民主黨執政後日本外國人勞動者問題對策之轉變(2009~2014)

戰後日本的外國人勞動者對策經歷了從解決歷史遺留問題、「拒絕接收」到「有限制接收」的變化過程,此變化與多重領域相關,涉及日本的政治、經濟和社會多個領域。本論文著重從日本民主黨執政後的政治決策角度分析外國人勞動者問題對策的轉變,並對影響日本外國人勞動者的導入的主要原因從日本的內外環境即日本少子高齡化的困境與東亞區域經濟整合中的勞動力移動加速的狀況這兩個層面解構。 如何避免接收外國人勞動者帶給日本的不良影響在日本是一個具有難度和爭議的問題。本研究認為,日本民主黨政權通過高端人才和低端勞動者雙方面的接收促進,將日本的外國人勞動者問題層次上升到一個較高的層次的同時,兼顧了日本對外國人勞動者的實際需求,平衡了社會多方利益。民主黨對外國人勞動者的對策並沒有深陷於以往關於是否接收非熟練勞動者的泥沼中。而自民黨政權更傾向於完全迴避外國人勞動者接收問題,試圖通過提高女性就業和高齡者就業比例,充分利用日本本國的人口解決勞動力不足的問題。兩個政黨不同的態度與傾向會深刻影響外國人勞動者問題對策的走向,而日本國內外環境所施加的壓力會讓日本政府不斷產生新的考量。

本論文以一九八七年國際獅子會年會會員為訪問對象,探討外國獅友對中華民國的形 象。本論文總共約五萬字,五個章節,其結構為如下: 第一章,研究動機與研究問題。此章主要敘述本研究與過去形象研究之不同點以及重 要性,並且伸述主要研究問題。 第二章,文獻探討。在此章中,探討「形象」的理論和定義。主要以Herbert C .K- elman 等人的理論,將形象分為認知、情感以及行為三個成份。 第三章,研究方法。主要說明本調查研究的過程、問卷的結構以及分析歸類的過程。 第四章,資料分析。先說明調查結果的基本資料,並依據本研究問題,解釋幾個變項 與形象的相關性。 第五章,結論。依據資料分析的結果,解答本論文所要解答的問題,並且提出本研究 的限制及對未來研究的建議。

The Political Inclinations of Foreigners in Taiwan Regarding the Cross-Strait Situation

在台灣的外國人對兩岸關係的看法 / The focus of this study is to shed light on what foreign residents in Taiwan think about the cross-strait situation and what factors influence the way they think. The study is motivated by what the author sees as a scarcity of information on foreigners in Taiwan, coupled by a spectacular local interest on identity as it relates to the unfolding of cross-strait politics. The author would like to call attention to the distinct voices of foreigners in Taiwan, their plight and what they see as an ideal way to resolve the current impasse. In this light, the study’s approach is exploratory in nature, employing a survey, to solicit foreigners’ opinions regarding the cross-strait situation. The study also contextualizes the social, political and economic space occupied by foreigners in Taiwan with leading intellectual theories that have been used to analyze the idea of diaspora as it occurs worldwide. It tries to single out the most potent forces that shape foreigners’ political inclinations in Taiwan. The study explores such topics as the impact of one’s country of origin, socioeconomic status, mobility, language abilities, and newspaper preferences, on foreigners’ political inclinations.

融入臺灣:外國人使用智慧型手機為整合工具的經驗 / Expats living in East Asian nations have a distinctly fresh view of the burgeoning cultures around them. The field of media ethnography has largely ignored this view in favor of domestic perspectives, focusing on virtual ethnography, digital observation, and the collection of empirical data within these local populations. Taiwan is a fast-evolving nation state, with an ever-increasing foreign community and a mobile phone penetration rate of 98%. This study, recounted from the eyes of an American expat living in Taiwan, examines the successes and pitfalls Western nationals face when using their smartphones to overcome cultural barriers, maintain social relationships, and build an identity overseas. The research itself takes shape through a series of one-one-one interviews, concentrating on five subjects of differing age, gender, travel background, language level and locale. The second focus is on in-depth, on-site participant observation of these individuals interacting with Taiwanese locals and attempting to build a life for themselves away from home. Observations of their daily lifestyles, combined with interview content, sheds light on the intentions and contradictions they face in using their smartphones to traverse their environment. The goal of this study is to draw a detailed and nuanced picture of the expatriate experience and image in Taiwan, as well as analyze the ability of Westerners to use technology to integrate into Taiwanese culture.

論外國人的國際遷徙自由

我國憲法學者多數認為外國人雖為基本權主體,但依照權利性質說,並不享有國際遷徙自由,從而國家可任意地拒絕其入境、居留或驅逐出境。最主要的理由在於,依照國際法,主權可自由決定是否允許外國人入境及課予入境條件。從而,主權也可自由設計入出境管理制度,那麼藉此箝制外國人言論、宗教或學術自由等基本權利,並非不可想像,甚至我國亦有實例發生。雖然,憲法學者也指出國家應儘量尊重外國人的入出境,亦不得任意藉此任意侵害其他基本權利。不過,既然外國人沒有作為憲法權利的國際遷徙自由,即難以對抗立法者藉由入管制度造成的侵害,更抹滅全球化時代下外國人國際遷徙活動本身具有的各種意義與功能。 有鑑於此,本文一方面嘗試跨足國際法,檢視現行國際人權法對外國人國際遷徙的保障程度,並回溯國際法古典著作探尋主權與國際遷徙自由的軌跡;另一方面,分析現行憲法學說之不足,藉由與國際法的對話成果,嘗試重新構築憲法保障外國人國際遷徙自由的體系。之後探討國家於限制外國人的國際遷徙自由時,應如何遵循法律保留原則、比例原則與正當法律程序,並提供救濟管道,始合乎憲法第23條之意旨。經由憲法基本權保障機制的確立,最後進一步檢討現行入出國及移民法,提出建言。 / The study is intended for elaborating on the freedom of international movement for aliens. First of all, the author examines the protected area of international movement for aliens under current international law and explores the classics of international law in order to research into the entangling relationship between sovereignty and freedom of international movement. In addition, the author analyzes constitutional doctrines at the present times and their inadequacy by applying international law. Meanwhile, what this article does attempt to do is to provide a new framework of the protected area of freedom of international movement for aliens under constitutional law. Also, in an effort to protect the freedom of international movement for aliens, the author discusses how to apply principles of non-delegation and proportionality and due process of law appropriately to prevent state power from violating it. Finally, the author examines immigration law and offers suggestions.
