Le traitement juridique de la rupture du couple : réflexion sur l'émergence d'un droit commun de la rupture du couple / The legal processing of the couple's split

La consécration sur la scène juridique, en 1999, des modes de conjugalité alternatifs au mariage - le concubinage et le PACS-, a contribué à renouveler l'appréhension de la notion de couple, placée au coeur des préoccupations législatives. De plus en plus envisagé comme une notion unitaire, le couple est désormais compris dans une acception qui transcende les modes de conjugalité, au point que la réalité d'un droit commun du couple encouragé par le législateur est aujourd'hui tangible. Dans cette logique, on observe un rapprochement des processus de rupture résultant de l'extension de certaines règles protectrices du divorce aux ruptures du PACS et du concubinage. Dès lors, le développement d'un droit commun de la rupture du couple au détriment de la spécificité du divorce est-il inéluctable ? ou à l'inverse, la rupture est-elle encore le symbole des différences fondamentales entre les modes de conjugalité, en révélant ce qui est l'essence irréductible de chacun d'eux -et ceci, dans un contexte du droit de la conjugalité profondément renouvelé par l'appréhension nouvelle du mariage en tant qu'union ouverte aux personnes de même sexe ?Telle est l'alternative pour le législateur à qui il incombe de donner une nouvelle cohérence au droit de la conjugalité. / The arising on the legal scene in 1999 of various types of union as alternatives to marriage (cohabitation and french civil partnership -PACS-) contributed to reconsider the very notion of couple as the core of legislative priorities. More and more understood as a unitarian concept, the couple is now included in an understanding that goes beyond the type of union, to the point where a common law of couples becomes a reality, promoted by the legislator. Doing so, the legal ways of ending a cohabition or a PACS are now obviously converging with the way of ending a marriage, thanks to the extension of protective laws that initially concerned only married couples.From here, must we consider inevitable the development of a common law of ending a couple, at the expense of the specificity of divorce ? Or, at the opposite, is the ending of a couple still the best representation of the fundamental differences between unions, revealing their very nature - moreover now that the laws of conjugality have been deeply reconsidered through the legalization of same sex marriage ?Such is the alternative for the legislator, who has now to give a brand new coherence to the laws of conjugality.

According to the education act, all pupils have the right to develop, based on their own ability and potential, which means that the teaching needs to be adapted and differentiated to suit all pupils. Studies show that gifted children often feel mentally bad in school, feel misunderstood and in some cases become misdiagnosed with various disabilities. The aim of this study is to deepen the knowledge about how teachers talk about giftedness and gifted children. The study is based on a social constructivist and sociocultural theoretical approach with qualitative focus group interview of teachers. With the help of hermeneutical analysis and a focus on the theory of social constructivism and sociocultural theory, this study shows that, among teachers, there is a great uncertainty about the concept of giftedness, both regarding what it means to be gifted and how these pupils can be noticed in school. / Alla elever har enligt skollagen rätt att utvecklas utifrån sin egen förmåga och potential, vilket innebär att undervisningen behöver anpassas och differentieras för att passa alla elever. Studier visar att särbegåvade elever ofta mår dåligt i skolan, känner sig missförstådda och i vissa fall blir feldiagnostiserade med olika funktionsnedsättningar. Syftet med denna studie är att fördjupa kunskapen om hur lärare samtalar kring särbegåvning och särbegåvade elever. Studien är gjord utifrån en socialkonstruktivistisk samt -sociokulturell teoretisk ansats med kvalitativ fokusgruppsintervju av lärare. Med hjälp av hermeneutisk analys och ett fokus på socialkonstruktivismens teoribildning samt sociokulturell teori visar denna studie att, det bland lärare, finns en stor osäkerhet kring begreppet särbegåvning, både gällande vad det innebär att vara särbegåvad samt hur dessa elever kan uppmärksammas i skolan.

El presente estudio se enfoca en resolver los problemas del Mercado de Abastos de Tumán a través de una propuesta que implica el diseño de un edificio de usos variados, incluyendo comerciales e informales, así mismo incluyendo actividades no cotidianas en un mercado, con el propósito de revitalizar tanto el funcionamiento del mercado como el entorno urbano circundante. La investigación se llevó a cabo empleando un enfoque descriptivo, con el objetivo de ofrecer una solución innovadora, se establecieron metas específicas. En primer lugar, se realizó un diagnóstico del estado físico actual del mercado, evaluando su cumplimiento con las regulaciones vigentes. En segundo lugar, se identificaron las actividades comerciales existentes en la ciudad de Tumán con el fin de incorporarlas en la nueva infraestructura. Además, se llevó a cabo un análisis y estudio de proyectos arquitectónicos similares a edificios de usos mixtos, que han abordado desafíos análogos en mercados minoristas urbanos. El propósito fundamental de este estudio es mejorar el entorno arquitectónico del Mercado de Abastos de Tumán, promoviendo la creación de un espacio saludable y fomentando el bienestar general de la comunidad. The research was carried out using a descriptive approach, with the aim of offering an innovative solution, specific goals were established. Firstly, a diagnosis of the current physical state of the market was carried out, evaluating its compliance with current regulations. Secondly, the existing commercial activities in the city of Tumán were identified in order to incorporate them into the new infrastructure. Additionally, an analysis and study was carried out on architectural projects similar to mixed-use buildings, which have addressed analogous challenges in urban retail markets. The fundamental purpose of this study is to improve the architectural environment of the Tumán Food Market, promoting the creation of a healthy space and promoting the general well-being of the community. The goal is to develop an optimal, safe and diversified infrastructure, which offers a different experience from that of a traditional market and encourages interaction between the community and its urban environment. In summary, this research proposes an innovative and sustainable solution to address the dysfunctionality of the Tumán Food Market with the aim of promoting progress and comprehensive development of the city.

Religious education in Zimbabwe secondary schools : the quest for a multi-faith approach

This study explores the problem of a bibliocentric Religious Education curriculum in Zimbabwe amid the quest for a multi-faith curriculum. It traces the history of Religious Education, how it was started and crafted by the so-called missionary propagandists in order to suit their dogmatic interests. Two main aspects of the christianization of the Religious Education curriculum are highlighted, namely cultural alienation and indoctrination. Two post-independence teaching approaches, the life experience approach and the multi-faith approach are discussed in a comprehensive manner as possible solutions to the problem of Religious Education in Zimbabwe. An empirical analysis and evaluation of the views of various stakeholders about post-independence developments in Religious Education is also presented. Taikant improvizacijos būdus solfedžio pamokoje svarbu parinkti tokias užduotis, kurios atitiktų mokinių gabumų ir gebėjimų lygį. Improvizacijos užduočių panaudojimas reikšmingas ne tik solfedžio, bet ir kitose mokinių ugdymo bei gyvenimo sferose. Improvizacija suteikia galimybę tinkamai save realizuoti, laisvai reikšti mintis ir idėjas, giliau įsisavinti improvizuojamą medžiagą. Dėl unikalių solfedžio ugdymo ypatybių, ši pamoka muzikos mokyklose dažnai įgauna neigiamą atspalvį. Sustiprintose ir specializuotose muzikos mokyklose solfedžio gana stipriai susijęs su ugdymo procesu: mokiniams tai tampa tiesiog savaimine ugdymo priemone. Didžiajai daugumai ugdytinių pasidaro visai nesvarbi solfedžio mokymo eiga. Improvizacija – aktualus muzikavimo būdas. Ji turi būti tobulinama remiantis visomis muzikinės veiklos formomis, taip pat ir solfedžio pamokose. Todėl improvizacijos būdų taikymas yra aktuali pedagoginė problema. Tyrimo objektas – improvizacijos būdų taikymas solfedžio pamokoje. Tyrimo tikslas - atskleisti improvizacijos būdų taikymo galimybes solfedžio pamokoje. Tyrimo hipotezė – solfedžio pamokoje skatinama ugdytinių mokymosi kokybė, plėtojama jų saviraiška, jeigu taikomi mokinio muzikinę patirtį atitinkantys improvizacijos būdai. The improvisation tasks are significant not only for the sol-fa lessons but in other spheres of students’ education and life, too. Improvisation provides a possibility to properly materialize oneself, to freely express one’s thoughts and ideas and to realize the improvised material more deeply. The unique educational characteristics of the sol-fa lessons often cast a negative shade on them at music schools. Specialised music schools strongly tie the sol-fa subject with the entire educational process: the students treat it as a means of self-education. Most of the students stop thinking about the course of the sol-fa training. That is why indifference to the sol-fa lessons could be described as the main educational problem among the students. The renowned Italian Educator Loris Malaguzzi, in the book A Hundred Languages of a Child (1999), reported this experience. The research was accomplished in the first semester of 2003, whose methodology used was research-action, involving direct observations to children, studies and reflections with the teachers and with the Parents of Children from SESI/Infantile Education and graduate students (Pedagogy Course Unidavi). The study provided the proximity from the lived experience in Reggio Emilia, in which the intellectual, emotional, social and moral potential of every child is carefully cultivated and oriented. It was possible to notice the myriad of children s movements, such as gestures, looks, smiles, silences, and several everyday elements that were manifested as contents, marking an educational action. These contents started being explored on an organized way and were viable in learning situations in the Infantile Education. In this perspective, the challenge wasn t set up exclusively to children, but the teachers were also challenged by the children in the sense of identifying their wishes and needs, revealed in their productions in most different languages, generating a new look to the children s manifestations during their playing. The reorganization of physical space in the classroom also took part of this challenge, providing the teachers and the children to live situations of entertainment with pedagogical intention. The involvement of the Parents of the children in the process was fundamental, then, there was a better understanding of the importance of games in the pedagogical process for the children s development and learning. The records and analyses presented in this study translate a certain historic moment at SESI/Infantile Education; however, it s necessary to pursue with the studies about the theme, because it is not finished here. / Para uma melhor compreensão do caráter educativo das brincadeiras, propõe-se nesse Projeto ampliar as possibilidades da prática pedagógica com crianças de 2 a 6 anos do Sesi/Rio do Sul, através da formação dos Professores. Inspirado nos trabalhos de Reggio Emilia (Itália) esta experiência enfatiza a importância das várias linguagens da criança. A pesquisa foi iniciada no primeiro semestre de 2003, através de um estudo de caso com características de pesquisa-ação. Envolveu observações direta das crianças, estudos e reflexões com Professoras; vivências com os Pais e alunos da Graduação; entrevista com adolescentes, adultos e idosos. Foi aqui possível perceber a miríade de movimentos das crianças, como seus gestos, olhares, sorrisos, silêncios e diversos elementos do cotidiano que se manifestavam como conteúdos, sinalizando uma ação educativa. Esses conteúdos começaram então a ser explorados de maneira organizada e viabilizados em situações de aprendizagem na Educação Infantil do Sesi. A reorganização do espaço físico da sala de aula; o envolvimento dos Pais; dos alunos de graduação, oportunizaram aos Professores e às crianças, vivências lúdicas com intencionalidade pedagógica, e desencadearam uma aproximação maior entre escola e comunidade. Os registros e as análises apresentadas neste estudo, traduzem um momento histórico da Educação Infantil do Sesi, e abrem espaço para o necessário aprofundamento da ação-reflexão-ação no processo de mudanças oportunizado e iniciado a partir deste trabalho que se encontra em franca evolução.

There are two transport systems used by agricultural businesses engaged in primary production. These are transport systems involving tractors and motorized vehicles. Transport systems involving tractors are made up of motorized vehicles and vehicles that are Toled Grand Super , or more specifically, a motor vehicle plus one or more vehicles that are towed along. A motorized vehicle refers to an agricultural traktor John Deere 6620. Motorized transport systems are comprised of Lorries Tatra 815 Agro. A lorry can only have one additional vehicle connected to itself. The transport systems mentioned above can be used in agricultural businesses engaged in primary production along with similar or identical productions. Motorized transport systems used in agricultural primary production are in the majority of cases applied to additional productions. This is the given transport system framework, which can be setup with adaptations for various uses. It therefore follows that the possibilities of comparing transport systems using universal undercarriages are increased. Expenditure associated with these transport systems, are easily compared. It is also possible to easily compare transport systems involving tractors with motorized transport systems as long as there is no need for more vehicles connected to them. It is obvious that the use of motorized transport systems for longer distances is preferable to transport systems involving tractors. Expenses for every driven kilometre with the comparable transport systems show a significant difference in cost. This difference is 36,85 Kč. On the other hand, it is preferable to use tractors for shorter distances involving a larger amount of material. he cost of one tonne of material transported is different about 11,55 Kč.
