A região antártica é foco de constante observação por ser uma região de importante monitoramento climático global. Ao sedimento de fundo marinho está associada uma biota que responde aos processos de alterações ambientais e dentre seus representantes os foraminíferos são considerados bons indicadores marinhos. O objetivo do presente estudo é avaliar a fauna de foraminíferos recentes na Baía do Almirantado durante três verões austral consecutivos (2002/2003, 2003/2004 e 2004/2005) e, através da determinação de algumas variáveis ambientais, compreender melhor a ecologia e a distribuição desses organismos na região. Foram coletadas 56 amostras de sedimento de fundo marinho ao longo da Baía do Almirantado para análise e identificação da fauna de foraminíferos e de variáveis abióticas amostradas na água de fundo e no sedimento. Foram encontradas 66 espécies de foraminíferos bentônicos, sendo 36 espécies aglutinantes e 30 espécies calcárias. As espécies mais freqüentes foram as calcárias Bolivina pseudopunctata, Cassidulinoides parkerianus e Globocassidulina biora, e as aglutinantes Portatrochammina antarctica, Pseudobolivina antarctica e Spiroplectammina biformis. As espécies Portatrochammina antarctica e Pseudobolivina antarctica foram as mais abundantes na porção central e em algumas estações das três enseadas da baía. As regiões mais internas das enseadas apresentaram predominância de espécies hialinas principalmente do gênero Globocassidulina e Cassidulinoides. A predominância de espécies hialinas também foi observada nas estações próximas a desembocadura da Baía do Almirantado com as espécies Bolivina pseudopunctata e Fursenkoina fusiformis. / The Antarctic region is focus of constant scientific surveys because of its importance as global climate changing area. The marine bottom sediment has an associated biota that indicates some environmental changes and among them Foraminifera could be considered as one of the best marine biomarkers. The aim of the present study is describe the recent benthic foraminifera fauna from Admiralty Bay collected during three consecutive austral summers (2002/2003, 2003/2004 and 2004/2005) and better understand its ecology and distribution patterns throughout the bay and its relations with some environmental factors. Fifty-six bottom sediment samples were collected along the Admiralty Bay for analysis and identification of the forams fauna and abiotic factors from sediment and bottom water. We found 66 species of benthic foraminifera, 36 agglutinated and 30 calcareous. The most frequent species were the calcareous Bolivina pseudopunctata, Cassidulinoides parkerianus and Globocassidulina biora, and the agglutinated Portatrochammina antarctica, Pseudobolivina antarctica and Spiroplectammina biformis. The species Portatrochammina antarctica and Pseudobolivina antarctica were the most abundant in the central portion of the bay and in some samples of the three inlets of the bay. The inner parts of the inlets there was a predominance of calcareous such as Globocassidulina spp. and Cassidulinoides spp.. The predominance of calcareous species, such as Bolivina pseudopunctata and Fursenkoina fusiformis was also observed at samples near the connection between the Admiralty Bay and the Bransfield Strait.

This thesis attempts to describe the role of the British Admiralty&rsquo / s oil related naval policies from 1909 to 1914 in the formation of British oil diplomacy in the northern hinterlands of the Persian Gulf. On the basis of this attempt, it examines the precise beginning of oil security concerns of Britain and its articulation on the southwest Persian and Mesopotamian oil basins in light of the transition of the Royal Navy from coal to oil burning internal combustion engines. It delineates the interconnectedness of the issues relating to the significance of oil in British naval developments and naval supremacy and her clash of interests with the other Great Naval Powers, which had significant interest in oil rich Mesopotamia and southern Persia. By 1914, the Admiralty, through its exceptional relations with the Anglo-Persian Oil Company in the hinterlands of the Persian Gulf became an important actor in the government&rsquo / s involvement in the oil industry. This thesis, suggests that the Admiralty was the political demand channel in the processes of British imperial expansion under the spread of new imperialism in general, and in the consolidation of fuel oil security in particular. The study will be a contribution to the academic literature on the history of naval powers in Turkey.

Avaliação de teores de metais e arsênio na Estação Antártica Comandante Ferraz após incêndio de 2012 / Evaluation of metal and Arsenic levels on the Comandante Ferraz Antarctic Station after 2012 fire

Em fevereiro de 2012 um incêndio atingiu a Estação Antártica Comandante Ferraz (EACF), consumindo cerca de 70% das instalações, liberando diversos compostos para o meio ambiente. Desde então, processos de remoção de resíduos vêm sendo realizados. Com base no cenário de efeitos ambientais em um ambiente antártico, amostras de solo e sedimento foram coletadas em diferentes períodos pós-acidente a fim de se avaliar os efeitos do incêndio. As amostras foram tratadas através de digestão ácida e as concentrações parciais de metais e As foram quantificadas através de ICP-OES. O Fator de Enriquecimento foi utilizado para avaliação dos impactos causados no solo, enquanto que comparação com os valores estabelecidos pela legislação canadense (TEL e PEL) foi utilizada na avaliação do grau de contaminação do sedimento. Os resultados indicaram a introdução de Pb, Cu e Zn antropogênico em parte das amostras de solo coletadas ao redor da antiga estação antártica, cujos Fatores de Enriquecimento chegaram a, respectivamente, 208,9; 189,7 e 111,6; sendo estes presentes sob a forma de fragmentos metálicos. Também indicaram que os processos de remoção de resíduos podem ter sido tanto responsáveis pela redução nos teores de metais, como por ter reintroduzido estes elementos em outros pontos mobilizando-os durante a movimentação de resíduos. Além disso, não foram encontradas evidências de alterações significativas nos teores de Hg em solo e metais e As em sedimento marinho. / In February 2012, a fire at the Comandante Ferraz Antarctic Station (EACF) destroyed approximately 70% of the Brazilian research station. This event released many substances and residues to the region and, since then, operations for the removal of the fire wastes have been executed. Based on the scenario of environmental effects on an Antarctic environment, soil and sediment samples were collected in several different moments after the accident to study the impacts of the fire. The samples were treated through acid digestion and the partial levels of metals and As were quantified through ICP-OES. Enrichment factor was used to evaluate the impacts caused in soils, and comparisons with Canadian environmental quality guidelines (TEL and PEL) were used to assess the intensity of the sediment contamination. The results indicated the introduction of anthropogenic Cu, Pb and Zn in some of the collected soil samples around the former Antarctic station, with enrichment factors of 189.7, 208.9 and 111.6, respectively, elements those present in metallic fragments. Moreover, the analysis of the generated data showed that the procedures for wastes removal could have been responsible for the decrease in the elements\' content as well as the reintroduction of those elements due to the mobilization of the wastes in some of the sampled sites. Furthermore, there\'s no evidences of significate changes on Hg levels in soil or metal and As levels in marine sediment.

L'assurance maritime constitue la première forme d'assurance connue, qui s'est développée à la fin du Moyen-Âge et a gagné l'ensemble de l'Europe au XVIe siècle. Rouen, l'une des plus importantes villes commerciales et maritimes du royaume de France, fut la première – et la seule – à être dotée d'un greffe des assurances dès 1556. Elle constitue donc un lieu de choix pour l'étude de ce contrat dans notre pays. Le caractère aléatoire de l'assurance a posé très tôt le problème de l'équilibre des intérêts des parties. D'une part, l'assuré devait pouvoir bénéficier de garanties suffisantes pour recourir à l'assurance. Il s'agissait d'autre part de protéger l'assureur, qui, en plus de prendre les risques de l'expédition à sa charge, se trouvait en grande partie dépendant de la bonne foi de son assuré. Aux côtés de leur « commis aux assurances », les marchands rouennais ont alors recherché et adopté des solutions. L'ordonnance de la Marine de 1681, première législation française sur les assurances, a ensuite tenté d'unifier les usages et pratiques du royaume. Elle a proposé différentes mesures pour promouvoir ce contrat tant auprès des assurés que des assureurs. L'assurance maritime, en lien avec les nombreux domaines juridiques que sont le droit des obligations, le droit commercial, le droit maritime, le droit cambiaire ou encore celui des sociétés, a alors évolué sous l'influence conjuguée des juges et des marchands, toujours soucieux de trouver un équilibre contractuel. / Shipping insurance is the first known form of insurance. It was instituted at the end of the Middle Ages and spread to the whole of Europe in the sixteenth century. Rouen, as one of the largest commercial and maritime cities in the Kingdom of France, was the first and indeed the only city to be given a patent for insurance as early as 1556. It is therefore the ideal place in which to study such a contract in this country. The fluctuating nature of insurance quickly pinpointed the problem of balancing the interests of the parties involved. On the one hand, the insured person needed to be able to benefit from guaranties allowing him to resort to insurance. Similarly, the insurer needed to be protected since he not only had the responsibility of the voyage, with the risks that that implied, but was also dependent on the honesty of the person insured. Together with their “insurance agents”, the merchants of Rouen therefore sought and adopted solutions to this problem. The Royal Ordinance of Shipping, in 1681, – the first French legislation on insurance – then endeavoured to unify the customs and uses carried out in the Kingdom of France. It offered various measures to develop this contract between the insured and the insurer. Maritime insurance, together with the many other sectors of law such as that of obligations, commercial law, maritime law, law pertaining to Exchange or to Societies, then evolved under the combined influence of the judiciary and of merchants, continually seeking a contractual balance.

無論我國航運公司所屬船舶有無「權宜船籍」的問題,於船舶航經英國法權或間接繼受英國法學之區域(如美國、澳洲、紐西蘭、新加坡、香港與加拿大等),皆有受該海事法系統管轄之可能。海上犯罪之行為地管轄固勿論,即使英國非行為地,英國海事法向來均允許對航經英國法權之船舶、運費或貨載等財產(res;property)進行扣押(arrest)以取得對財產之管轄權,俾迫使財產之利害關係人提供擔保或出庭應訊,故即使位居東南亞的我國航運公司亦有了解英國海事法程序特殊性之必要,此不僅可事先規避可能遭受司法扣押的風險,於受扣押之後,亦可即使採取適當行為減少損害進而保護應有權利。因此,對我國航運公司而言,對英國海事程序,特別是對物訴訟(action in rem)的研究不啻為一種法律上的「風險管理」(Risk Management)。 本文第二章介紹以複雜著稱的英國法院系統,並將重心置於海事法院之地位與其管轄權之發展,並分類逐條論述海事法院之對物訴訟管轄權(即何種性質之請求權得提海事對物訴訟)。第三章為本文重心,介紹英國對物訴訟理論之發展,並對其理論形成之歷史景、本質理論(程序說(procedural theory)或人格化說(personification theory)等)、與國際公約及普通法間如何取得平衡?財產所有權人或利害關係人出庭應訴與否之責任差異何在等,並於最後對容易致生混淆的相關概念一併釐清。第四章論述現行對物訴訟「程序」問題,從對物訴訟令狀(writ in rem)之聲請、簽發與送達、扣押裁定之聲請與船舶扣押之執行、各種特別聲請(caveat)、財產利害關係人之承認送達(acknowledgment of service)、保釋金(bail)或擔保等之提出、財產之放行(release)、船舶之鑑價與變價、對物訴訟缺席判決(default judgment)、聲請法院付出(payment out)與準備程序行為(preliminary acts)等。第五章討論瑪瑞發禁制令(Mareva Injunction)之最新發展,其可補充對物訴訟船舶扣押效力不足之部分,且其現於海事及商事訴訟上頗為盛行,其可避免被告惡意所為之脫產行為,可禁制大於一艘以上之被告船舶,有特予介紹論述的必要。 於民事訴訟法中增訂一編海事程序之草案,以為本文結論。

L’activité du port de Bordeaux en plein essor au XVIIIe siècle est bien connue des historiens modernistes. Paradoxalement, les développements consacrés aux professionnels embarqués sur les gréements sont plus rares, alors qu’une telle étude a déjà été réalisée pour la capitale de la Guyenne à la fin du Moyen-âge. Parmi les « gens de mer » demeurés dans l’ombre, les capitaines de navire se démarquent à plus d’un titre. Par la charge symbolique mais aussi juridique que revêt la fonction, en premier lieu, dans le convoi des hommes et des marchandises au-delà des océans. Par le champ de compétences étendu que recouvre la profession, ensuite. Les commandants de bord doivent en effet non seulement être en capacité de piloter un bâtiment au long cours, mais en outre diriger un équipage bigarré, tout en versant dans le commerce au moment jugé le plus opportun. Les capitaines apparaissent ainsi comme des acteurs incontournables des échanges maritimes à l'époque moderne, cernés par un océan d’archives dont l’importance des fonds conservés à Bordeaux, en dépit des ravages du temps, rend parfaitement compte. Par les perspectives de mobilité sociale offertes par le métier, en dernier lieu. Affiliée aux négociants avec lesquels elle partage une même communauté de vues et de pratiques, contrôlant l’information, brouillant les pistes entre les acteurs de l’échange, la figure du « capitaine-géreur » placée à la tête des expéditions maritimes ou paradant parmi les cercles mondains révèle une confusion des genres pouvant induire des changements d’état. Il s’agit de déterminer si le négoce à temps plein constitue un horizon accessible puis pérenne, parmi d’autres opportunités de reconversion à portée du groupe. Alors que le commerce colonial et négrier assure la prospérité de la capitale de la Guyenne, c’est l’identité de la profession via sa capacité à se fondre parmi les élites urbaines qui questionne, de la Régence à la Révolution française. / Modern historians have good knowledge of the 18th century growth of Bordeaux harbour activity. But works about crew members are scarce while paradoxically such a study had already been led for the « Guyenne » capital as early as in the end of the Middle Ages. Ship commanders stand out from all other rather discreet socio-professional categories related to sailors for many reasons : first, because of the symbolical and legal dimension of their occupation which implies their responsibility whenever it comes to the transportation of men and goods ; secondly, because of their huge fields of expertise, like to be able to steer boats over long distance, to handle crews of dozens of members or to carry out commercial transactions ; last, but not least, because of the social mobility offered by their position. Highly documented in a rich archive collection kept and preserved in Bordeaux, captains have turned into key players of the maritime trade of the modern era. By frequently working and diverting themselves with traders and ship owners, they developed a trusting relationship with them. The question is to determine how this cooperation was shaped, and to know if trading or ship armament were possible career changes within the reach of captains, and if not, how they could integrate the urban elites at work under the « Ancien Régime ». When the colonial and slave trade ensured the Bordeaux harbour’s prosperity, it is the identity of the merchant navy ship commanders working from the capital of « Guyenne » that will be here studied, from the Regency to the French Revolution.
