Vårdande och icke-vårdande tröst / Caring and non-caring consolation

Syftet med avhandlingen är att, ur ett vårdvetenskapligt, och ett i detta inkluderat vårdteologiskt per- spektiv, belysa innebörden av fenomenet tröst och hur tröst förhåller sig till lidande och vård. Det görs i två empiriska intervjustudier med vårdare och äldre vårdtagare samt en tredje delstudie som analyse- rar tröst såsom den framstår i Jobs bok i Gamla testamentet. Dessa delstudier behandlar vårdares upp- levelse av tröst och att trösta, äldre vårdtagares upplevelse av tröst samt Jobs upplevelse av tröst. Metodologiskt har forskningen sin utgångspunkt i fenomenologi och hermeneutik. En fenomenolo- gisk-hermeneutisk metod, inspirerad av Paul Ricoeur, har använts för textanalyserna. I avhandlingen behandlas också det som är signifikant för poetisk och religiös text. De metaforer som förekommer i de empiriska delstudierna med vårdare och äldre analyseras för att ta tillvara det överskott av mening som metaforer, enligt Ricoeur, kan uttrycka. Resultatet visar fem övergripande innebörder: Den motsägelsefulla trösten, Den sammanbindande trösten, Den stumma trösten, Den okontrollerade trösten och Den vilsamma trösten. En vårdande tröst är motsägelsefull såtillvida att den innebär dels att den lidande överlämnar sitt lidande till någon an- nan, dels att lidandet kan ges tillbaka för att lidas. Tröst kan således vara att lida. En sammanbindande tröst är närvarande, d.v.s. är hos den lidande och utgår från dennes lidande. Denna tröst kännetecknas av djup gemenskap, en upplevelse av att vara förstådd på ett djupare sätt. Resultatet visar också en tröst som är stum. Denna tröst svarar inte an på den lidandes upplevelse av sitt lidande, är oformlig och saknar följsamhet för lidandet. Ett exempel på en stum och icke-vårdande tröst är vännernas tröst i Jobs bok. Denna tröst förmår inte trösta därför att den inte är där Job är, d.v.s. i hans upplevelse av sitt lidande. Vidare framstår en vårdande tröst som okontrollerad därför att den dels är spontan, dels bistår den lidande att släppa kontrollen över lidandet. Att släppa kontrollen innebär bl.a. att den lidande ger upp försöken att förstå lidandet för att istället låta det oförståeliga vara oförståeligt. Genom att ge upp det som på olika sätt binder lidandet infinner sig en tröstande och hälsobringande vila i eller från li- dandekampen. Resultatet som helhet tolkas ur ett vårdvetenskapligt perspektiv som vårdgemenskap, tro, hälsa och offer. Tröst som hälsa förstås utifrån en teoretisk modell, inspirerad av Katie Erikssons ontologiska hälsomodell. Filosofiskt-etiskt belyses forskningen utifrån företrädesvis Emmanuel Levinas. Resultatet diskuteras i förhållande till tidigare forskning och i förhållande till vårdvetenskap, samhälle och vård. / The aim of the thesis is, from a caring science perspective including a caring theology perspective, to illustrate the meaning of the phenomenon consolation and how consolation relates to suffering and care. Two studies were completed where staff and elderly care receivers were interviewed and a third study focused on an analysis of consolation as it is presented in the Book of Job in the Old Testament. These studies deal with carers’ experiences of consolation and consoling, elderly care receivers’ ex- periences of consolation, and Job’s experience of consolation. Phenomenology and hermeneutics form the basis for the methodological approach. A phenomenologi- cal-hermeneutic method, inspired by Paul Ricoeur, has been used for the text analyses. The thesis also covers significant aspects of poetical and religious texts. The metaphors that occur in the interview studies with the carers and the elderly are analysed in order to take care of the excess of meaning that, according to Ricoeur, can be expressed in metaphors. The result show five overall meanings: The contradictory consolation, The bonding consolation, The mute and rigid consolation, The uncontrolled consolation and The restful consolation. A caring conso- lation is contradictory in the sense that it entails that the sufferer on the one hand passes on his or her suffering to someone else and on the other hand that the suffering can be returned to be suffered. Con- solation can thus entail suffering. The bonding consolation is present, i.e. is with the sufferer and is based on that person’s suffering. This consolation is characterised by a close fellowship, a feeling of being understood at a deeper level. The results also reveal a consolation that is mute and rigid. This consolation does not respond to the sufferer’s experience of his or her suffering, is shapeless and therefore unable to follow the suffering. An example of a mute, rigid and non-caring consolation is the consolation of the friends in the Book of Job. This consolation is not capable of consoling because it does not correspond to where Job is, i.e. in his experience of his suffering. A caring consolation is also uncontrolled because it is on the one hand spontaneous and on the other hand helps the sufferer to lose control over the suffering. To lose control entails, amongst other things, the sufferer giving up trying to understand suffering and instead lets that which is incomprehensible be incomprehensible. A con- soling and health-bringing rest in or from the struggle with suffering presents itself by giving up what in various ways is tied to the suffering. The result as a whole is interpreted from a caring science perspective with the following important concepts: caring relationship, faith, health and sacrifice. Consolation as health is considered on the basis of a theoretical model inspired by Katie Eriksson’s ontological health model. The research is also illustrated from a philosophical-ethical perspective, mainly based on the work of Emmanuel Levinas. The findings are discussed in relation to previous research and also to caring science, society and care. / <p>The theis also includes 10 pages summary in Enligh, p. 153-163.</p>

The objective is to analyze the subject-matter both from legal and economic point of view, with respect to tax and accounting implications. The thesis contains also the analysis of suitability of particular takeover techniques for specific types of investors, with respect to the aims and intents pursued.

In the theoretical part of the paper there are explained key definitions and general facts concerning with takeovers. The main theme of the theoretical part analyzes the most frequent takeover techniques. The paper studies how particular techniques work. It also takes into account expert discussions about the takeover theme. The takeover laws of the Czech Republic are analyzed in the second part of the diploma thesis. The paper contains a synthesis of theoretical findings and regulation of corresponding laws. It reveals practical use of particular takeover techniques in the Czech Republic.

Marketing turistické nabídky města Žatce / Marketing of tourism offer of the town of Žatec

The thesis analyses the marketing of tourism offer of the town of Žatec with a particular emphasis on its principal product -- the Temple of Hops and Beer. Its main objective is to formulate proposals of specific marketing measures for the popularization of the general tourism offer of the town of Žatec and the Temple of Hops and Beer for the last quarter of the year 2011 and 2012. After defining the main tourist industry attractions of Žatec, the thesis builts upon the SWOT analysis and 5P marketing mix. In the case of the Temple of Hops and Beer the paper presents a proposal of the marketing plan incorporating 5C marketing approach, which assesses the above-mentioned product from a broader visitor's point of view. Both approaches are adjusted to budget and public administration management rules. This thesis' conclusion will serve as an input for the tourism industry subjects in Žatec in accordance with the development strategies approved on local, regional, as well as national level.

Web Intelligence has been quiet a popular topic lately. This thesis doesn't try to form the exact definition of Web Intelligence, because it's impossible. The aim is to demonstrate practical use of WI in retail banking instead. Since Web Intelligence can be seen as some kind of advanced Web Analytics system, the text starts off with explaining basics of Web Analytics. Then a hypothetical story about Mr. Cerny ' looking for a bank that would give him a mortgage loan is told. Meanwhile, a bank that provides Mr. Cerny 's current account tries to sell its own mortgage loan to him. Unfortunately, wrong channel at a wrong time is used to communicate the message which ends up with Mr. Cerny denying the offer instantly. Obvious mistakes made by the bank are then picked up and discussed. The conclusion is you need to know your customer very good to have long and healthy relationship. One way to achieve this is to deployWeb Intelligence solution that would reveal online habits of every one of your customers. Event Driven Marketing online campaigns can then be used to identify customers needs and target them at the right time, through the right channel and with the right message. If everything works well, the customer starts to percieve marketing communication as a personal support rather than annoying advertisement.

This qualitative study highlights the fact that sexual abuse is considered a social problem. However, few are disclosing their experiences of sexual abuse during childhood, and although children tell, it is difficult to regard them as credible victims. Our aim with this study is to gain an understanding through adults stories about the sexual abuse they were exposed to during their childhood. In order to achieve this purpose, we have analyzed autobiographies written by adults, who during their childhood have become sexually exposed. The study resulted in the problem of considering children as victims, before the abuse's disclosure but also after. The children were seen, in the cases studied, not as credible due to the perpetrator's identity. This study also found that the children did not report their experiences of sexual abuse due to factors such as shame and normalization. The study thus found that sexual abuse against children is complex and so is the view of the children as victims and their silence.

La liberté contractuelle est un principe fondateur du droit civil français, en vertu duquel chaque sujet de droit est libre, non seulement de décider de s’engager ou non, mais également de déterminer les conditions de son engagement contractuel et la personnalité de son cocontractant. Malgré ses apparentes particularités, dues à son objet, le droit des marchés financiers ne constitue pas une branche autonome du droit, de telle sorte que le droit civil a toute vocation à s’appliquer sur les marchés financiers. Pour autant, un rapide examen du droit des marchés financiers fait apparaître des atteintes à la liberté contractuelle, en premier lieu à la libre détermination du contenu du contrat. Ce constat est d’autant plus frappant lorsque l’on approfondit l’étude des marchés financiers, les offres publiques étant en effet l’occasion de multiples atteintes. Plus particulièrement, l’initiative contractuelle est lourdement affectée par les offres publiques obligatoires, qu’elles soient d’acquisition ou de retrait. Cette thèse a pour objet d’examiner ces diverses atteintes portées par le droit des marchés financiers à la liberté contractuelle afin d’en déterminer le fondement. / Contractual freedom is a founding principle of French civil law, under which each legal subject is free, not only to decide whether to engage, but also to determine the conditions of his contractual commitment and the personality of the other party. Despite its apparent peculiarities, due to its object, the financial market legislation is not an autonomous branch of law, so that the civil law should apply to the financial markets. However, a quick review of the financial markets legislation revealed violations of contractual freedom, in the first place to free determination of the content of the contract. This finding is even more striking when looking further : the contractual intent is heavily affected both through the mandatory public bid and through the mandatory buyout offer. This thesis examines how the contractual freedom is affected by the financial market legislation to determine the causes.

Analýza systému zadávání, hodnocení a výběru podlimitních veřejných zakázek / Public contracts below threshold: an analysis of terms, evaluation and selection

The thesis aims to examine effectiveness of the system of public procurement in the Czech Republic and emphasisizes its evaluation criteria. Evaluation criteria in public procurement are an essential part of the selection process and play thus a highly important role when selecting the winning bid, or rather the the winner awarded with the public contract to be implemented. The paper focuses on below-threshold procurement in building area. Below-threshold public contracts can be divided into two groups according to the pre-set evaluation criteria. Either is there a single criterion for evaluation of the bids accepted, i.e. the key criterion is the lowest bid placed or more sub-criteria are applied, i.e. the key criterion is economic advantage of the offer. In order to determine/identify, which way of public procurement is more efficient, different characteristics of the evaluation process in each of the groups are compared. In the final part these partial results are generalized and thus allow formulating a few recommendations for practise/real-life recommendations.

This Master's thesis focuses on the United Nations Convention on Contracts for the International Sale of Goods (CISG), better known as the Vienna Convention. The main purpose of this thesis is to evaluate conditions for application of this international treaty and to assess the contracting process under the CISG including the similarities and differences with the Czech national legislation. Finally, it seeks an answer to the question, which of these rules (international or national) are more advantageous for a Czech contractual party with respect to concluding a contract. The thesis is divided into five parts. The first one represents an introduction to the CISG, its origin and the Czech Republic's attitude to it. The second part identifies the conditions for application of the CISG and therefore defines a subject and an object of an international contract of sale under the CISG. Both third and fourth parts gradually introduce two phases of the contracting process (offer and acceptance) including the relevant case-law. The last chapter strives to complete the contracting process with an analysis of the exact moment, when a contract is concluded, as well as with an analysis of a potential battle of the forms and its impact on a contract conclusion.
