Role investigativní žurnalistiky v demokratické společnosti na příkladu Güntera Wallraffa / The Role of Investigative Journalism in a Democratic Society on the Example of Günter Wallraff

This diploma thesis deals with the topic of investigative journalism in a democratic society, on the example of Günter Wallraff, a pioneer of German investigative journalists. His work and methods are controversial and questioned, so I focused on what ethical and legal obstacles his two selected works had to overcome. I chose two reports - Informationen aus dem Hinterland and Ganz unten, from the seventies and eighties of the twentieth century. Both reports were filmed with a hidden camera and were therefore not accepted by the public at first, but after the Federal Constitutional Court's decision, the hidden camera search method was just recognized if it leads to the detection of misstatements. To answer the research questions, I worked with period archival articles and secondary literature. I have connected concrete information from the articles with the knowledge from secondary literature. Reconstructing the link between the two works, the motive of the whole work was journalism as the fourth power in the state, which ensures respect for human rights and freedoms and thus contributes to the maintenance of a democratic society.

The aim of this diploma thesis was to present in detail the document made by the director of News and Sport division of Czech Television Zdeněk Šámal entitled Decaloque for the Work od Czech Television Journalists on Social Networks. This document recommends Czech Television journalists how to communicate on their personal profiles on social networks. In this context, the thesis also includes a relatively wide research, which introduces to readers, whether there are some similar documents published in other european public service media. An important question in this issue was a journalists autonomy and the freedom of speech, which could theoretically be by this type of document threatened. For a compehensive approach to the whole issue, there is also a practical part of this thesis, which inludes interviews with Czech Television journalists, which helps to introduce readers also a subjective view, both of the Decaloque and freedom of speech. The diploma thesis acquainted the readers with the document published by Czech Television and presented in detail a similar ones that are used by our geographical neighbours but also by other european countries such as France and United Kingdom (Czech Televisions Decaloque was mostly inspired by BBC). The thesis focuses on the behaviour of the largest world superpowers, the United States of America, the Russian Federation, and the People's Republic of China, in terms of internet freedom. The aim is to examine in what manner and to what extent these countries limit or protect their citizens' right to freedom of expression on the internet. The resulting data should reveal or disprove significant discrepancies between the character of the political regimes which the selected countries represent, and their real practices towards the freedom of speech on the internet. The subject of the analysis is to compare these countries' data which were presented in the Freedom on the Net 2011-2015, a series of reports by the independent non- profit organisation of Freedom House. The data are compared through comprehensive graphs and charts, which help to illustrate and map the development of the individual countries' behaviour in time. The thesis is complemented by a chapter focusing on the historical development of internet, illustrating who participated at its birth and who has a major influence on its current form.

Modernitetens moraliska rättssystem: cancel culture : - en kvalitativ studie om cancel culture och yttrandefrihet ur generationen millennials perspektiv

Cancel culture is a debated phenomenon both in social and traditional media. The aim of this study is to contribute to the ongoing conversation and discussion regarding cancel culture using semi-structured interviews with informants of the generation millennials. The study depicts the informants’ options of cancel culture including both the positive and the negative consequences. In order to reach a broader sense of understanding and a better insight in how the phenomenon affects society, cancel culture is put in a context of freedom of speech. Keith Tester's theory about the social thought as well as Jürgen Habermas theory regarding public sphere is used in order to fulfil the study's aim and answer related issues. The study’s conclusion demonstrates how the millennials have in general a negative perception of cancel culture and how the phenomenon generates destructive consequences such as hate online. Apositive outcome of cancel culture is the possibility to elucidate and reform structural social problems. Furthermore, knowledge of cancel culture to get a vast understanding of the phenomenon and its effects is established in the discussion of the study. / Cancel culture är ett modernt fenomen som är omdiskuterat både i sociala och traditionella medier. Syftet med studien är att bidra till den pågående diskussionen kring cancel culture genom semistrukturerade intervjuer med informanter ur generationen millennials. Studien skildrar informanternas åsikter kring cancel culture samt dess positiva respektive negativa konsekvenser. Cancel culture sätts även i relation till yttrandefrihet för att få en bredare förståelse av fenomenets inverkan på samhället. Tidigare forskning redovisar olika perspektiv av fenomenet, som använts för att öka förståelsen av denna studie. Keith Testers teori om den sociala frågan och Jürgen Habermas teori om det publika rummet bidrar till att studien uppnår sitt syfte och besvarar frågeställningarna. Slutsatsen visar hur studiens millennials har en generellt negativ uppfattning av cancel culture och hur cancel culture genererar destruktiva konsekvenser i form av hat online. En positiv följd av cancel culture är det ges möjlighet att belysa och förändra strukturella samhällsproblem. Ytterligare kunskaper krävs för att förstå fenomenet och dess effekt i samhället, något som tas upp i diskussionsdelen.

Conspiracy theories and freedom of speech in the online sphere : An analysis of QAnon’s ban from Facebook and Twitter

At the crossroads of law, conspiracy theory research and philosophy, this thesis investigates the permanent ban of QAnon from Facebook and Twitter, determining whether their deplatforming constitutes a violation of free speech. By first conducting a content analysis of free speech legislation in Germany and the US, it becomes evident that the matter needs to be approached from an ethical perspective rather than a legal one. To this end, I am testing an ethical framework suggested by Cíbik and Hardoš (2020). Based on the concept of ethical unreasonableness, the framework will be used to determine whether QAnon is harmful and its ban was justified. The case study consists of an in-depth analysis of QAnon’s evolution, distribution and core narratives in Germany and the US, followed by an examination of Facebook and Twitter’s justifications for deplatforming all QAnon assets. The ethical framework will then be applied to selected QAnon narratives based on their prevalence in the time from February 2020 to February 2021. It becomes clear that the ethical framework at hand needs to be adjusted and is unsuitable for everyday content moderation but should still be used by the social media companies for training purposes to improve decision making. The question of whether deplatforming QAnon was a violation of free speech is not easily answered as depending on the point of view it is or is not a violation of freedom of speech. Ultimately, big social media companies need to be redefined as to their role and responsibilities in today’s societies before any content moderation measures can be adequately examined.

Denna studie har som mål att ge en inblick i varför och hur Internetanvändare nyttjar Tor Browser och The Dark Web. Nätverket och webbläsaren förknippas ofta med illegal verksamhet, men även med yttrandefrihet och anonymitet. Vi vill undersöka hur användandet av dessa ser ut och skapa en förståelse kring varför individer väljer att vända sig dit. Detta görs med hjälp av kvalitativa intervjuer med sammanlagt nio personer som använder sig av nätverket och webbläsaren. Intervjuerna har genomförts på forumen Flashback Forum, Quora och Reddit genom sajternas privata chattfunktioner. Materialet har sedan analyserats med hjälp av det teoretiska perspektivet Uses and Gratification för att synliggöra vilka sociala och psykologiska behov som tillgodoses genom användandet. Studiens resultat visade att merparten av de intervjuade vände sig till Tor Browser och The Dark Web eftersom att de, i förstahand, var intresserade av illegal verksamhet och använde nätverket samt webbläsaren för att få tillgång till materialet, men även för att göra det svårare för myndigheter att spåra deras aktivitet online. Användandet grundade sig, i andrahand, i ett intresse för yttrandefrihet och anonymitet och det var även dessa ämnen som gjorde att användarna fortsatte att återvända till Tor Browser och The Dark Web.

Internet et la liberté d'expression : l'exemple des critiques dirigées contre les oligopoles

"Mémoire présenté à la Faculté des études supérieures en vue de l'obtention du grade de maîtrise en droit option droit des technologies de l'information" / Ce mémoire de maîtrise présente une situation dans laquelle un citoyen ordinaire tente de diffuser sur Internet une opinion critique qu'il dirige contre une grande entreprise commerciale et tente d'analyser les éléments favorables à la diffusion de cette opinion critique ainsi que les embûches qui sont à prévoir. Cet exemple permet d'illustrer les forces et les faiblesses d'Internet en matière de liberté d'expression. Il permet de poser une mise en garde concernant les dangers de transposer les limites actuelles à la liberté d'expression des citoyens au contexte d'Internet. La première partie de l'analyse souligne les caractéristiques d'Internet et les différentes façons d'aborder la question de la liberté d'expression sur Internet selon les approches libertaire, libérale ou interventionniste, pour finalement faire le point sur l'apport d'Internet en matière d'information et de communication. La deuxième partie de l'analyse aborde la question de l'efficience en identifiant les éléments qui encouragent l'exercice de la liberté d'expression et ceux qui découragent les utilisateurs de s'exprimer sur Internet. L'exemple des critiques dirigées contre les oligopoles permet d'illustrer la nécessité d'établir des règles propres à Internet en matière de liberté d'expression. Cet exemple fait ressortir le caractère inadéquat des limites actuelles à la liberté d'expression établies par le droit de la presse, le droit de la radiodiffusion, le droit de propriété et le droit de la propriété intellectuelle. L'auteur vient à la conclusion qu'en matière de liberté d'expression, il serait souhaitable: 1) Que Internet soit considéré comme un espace public de discussion; 2) Que la préséance des intérêts économiques sur les intérêts démocratiques au niveau du développement de la société de l'information soit avouée; 3) Que les inégalités en termes d'opportunités d'expression soient reconnues; 4) Que les limites imposées en vertu des règles du droit de la propriété soient reconsidérées à la lumière des caractéristiques d'Internet. / This master thesis presents a case in which an ordinary citizen tries to spread on the Internet a criticizing opinion aimed at a large company, and attempts to analyse what are the elements in favour of this criticism broadcasting, as weil as the obstacles to be expected. This example allows us to illustrate the strengths and weaknesses of the Internet in matter of freedom of speech. It also allows to put forward a warning concerning the risks of transposing current Iimits of freedom of speech in an Internet context. The first part of the analysis underlines the Internet's characteristics and the different ways to broach the subject of freedom of speech over the Internet, following severaI approaches, to finally focus on the Internet's contribution in matter of information and communication. The second part of the analysis deals with the question of efficiency, while identifying the elements that encourage the exercise of freedom of speech and those that discourage Internet users from expressing themselves. The example of criticism aimed toward large companies allows to illustrate the need to establish the Internet's own rules in matter of freedom of speech. What emerges from this example is the inadequate character of current limits to freedom of speech as set up by freedom of the press, broadcasting law, property and intellectual property law. The author concludes that in matter of freedom of speech, it wouId be recommended: 1) that the Internet be considered as a public forum; 2) that the predominance of economic interests over democratic interests in the development of the information society be admitted; 3) that the inequalities in terms of expression opportunities be recognized; 4) that the limits imposed in accordance with property law be reconsidered in an Internet context.
