The Effects of Juvenile Life Sentences on Family RelationshipsPigatt, Antoinette 01 January 2018 (has links)
Juveniles serving adult sentences are separated from their families for extensive amounts of time. During incarceration, youths attempt to maintain close relationships with family members, but are faced with challenges. The purpose of this multiple case study was to explore adult incarceration of youthful offenders and its effect on family relationships using Bowen's family systems theory as the theoretical foundation. Three Maryland families who have first-hand experience with the phenomenon were selected to share their stories. Through this study, to the family unit was given voice to assist understanding the experience from multiple perspectives. Interviews were conducted with each family member separately using semistructured protocols, triangulated, coded using open coding strategies, and summarized as case descriptions. Study results led to understanding that families experience different individual and collective adverse effects in relation to the experience. Families shared factors which contributed to breakdowns and resiliency of relationships between family members during and after the experience of incarceration of a youthful offender. Findings of this study support positive social change in human services and public policy. Outcomes of this inquiry support the efforts of advocates in promoting awareness and activism to encourage legislation and funding to serve the needs of this unique population. Findings inform policymakers of the need to promote policies and practices in correctional institutions that address concerns about unsafe and nontherapeutic prison environments, and the need to champion policies and practices that support families in maintaining healthy relationships with incarcerated individuals during and after long periods of incarceration.

Denna studie syftar till att, med hjälp av tematisk analys, undersöka hur kvinnor inom kriminella nätverk konstrueras i domar där krypterade chattar helt eller delvis ligger till grund för bevisningen. Den undersöker också om det finns skillnader vid jämförelse med män i samma domar. Utifrån ett socialkonstruktivistiskt perspektiv används genusteori som analysram där nyckelbegrepp såsom kön, genus, dikotomier och konstruktioner av genus används för att analysera studiens teman; Roll, Ansvar samt Karaktärsdrag. Dessa situeras i en bredare samhällskontext med utgångspunkten i att domar kan ses som meningsbärare, där konstruktioner kring de åtalade kvinnorna respektive männen i domarna problematiseras utifrån genusteoretiska utgångspunkter. Studiens huvudfynd visar att den största delen av empirin redogör för fakta snarare än konstruktioner av genus, men att det finns genuskonstruktioner både kring kvinnor och män som kan uttolkas i domarna. Ett viktigt fynd i förhållande till studiens genusperspektiv är det ansvar för andra som konstrueras i flera av narrativen kring de kvinnliga åtalade. Detta kan både vara en indikation på kvinnornas egna feminitetskonstruktioner och rättens reproduktion av traditionella femininitetsideal. Föreställningar om normativ femininitet och maskulinitet identifieras som att riskera att påverka rättens syn på kvinnors och mäns deltagande i kriminella nätverk, men också som ett sätt för, främst de åtalade kvinnorna, att positionera sig själva i förhållande till brotten de står åtalade för.

Recycled Wisdom: Maxims and Meaning Making in Late Antique and Medieval ChristianityDomach, Zachary January 2024 (has links)
Maxims, proverbs, and other forms of pithy sayings are sprinkled throughout ancient and medieval literature; polysemous and manipulable by nature, they serve as communicative tools whose precise meaning and function shifts from context to context. My dissertation explores how late antique and medieval Christians capitalized on the flexible forms of Greek and Latin aphorisms to negotiate and construct what it meant to be a Christian.
Using theories and methods developed in the fields of folklore, linguistic anthropology, and ethno- and sociolinguistics, I investigate three examples in which Christians revised and reused wisdom in new contexts. First, I document the proverbial concept of gathering something useful from somewhere dangerous as expressed in sayings like “to pluck a rose from among thorns” and “to gather gold from shit,” charting how it originally went viral in the late fourth and early fifth centuries, remained in vogue well into the Middle Ages, and continued to evolve in meaning throughout its usage.
I then analyze the Sentences of Sextus, a second-century collection of Greek maxims assembled from various Pythagorean aphorisms and sayings of Jesus. Whereas previous scholarship has focused on the authorship, content, and structure of the Sentences, I study the new meanings, functions, and forms the collection acquired as it underwent processes of translation, transcription, epitomization, excerption, and quotation. The text’s gnomic format and armchair morality contributed not only to its centuried popularity and widespread readership, but also to the dispersion of many of its individual sayings.
In particular, I consider the extensive and unstudied reception of the Sentences of Sextus within the mid-ninth-century legal forgeries known as the Pseudo-Isidorian Decretals. I show that the Sextine elements reveal the presence of recurring textual units across the Decretals and offer new insights regarding Pseudo-Isidore’s compositional method—a method that, in many ways, parallels the Sentences’ recycling of Pythagorean and biblical material. Ultimately, my project models how wisdom-centered investigations of late antique and medieval literature lead to new understandings of the craftsmanship of individual authors as well as to deeper understandings of the time and its culture.

Ce faisant, il est rapidement apparu que la détermination de la peine en droit de l'environnement par les tribunaux canadiens souffrait de certaines lacunes, principalement au niveau de l'importance accordée à l'objectif pénologique de la dissuasion. Cet accent indu menant à l'imposition de sanctions pénales aussi inefficaces qu'ineffectives, une nouvelle approche devait être offerte aux tribunaux canadiens. Il s'agit donc du second objectif du présent mémoire. S'inspirant de la philosophie de la justice réparatrice, une approche centrée sur la réparation de l'atteinte découlant de la commission d'une infraction environnementale est proposée aux tribunaux canadiens afin que la peine imposée puisse s'avérer aussi efficace qu'effective et s'harmoniser au particularisme du droit de l'environnement.

Die fokus van die studie wentel om die rehabilitasie van die oortreder en die vraag of hierdie doelwit binne die korrektiewe stelsel haalbaar is. Heelwat klem word op die noodsaaklikheid van alternatiewe vonnisse geplaas asook rehabilitasie as strafoogmerk tydens vonnisoplegging. Summaries in English and Afrikaans / The study explores the beliefs and wishes of respondents in Pretoria concerning crime seriousness and criminal sentencing in South Africa. It is suggested that in a democracy, the legal system must reflect the values of the individual citizen if it is to achieve a legitimacy based upon the concepts of moral consent and universality, and argues that this can only be achieved when all citizens have a voice. The study undertakes and reports on a survey of 400 units, across race divisions in and around the City of Pretoria by initially emulating, and thereafter extending, the British Crime Survey. The thesis offers seven chapters divided into two primary components. The first component, chapters one to four, systematically debate the historical/theoretical foundations of sentencing practice (both globally and in respect of South Africa), and identifies the inherent problems faced by contemporary criminal justice systems. The study utilises sentencing literature to provide an in-depth appraisal of theoretical paradigms and, thereafter, evaluates the successes and failures of various sentencing options. The second component, chapters five to seven, unpack the Pretorian research in relation to various other foreign research surveys, and culminates by offering a South African sentencing guide (severity index) based upon the research findings. The findings identify the people of Pretoria to be punitive. Respondents are shown to regard rape and driving whilst over the legal alcohol level causing the death of an innocent victim as
the most serious crimes, followed by deliberate murder, selling illegal drugs and terrorism. Percentage differential between these "most serious" crimes is negligible. Many respondents indicate long prison sentences or the death penalty for these specific offences. Overall,
Blacks prefer imprisonment whilst Whites are shown to be more conservative and more amenable to other sentencing options. Gender differences in relation to seriousness and sentence scores are slight, but females and the older age group are noted to be more fearful
of being victimised even though this fear is not supported by actual victimisation rates. The study justifies the motivation fot the inclusion of public opinion into sentencing policy by recording a 72 percent positive response to people involvement in the sentencing of offenders. / Hierdie navorsing verken respondente in Pretoria se menings en verwagtinge aangaande die erns van misdaad en vonnisoplegging in Suid·Afrika.
