Lietuvos teismų praktika bylose, susijusiose su žalos, atsiradusios dėl didesnio pavojaus šaltinio valdymo, atlyginimu / The lithuanian case-law regarding compensation for damage arising from a possession of a potentially hazardous object

Civilinės atsakomybės taikymas yra labai jautri sritis, todėl svarbu užtikrinti jos taikymo vienodumą bei nukentėjusiojo asmens bei už žalą atsakančio asmens interesų balansą. Viena iš civilinės atsakomybės instituto dalių – atsakomybė be kaltės. Atsakomybės be kaltės („griežtosios atsakomybės”) normų egzistavimas visuomet kėlė nemažai diskusijų, nes atsakomybės taikymas nekaltam asmeniui gana prieštaringas ir sunkiai moraliai pateisinamas. Todėl pirmojoje darbo dalyje pateikiama griežtosios atsakomybės samprata bei pagrindimas. Toliau darbe nagrinėjama atsakomybės už žalą, atsiradusią dėl didesnio pavojaus šaltinio valdymo, įtvirtintos Lietuvos Respublikos civilinio kodekso 6.270 str., kategorija. Atsakomybė pagal šį straipsnį taikoma be kaltės, todėl svarbu preciziškai apibrėžti jos taikymo ribas bei nustatyti taikymo specifiką. Pirmiausia darbe yra apžvelgiami didesnio pavojaus šaltinių rato nustatymo principai. Ši dalis svarbi, nes nuo minėtų principų priklauso griežtosios atsakomybės ribos. Pasirinkus didesnio pavojaus šaltinių ratą apibrėžti įstatymuose, atsakomybės be kaltės taikymas tampa aiškus, tačiau įstatymų leidėjui atsiranda rizika pamiršti tam tikrus pavojingus objektus. Kita vertus, paliekant didesnio pavojaus šaltinio plėtojimą teismų praktikai, rizikuojama susidurti su neprognozuojamu atsakomybės be kaltės taikymu. [toliau žr. visą tekstą] / Since application of civil liability is a very sensitive area it is important to ensure the consensus of its application and the balance of interests of the aggrieved party and the person who is liable for damage. Liability without fault is a part of civil liability institute. The existence of liability without fault (strict liability) norms has always been negotiable since the application of civil liability on an innocent person is quite controversial and hard to justify morally. Therefore, the conception and the grounding of strict liability is introduced in the first part of the paper. Later in the paper the category of liability arising from a possession of a potentially hazardous object, which is provided in Article 6.270 of Civil code of the Republic of Lithuania, is being analysed. Since liability according to this Article is applied without fault it is very important to define the boundaries and particularity of its application. First of all, the principles of the definition of the unit of potentially hazardous objects are reviewed. This part is quite important since the boundaries of strict liability depend on the above mentioned principles. Analysis of Cepheid Spectra

Using high resolution optical spectra from Mount John University Observatory, Mount Stromlo Observatory and the Anglo-Australian Observatory, new, high accuracy radial velocity curves have been obtained for the two bright southern Cepheids l carinae (HR 3884) and beta doradus (HR 1922). An indepth investigation into period variations, cycle-to-cycle and long-term variations in the velocity curves and the reliability of the combination of velocity data from different observatories is carried out. Evidence for shock waves in the atmosphere of l car and resonance in beta dor is discussed. A grid of static model atmospheres incorporating plane-parallel geometry is compared with the observational spectra of both Cepheids, using line depth ratios, to determine the variation in effective temperature, surface gravity and microturbulence with phase. This information is used to determine the phase dependence of the surface-brightness for both Cepheids. The surface brightness variation with phase was found to follow an almost linear relationship. The distance to and radius of the Cepheids are determined using both a near-infrared version of the Barnes-Evans method and the Fourier Baade-Wesselink (BW) method. The derived radii and distances agree within the limits of the errors for both methods. The Fourier BW method was found to be very sensitive to phase shifts between the photometric and spectroscopic data and the derived distance highly dependent on the assumed reddening. An investigation into line profile variations in l car and beta dor has revealed the magnitude of these phenomena increase as the pulsational period of the Cepheid increases. It is estimated that line level variations introduce an additional uncertainty into derived radii of approximately 4 per cent for beta dor and 10 per cent in lcar. The uncertainty introduced into derived distances and radii by line profile asymmetries was estimated to be of the order of 6 per cent in beta dor and 10 per cent in l car. A comparative analysis is made of the hydrogen line radial velocity curves of l car and beta dor. A trend in the properties of these radial velocity curves with period has been revealed. In longer period Cepheids, the Halpha line seems to be forming in a region that does not partake in the pulsation as a whole, probably in a chromospheric shell. A quantitative analysis of the asymmetries in these lines reveal large redward asymmetries near maximum infall velocity. The magnitude of these asymmetries and the period for which they are present are larger in l Car than in beta dor. The blueward asymmetries in the Halpha line in l Car are comparable in magnitude to the redward asymmetries while the other lines exhibit only small blueward asymmetries. A qualitative analysis of these line profiles with phase reveal no conclusive evidence for line doubling in these Cepheids. Evidence of emission is found in the Halpha and H Beta lines of beta dor and l car. The strength and duration of the emission is found to be greater in the longer period Cepheid. Although it is likely that this emission is shock-related, theoretical work is needed to determine the exact origin of the emission. A non-LTE radiative hydrodynamic model for l Car has been created. This atmosphere will be used in further work to calculate synthetic spectral line profiles which will aid the interpretation of our observational results.

Zhodnocení brakace dojnic v systému volného ustájení / The evaluation of culling rates of dairy cows in free range farming system

This diploma thesis is focused on producing dairy cows and their culling rates. The general goal of this work was to compare and to evaluate the culling rates of dairy cows on 2 independent farms with free range farming system from 2012 to 2014. The diploma thesis provides the facts about culling rates in heifers and in cows till 90 days after calving, reasons to be culled, the age at culling, the age at first calving, parity when the cows were culled and the comparison of milk parameters at culling. The study was compiled from the detailed data about 474 dairy or combined utility cows. Farm Senagro a.s. Senožaty disposes pure-blooded cows or crossbreds with 51-100% of principal breed in blood. Only purebred cows are raised at farm Nečerák Vystrkov. It is obvious that culling rate markedly over 30% from all of the cows at farm Senagro a.s. Senožaty negatively influences profitability of this farm. Vice versa farm Nečerák Vystrkov belongs into category which accomplishes recommended value.

Divadelní tvorba v původně nedivadelním prostoru / THEATRE PRODUCTION IN ORIGINALLY NON-THEATRICAL SPACES

In this essay, I focus on the issues of theatre production in an originally non-theatrical space. The work aims at describing the relation between the space and the directorial, stage design and visual component of a production, setting specific projects as examples. I map my work in an originally non-theatrical space and I describe the process of creation of individual projects of that kind. Based on the realization of many productions, theatre installations and one visual installation, I introduce possible artistic approaches and working procedures. The essence of this work lies in finding and naming the moments where the project is formed by the space and those where, in the contrary, the project affects an existing non-theatrical space. The thesis provides a summary of experience gained by working in non-theatrical spaces and suggests possible connection between artistic and production management activity. The reader is offered a number of starting points and assumptions in the matter of working in a non-theatrical space and our attention is brought to the advantages and difficulties of such work.

Desse modo, situações que façam apelo ao significante foracluído podem provocar o desencadeamento da psicose. Desde Freud, foi estabelecida a relação entre maternidade e atribuição fálica, ou seja, o filho como um substituto fálico para a mãe. Ao estabelecer a inveja do falo como marca do psiquismo das mulheres, Freud propôs a maternidade como condição para a constituição da feminilidade. A relação entre maternidade e atribuição fálica se mantém na perspectiva lacaniana, uma vez que, o filho enquanto substituto fálico permite que a mãe o inscreva no campo do seu desejo, possibilitando a inscrição da criança na linguagem. Contudo, para a teoria lacaniana a mediação do falo não comporta o que diz respeito à mulher. Para o desejo da mãe há um significante que o representa, que é o falo, mas não existe um significante que represente a mulher, o que determina sua posição não-toda referida à função fálica, marcando assim uma disjunção entre mãe e mulher. Estas considerações levaram-me a questionar a maternidade como uma situação que pode provocar o desencadeamento da psicose, pois devido à foraclusão do Nome-do-Pai, a mulher na psicose não está inscrita na função fálica. A disjunção entre mãe e mulher conduziu-me ainda a um questionamento sobre a possível posição para a mulher na psicose, uma vez que devido a não inscrição da função fálica, não haveria possibilidade de se posicionar nem como mãe nem como mulher. Na psicose, devido a não inscrição da função fálica o sujeito não tem como se posicionar como homem ou como mulher na partilha sexual. Diante desta impossibilidade, o sujeito pode inventar uma solução delirante a partir do empuxo-à-mulher, o que me levou a analisar o empuxo-à-mulher como uma possível posição para a mulher na psicose. Desse modo, a questão norteadora do presente estudo pode ser formulada do seguinte modo: como uma mulher na psicose pode responder à convocação fálica da maternidade? A análise de um caso clínico de uma mulher que se dizia a mãe da humanidade foi utilizada para abordar essa questão. For psychoanalytic theory, since the teaching of Lacan, psychosis is characterized by the foreclosure of the significant name-of-the-father, having as one of its consequences the non-inscription within the phallic function. In this manner, situations which demand the foreclosed significant may provoke the eruption of psychosis. Since Freud, the relationship between motherhood and the phallic attribute had been established or, in other words, the child as a phallic substitute for the mother. While establishing envy of the phallus as the psychic token of women, Freud proposed maternity as the condition for the constitution of femininity. The relationship between maternity and the phallic attribution is maintained in Lacan‟s perspective, since, the child as a phallic substitute allows the mother to inscribe him within her desire, making possible the inscription of the child within language. However, for Lacan‟s theory the phallus mediation does not enclose that which is related to women. For the mother‟s desire there is a significant that represents her which is the phallus, however there is no significant to represent the woman, which determines her position of not-all refereeing to the phallic function, establishing the dis-function between mother and woman. These considerations lead me to question maternity as a situation which may provoke the eruption of psychosis, for due to the foreclosure of the name-of-the-father, a psychotic woman is not inscribed in the phallic function. The dis-junction between mother and woman led me to another question, as to the possible position for a psychotic woman, and due to the non-inscription of the phallic function, if there might be the possibility of positioning herself as neither mother nor woman. In psychosis, due to the non-inscription of phallic function the subject has no way of positioning either as man or as woman within the sexual partage. Facing this difficulty, the subject may create a delirious solution coming from the push-to-be-a woman, which took me to analyze that as a possible position for women within psychosis. In this manner, the guiding question of the present work may be formulated this way: how can a psychotic woman answer the phallic convocation of maternity? The analysis of a clinical case of a woman who said to be the mother of humanity was used to approach this question.

Com enfoque qualitativo, do tipo estudo de caso, teve como objeto de estudo o Grupo PIBID do curso de Licenciatura em Matemática da Universidade Estadual Paulista “Júlio de Mesquita Filho”. Dessa forma, tivemos como sujeitos os integrantes que participam diretamente do processo de elaboração e desenvolvimento de atividades pedagógicas em escolas públicas da Rede Estadual em Presidente Prudente (SP). Realizamos entrevistas semiestruturadas com 17(dezessete) sujeitos, sendo 1(uma) professora coordenadora do grupo PIBID e 16(dezesseis) alunos bolsistas. Também adotamos o procedimento da observação, divididas em dois momentos: observações das aulas em que as atividades elaboradas pelos bolsistas eram desenvolvidas e os momentos de reuniões na universidade com todo o grupo PIBID. Foram analisados alguns documentos que respaldam legalmente a implantação deste Programa na universidade, bem como os documentos oficiais que norteiam a criação e o desenvolvimento do PIBID. Os dados obtidos, por meio da análise documental, da observação e da entrevista revelaram contribuições do projeto para que o aluno da licenciatura possa ter mais segurança e um olhar crítico para as situações de ensino aprendizagem. Os resultados evidenciaram a importância de propor ainda no processo de formação inicial de professores, situações em que possibilitem a aproximação dos acadêmicos com o contexto escolar, uma vez que contribuiu para a constituição da identidade profissional. Também apontou possíveis medidas que podem contribuir efetivamente para uma melhor articulação entre conhecimento especifico e conhecimento pedagógico, tendo a escola como sendo o lócus da formação e aprendizagem docente. / Starting from a concept of teachers as critical and reflexive, this study is associated with the Education Graduate Program at FCT/UNESP in the line of research “Public Policies, School Organization and Teacher Education” and its general objective was to investigate how PIBID contributed to the process of initial training and the learning how to teach among students from the Mathematics teaching degree at the School of Science and Technology – FCT/UNESP, campus of Presidente Prudente/SP. With a qualitative approach and being a case study, the object of the research was the PIBID Group in the Mathematics teaching degree at the São Paulo State University “Júlio de Mesquita Filho”. Thus, the subjects were members of the group who participated in the process of preparing and developing pedagogical activities in public schools belonging the the State Education Network in the city of Presidente Prudente (SP). Semi-structured interviews were done with seventeen (17) persons, and one (1) of them was the PIBID group coordinator and sixteen (16) students who were scholarship holders in the program. I also adopted the procedure of observation, divided in two moments: class observation in which the activities prepared by the scholarship holders were conducted and the moments when the entire PIBID group got together in the meetings at the university. Documents that legally support the implementation of this Program at the university were reviewed, as well as the official documents that serve as the guidelines for the setup and development of PIBID. Data collected by means of documental review, by observation and by the interviews revealed contributions of the project so that a teachingdegree student may feel more secure and hold a critical view of the teaching and learning situations. Results highlighted how important it is to work, in the early teacher training, on situations that get the students closer to the school ambience, which helps in acquiring a professional identity. Measure that may effectively contribute to better articulate specific knowledge and pedagogical knowledge, as the school is the place where someone is trained and learns how to be a teacher. / FAPESP: 2012/24188-6

A negatividade enquanto estrutura ontológica da existência segundo Heidegger / Negativity as the ontological structure of existence according to Heidegger

Coordenação de Aperfeiçoamento de Pessoal de Nível Superior / A presente dissertação tem por objeto o tema da negatividade ontológica constitutiva da existência humana na obra Ser e Tempo de Martin Heidegger. Na primeira parte é analisada as descrições efetuadas por Heidegger na primeira seção de Ser e Tempo sobre a dinâmica existencial do homem compreendido como ser-aí (Dasein). Nesse primeiro momento é evidenciado o caráter negativo da existência. Para tanto, partiremos da reconstrução dos conceitos de existência e deu seu caráter intencional e poder-ser (Seinkonnen) em Ser e Tempo. Na segunda parte, a análise da tonalidade afetiva da angústia é o ponto de partida para se chegar ao modo de ser do homem, descrito por Heidegger como cuidado (Sorge). Argumentaremos também, que o cuidado é o único modo de ser compatível com um ente que em seu modo de ser mais próprio é marcado por uma negatividade (incompletude) radical. Por último, em nosso terceiro capítulo, apresentaremos, em seus traços gerais, a possibilidade compatível com o caráter de poder-ser do ser-aí: a possibilidade da morte, compreendida ontologicamente como ser-para-a-morte. Na conclusão, apontaremos o interesse maior de Heidegger em investigar a dinâmica existencial do ser-aí. Esse interesse consiste, em visualizar, por meio do que Heidegger chama de crise existencial do ser-aí (proporcionada pela angústia) o ponto de gênese das ontologias. / The present dissertation aims the theme of ontological negativity constitutive of human existence in the work Being and Time of Martin Heidegger. In the first part, we examine the descriptions made by Heidegger in the first section of Being and Time about the dynamics of the existential man understood as being-there (Dasein). Initially is shown the negative character of existence. To do that, we start with the reconstruction of existence concepts and its intentional characteristcs and able to be (Seinkonnen) in Being and Time. In the second part, the analysis of the affective tone of anguish is the starting point to get to the mode of being of man, described carefully by Heidegger (Sorge). We also argue that caution is the only way to be compatible with an entity that in its own way of being is marked by an radical negativity (incomplete). Finally, in the third chapter, we present, in its general features, the possibility compatible with the character of able to be of the being-there: the possibility of death, ontologically understood as being-for-death. In the conclusion, we pointed the greatest interest of Heidegger in his investigation of existential dynamics of the being-there. This interest consist in to visualize, through what Heidegger calls of existential crisis of being-there (provided by the anguish) the genesis point of the ontologies.

Conselho Nacional de Desenvolvimento CientÃfico e TecnolÃgico / nÃo hà / Este trabalho à um estudo sociopoÃtico que tem como tema gerador o que à ser negro/ser negra? Intenta-se saber que confetos (conceitos perpassados de afetos) estudantes universitÃrios, futuros educadores tecem sobre a questÃo quando convidados por linguagens que instigam o imaginÃrio, como à o caso da pesquisa sociopoÃtica. Para tanto, foram realizadas duas oficinas de produÃÃo de dados buscando aguÃar os sentidos dos corpos do grupo pesquisador uma vez que sÃo fontes de conhecimento. A primeira teve como metÃfora uma viagem ao lugar do ser negro. A segunda, a metamorfose do grupo pesquisador em bicho do ser negro. A anÃlise dos dados foi confrontada com autores que versam sobre o tema em questÃo, assim como alguns conceitos caros à esquizoanÃlise, notadamente: rizoma, devir e multiplicidade. Na tentativa de ir alÃm da escrita acadÃmica convencional, à adotado o conto enquanto estilo literÃrio. A menina interiorana negra deseja descobrir quem à o ser negro/ser negra, e viaja com Macu, um erà de verdade, nas trilhas desta aventura/pesquisa. Ao longo das muitas viagens que fazem com ajuda da sociopoÃtica encontram muitos outros aventureiros desejosos de respostas sobre a pergunta que nÃo cala em seus seres: quem à o ser negro/a?

O objetivo foi compreender a escola em seu papel social na inserção do ser em um lugar-espaço, percebendo as possíveis tentativas da escola para compreender esse ser e possibilitar sua introdução em seu meio. Para tanto, utilizei como referencial teórico-metodológico a perspectiva qualitativa de cunho etnográfico e contribuições de Geertz, assim como autores que me possibilitaram compreensão do ser, do espaço e da educação como, Nietzsche, Deleuze, Certeau, Larossa, entre outros. Foi tomada como lugar e espaço dessa pesquisa uma escola municipal de Tiradentes, onde aconteceram as observações participantes. Também como instrumentos foram utilizados as entrevistas semi-estruturadas, que ocorreram dentro e fora da escola, e a análise de alguns documentos da escola, como o Projeto Político Pedagógico e o Currículo. As perspectivas analisadas partiram do particular para o geral podendo identificar múltiplos olhares necessários para a compreensão da educação e do turismo em prol do ser, por entender que o ser, a escola, a cidade estão mergulhados num contexto ainda maior de conexões. Este trabalho também trouxe a oportunidade de repensar o modelo atual de educação no qual estamos trabalhando. Deixando claro que mudanças precisam ser feitas que caminhem na direção de uma escola cujo Currículo e o Planejamento Político Pedagógico se voltem para a aprendizagem e valores que contribuam para a compreensão do ser e da produção de seu espaço social. Admitindo a aprendizagem como proposta de compreensão dos seres humanos e sua multiplicidade de sentidos e olhares constitutivos e próprios. / The existence of the present work if must to the desire get ways so that the school can be a propitious space for the matureness and the happiness of human beings. The objective was to understand the school in its social paper in the insertion of the being in a place-space, being perceived the possible attempts of the school to understand this being and to make possible its introduction in its half one. For in such a way, I used as referencial theoretician-method the qualitative perspective of ethnographic matrix and contributions of Geertz, as well as authors who make possible me understanding of the being, the space and the education as, Nietzsche, Deleuze, Certeau, Larrosa, among others. It was taken as place and space of this research a municipal school of Tiradentes, where they had happened to the participant comments. Also as instruments the half-structuralized interviews had been used, that had occurred inside and outside of the school, and it analyzes it of some documents of the school, as the Project Pedagogical Politician and the Resume. The analyzed perspectives had left of the particular one for the generality having been able to identify to multiples necessary looks for the understanding of the education and the tourism in favor of the being, for understanding that the being, the school, the city is dived in a still bigger context of connections. This work also brought the chance to rethink the current model of education in which we are working. Leaving clearly that changes need to be made that they walk in the direction of a school whose Resume and the Planning Pedagogical Politician if comes back toward the learning and values that contribute fo toward the learning and values that contribute for the understanding of the being and the production of its social space. Admitting the learning as proposal of understanding of sensible the human beings and its multiplicity of and constituent and proper looks.
