[pt] Esta tese de doutorado é um estudo sobre a política internacional de banimento, uma política internacional de criminalização e proscrição. A partir da leitura de alguns dos memorandos norte-americanos da Guerra contra o Terror, e influenciado pelo quase-conceito de rastro de Jacques Derrida, bem como pelo insight de Carl Schmitt sobre o dualismo exceção/regra, este trabalho segue certos rastros constitutivos daqueles documentos e, sobretudo, do status de combatente ilegal daqueles prisioneiros determinado ali. A partir destes rastros constitutivos da categoria de combatente ilegal, identificam-se os rastros da categoria de pirata na arquitetura político-jurídica da ordem internacional, e, a partir destes, os de uma alteridade excepcional que Schmitt identificou como a de um inimigo fora-da-lei, ou fora-da-lei da humanidade. Nesse sentido, destacam-se a alteridade e o espaço-tempo excepcionais do pirata, comentando-se seu ambíguo status político-jurídico – de fora-da-lei internacional e inimigo da humanidade (hostis humani generis) –, bem como seu banimento do espaço-tempo do sistema internacional moderno e da humanidade. A partir daí, e influenciado pelos estudos mais recentes de R. B. J. Walker sobre o fora constitutivo e as práticas soberanas de exclusão do sistema internacional moderno, identificam-se e comentam-se os rastros, sobretudo contemporâneos, da política internacional de criminalização e proscrição. E então, influenciado por aquele quase-conceito de rastro de Derrida, conclui-se este trabalho posicionando-o em relação a esta política internacional de banimento; ou seja, rastreando o Fora-da-lei da Humanidade. / [en] This PhD dissertation is a study on the international politics of outlawing, an international politics of criminalization and proscription. Starting from the reading of some of the US Memos on the War on Terror, and influenced by Jacques Derrida s quasi-concept of trace, as well as by Carl Schmitt s insight on the exception/rule dualism, this work follows certain traces which are constitutive of those documents and, most importantly, of the unlawful combatant status of those detainees as determined therein. Thus, from these constitutive traces of the category of unlawful combatant, this work identifies the traces of the category of the pirate within the political-legal architecture of the international order, and, from them, those of an exceptional alterity which Schmitt has identified as one of an outlaw enemy, or an outlaw of humanity. In this regard, it focuses on the exceptional alterity and space-time of the pirate, analyzing his ambiguous political-legal status – as both an international outlaw and an enemy of humankind (hostis humani generis) –, as well as his outlawry from the space-time of the modern international system and of humanity. From this analysis, then, and influenced by R. B. J. Walker s most recent studies on the constitutive outside and the exclusionary sovereign practices of the modern international system, it identifies and comments on the traces, most especially on the contemporary traces, of the international politics of criminalization and proscription. And then, influenced by that Derridian quasi-concept of trace, this PhD work concludes positioning itself in relation to this international politics of outlawing; that is, tracing the Outlaw of Humanity.

Unidos adotaram uma nova estratégia para orientar sua
política externa no mundo pós-Guerra Fria. A Doutrina da
Contenção guiou as relações internacionais dos Estados
Unidos durante o período de confronto entre as duas
superpotências. Com o fim do mundo bipolar, os Estados
Unidos consolidaram-se como a única superpotência mundial.
Na ordem do pós-Guerra Fria, o novo referencial da política
externa dos Estados Unidos seria a estratégia da Primazia.
Preservar o mundo unipolar tem sido o principal objetivo da
diplomacia norte-americana desde a queda do muro de Berlim. / [en] This study intends to show that the United States adpoted a
new strategy to guide its foreign policy in the post Cold
War world. The Doctrine of Containment has oriented the
American foreign affairs throughout the period of
confrontation between the two superpowers. As a result of
the end of the bipolar world, the United States has emerged
as the world´s only superpower. In the post Cold War order,
the new beacon of the United States foreign policy would be
the strategy of Primacy. Since the fall of the Berlin Wall,
the maintenance of the unipolar world has been the main
objective of the American foreign policy.

[pt] O conceito de excepcionalismo americano permeou a história dos EUA
e criou uma imagem de um país com um sistema e uma sociedade democráticos
superior, capaz de promover a democracia, os direitos humanos e o Estado de
Direito em nível nacional e internacional. Essa ideia legitimou a liderança dos
EUA na construção de uma ordem liberal internacional. A ascensão ao poder
do Presidente Donald Trump e a atual crise da ordem global contribuíram
para questionar essa ideia e seus pressupostos. Esta dissertação tem dois
objetivos principais: em primeiro lugar, discutir o conceito de excepcionalismo
americano e, em segundo lugar, analisar como o conceito de excepcionalismo
americano afeta a relação entre os Estados Unidos e o Direito Internacional.
Será argumentado que o excepcionalismo pode ser definido como um conceito
e analisado com as lentes teóricas e metodológicas da História Conceitual.
Sem um significado definitivo, o excepcionalismo americano é composto de
diferentes interpretações que variam de acordo com o contexto em que o autor
se situa. Ainda assim, sua importância na história e na identidade americanas
é inquestionável, tornando necessário levar em conta o excepcionalismo ao
tentar entender as ações dos Estados Unidos. Para analisar a relação entre o
excepcionalismo americano e o Direito Internacional, a dissertação se envolverá
com a literatura sobre a Ordem Liberal Internacional, a hegemonia dos EUA
e o multilateralismo. Além disso, será perguntado se a ascensão de Donald
Trump pode ser considerada uma ruptura em duas tradições americanas:
a relação dos Estados Unidos com o Direito Internacional e o uso político
do excepcionalismo. Argumenta-se que, apesar de se distanciar claramente
da tradição excepcionalista, Trump não se desviou da tradição do Direito
Internacional como é comumente percebido. Essa percepção é derivada de seus
discursos radicais, de sua personalidade estrondosa e de seus vínculos com a
extrema direita, mas não se traduz na maioria de suas políticas. / [en] The concept of American exceptionalism has permeated U.S. history
and created an image of a country with better democratic system and society,
able to promote domestically and internationally the democracy, human rights
and the rule of law. This idea has legitimatized U.S. leadership in the
construction of a liberal international order. The rise to power of President
Donald Trump and the current crisis of the global order have contributed
to question this idea and assumptions. This dissertation has two main aims,
firstly, to discuss the concept of American exceptionalism, and secondly to
analyse how the concept of American exceptionalism affects the relationship
between the United States and International Law. It will be argued that
exceptionalism can be defined as a concept and analysed with the theoretical
and methodological lenses of Conceptual History. With no definitive meaning,
American exceptionalism is made of different interpretations that vary across
the context the author was situated in. Still, its importance in American history
and identity is unquestionable, making it necessary to take exceptionalism
into account when trying to understand the United States actions. In order
to analyse the relation of American exceptionalism and International Law,
the dissertation will engage with the literature of International Liberal Order,
U.S. hegemony and multilateralism. Furthermore, it will inquire if the rise
of Donald Trump can be considered a rupture in two American traditions:
the United States relationship with International Law and the political use
of exceptionalism. It is argued that, although clearly distancing himself from
the exceptionalist tradition, Trump did not deviate from International Law
tradition as it is commonly perceived. This perception is derived from his
radical speeches, loud personna and ties to the Far-Right, but do not translate
into most of his policies.
