Tutelas de urgências no processo arbitral

With this goal, the paper seeks to study the competence of the arbitrator to decide the precautionary and anticipatory measures, before and after the installation of the arbitral proceedings, in light of the Arbitration Act, of the current Civil Procedure Code, of the regulations from the Arbitration Chambers, of the result of the research undertaken between the Law School of São Paulo from the Getúlio Vargas Fundation and the Brazilian Arbitration Committee, of the doctrine, the jurisprudence and of the Reform Project of the Civil Procedure Code. Although divergent interpretations were identified in the doctrine about the power of the arbitrator to grant and judge the emergency measures, due to the prevision of Article 22, § 4 of Law No. 9.307/96, there is the prevailing understanding that the arbitrator holds the referred power against the autonomy of the parties. Regarding the pre-arbitration precautionaries, the judiciary is vested with the power of decision, while not initiated the arbitration proceedings, except when the parties impute the arbitrator with the decision, through the prevision in the Arbitral Convention or in the Arbitration Rules of the Chamber chosen by them to administer the arbitration. It is evident in the doctrine, as well as in the jurisprudence, the understanding about the sovereignty of the arbitrator to keep or reject judicially the precautionary measures considered, in seat of the arbitration award. Due to the absence of coercive power of the arbitrator, it is identified the cooperation of the judiciary to comply with precautionary and anticipatory arbitration awards, not met voluntarily by the parties, to ensure the effectiveness of the jurisdictional protection. / O presente trabalho dissertativo se propõe à análise da apreciação das tutelas de urgência em sede de arbitragem, nas fases antecedente e incidental. Para tanto, busca-se o estudo da competência do árbitro para decidir as medidas cautelares e antecipatórias, antes e depois de instalado o processo arbitral, à luz da Lei de Arbitragem, do Código de Processo Civil atual, dos regulamentos das Câmaras Arbitrais, do resultado da pesquisa realizada entre a Escola de Direito de São Paulo da Fundação Getúlio Vargas e o Comitê Brasileiro de Arbitragem, da doutrina, da jurisprudência e do Projeto de Reforma do Código de Processo Civil. Embora identificadas interpretações divergentes na doutrina acerca do poder do árbitro de conceder e julgar as medidas de urgência, em razão da previsão do Art. 22, § 4º da Lei nº 9.307/96, observa-se o entendimento majoritário de que o árbitro detém o referido poder, ante a autonomia da vontade das partes. Quanto às cautelares pré-arbitrais, encontra-se o judiciário revestido do poder de decisão, enquanto não seja instaurado o processo arbitral, exceto quando as partes atribuam ao árbitro a decisão, através de previsão na Convenção Arbitral ou no Regulamento da Câmara escolhida por elas para administrar o processo arbitral. Evidencia-se na doutrina, bem como na jurisprudência, o entendimento acerca da soberania do árbitro para manter ou rejeitar as cautelares apreciadas judicialmente, em sede de sentença arbitral. Em razão da ausência do poder coercitivo do árbitro, identifica-se a cooperação do judiciário para dar cumprimento às decisões arbitrais acautelatórias ou antecipatórias, não cumpridas voluntariamente pelas partes, a fim de assegurar a efetividade da tutela jurisdicional.

Chapter one examines the history of public accountability and the creation of the Court of Accountability in Brazil. The second chapter examines the nature of jurisdiction, commenting the work of the most important authors that addressed the issue. The third chapter reviews the bibliography on the discussion of the subject, considering the context of various Constitution drafts occurred since 1891 in Brazil. Finally, on the forth chapter the main arguments concerning the legal status of the decisions made by the Court of Accounts in Brazil are described and discussed. / A presente dissertação estuda a natureza jurídica das decisões proferidas pelos Tribunais de Contas no Brasil, investigando a hipótese de que o controle externo, quando exercido através de processos de julgamento de contas, constitui uma jurisdição especial, exercida fora do âmbito do Poder Judiciário, como exceção ao modelo de jurisdição única previsto no art. 5º, inciso XXXV, da Constituição Federal de 1988. No primeiro capítulo, será abordada a origem histórica e os fundamentos da função de controle externo da administração pública e a criação do Tribunal de Contas no Brasil. Em seguida, no segundo capítulo, será discutido o conceito e a natureza jurídica da função jurisdicional, através do estudo dos principais autores que se dedicaram ao instituto. A partir das considerações sobre o conceito de jurisdição, no terceiro capítulo se procederá a uma revisão bibliográfica das obras que se dedicaram à discussão do tema proposto, contextualizando os argumentos doutrinários com as Constituições Republicanas que se sucederam no Brasil desde 1891. Por fim, no quarto capítulo os principais argumentos sobre o tema serão sintetizados e debatidos.

The overall aim of this licentiate thesis is to increase knowledge of the special educators’ professional role and work in relation to special educational support for recently arrived immigrant pupils. The need for the study is motivated by the immigrant pupils’ low achievement of goals and schools responsibility to adapt education to each pupil’s needs in a school for all. The first study examines special educators’ role and work in relation to special educational support for recently arrived immigrant pupils and the professional group's view of the reasons for special educational support for these pupils. The results are based on responses in a questionnaire directed to 483 special educators. The results show that the special educators state that the reasons why recently arrived immigrant pupils are in need of special educational support are that the knowledge requirements are too difficult for the pupils to achieve or that the pupils have individual shortcomings. The occupational group's tasks consist of administrative work and the development of learning environments. According to the special educators, most often class and subject teachers and mother tongue tutors provide special educational support. The special educators collaborate to the greatest extent with class and subject teachers and with the pupils, while they want more collaboration with mother tongue tutors. The results of the study are interpreted and discussed based on Abbott's theory (1988) reasoning about professional groups’ claims of jurisdiction, Persson's (1998) categorical and relational perspectives and Hughes' (1958) concept of dirty work. In the second study, free text answers (n = 451) from the questionnaire are examined, where the special educators describe how they and their schools have developed learning environments for recently arrived immigrant pupils in need of special educational support. The free text answers are analyzed using a qualitative content analysis (Hsieh & Shannon, 2005). This analysis is then theorized based on Skrtics´ (1991; 2005) concepts of the school system to interpret obstacles and opportunities in the development of the learning environments. The results show that the development have mainly taken place through general adaptations (one size fits all solutions), language-adapted solutions and special solutions. The analysis based on Skrtics’ concepts shows how the machine and professional bureaucracy can act as an obstacle to the development of learning environments for recently arrived immigrant pupils in need of special educational support. The thesis helps to bring together the results from the two studies. A developed contextualization is made, and the results from the two studies are discussed in relation to previous research and theoretical points of departure. Abbott's (1988) reasoning on claims of jurisdiction and Skrtics’ conceptions of the school system (1991; 2005) are combined to get a deeper understanding of the deadlocks that may exist in the bureaucratic system.

Shortcomings of and recommendations to improve double taxation relief mechanisms: a study of South African resident companies engaged in the exploration for and production of oil and gas outside of South Africa

South African resident companies engaged in the exploration for and production of oil and gas outside of South Africa are subject to double taxation. This thesis evaluates whether South African resident companies engaged in the exploration for and production of oil and gas outside of South Africa receive full relief from double taxation in South Africa. The thesis provides a qualitative examination of the fundamental legal designs used for the allocation of the right to mine oil and gas and the fiscal regimes applied to the taxation of oil and gas mining at the source. The thesis explores the basis for taxation of foreign oil and gas income in South Africa and the remedies for double taxation in terms of the domestic tax legislation. Assuming that a tax treaty exists between South Africa and the host government, qualification for double taxation relief and classification of income in terms of a double taxation agreement (DTA) are evaluated. It is anticipated that a South African resident Oil and Gas company will choose the most favourable method and form of double tax relief when filing its corporate tax return in South Africa based on the commercial impact thereof. To aid in this decision, the thesis contrasts the quantum of the double tax relief under the domestic tax legislation with that available under the DTA. Using an adaptation of the IMF's FARI methodology, a quantitative analysis of the economic impact for a South African resident Oil and Gas company mining in Egypt, Equatorial Guinea, Ghana and, Nigeria is examined. The thesis concludes that there are circumstances where South African resident Oil and Gas companies are unable to achieve full double tax relief under the domestic tax legislation and make recommendations (where applicable) for amendments to the domestic tax legislation to achieve a form of full double tax relief as close as possible to the single tax principle.

El presente trabajo es una lectura de la obra jurídica de Michele Taruffo desde la teoría y la filosofía del derecho. Consiste en reconstruir la obra del profesor lombardo, dispersa a lo largo de cinco décadas, no como un sistema de derecho procesal o una línea de monografías coherente -que serían lecturas posibles-, sino como una teoría de la decisión judicial, a partir de dos ejes cardinales que son recurrentes en sus trabajos: el concepto de motivación de la sentencia y el concepto de prueba. Para ello, la investigación parte de describir el marco de las principales influencias teóricas en la formación del profesor de la Universidad de Pavía, desde tres perspectivas: la del procesalismo italiano, la de la iusfilosofía analítica y la de un conjunto heterogéneo de autores, desde comparatistas a teóricos, con los que se cruzó la obra de Taruffo. La parte propositiva consiste en reconstruir aquello en lo que consiste la obra fundamental del autor: el concepto de jurisdicción, el concepto de decisión judicial que se deriva del primero, y el concepto de prueba. El primero supone una lectura -en clave de “alta dogmática”- de la actividad consistente en resolver controversias y de los presupuestos de su legitimidad. El segundo redescubre la funcionalidad de la motivación de la sentencia judicial desde las razones por las que se exige en los ordenamientos modernos. El tercero se concentra en la racionalidad subyacente a la búsqueda (de la fijación) de la verdad en las premisas que integran el discurso justificativo de las decisiones judiciales.

Portrait actuel des services de bibliothèque dans le milieu carcéral québécois

La présence d'une bibliothèque en milieu carcéral apporte des bienfaits aux personnes incarcérées. Elle est source de loisir, d’éducation et d'accès à l'information dans un environnement hautement sécurisé et limitatif. La bibliothèque de prison est soutenue par les déclarations des Nations Unies pour le traitement des détenus, le Manifeste de l'UNESCO sur la bibliothèque publique et par la Fédération internationale des associations et institutions des bibliothèques (International Federation of Library Association and Institutions (IFLA)) qui en soulignent les avantages. Des études ont été menées dans différents pays sur la présence, la gestion et les rôles de la bibliothèque de prison dans différents types d'établissements correctionnels. Cependant, très peu d'études ont été publiées au Canada et, au Québec, aucune depuis 1973. Ainsi, cette recherche vise à dresser un portrait des services de bibliothèque offerts dans les établissements de détention de juridiction provinciale du Québec. Cette recherche descriptive repose sur une recherche documentaire et une enquête auprès des responsables de la bibliothèque par le biais d'un questionnaire en ligne. Les résultats montrent que tous les établissements ayant répondu à l'enquête offrent des services de bibliothèque, et que presque toutes les bibliothèques possèdent un local dédié et une collection assez riche. On observe toutefois que plusieurs cibles notamment celles de l'IFLA ne sont pas atteintes (accessibilité physique, diversification des supports, activités, ressources technologiques). Ces résultats enrichissent un volet de la bibliothéconomie qui est peu traité en apportant des données actuelles sur la situation dans les établissements de détention de la province. Ils mettent en lumière une tranche de la population souvent invisible pour qui la bibliothèque est importante et ouvrent la voie à de futures recherches sur le sujet. / The presence of a library in a prison environment brings benefits to prisoners. It is a source of leisure, education and access to information in a highly secure and limiting environment. The prison library is supported by the statements of the United Nations for the treatment of prisoners, the UNESCO Public Library Manifesto and the International Federation of Library Associations and Institutions (IFLA) which highlight its benefits. Studies have been conducted in different countries in the presence, management and roles of the prison library in different types of correctional institutions. However, very few studies have been published in Canada and none in Quebec since 1973. Thus, the research aims to draw a portrait of the library services offered in detention facilities under Quebec's jurisdiction. The realization of this descriptive research has been done through a documentary research and a survey with the people managing the libraries using an online questionnaire. The results of this study show that all establishments offer library services in detention centres under provincial jurisdiction in Quebec. The results show that prisoners cannot use services on site or directly access documents in almost all establishments. In addition, there is a lack of diversity in the document supports, few activities are proposed, and no technological resources are accessible. These results enrich a section of librarianship that is little treated by providing current data on the situation in the province’s detention facilities. They shed light on an often invisible segment of the population for whom the library is important and pave the way for future research on the subject.

[pt] A centralidade assumida pelo STF na cena política brasileira tem suscitado diversas reflexões teóricas sobre o papel a ser exercido pela jurisdição constitucional e sobre sua legitimidade democrática. No âmbito latino-americano, muito tem se falado em um novo constitucionalismo caracterizado, dentre outros aspectos, pela ampliação da gama de direitos previstos e pelo fortalecimento do Judiciário. O presente trabalho tem por objetivo discutir a atuação do Supremo Tribunal Federal em face das perspectivas criadas pelas teorias que buscam justificar seu protagonismo. Para tanto, parte-se da premissa de que a análise crítica do fenômeno deve contemplar não apenas os elementos jurídicos, mas também a natureza política de muitas das escolhas realizadas pela corte e por seus membros. Nessa linha, são trazidos alguns julgamentos históricos do tribunal, escolhidos para demonstrar como ele construiu seu personagem ao longo do tempo, dando destaque tanto para as dimensões políticas como jurídicas de sua atuação. Em seguida, discutem-se as possibilidades de desenhos institucionais em países marcados por fortes desigualdades sociais, dentro de um contexto de entusiasmo com o desempenho das cortes constitucionais na efetivação de garantias básicas da cidadania. Após este panorama teórico, o trabalho se debruça sobre a realidade empírica da atuação do tribunal, verificando em que medida sua conduta corresponde às expectativas criadas em torno das capacidades institucionais da jurisdição constitucional. / [en] The central role assumed by the Federal Supreme Court in the Brazilian political scene has raised various theoretical considerations about the part that the constitutional jurisdiction will play, and about its democratic legitimacy. In the Latin-American context, a lot has been said about a new constitutionalism, which is characterized, among other aspects, by a greater scope of prescribed rights and by the strengthening of the judiciary. The present work intends to discuss the Federal Supreme Court’s practice, taking in consideration perspectives created by theories that seek to justify its protagonism. For this purpose, this work assumes that the critical analysis of the phenomenon must contemplate not only legal elements, but also the political nature of many of the choices made by the Court and its members. Therefore, historical judgments of the Court were selected to demonstrate how it has built its persona through time, highlighting both the political and legal dimensions of its action. After that, this work will discuss institutional designs possibilities in countries characterized by strong social inequalities, inside a context of social excitement about the performance of constitutional courts in implementing basic citizenship guarantees. After the theoretical overview, the research approaches the empirical reality of Court practices, verifying to what extent its conducts correspond to the expectationsvcreated around the institutional abilities of constitutional jurisdiction.

International Criminal Justice : An Interdisciplinary Inquiry into the Territorial Jurisdiction of the International Criminal Court over National’s of Non-State Parties

Over the years, the International Criminal Court (ICC) has received criticism for exercising its territorial jurisdiction over non-state parties’ nationals. Non-state parties claim that the Court is illegitimate and that its jurisdictional claim over their nationals violates the principle of consent in public international law. This thesis aims to develop interdisciplinary research into international relations and international law by asking the question of how the alleged legitimacy deficit of the ICC can be alleviated. The interdisciplinary methodology is approached through supplementing the legal dogmatic method with international relations theory. In turn, the analysis is carried out in two sections, one dedicated to legal analysis and the other to the international relations theory constructivism. The main finding of legal analysis is that the ICC’s jurisdictional claim over non-state parties is in most cases fully in line with the principle of consent. The analysis finds that the main solution to the legitimacy deficit is that the Court should make an effort to employ its secondary and tertiary sources of law in its interpretation. Both the legal analysis and constructivist theory point to the ICC needing to be more persuasive. The ICC and its allies should create new understandings about it through norm transformation. This norm transformation will take the form of legal persuasion as well as diplomatic and political pressure. In regard to the interdisciplinary research agenda, this inquiry demonstrates that interdisciplinary researchers can tap into the legal discipline and its methodology by embracing legal formalism. Such use of the legal discipline will also allow for constructivists to learn from legal scholars about persuasion and norm systematisation.

Rights, responsibilities and reform: a study of French justice (1990-2016)

The principal questions addressed in this portfolio of eleven publications concern the reforms to French justice at the end of the twentieth and beginning of the twenty-first centuries. The portfolio is accompanied by a supporting statement explaining the genesis and chronology of the portfolio, its originality and the nature of the submission's distinct contribution to knowledge. The thesis questions whether the reforms protect the rights of the defence adequately. It considers how the French state views its responsibility to key figures in criminal justice, be they suspected and convicted criminals, the victims of offences or the professionals who are prosecuting the offences. It reflects upon the role of the examining magistrate, the delicate relationship between justice, politics and the media, breaches of confidentiality and the catastrophic conditions in which suspects and prisoners are detained in French prisons. It then extends its scope to a case study of the prosecution of violent crimes before the International Criminal Tribunal for Rwanda, and discovers significant flaws in procedures even at international levels. In concluding, it asks whether, given the challenges facing the French criminal justice system, French courts are adequately equipped to assure justice when suspects charged with the most serious international crimes appear before them under the principle of universal jurisdiction. The research, carried out over a number of years, relies predominantly on an analysis of French-language sources and represents a unique contribution to the understanding and knowledge of French justice for an English-speaking public at the turn of the twenty-first century.

Primeiramente, são apresentados os aspectos jurídicos da progressão da forma de ingresso e as normas que são base à relevância atual da Suprema Corte e seus juízes. Em seguida, essa exploração é expandida com a demonstração da aplicação prática da norma por parte dos agentes oficiais competentes. Como isso atrai muitos debates na literatura acadêmica, o terceiro item é responsável por classificar as críticas existentes ao modelo vigente. Por fim, o mesmo é feito quanto às proposições de modificação do sistema, filtrando e organizando as Propostas de Emenda à Constituição atinentes ao tema. / [en] This master s dissertation explores the selection of the Ministers of the Brazil s Federal Supreme Court. It intents to offer a descriptive and detailed study about the data and discussions about the subject. In order to do that, four topics were elaborated and concatenated. Firstly, the legal aspects of the progression of selection and the norms that grounds the current relevancy of the Supreme Court and it s judges are presented. Following, that analysis is expanded with the demonstration of the pratical aplication of the norm by it s official competent agents. As that attracts a lot of debates in the academic literature, the third item is responsible for classifying the existing critics about the current model. Lastly, the same is done with the propositions for reforming the system, by filtering and organizing the Constitucional Amendment Proposals related to the theme.
