La vraisemblance en matière pénale

Si la manifestation de la vérité apparaît comme l’un des objectifs centraux du procès pénal, confronté à l’obstacle du doute, le droit doit bien souvent se contenter de vraisemblance. Pressés par les nécessités d’agir et de décider, les acteurs de la justice pénale ne pourront pas toujours attendre d’être absolument certains de leur opinion. Afin d’éviter l’écueil de l’immobilisme - qui serait préjudiciable à l’intérêt de la société - ou celui de la précipitation – qui serait préjudiciable à l’intérêt de l’individu -, le droit pénal organise une réaction fondée sur une réalité vraisemblable. La vraisemblance contribue ainsi à la réalisation prudente et efficace du droit pénal. Il faut alors admettre que si la vraisemblance n’est pas une notion spécifiquement juridique, il n’en demeure pas moins que le droit lui reconnaît des effets. L’ambition de cette étude est de démontrer que la vraisemblance innerve l’ensemble de la matière pénale et permet d’y introduire les garanties suffisantes d’objectivité dont elle a besoin, car seule l’existence hautement probable d’une réalité infractionnelle permet de forger le seuil de vraisemblance à partir duquel ce standard va pouvoir produire des effets de droit. Il est alors question d’identifier ces effets de droit, d’en démontrer les ressorts et de déterminer les possibilités de surpassement du doute qu’offre cette notion / If the manifestation of truth appears as one of the central objectives of the criminal trial, confronted with the obstacle of doubt, the law must often be satisfied with verisimilitude. Pressed by the necessity to act and decide, the actors of the criminal justice system can not always wait to be absolutely certain of their opinion. In order to avoid the pitfall of immobilism - which would be prejudicial to the interests of society - or that of precipitation - which would be detrimental to the interest of the individual - the criminal law organizes a reaction based on a plausible reality. The likelihood thus contributes to the prudent and effective realization of criminal law. It must be recognized, then, that while verisimilitude is not a legal concept, the fact remains that the law recognizes its effects. The ambition of this study is to demonstrate that the likelihood serves as a basis for the whole of penal matters and allows the necessary guarantees of objectivity to be introduced, since only a certain degree of conviction allows for the threshold of Likelihood that this standard will produce legal effects. It is then a question of identifying these legal effects, of demonstrating the springs and of determining the possibilities of overcoming the doubt that this notion offers. Likelihood is indeed a formidable tool for overcoming doubt, to which the law assigns two predominant roles : an operative role in the first place, by authorizing the investigating and investigating authorities to act in spite of their doubts. A probative role then, to the extent that the existence of certain facts presents such a likelihood that they benefit from a presumption of truth

La personne qui a osé porter atteinte à une valeur pénalement protégée par la société mérite-t-elle, de la part de celle-ci une quelconque défense? Pendant longtemps, cette défense a fait l'objet de controverses, si certains y étaient favorables, d'autres y étaient résolument hostiles. Le compromis a consisté à refuser les droits de la défense dans l'enquête policière en adoptant un système inquisitoire et à les consacrer largement dans la phase de jugement avec un système accusatoire. Cette mixité de la procédure semble a priori répondre aux intérêts antagonistes au cœur de la procédure pénale. Mais, à l’aune des droits fondamentaux et sous l’influence des dispositions internationales et européennes, cette conception de la procédure devient inadaptée. Les droits de la défense, droits du procès équitable, ne doivent plus faire l’objet de limitations, ils doivent gouverner toute la procédure, de l’enquête policière jusqu’à la phase de jugement. Comment des droits qui ne s’appliquaient initialement que devant une juridiction indépendante et impartiale vont-ils faire irruption dans l’enquête policière sans l’existence d’un juge présentant des garanties équivalentes à celles de la juridiction de jugement ?Si le législateur a d’abord introduit les droits de la défense dans la phase de l’instruction pénale, le déclin de cette dernière au profit de l’enquête policière devrait le pousser à procéder à leur extension. C’est ce qu’il a d’ailleurs commencé à faire, mais de manière timorée. L’effectivité des droits de la défense dans l’enquête policière nécessite non seulement de procéder à leur élargissement, mais aussi de mettre en place un juge indépendant et impartial chargé de garantir leur pleine application comme dans la phase de jugement. Une juridictionnalisation de l’enquête policière est aujourd’hui un impératif. / Did the person who dared to infringe a value criminally protected by the society deserve any defense from that latter? This defence has been controversial for a long time, while some have been in favor, others have been resolutely hostile. The compromise consisted in refusing the rights of the defense in the police investigation by adopting an inquisitorial system and devoting them largely in the judgment phase with an adversarial system. This diversity of the procedure seems a priori to answer the conflicting interests at the heart of the criminal proceedings. But in the light of fundamental rights and under the influence of international and European provisions, this conception of procedure becomes inappropriate. The rights of the defense, as well as the rights to fair trial must no longer be limited, they must govern the entire procedure from the police investigation to the trial stage. How would rights that initially applied only before an independent and impartial jurisdiction break into the police investigation without the existence of a judge providing guarantees equivalent to those of the trial court? If the legislator first introduced the rights of defense in the criminal investigation phase, the decline of the latter in favor of the police investigation should push him to extend them. In fact, this is what he has started to do, but in a timorous way. Not only does the effectiveness of the rights of the defense in the police investigation require to be enlarged, but it also allows putting in place an independent and impartial judge responsible for ensuring their full implementation as in the trial stage. A jurisdictionalization of the police investigation is now a requirement.

This thesis deals with the institute of summary preliminary proceedings. The introduction of this work briefly outlines the evolution of the legislation, which was the impulse for conducting the summary preliminary proceedings, and the reason for the introduction of this institute. The author defines the concept of summary preliminary proceedings in relation to other forms of preliminary proceedings and proceedings taking place before court. Further on the author tries to capture the essence and meaning of the summary preliminary proceedings. The work introduces the current legislation of the institute and its use under other criminal laws. The work defines the basic principles of summary preliminary proceedings. The author discusses the statutory conditions for holding summary preliminary proceedings. At the same time she defines the subjects of summary preliminary proceedings, their status, specific rights and obligations. Within this work, the emphasis is placed on the issue of time-limits, especially the determination of commencement and completion of summary preliminary proceedings and its length. An analysis of the prosecution-led investigation model in murder cases

The investigation of crime is one area in which the South African Police Service is measured on. There is no doubt that poor application of investigation methods results in acquittal of criminals or, at worst, failing to identify the perpetrator. In murder cases, the response from the communities who are directly affected is usually unpleasant and intolerable. This is so because murder is a crime against human life. One death in the family will have significant, undesirable implications to the family involved and, to a certain extent, the community. Violent crime such as murder has a negative effect, not only on the family who has lost the loved one, but also has a severe direct impact on the economy. For instance, no potential investors would want to associate themselves with a country where the incidence of violent crimes has become the norm and where the government appears to be reluctant to take tangible actions to remedy the situation. For years, the South African Police Service applied one methodology in murder investigations, even though their crime statistics showed that this type of crime was constantly increasing and required drastic steps to curb it. This study gives a detailed analysis of the prosecution-led investigation model and its feasibility in murder cases. This research was conducted on the basis that this model appears to work successfully in commercial crimes, judging by the conviction rates reported annually by the National Prosecuting Authority. The study discusses the current investigation model used by the South African Police Service in the investigation of murder and compares it to an intelligence-led investigation model. It then examines the meaning of the prosecution-led investigation. Finally, international experiences in terms of criminal investigation and prosecution procedures are discussed and compared with those of South Africa. The researcher explored the models from the selected countries and interviews conducted were used as a foundation for describing and explaining the future application of the findings emanating from this research. Using the qualitative approach, data was gathered by means of a literature review and qualitative interviews with the sampled participants to answer the research questions. The researcher is of the view that this study (analysing the prosecution-led investigation model in murder cases) presents a significant contribution to the development of practical guidelines that can be used to effectively and efficiently investigate murder cases. / Police Practice / D. Le rôle de la cessation des paiements dans la prévention et le traitement des difficultés des entreprises / Cessation of payments in the interprises fighting for survival

La cessation des paiements, c’est sans aucun doute l’une des notions clés du droit des procédures collectives. Pour s’en rendre compte, il suffit de vérifier le contentieux qui en la matière est très abondant. Légalement définie au sein du premier alinéa de l’article L. 631-1 du Code de commerce comme l’impossibilité pou un débiteur de faire face à son passif exigible avec son actif disponible, cette définition, a été, à l’origine, l’œuvre d’une décision de la Cour de cassation rendue le 14 février 1978. Sous l’empire des dispositions antérieures à la loi de sauvegarde des entreprises, la cessation des paiements est un « curseur » qui sert de ligne de démarcation entre les procédures amiables et les procédures judiciaires. Un tel système a été dénoncé car il manquait cruellement de souplesse et d’efficacité dans la lutte contre les défaillances des entreprises. La loi du 26 juillet 2005, dans l’optique d’anticiper le traitement des difficultés des entreprises a mis un terme au système de « la cessation-curseur » en instituant la procédure amiable de conciliation et la procédure collective de sauvegarde. Toutefois, lorsque les « digues » que constituent les outils de l’anticipation n’ont pas pu enrayer le risque de cessation des paiements, le chef d’entreprise qui se retrouve dans une telle situation doit, dans un délai de quarante-cinq jours, demander l’ouverture d’une procédure de redressement ou de liquidation judiciaire. Lorsqu’il ouvre l’une ou l’autre de ces deux procédures, le tribunal saisi doit fixer une date de cessation des paiements. Cette date sera décisive pour la détermination de la période suspecte. De plus, l’ouverture des procédures collectives aura une incidence sur l’entreprise, elle joue sa survie, sur les créanciers dont le recouvrement de la créance est menacé, sur les fournisseurs qui craignent pour leurs relations contractuelles avec le débiteur, sur les garants qui craignent d’être appelés et sur la personne du débiteur elle-même. Sa gestion antérieure de l’entreprise sera scrutée et s’il en résulte des fautes en relation plus ou moins directe avec la cessation des paiements, il encourt des sanctions ou des actions en responsabilité. / Cessation of payments is certainly one of the key concepts in the law on collective insolvency proceedings. This can be seen by checking the litigation, which is very abundant in this matter. Legally defined in the first paragraph of Article L. 631-1 of the Commercial Code as the inability of a debtor to meet its accrued liabilities with its quick assets, this definition originated in a decision of the Court of Cassation issued on February 14, 1978. Under the provisions prior to the insolvency act, cessation of payments is a "cursor" which serves as a line of demarcation between amicable proceedings and judicial proceedings. Such a system has been criticized for being sorely lacking in flexibility and effectiveness in preventing business failures. The law of July 26, 2005, with the objective of anticipating treatment of company difficulties, put an end to the "cessation-cursor" by instituting the amicable conciliation proceeding and the collective insolvency proceeding. However, when the "barriers" formed by the anticipation tools have not been able to halt the risk of cessation of payments, the company director in such a situation must, within a period of forty-five days, request the initiation of a receivership or court-supervised liquidation proceeding. When either of these proceedings is initiated, the court must fix a date of cessation of payments. This date will be final for the determination of the suspect period. Moreover, the initiation of collective insolvency proceedings will have an effect on the enterprise fighting for survival, on the creditors whose ability to collect their debt is threatened, on the suppliers worried about their contractual relations with the debtor, on the guarantors who fear being called upon and on the debtor itself. Prior management of the enterprise will be probed and if faults more or less closely connected to the cessation of payments are revealed, sanctions or tort actions may result.

This thesis deals with the institute of summary preliminary proceedings in the context of past and current legislation and also the reasons that led to its introduction into law. The paper also outlines the objectives of summary proceedings and the use of the institute for other criminal laws. In this work there are also defined summary preliminary proceedings within individual forms of pre-trial proceedings. In some cases, the work compares the above mentioned institute of summary preliminary proceedings with foreign legislation. This study also defines the essence of summary preliminary proceedings and acts carried out in it. At the same time the author tries to define the legal conditions for holding summary preliminary proceedings, further the course of summary preliminary proceedings. The paper also describes the course of summary preliminary proceedings, from the record of initiation of criminal proceedings, to notification about suspicion, further deals with the question of proving evidence in summary proceedings.
