Perspectivas acerca do niilismo na Genealogia da moral / Perspectives about the nihilism in the Genealogy of morals

This concept usually presents signifying a consequence of the moral development of the West, where the slave resentment and bad conscience, rooted in culture, ends up affecting modern man of a weariness and an emptying of value: it is nihilism in its own sense, a phenomenon of modern origin. On the other hand, there are aphorisms and excerpts, least discussed by the German philosopher in his work, indicating that the origin of nihilism refers to a distant period of human history, preceding the Christian moral-ascetic, and a phenomenon that opens a gap of absence of meaning about life and human suffering. These incompatible aspects of nihilism are present both in print, and in private notes of Nietzsche. The interior of the book Genealogy of Morals also holds that ambiguity of the concept of nihilism. The main objective of this work is to investigate the work Genealogy of Morals, with the help of other texts, trying to understand the meanings of nihilism and position in the history of civilization. Nietzsche s work as objects of study presents the concepts of resentment and bad conscience ascetic ideal, elements that are constitutive of Western morals. With interests in its topicality, Nietzsche investigates the past moral to its prehistory. Thus, this work is fundamental research into the origin of nihilism. His concepts are analyzed from a procedure that puts them in the realm of historical development and the dynamics instinctual, while concepts that change over time and have multiple meanings: with this polysemic feature that the central elements of the work are presented as well as nihilism. The Genealogy of Morals finally reveals that nihilism has various meanings, but that does not necessarily clash with each other. We show in this work a form of nihilism primordial, a "first nihilism" that is precedent-Christian ascetic morality, including that operates as one of the causes of this moral. However, nihilism is presented as historical product of peacemaking mechanisms of civilization, which inevitably leads to poor awareness and resentment. Human instincts turn inward, causing a great malaise of civilization in the form of a long suffering baseless. The ascetic priest gives an answer to this suffering, reverses the direction of resentment, bad conscience reinterpreting the animal, making it more serious, in a way defined as the interpretation of suffering for sin. The bad conscience made man suffer senseless with instincts that turned against him, however, with the ascetic interpretation, now he unloads his forces against them with a sense that justifies the suffering. / Ao analisar o conceito de niilismo, que se mostra polissêmico na obra de Nietzsche, nos deparamos com impasses frequentes referentes à origem desse fenômeno. Esse conceito se apresenta geralmente significando uma consequência do desenvolvimento da moral do ocidente, em que o ressentimento escravo e a má consciência, enraizados na cultura, se transformam até que terminam acometendo o homem moderno de um cansaço e de um esvaziamento de valor: é o niilismo em seu sentido mais próprio, um fenômeno de origem moderna. Por outro lado, há aforismos e trechos, menos debatidos pelo filósofo alemão em sua obra, que indicam que a origem do niilismo remete a um período longínquo da história humana, precedente à moral ascético-cristã, e a um fenômeno que abre uma lacuna de ausência de sentido em relação à vida e ao sofrimento humano. Esses aspectos incompatíveis do niilismo se apresentam tanto em textos publicados, quanto em anotações privadas de Nietzsche. O interior da obra Genealogia da moral também detém essa ambiguidade do conceito de niilismo. O objetivo principal desse trabalho é investigar a obra Genealogia da moral, com a ajuda de outros textos, buscando compreender os significados e a posição do niilismo na história da civilização. O escrito nietzschiano apresenta como objetos de estudo os conceitos de ressentimento, má consciência e ideal ascético, elementos que são constitutivos da moral ocidental. Com interesses na sua atualidade, Nietzsche investiga o passado moral até a sua pré-história. Com isso, essa obra é fundamental na investigação sobre a origem do niilismo. Seus conceitos são analisados a partir de um procedimento que os coloca sob a esfera do devir histórico e da dinâmica instintual, enquanto conceitos que se transformam ao longo do tempo e possuem múltiplos sentidos: é com essa característica polissêmica que os elementos centrais da obra se apresentam, assim como o niilismo. A Genealogia da moral revela finalmente que o niilismo possui sentidos variados, mas que não necessariamente se chocam entre si. Evidenciamos nessa obra uma forma de niilismo primordial, um niilismo primeiro , que é precedente à moral ascético-cristã, que opera inclusive como uma das causas dessa moral. Entretanto, o niilismo se apresenta como histórico, produto dos mecanismos de pacificação da civilização, que inevitavelmente levam à má consciência e ao ressentimento. Os instintos humanos se voltam para dentro, causando um grande mal estar civilizatório, sob a forma de um sofrimento por longo tempo sem fundamento. O sacerdote ascético dá uma resposta a esse sofrimento, inverte a direção do ressentimento, reinterpretando a má consciência animal, tornando-a mais grave, de uma forma definida, como a interpretação do sofrimento pelo pecado. A má consciência fazia o homem sofrer sem sentido com os instintos que se voltavam contra si, porém, com a interpretação ascética, ele agora descarrega suas forças contra si com um sentido que justifica o sofrimento.

Cette thèse propose une analyse de la question de la survivance – notion ayant retenu l’attention de penseurs issus de différentes disciplines tels que Janine Altounian, Jacques Derrida et Georges Didi-Huberman – dans l’œuvre de Sarah Kofman, plus particulièrement dans son récit autobiographique intitulé Rue Ordener, rue Labat, paru en 1994. Quatre grandes orientations guident ce travail dont l’approche théorique se situe à la croisée de la littérature, de la philosophie, de la psychanalyse, de l’histoire (tant sociale que de l’art) et du juridique. Premièrement, nous nous intéressons à ce qu’implique non seulement le fait d’« échapper à la mort », en observant les moyens mis en œuvre pour y parvenir, mais aussi celui de « continuer à vivre » après l’événement de la Shoah. Deuxièmement, nous étudions les différentes manifestations de « la survivance active de l’enfant en nous » (J.-B. Pontalis) de même que celle de « l’objet perdu » dans le travail de deuil impossible, encore autrement « interminable », qui a pris corps dans l’œuvre de Sarah Kofman. Troisièmement, nous abordons la « survivance » au sens du Nachleben d’Aby Warburg et repérons la trace des autres écrits de la philosophe, elliptiquement condensés dans son récit par la reprise de thèmes, le retour de sujets antérieurement évoqués. Quatrièmement, nous interrogeons la locution pronominale « se survivre » et la portée de ses compléments : « dans son œuvre », « dans son témoignage », « dans les mémoires ». Parmi les points qui sont analysés en profondeur dans les chapitres de cette thèse, notons les motifs du ressentiment, du double tragique, du pardon et de l’oubli, de la « disgrâce », de la honte et de la culpabilité, ainsi que les différentes modalités de la survivance – la capacité d’adaptation et le rôle des mères, la lecture, le rire, les arts visuels – mises en œuvre par Sarah Kofman. Dans cette « œuvre-vie » (Pleshette DeArmitt), ce corpus singulier et unique, il s’est toujours agi de ceci, quoi qu’il lui en coûta : « affirmer sans cesse la survie », selon l’expression de Derrida. / This thesis considers the notion of survival—a concept that has attracted the attention of thinkers from various disciplines, from Janine Altounian to Jacques Derrida and Georges Didi-Huberman—in the work of Sarah Kofman, and specifically in her autobiography, Rue Ordener, rue Labat, which came out in 1994. Four lines of inquiry guide this work, whose theoretical approach lies at the crossroads of literature, philosophy, psychoanalysis, and history (both social history and art history), and which, in the central chapter, addresses the legal sphere as well. We begin by looking not only into what it means to “escape death,” (including the attempts to achieve such a goal), but also into the drive to “live on” after the event of the Shoah. Secondly, we study various manifestations of the “active survival of the inner child” (J.-B. Pontalis), as well as the manifestations of the “lost object” in the work of impossible mourning, equally “interminable,” as it takes shape in Kofman’s works. Thirdly, we address the question of “survival” in the sense of Aby Warburg’s Nachleben (a concept studied by Georges Didi-Huberman) and find traces of other writings by Kofman, elliptically condensed in her autobiography, which takes up themes and revisits subjects previously touched upon in her writings. Fourthly, we question the pronominal French locution “se survivre” (to outlive, to outlast) and the scope of its complements: “in his/her work,” “in his/her testimonial,” “in memories”—all drawn together in Kofman’s work in an exemplary manner. Among the points analyzed in depth in the chapters of this thesis are the motifs of resentment, the tragic double, forgiveness and forgetting, “disgrace,” shame and guilt, as well as various modalities of survival—the adaptation ability and the role of mothers, reading, laughter, the visual arts—all used by Kofman. Libertés, Droit, Désordres : les violences émeutières dans l'espace urbain, dynamique des phénomènes et organisation de la réponse sociale / Liberties – Law – Disorders : rioting acts of violence in Urban Areas, Dynamics of the Phenomena and organisation of the social response

L’objet de la recherche consiste à mettre en évidence que la prise en compte des violences émeutières requiert une évolution de l’environnement juridique et des méthodes de maintien de la paix publique hérités de notre histoire. Notre dispositif de gestion de l’ordre public est particulièrement adapté au modèle français de manifestation. C’est considérable et exemplaire à beaucoup d’égards mais cela ne peut clore le débat sur les formes de la réaction sociale nécessaires pour répondre aux différentes formes du répertoire de la protestation en particulier à la dynamique complexe des désordres émeutiers.Alors que la manifestation, son encadrement par les forces de sécurité intérieure et son environnement juridique ressortissent à la culture de l’organisation et de l’ordre, les violences émeutières relèvent, quant à elles, de comportements colériques naturels. Elles constituent un objet et un enjeu différents que traduisent notamment la récurrence des crises en milieu urbain et la difficulté d’y faire face de façon satisfaisante.Sur le plan opérationnel comme sur le plan juridique, l’éventail de la réponse aux désordres est particulièrement large, mais il traduit également un double embarras :• Les violences émeutières sont le plus souvent des violences d’expression. Qu’ils en soient conscients ou non, face à ces comportements, le juge et le politique se sont montrés fréquemment indulgents dans un contexte juridique où la liberté d’expression est un droit fondamental et la manifestation une conquête sans équivalent dans notre pays. Les réponses sociale et judiciaire se caractérisent donc par une mansuétude parfois légitime, parfois inadaptée mais souvent mal comprise.• Les modes d’action policiers et les outils du Droit façonnés par l’environnement juridique et la culture de la manifestation, peuvent se révéler inadaptés pour répondre aux émeutes urbaines et conduire à des évolutions aussi variées qu’inappropriées comme la banalisation du recours à des régimes juridiques d’exception et la sédimentation d’une culture d’affrontement entre police et population.Le concept retentissement / identification et l’analyse des colères rebelles et insoumises ouvrent la voie à une adaptation du droit et de la réponse sociale conciliant le respect des droits fondamentaux et le maintien de la paix publique dans l’espace urbain. Tel est l’enjeu de la dialectique « Libertés - Droit - désordres ». / The object of the research is to highlight that rioting violence cannot be dealt with without an evolution of the legal framework and public-order policing inherited from our History. Our way to manage public-order policing is particularly suitable to our French traditional demonstration pattern. It is significant and exemplary in many respects but that alone cannot close the debate about the forms of social reaction that would be necessary to answer the various forms of the repertoire of protest especially the complex dynamics of rioting disorders.Even though the demonstration, its framing by the police and its legal framework are both an order issue and a cultural issue, rioting acts of violence are a natural irascible behaviour of the human nature. Riots are an object and an issue which translate into in recurring urban crises and the difficulty to satisfactorily deal with them.From an operational point of view and from a judicial one, there is a wide range of answers to the disorders but this results in a double embarrassment:• Riots are very often a means of expression. Consciously or not, the judge and the policy-maker have frequently been indulgent with these behaviours in a legal context in which freedom of expression is a fundamental human right and demonstrating a conquest without equivalent in our country. Social and judicial answers are characterized by indulgence, sometimes legitimate, sometimes inadequate and often ill-understood.• Policing and the tools of the law that were shaped by the legal framework and the culture of demonstration can prove to be inadequate to cope with urban riots and they can result in various as well as inappropriate answers like the trivialization of emergency legal schemes and the sedimentation of a culture of clash between people and the police.The repercussion and identification concept and the analysis of the rebel and unsubdued bouts of anger pave the way to an adaptation of the law and the social response aiming at balancing both the expression of the basic rights and the preservation of public peace in urban areas. This is what is at stake with the dialectics « Liberties – Law – Disorder ».
