The impact of the application of international air cargo security regulations in South Africa

Text in English / This research project, within the context of security risk management in general and aviation security in particular, aimed to explore the impact of the application of international and local air cargo security regulations on South Africa, with specific reference to the regulations of the International Civil Aviation Organisation (ICAO), as well as the European Union (EU) and the United States of America (USA). In South Africa, since the early 2000s, the South African Civil Aviation Authority (SACAA) has been the lead agency for dealing with and managing the needs for air cargo security. This oversight by SACAA culminated in 2009 with the promulgation of the SACAA Regulation commonly known as Part 108. Accordingly the primary research focus was on the impact Part 108 has had on the air cargo industry in South Africa. In addition, it compared the South African regulations with those of the USA and EU regulations; explored the compliance of the various roleplayers; sought to understand the enforcement of the regulations; and examined the effectiveness of the available security and screening methods. Creative financing & strategies for mixed-income transit oriented development in Dallas, Texas

This study evaluates the current environment for mixed-income transit oriented development along DART rail within the city limits of Dallas. A close look at income and racial disparity is used as the foundation for advocating for a more proactive and aggressive approach to the development of affordable units proximate to affordable transportation choices. Assembling financing for mixed-income TOD projects is especially challenging, and multiple layers of federal, state, and city funding mechanisms are required for achieving the capital requirements of the development. Both typical affordable housing funding methods and new and nontraditional funding methods for multifamily housing were researched and evaluated with the intention to propose possibilities for catalyzing development in DART station areas within the City of Dallas that have, to this point, experienced underdevelopment. / text

The Bill of Rights in public administration

Contemporary South Africa prides itself on having a Bill of Rights. For 84 years (1910 to 1994) public administration regulated the general welfare and lives of inhabitants in the finest detail, while being subject to almost only the whims and political objectives of the governing authority. On 27 April 1994 the 1993 Constitution introduced a constitutional obligation and radical change to the manner in which public administration must be exercised. Today, still an infant in experience relating to a bill of rights, public administration must be exercised with the Bill of Rights as an integral part of this inhabitant / governing authority interaction. The primary aim of this study is to attempt to describe the manner in which public administration was exercised, firstly, during constitutional dispensations prior to 1994 and, secondly, since public administration became subject to constitutionally entrenched fundamental rights. The empirical investigation is aimed at exploring and analysing the extent to which public administration has realised the constitutional obligation in practice. The results of the empirical investigation highlighted, primarily, that the majority of the officials that participated in the survey do not know of the Bill of Rights, and that half of those who do know of the Bill have little knowledge of its provisions. More than half of the respondents lack awareness of section 195 of the 1996 Constitution, which states that public administration must be governed by democratic principles enshrined in the Constitution. Barely one tenth of respondents were informed of the significance of the Bill and its role regarding public administration. The majority of respondents have not of their own accord studied the Bill and the Bill does not have the desired effect on the manner in which public administration is exercised. Two thirds of respondents have mixed perceptions as to whether to serve the interests of inhabitants above the political objectives of the governing authority and less than a quarter of respondents give recognition to the Bill when rendering public services. It seems as if South African public administration has a long way to go in adhering to its constitutional obligation in practice. / Public Administration and Management / D. Reform of the UN Security Council and a stumbling block associated with it - abstract This thesis deals with matter of the Security Council reform, the most crucial body of the United Nations. It examines approaches of eleven specific countries which are divided into two groups. The first group is comprised by permanent members of the Security Council, the second one by states which, in case of their creation, could claim new permanent seats in this body. This thesis examines not only their real policies, but also their policies from theoretical - specifically neorealistic - point of view. Two different hypotheses were deduced from neorealism which were tested and subsequently evaluated as (in)valid. Hypothesis emerging from a standard neorealism put emphasis on policy whose goal is to maintain, alternatively to increase a state's autonomy (autonomy-seeking policy). International organizations are viewed as entity which limits, to some extent, this autonomy. On the other hand, hypothesis emerging from a modified neorealism put emphasis on policy whose goal is to gain, alternatively to increase influence on other actors (influence-seeking policy). Den unionsrättsliga statsstödsrätten är ett omfattande rättsområde med huvudregel att statligt stöd är förbjudet enligt art. 107.1 FEUF, eftersom statliga stödåtgärder kan snedvrida konkurrensen på den inre marknaden. Det finns undantag från förbudet, exempelvis när ett statligt stöd kan underlätta utvecklingen av vissa näringsverksamheter. Kommissionen gör i de fallen en skönsmässig bedömning av stödåtgärden och dess förenlighet med den inre marknaden. Två sådana bedömningar har gjorts angående offentliga medfinansieringar av multiarenor i Uppsala respektive Köpenhamn. Utredningen i uppsatsen av kommissionens beslut i frågorna innebar att undersöka hur kommissionen bedömer rekvisiten i art. 107.1 och 107.3 c FEUF, och undersöka när undantaget bedöms som tillåtet respektive otillåtet. Utredningen visar att undersökningen huruvida statligt stöd förelåg enligt art. 107.1 FEUF utgjorde en relativt enkel bedömning, och tillämpningen av art. 107.3 c en djupare granskning av påverkan på konkurrensen och samhandeln. Trots multiarenornas olika karaktärer, lokal respektive kommersiell, där den ena var tänkt att drivas av världens största evenemangsbolag, utgjorde arenorna ett undantag från förbudet att statligt stöd inte är tillåtet. Kommissionen lade bland annat vikt vid att den offentliga medfinansieringen inte fick vara större än vad som var tillräckligt för marknadsmisslyckandet, men även att det saknades arenakapacitet i områdena.  I uppsatsen behandlas även förekomsten av olagligt stöd. Kommissionen har befogenhet att utöva kontroll över medlemsstaternas stödåtgärder, och nationella domstolar har en skyldighet att pröva en talan som väcks av en enskild som påstår att en åtgärd skett i strid mot genomförandeförbudet, med grund i förbudets direkta effekt i medlemsstaterna. Ett stöd som beviljats i strid mot genomförandeförbudet innebär flertalet legala risker för stödmottagare respektive stödgivare. I uppsatsen diskuteras riskerna, bland annat skyldigheten för stödgivaren att återkräva ett utbetalat stöd som bedöms olagligt med alla medel som krävs. Ett sådant förfarande kan innebära att stödmottagaren tvingas i konkurs, på grund av att staten som stödgivare inte anmält stödåtgärden till kommissionen. Även konkurrenters möjligheter till överklagande vid ett beslut som innefattar en eventuell olaglig stödåtgärd utreds. I den svenska statsstödslagen, vilken hanterar olagligt statsstöd, har endast stödgivaren rätt att väcka talan om olagligt stöd. Lagen har kritiserats och rättsläget betraktas om osäkert, inte minst eftersom svensk rätt innehåller ett huvudförbud mot tredje mans talan. I uppsatsen utreds en konkurrents överklagandemöjligheter enligt kommunallagen, förvaltningslagen samt i allmän domstol. Utredningen visar att den kontrollfunktion som konkurrenter ska utgöra på statsstödsrättens område inte är tillräcklig i svensk nationell rätt. De risker som diskuterades tidigare i uppsatsen kan således antas ha en relativt låg risk att realiseras när en konkurrent vill angripa ett olagligt statsstöd. Det är sannolikt att den svenska nationella statsstödsrätten inte uppfyller unionsrättens krav på effektivt rättsmedel för enskilda, och att regleringen för konkurrenter således är bristfällig i svensk rätt.
