El presente trabajo de investigación tiene como finalidad identificar si existe o no Acoso laboral o Mobbing en contra de los trabajadores de la empresa Ocean Pacific S.A.C. Para tal efecto, se presentará un completo sondeo de todos los trabajadores de dicha empresa, para cuya realización se acogió en estricto el cuestionario denominado LIPT-60 (Leymann Inventory of Psychological Terrorization), creado por el más importante estudioso y destacado psicólogo que ha dedicado buena parte de su vida a investigar el Mobbing, su afectación en contra del colaborador y el entorno en el que se puede manifestar, el Dr. Heinz Leymann. Con ello no solo se pretende determinar o no la existencia del Mobbing o Acoso laboral en los trabajadores de Ocean Pacific S.A.C., sino también en qué medida dicho fenómeno afecta su desempeño laboral, si están o no sujetos a continuos actos de discriminación y las consecuencias psicosociales a los que se encuentran expuestos; actos que en buena cuenta los obliga a ausentarse del lugar de trabajo. Todo ello con el único propósito de demostrar que, subsiste la necesidad de crear un procedimiento tutelar de protección al trabajador sujeto a dicha afectación, teniendo en consideración que el Mobbing o acoso laboral a la fecha no se encuentra regulado en la legislación vigente, siendo el Perú uno de los Países de la Región que no toma conciencia de la urgencia de dicha regulación. / The purpose of this research work is to identify whether or not there is Labor Harassment or Mobbing against the workers of the company Ocean Pacific S.A.C. For this purpose, a complete survey of all the workers of said company will be presented, whose realization strictly incorporated the questionnaire called LIPT-60 (Leymann Inventory of Psychological Terrorization), created by the most important scholar and outstanding psychologist who has dedicated a good part of his life to investigate the Mobbing, its affectation against the collaborator and the space or ambient in which it can manifest itself, Dr. Heinz Leymann. This is not only intended to determine or not the existence of Mobbing or Workplace Harassment in the workers of Ocean Pacific SAC, but also to what extent this phenomenon affects their work performance, whether or not they are subject to continuous acts of discrimination and psychosocial consequences to those who are exposed; acts that in good account force them to leave the workplace. All this with the sole purpose of demonstrating that, there remains a need to create a protective procedure for protection of the worker subject to such affectation, taking into account that the Mobbing or labor harassment to date is not regulated in current legislation, being the Peru one of the Countries of the Region that is not aware of the urgency of said regulation. / Trabajo de Investigación

Dans une recherche-action menée au sein de La Poste, nous problématisons le rôle d’une « communication organisante » dans la prévention des risques psychosociaux liés à un changement : « l’acculturation au numérique ». Dans cette thèse, nous revenons sur les différentes transformations opérées au sein de La Poste depuis sa création, et nous nous intéressons au rôle de la communication dans l’accompagnement de ces dernières, plus particulièrement avec le « Grand Dialogue » se présentant comme « une démarche inédite en faveur du bien-être au travail ». A l’issue de nos recherches, il apparaît qu’une majorité des collaborateurs n’est pas en difficulté dans ses usages du numérique, compte tenu des actions d’accompagnement à l’acculturation mises en place par la direction de la communication, grâce à ses différentes innovations. La communication des organisations se révèle donc être un facteur de protection des RPS de cette « acculturation au numérique », et vient par là même questionner son rôle en tant que contributrice de la citoyenneté. En effet, cet engouement des postiers pour les technologies numériques semble révéler que leur usage devient une nécessité pour tous et trouve une utilité au-delà de l’entreprise, dans leur vie quotidienne. Par ailleurs, la recherche-action vient mettre en lumière les enjeux mais aussi les limites de la prévention des RPS au sein de l’organisation, pour l’ensemble des collaborateurs, y compris pour les assistants sociaux. Ainsi, découvrons-nous comment ces collaborateurs atypiques mettent en place des stratégies d’usage des technologies numériques pour palier à une organisation et à des pratiques communicationnelles jusque-là frustrantes. / This text deals with digital literacy at the French Post Office Company. As the firm worried about stress at work, a “Grand dialogue” was organized to estimate this level and take actions against it. At the same time, using this corporate communication, the company settled the “Lean management” to change the organization. On this occasion, that was an opportunity for a social worker to join a working group and study with an action-research the consequences for workers on their mental suffering.Besides after considering the links between psychological risks and digital literacy, he showed that it was not true for the postal workers. Indeed the actions that had been put in place in the company were effective help and much more, that the communication of organisations is a protection against psychological risks and social exclusion.However the action-research shows that the social workers were actually suffering from psychological risks and then they had set up strategies by using technologies to get better.

La gestion des risques liés à la pollution médicamenteuse / The legal management of risks linked to medicinal drugs pollution

Cette thèse traite la gestion juridique des risques liés à la pollution médicamenteuse. Aujourd’hui les études scientifiques signalent l’émergence des résidus médicamenteux dans notre environnement. Néanmoins, des incertitudes subsistent quant aux risques réels de ces résidus sur la santé humaine et sur l’environnement. Dans ce contexte, la politique actuelle fait recours au principe de précaution pour une maitrise de ce polluant émergent, mais ces mesures sont en pleine gestation. Fort de ce constat, ce travail se soldera par un état des lieux des outils juridiques pouvant servir la gestion des risques sur l’ensemble du cycle de vie du médicament, depuis la création de la molécule médicamenteuse jusqu’à sa pseudo-élimination par les stations d’épuration. La démonstration s’attache en particulier à retracer la récente prise de conscience de la pollution médicamenteuse par la politique environnementale. Dans un premier temps, il s’agira de mettre en exergue l’émergence d’un nouveau risque généré par le médicament et son impact sur la politique de la santé publique. Dans un second temps, il sera question d’analyser les moyens préventifs entrepris récemment par le gouvernement. Par ailleurs, l’insuffisante appréhension juridique de l’impact environnemental généré par les résidus médicamenteux sera évoquée. Il s’agira de mettre l’accès, dans un premier temps, sur les lacunes relatives à la réglementation régissant le médicament en tant que polluant. Dans un second temps, les insuffisances réglementaires pour les activités génératrices de pollution médicamenteuse seront abordées. / This thesis deals with the legal management of risks related to drug pollution. Nowadays, scientific studies indicate the emergence of drug residues in our environment. Nevertheless, uncertainties remain regarding the actual risks of these residues on the human health and on the environment. Given this observation, current policy makes use of the precautionary principle in order to control this emerging pollutant, but these measures are in the making. In light of the above, this work leads to a review of the legal tools that can be used to manage risks throughout the life cycle of the drug, from the its creation’s molecule to its pseudo-elimination by treatment plants. More precisely, the demonstration attempts to retrace the recent awareness of drug pollution by environmental policy. In a first step, we highlight the emergence of a new risk generated by the drug and its impact on public health policy. In a second phase, we analyze the preventive measures that have been recently undertaken by the government. the lack of a legal understanding concerning the environmental impact generated by drug residues will be mentioned. First, gaps in the regulations governing the medicinal product as a pollutant are identified. Then, regulatory deficiencies for drug-generating activities are being addressed.

This thesis first introduces the basic notions of univariate survival analysis. Then the survival analysis setting is extended to competing risk models, i.e. the cases considering several events of interest or several causes of one event. In the competing risk model, we discuss the problem of identification, which means that it is not possible to identify marginal distributions from observed competing risk data. Next, we present copula models, which are a suitable mathematical tool for modelling dependence structure between random variables. We explain their basic characteristics, present some useful copula families and the relationship of copula parameters with certain dependence (correlation) measures. Further, we show the utilization of copulas within competing risks models and how they can be helpful in the solution of identifiability problem. The thesis presents fundamental characteristics of survival analysis in the case of competing risks and their relationships. In the case without regression, basic nonparametric estimates and a logarithmic likelihood function for parameter estimates is given. The main focus is on Cox's proportional hazards model (PH), a model with accelerated time (AFT) and a flexible regression model (FG) are also mentioned. The identifiability of the associated survival function is solved using copulas. Basics of copula theory and the measurement of dependence by correlation coefficients (Pearson, Spearman and Kendal) are described in a separate chapter. A substantial part of the theory is practically used in a generated case without regression.

My thesis Threats, risks and prevention of violent radicalization of individuals deals with the phenomenon of radicalization, especially with violent radicalization of an individual. The theoretical section provides current theoretical background with emphasis on contemporary models and theories of radicalization. Further attention is paid to an individual in the process of violent radicalization, risk factors and comparison of self- radicalization of lone assailants and radicalization of an individual within terrorist group or within mainstream society. Specifics of radicalization in Czech Republic, contemporary risks and possibilities of prevention of the phenomenon are also included. As a research method in the empirical part, whose aim was to map key knowledge about radicalization in Czech Republic and experience of refined experts in this area, I chose a qualitative research strategy. Research group consists of 12 experts in the field of psychology, Political Sciences, members of armed forces and academic scholars, touching the topic of radicalization in their field of work. The data was obtained through the series of semi-structured interviews. Learning about marine cloud brightening: detectability of field experiments, benefits and risks of implementation

The main objectives of the thesis are to learn about the detection of a hypothetical marine cloud brightening (MCB) field experiment and to assess the benefits and risks of an actual implementation using model simulations. The first aim of the thesis is to assess the detectability of MCB from the natural variability of clouds using satellite data. The analysis uses two approaches, i) an analytical method, assessing the radiative forcing by aerosol-cloud interactions for an idealised perturbation of the droplet concentration and ii) a stochastic method, including the radiative forcing and the cloud adjustment effects of perturbing the cloud droplet number concentration. One of the main findings of the study is that in the analytical method, detection of an MCB experiment in the North Pacific region requires longer duration, larger domain and larger intensity of the Nd perturbation than in the South Pacific and the South Atlantic regions. In the Stochastic method, larger domain size as well as longer duration are required for the detection of the hypothetical field experiments compared to the analytical method. We found that increasing the duration of the experiment and intensity of Nd perturbation has more influence in detectability than increasing the domain size. Secondly, we analyse the detection of MCB using ECHAM GCM simulations. Two methods are used for the analysis, i) a temporal method, using temporal reference of nine years for the analysis, and ii) a spatial method, where a surrounding unperturbed regions are used as a reference for the analysis. In the temporal method, the detectability of the MCB experiment over the North Pacific region is most difficult. Our calculations suggest that for an experiment to be cost effective, it is preferable to design an experiment of longer duration with smaller domain sizes as well as less intensity of perturbation of Nd. Finally, we investigate the effectiveness of MCB in alleviating the changes in the mean and extremes for surface air temperature and precipitation. We compare these results with another climate engineering technique, namely stratospheric aerosol injection. The study is based on an existing multi model simulation of three Earth system models. The main conclusion from the study is that the two solar radiation management techniques are rather effective in mitigating the climate change driven increases in the mean and extremes of temperature and precipitation according to the climate simulations. However, the potential to mitigate differs around the globe and seasonally. The strong increases in lower temperature extremes, especially in the Arctic, are not well dampened with the solar radiation management implementation.

The provision of an adequate liability regime for ADAS technologies is an essential prerequisite for its roll out over the coming decade. Facing to the challenge of future highly automated vehicles, this paper proposed a Human-Machine Transition (HMT) approach as a common conceptual framework for considering Human Machine Interaction (HMI), liability and ethical issues in a unified way. The issues that arise are interrogated from a legal perspective, more specifically liability regimes and that of applied ethics. The paper highlights the issue of the handover/takeover. Potential consequences for insurance companies are then identified accordingly, with the aim to progress towards the sustainable deployment of automated vehicles on public roads.
