The legal obligations of retirement fund trustees in respect of section 37c of the Pension Funds Act 24 of 1956

Prior to the introduction of section 37C into the Pension Funds Act. 24 of 1956, the benefit payable as a result of the death of a member would devolve in accordance with his last will and testament or the provisions of intestate succession. The advent of section 37C brought a statutory regime which expressly excludes freedom of testation and rather looks to the board of a fund to distribute the death benefit. The board may only pay the dependants of a deceased (either factual or legal) or the persons he has recorded on his nomination form. The section relies on the board to exercise its discretion in a manner which results in an equitable distribution of the death benefit notwithstanding that it does not provide any guidelines as to how this is to be achieved. Accordingly, numerous decisions are challenged by the identified beneficiaries because they are unhappy with the manner in which the board exercised its discretion. This results in complaints being lodged with the Pension Funds Adjudicator. Many such complaints should never have arisen or could have been easily solved by a proper exercise of discretion on the part of the board. The problem is that these complaints are adding to an already burdened office. Adequate training and understanding of the obligations of section 37C would probably result in fewer complaints to the Adjudicator. This dissertation examines whether the determinations which have been issued by the Adjudicator in respect of section 37C indicate a need for such training and understanding and, if they do, what possible remedies there might be to cure such a problem. Recommendations arising from this are that trustees must receive training focused on section 37C and proposed practical protocols to assist a board when exercising its duty to make an equitable distribution. / Jurisprudence / LL. “Manager of Progress and Process”: The Life and Times of H. R. Haldeman

This dissertation examines the political and business career of H. R. “Bob” Haldeman. Scholars studying Richard M. Nixon’s presidency and administration have given very little attention to Haldeman’s career before and after his time as chief of staff. This dissertation argues that in order to understand Haldeman’s actions as chief of staff one needs to have a firm understanding of his career before he entered Nixon’s White House. In contrast to what many have argued, an overt interest in politics and overriding ambition to serve Nixon did not solely drive Haldeman. Instead, the development of Haldeman’s career is best understood through his consistent search for opportunities and activities in which he could alter, reform, or improve existing processes and organizations. Only a study of his entire career brings this motivation to the forefront. Using Haldeman’s recollections, his White House diaries, archival records relating to his business and political career, assessments of the Nixon presidency, and the recently published memoir of his wife, this dissertation provides an in-depth study of his career as a manager in business and politics. This study answers important questions regarding Haldeman’s background, intellectual makeup, and the trajectory of his career by reexamining Haldeman’s work for Nixon and his career in the advertising industry and analyzing how each of these experiences informed his life, skillset, and his managerial behavior. Providing the scholarship with a more complete picture of Haldeman’s life and career augments the understanding of Richard Nixon’s political career and presidency, by filling a critical void with a more comprehensive overview of a close aide and a major figure at the center of the Watergate scandal. An examination of Haldeman’s entire career, moreover, illuminates how significant developments in twentieth century United States political and business history impacted one individual.

Dans le Québec d’après-guerre, les préoccupations morales des opposants au gouvernement de l’Union nationale se cristallisent autour de deux dénonciations virulentes de la corruption politique : celle des mœurs électorales et celle des gouvernants. En 1960, la moralité politique est un enjeu électoral d’importance. Le Parti libéral est élu en promettant de réformer la vie politique. La « guerre au patronage » menée par le gouvernement passe par la condamnation des méthodes administratives utilisées par l’Union nationale. Entre 1956 et 1963, l’opinion publique, puis le gouvernement confèrent une importance grandissante à la responsabilisation des comportements et à la valorisation de la politique. Au fil des débats soulevés, nous voulons étudier les motivations des intervenants et leurs discours tels que rapportés dans la presse. Il en résulte la rencontre de deux visions de la vie dans la Cité, entre un idéal de vertu et la réalité effective de la politique partisane.

Die beginsel van testeervryheid is die grondslag van die Suid-Afrikaanse testate erfopvolging. Die Suid-Afrikaanse opvatting van testeervryheid is tans van so ʼn aard dat dit ʼn testateur toelaat om sy of haar boedelbates te bemaak volgens sy of haar goeddunke, onderworpe aan ʼn paar statutêre en gemeenregtelike uitsonderings. By die bepaling of ʼn spesifieke klousule in ʼn testament vervat kan word, sal sodanige klousule eerstens teen die Grondwet van die Republiek van Suid-Afrika getoets moet word om te bepaal of sodanige klousule moontlik op ʼn grondwetlik verskanste reg inbreuk maak. Verdere statutêre beperkings sluit onder meer die reg om oor onroerende eiendom te beskik wat gereël word deur die Wet op die Opheffing of Wysiging van Beperkinge op Onroerende Goed, die reg van ʼn minderjarige kind om onderhoud te eis van die boedel, die Wet op Onderhoud van Langslewende Gades en die Wet op Pensioenfondse in. Testeervryheid word direk gekoppel aan elke persoon se fundamentele regte wat in die Grondwet van die Republiek van Suid-Afrika gewaarborg word. Die beginsel van testeervryheid is in verskeie sake aangespreek en word hierdie sake vervolgens bespreek. Repositioning the problematic gender formation of a generation of white South African men through performance art

An overview of global statistics on violence, country to country and worldwide, indicates that men are the main perpetrators of violence in our societies. Furthermore, the behavioural traits of risk-taking and self-harm are also associated with men. It is my contention that the formative processes involved in gender identity are at the root of these dysfunctions. In an attempt to present a positive alternative, I focus on a group I name the X- Men: white South African Generation X males. Drawing on Judith Butler‟s theory of performativity and its allowance for agency and resistance, I argue that they are not necessarily trapped by how their gender identities were formed through Apartheid‟s gendered institutions. These included schools, sport and the military. I posit that within the institution of art, self-aware artists may present visual representations of resistance and transformation. Acknowledging art as signifying text, the X-Men situate signs differently in an effort to accomplish a social and intersubjective raising-of-awareness. Additionally, this new identity and its associated positive performance have the potential to undermine certain stereotypical perceptions harboured by the broader society as a result of problematic behaviour associated with men. / Art History, Visual Arts and Musicology / M.V.A.

La question moyenne-orientale est dans l'actualité depuis 1948. C'est en cette année que se crée l'Etat d'Israël sur les décombres du mandat britannique en Palestine. Dès le commencement, la guerre va commencer à fixer les frontières entre Israël et ses voisins arabes. Cependant, après 1967, une nouvelle question va apparaître, celle des relations avec les Territoires occupés. En conséquence, l'Etat d'Israël aura deux questions frontalières à gérer : la question interétatique classique et la question interne avec les Palestiniens. Cette recherche tente de démontrer les voies employées par les différents acteurs régionaux et internationaux pour trouver une solution à cette question juridique qui cause l'instabilité régionale. On s'appuiera sur le droit, l'Histoire, la science politique (en particulier, l'étude des idéologies sioniste et arabiste) et les relations internationales pour trouver une cohérence aux réussites et aux échecs qui ont émaillé l'histoire du Moyen-Orient depuis 1948 et le fait qu'Israël n'ait encore que deux frontières internationalement reconnues, une avec l'Egypte et l'autre avec le royaume de Jordanie.

Sovereignty, Peacekeeping, and the United Nations Emergency Force (UNEF), Suez 1956-1967: Insiders’ Perspectives

This research is concerned with the complex and contested relationship between the sovereign prerogatives of states and the international imperative of defusing world conflicts. Due to its historical setting following World War Two, the national vs. international staking of claims was framed within the escalating imperial-nationalist confrontation and the impending “end of empire”, both of which were significantly influenced by the role Israel played in this saga. The research looks at the issue of “decolonization” and the anti-colonial struggle waged under the leadership of Egypt’s President Nasser. The Suez War is analyzed as the historical event that signaled the beginning of the final chapter in the domination of the European empires in the Middle East (sub-Saharan decolonization followed beginning in the early 1960s), and the emergence of the United States as the new major Western power in the Middle East. The Suez experience highlighted a stubborn contest between the defenders of the concept of “sovereign consent” and the advocates of “International intervention”. Both the deployment of the United Nations Emergency Force (UNEF) and its termination were surrounded by controversy and legal-political wrangling. The role of UNEF and UN peacekeeping operations in general framed the development of a new concept for an emerging international human rights law and crisis management. The UNEF experience, moreover, brought into sharp relief the need for a conflict resolution component for any peace operation. International conflict management, and human rights protection are both subject to an increasing interventionist international legal regime. Consequently, the traditional concept of “sovereignty” is facing increasing challenge. By its very nature, the subject matter of this multi-dimensional research involves historical, political and international legal aspects shaping the research’s content and conclusions. The research utilizes the experience and contributions of several key participants in this pioneering peacekeeping experience.
