and damage, is proposed, under the Constitutional Court and our national doctrine view; as well as the scope of the first as a fundamental right, and second as a condition of execution. On the following part of the paper, the inclusion and the subsequent amendments to the article 159° of Tax Code is exposed, also its scopes and reasons. Finally, a possible modification of the article, that respect state´s raising goals and due process citizens’ right, is proposed. / El presente artículo desarrolla los conceptos de medida cautelar y contracautela, a la luz de lo resuelto por el Tribunal Constitucional y lo establecido por nuestra doctrina, así como los alcances del primero como derecho fundamental y del segundo como requisito de ejecución. De la misma forma, se analiza los alcances de la incorporación del artículo 159° del Código Tributario, mediante Decreto Legislativo N° 1121, y su modificatoria a través de la Ley N° 30230. Finalmente, se propone una posible modificación al mencionado artículo, de conformidad con los fines recaudatorios del Estado y el derecho a la tutela jurisdiccional efectiva de los administrados.

Remedies for dissenting shareholders : a comparison of the current option of personal action and the proposed appraisal remedy under the companies bill of 2008

Thesis / The Companies Bill B61-2008 proposes to introduce appraisal rights into South African law. Appraisal entitles a shareholder to demand payment from the corporate issuer of his shares at a fair cash value in certain instances where major transactions which would change the company's direction have been proposed. It allows a cash exit rather than being coerced into supporting the majority's decision. Arriving at a fair share value is a challenge to appraisal. Presently, under the Personal action, a shareholder who opines that the company's act or omission is unfairly prejudicial or that its affairs are conducted in an unfairly prejudicial manner, may apply to court for an appropriate order. It enables the minority to challenge the majority's decision. Both remedies will be available to dissenting shareholders under the new dispensation and a shareholder must decide which remedy best suits his purposes. As the living law may be influenced by the measure of westernisation that took place, a micro study has been carried out in a semi-urban area in order to ascertain whether own value judgments are replaced or substituted when Western legal institutions are used. Information has been collected by way of interviews with a panel of knowledgeable men and women and controlled by reference to available literature. An attempt was made not only to identify and define legal principles, but also to take note of those cultural institutions and social processes functioning outside the law. Although it is possible to identify the general principles of delict as well as several subjective rights that may be infringed, the peculiar nature of delict must be borne in mind and set off against the unspecialised nature of indigenous law. The indigenous law of delict shows clear signs of adaptation to new circumstances, but there is evidence of the retention of proven legal principles and human values. / Private Law / L.L. D.

Tick control practices in communal Tsholotsho

This study assessed the use of indigenous acaricides in Tsholotsho, Zimbabwe. An observational study design plus laboratory analysis were used in this study. Data on demographic profiles and tick control practices in 21 villages was collected using a questionnaire. Seven hundred and fifty nine (n=759) ticks were collected from cattle using systematic sampling at 15 dip tanks. Marula efficacy was assessed using pregnancy, repellence and mortality tests. Farmers used several tick control remedies (physical removal, chemicals, and plant and animal extracts), some of which have potential to harm the health of the public. Marula caused significant decrease in mass among pregnant ticks (p<0.05), had a significant kill percentage (p< 0.05), and also repelled, killed and hindered egg laying. The active ingredients in marula formulations should be investigated. The extra-label use of conventional acaricide, and the use of compounds with potential to harm the public health needs to be regulated. / Environmental Sciences / M. Sc. (Agriculture)

La réparation des dommages causés aux particuliers est une thématique ancienne en droit international. Toutefois, elle a été longuement appréhendée au seul prisme des relations interétatiques, l’individu n’étant perçu que comme un objet du droit international. Le bouleversement introduit par la protection internationale des droits de l’homme quant au statut de l’individu dans cet ordre juridique invite donc à une relecture de cette question. Les obligations substantielles contractées par les Etats en matière de protection internationale des droits de l’homme devraient logiquement trouver un prolongement dans l’existence d’une obligation de ces derniers de réparer les dommages causés aux particuliers. Or, l’identification d’une telle obligation s’avère délicate, tant au regard de ses créanciers que de son étendue. Sa réalisation est quant à elle laissée en grande partie aux mains du juge. Il s’avère donc malaisé de dégager un véritable régime juridique de la réparation des dommages causés par la violation des droits de l’homme. / The reparation of damage caused to individuals is a former thematic issue of international law. However, its development has been studied only from the point of view of interstate relations as soon as the individual was conceived and treated as an object, not as a subject of international law. The change, brought by the international protection of human rights relating to the status of individual, in this legal order, suggests to re-open the debate on this matter. As a result, the compelling obligations undertaken by member states regarding international protection of human rights, should logically lead to the existence of an obligation for the latter to repair the damage caused to the private individuals. But identifying such an obligation remains delicate both with regard to his creditors and with regard to its scope. Its implementation is left largely with the hands of the judge. It is therefore difficult to find a genuine legal regime for the reparation of damages caused by the violation of human rights.

L’objectif du travail effectué était la recherche de nouvelles substances actives d’origine végétale, présentant soit une activité antiplasmodiale soit une activité antifongique. Cette étude a été menée suivant deux stratégies différentes: l’étude de remèdes traditionnels antipaludiques identifiés suite à des enquêtes ethnopharmacologiques, et la mise en évidence des propriétés antifongiques d’huiles essentielles grâce à une stratégie bioinspirée. La première partie du travail a permis de mettre en évidence le rôle d’un quassinoïde connu, la simalikalactone D, dans l’activité antipaludique d’une tisane de jeunes feuilles fraîches de Quassia amara L. (Simaroubaceae). Dans le cas de la décoction de rameaux de Psidium acutangulum DC. (Myrtaceae), c’est cette fois un mélange de flavonoïdes glycosylés qui est responsable de l’activité du remède. Dans le cadre de la recherche de nouvelles substances antifongiques, le criblage effectué a permis d’identifier de nombreuses huiles essentielles présentant des activités intéressantes, validant ainsi la démarche bioinspirée retenue dans ce cas. L’huile essentielle d’Otacanthus azureus (Linden) Ronse a en particulier démontré une activité remarquable, à la fois seule et en combinaison avec des antifongiques azolés. Enfin, l’étude métabolomique de la composition des huiles essentielles a permis de mettre au point un outil pouvant orienter la sélection des huiles en fonction des données obtenues en GC/MS dans l’optique de la recherche de nouvelles substances antifongiques. Ce travail démontre donc la validité des stratégies retenues – ethnopharmacologie et bioinspiration – dans la recherche de nouvelles substances bioactives. / The aim of this work was to search for new bioactive compounds, displaying either antiplasmodial or antifungal activity. Two strategies were developed here: the evaluation of traditional remedies identified as antimalarial through ethnopharmacological studies, and the search for antifungal essential oils, the criterium being here a bioinspired approach. Our work led to the discovery that the antimalarial activity of Quassia amara L. (Simaroubaceae) fresh young leaves was due to the presence of a known quassinoid, simalikalactone D. In the case of Psidium acutangulum DC. (Myrtaceae), a flavonol glycosides mixture explained the activity observed for the decoction. The search for antifungal essential oils from the Amazonian flora led to the identification of several interesting species, thus validating our bioinspired strategy. The essential oil of Otacanthus azureus (Linden) Ronse was among the most active ones, either alone or in combination with azole drugs. Eventually, a metabolomic study of the GC/MS composition of these oils allowed us to develop a statistical tool which could help to select interesting antifungal products. This work thus demonstrates the major interest of the two strategies – ethnopharmacology and bioinspiration – for the search of new bioactive compounds.
