[pt] O tema da autoria docente permanece atrelado a um viés instrumental, relacionado à educação a distância ou à atuação do professor para o uso das tecnologias ou elaboração de material didático. O foco da presente pesquisa recai então sobre a autoria enquanto ato ético-estético, sobretudo a autoria de textos poéticos enquanto produção artística e literária. Este trabalho tem como objetivo investigar o que revelam as narrativas de um grupo de professores a respeito de sua constituição enquanto professores poetas e que elementos de reflexão seus textos e narrativas podem fornecer para se pensar sobre a autoria e a poesia na escola. Busca-se verificar que concepções de poesia os professores poetas pesquisados trazem consigo e conhecer como a poesia se faz presente na prática docente desses professores, bem como identificar experiências com a poesia que afetaram os sujeitos pesquisados e que podem servir de reflexão para se pensar sobre a autoria e a poesia na escola. Mikhail Bakhtin constitui o principal referencial teórico-metodológico deste estudo. As reflexões desenvolvidas pelo filósofo da linguagem, especialmente os temas voltados a uma filosofia da alteridade, compõem o fundamento basilar e orientam o percurso teóricometodológico adotado na investigação. Outros autores cujas reflexões amparam este estudo são Paul Celan, Cristóvão Tezza, Roland Barthes, Michel Foucault, Roger Chartier, Sir Ken Robinson. A pesquisa, de cunho qualitativo, ancora-se em uma metodologia marcada pelo viés narrativo, em que sujeito pesquisado e pesquisadora narram suas experiências a fim de construir sentidos em uma teia de significados que, coletivamente, vai se (entre) tecendo por meio das narrativas e poemas dos sujeitos constituintes do estudo, como uma rede. Os dados da pesquisa foram coletados a partir de dois principais procedimentos metodológicos: questionários online e narrativas autobiográficas, em uma costura que visa assumir a forma dialógica de vozes poéticas que, juntas, compõem um colar de poesia, arte e resistência, que traz à tona vozes e gritos silenciados, fiosmissangas das memórias dos professores poetas sujeitos da pesquisa, vozes que se colocam em diálogo e, unidas, costuram sentidos. As informações apreendidas nos enunciados dos professores oferecem elementos que conduzem a relevantes caminhos de reflexão, tais como o processo de formação do leitor-autor, as relações humanas que perpassam as práticas de formação, bem como o lugar da afetividade e da sensibilidade na constituição de uma aprendizagem significativa. Percebe-se, a partir dos relatos dos professores e das análises empreendidas, a importância do desenvolvimento de uma educação para a sensibilidade, em que se potencializem a multiplicidade de leituras, a metaforização, a imaginação, a criatividade, o pensamento divergente, componentes indispensáveis para um agir ético e estético que interrogue a realidade de forma crítica e criativa. A pesquisa aponta que o trabalho com a poesia na escola torna-se fundamental na medida em que é capaz de aguçar a sensibilidade, a criatividade, a vertente ética e estética, a ampliação do pensamento crítico-reflexivo e a aquisição de novas formas de empoderamento através do poder libertador da palavra. A investigação conduziu à conclusão de que a autoria é uma forma de resistir e a poesia é uma manifestação de resistência contra a reificação do homem e uma forma de in(ter)venção no mundo, propiciando o não anestesiamento dos sentidos. / [en] The theme of teaching authorship remains tied to an instrumental bias, related to distance education or to the teacher s performance for the use of technologies or the elaboration of didactic material.The focus of this research is then on authorship as an ethical-aesthetic act, especially the authorship of poetic texts as artistic and literary production. This work aims to investigate what the narratives of a group of teachers regarding their constitution as poet teachers and what elements of reflection their texts and narratives can provide to think about authorship and poetry in school. It seeks to verify what conceptions of poetry the poets researched bring with them and to know how poetry is made present in the teaching practice of these teachers, as well as to identify experiences with the poetry that affected the subjects researched and that can serve as reflection to think about authorship and poetry at school. Mikhail Bakhtin is the main theoretical and methodological reference of this study.The reflections developed by the philosopher of language, especially the themes focused on a philosophy of otherness, make up the basic foundation and guide the theoretical-methodological course adopted in the research. Other authors whose reflections supported this study are Paul Celan, Christopher Tezza, Roland Barthes, Michel Foucault, Roger Chartier, Sir Ken Robinson.The qualitative research is anchored in a methodology marked by narrative bias, in which researched subject and researcher narrate their experiences in order to construct meanings in a web of meanings that collectively will be (through) weaving through the narratives and poems of the constituent subjects of the study, as a network. The data of the research were collected from two main methodological procedures: online questionnaires and autobiographical narratives, in a seam that aims to take on the dialogic form of poetic voices that, together, make up a necklace of poetry, art and resistance, which brings up voices and silenced cries, beads of the memories of the professed poets of the poets, voices that put themselves in dialogue and, united, stitch senses.The information seized in teachers statements offers elements that lead to relevant ways of reflection, such as the process of reader-author formation, human relations that permeate the practices of formation, as well as the place of affection and sensitivity in the constitution of meaningful learning. From the reports of the teachers and the analyzes undertaken, the importance of the development of an education for sensibility, in which multiplicity of readings, metaphorization, imagination, creativity, divergent thinking, and indispensable components are potentiated to an ethical and aesthetic action that interrogates reality critically and creatively.The research points out that work with poetry in school becomes fundamental in that it is able to sharpen sensitivity, creativity, ethical and aesthetic aspects, the expansion of critical-reflexive thinking and the acquisition of new forms of empowerment through the liberating power of the word. Research has led to the conclusion that authorship is a form of resistance and poetry is a manifestation of resistance against the reification of man and a form of in (ter) venation in the world, providing for the non-anesthetization of the senses.

Electrocatalyseurs à base d’oxydes métalliques poreux pour pile à combustible à membrane échangeuse de protons / Porous metal oxide-based electrocatalysts for proton exchange membrane fuel cells

Les électrocatalyseurs conventionnels utilisés dans les piles à combustibles à membrane échangeuse de protons (PEMFC) sont composés de nanoparticules de platine supportées sur des noirs de carbone de forte surface spécifique. A la cathode de la PEMFC, siège de la réaction de réduction de l’oxygène (ORR), le potentiel électrochimique peut atteindre des valeurs élevées - notamment lors de phases arrêt-démarrage - engendrant des dégradations irréversibles du support carboné. Une solution « matériaux » consiste à remplacer ce dernier par des supports à base d’oxydes métalliques. Ceux-ci doivent être résistants à la corrosion électrochimique, conducteurs électroniques et posséder une structure poreuse et nano-architecturée (permettant le transport des réactifs et produits et une distribution homogène de l’ionomère et des nanoparticules de platine). Dans ce travail, nous avons donc élaboré et caractérisé des électrocatalyseurs à base de nanoparticules de platine (Pt) déposées sur du dioxyde d’étain (SnO₂) et de titane (TiO₂) texturés (morphologies aérogel, nanofibres ou « loosetubes ») et conducteurs électroniques (dopés au niobium Nb ou à l’antimoine Sb). Le support permettant d’atteindre les meilleures propriétés électrocatalytiques est un aérogel de SnO₂ dopé à l’antimoine, noté ATO. En particulier, l’électrocatalyseur Pt/ATO présente une activité spécifique vis-à-vis de l’ORR supérieure à celle d’un électrocatalyseur Pt/carbone Vulcan® synthétisé dans les mêmes conditions, suggérant des interactions bénéfiques entre les nanoparticules de Pt et le support oxyde métallique (Strong Metal Support Interactions, SMSI).Des tests de durabilité simulant le fonctionnement d’une PEMFC en conditions automobile ont été effectués en électrolyte liquide à 80 °C sur ces deux électrocatalyseurs : cyclage entre 0,60 et 1,00 V vs l’électrode réversible à hydrogène (RHE) ou entre 1,00 et 1,50 V vs RHE. Le catalyseur Pt/ATO présente une durabilité accrue par rapport au catalyseur Pt/carbone Vulcan® de référence. Cependant, de nouveaux mécanismes de dégradation ont été mis en évidence dans cette étude : tout d’abord, l’élément dopant Sb est progressivement dissout au cours du vieillissement électrochimique, ce qui implique une perte de conductivité électronique. Cette perte est en partie liée à des incursions à bas potentiel, notamment durant les caractérisations électrochimiques. De plus, entre 5 000 et 10 000 cycles de vieillissement électrochimique (entre 0,60 et 1,00 V vs RHE ou entre 1,00 et 1,50 V vs RHE à 57 °C), le matériau support perd sa structure poreuse et forme un film amorphe peu conducteur. / Conventional electrocatalysts used in proton exchange membrane fuel cells (PEMFC) are composed of platinum nanoparticles supported on high specific surface area carbon blacks. At the cathode side of the PEMFC, where the oxygen reduction reaction (ORR) occurs, the electrochemical potential can reach high values - especially during startup-shutdown operating conditions - resulting in irreversible degradation of the carbon support. A “material” solution consists of replacing the carbon with supports based on metal oxides. The latter have to be resistant to electrochemical corrosion, be electronic conductor and have a porous and nano-architectural structure (for the transport of reagents and products and the homogeneous distribution of the ionomer and platinum nanoparticles).In this work, we have developed and characterized electrocatalysts composed of platinum (Pt) nanoparticles based on tin dioxide (SnO2) and titanium dioxide (TiO2) with optimized textural (aerogel, nanofibres or loosetubes morphologies) and electron-conduction properties (doped with niobium Nb or antimony Sb). The best electrocatalytic properties are reached for an antimony-doped SnO2 aerogel support, denoted ATO. The Pt/ATO electrocatalyst has especially a higher specific activity for the ORR than a Pt/carbon Vulcan® electrocatalyst, synthesized in the same conditions, suggesting beneficial interactions between the Pt nanoparticles and the metal oxide support (Strong Metal Support Interactions SMSI).Durability tests simulating automotive operating conditions of a PEMFC were carried out in liquid electrolyte at 57 °C on these two electrocatalysts by cycling between 0.60 and 1.00 V vs the reversible hydrogen electrode (RHE) or between 1.00 and 1.50 V vs RHE. The Pt/ATO electrocatalyst has an increased stability compared to the reference Pt/carbon Vulcan® electrocatalyst. However, new degradation mechanisms were highlighted in this study: first, the doping element (Sb) is progressively dissolved during electrochemical ageing, which implies a loss of electronic conductivity. This loss is partly due to incursions at low potential, including during electrochemical characterizations. Moreover, between 5,000 and 10,000 cycles of the accelerated stress tests (between 0.60 and 1.00 V vs RHE or between 1.00 and 1.50 V vs RHE at 57 °C), the support loses its porous structure and forms a poorly conductive amorphous film.

Le développement de catalyseurs de la réaction de dégagement de l’oxygène (OER) pour les électrolyseurs à membrane échangeuse de protons (PEM) dépend de la compréhension du mécanisme de cette réaction. Cette thèse est consacrée à l'application de la spectroscopie d’émission de photoélectrons induits par rayons X (XPS) et de la spectroscopie de structure près du front d'absorption de rayons X (NEXAFS) operando sous une pression proche de l'ambiante (NAP) dans le but d’étudier les mécanismes de la réaction d’oxydation de l’eau sur des anodes à base d’iridium et de ruthénium et leurs dégradation dans les conditions de la réaction. Cette thèse montre les mécanismes différents de la réaction OER pour les anodes à base d’Ir et de Ru impliquant respectivement des transitions anioniques (formation d’espèce OI- électrophile) ou cationiques (formation des espèces de Ru avec l’état d'oxydation supérieur à IV) quelle que soit la nature (thermique ou électrochimique) des oxydes. / Development of oxygen evolution reaction (OER) catalysts for proton exchange membrane water electrolysis technology depends on the understanding of the OER mechanism. This thesis is devoted to the application of near-ambient pressure X-ray photoelectron spectroscopy (NAP-XPS) and near edge X-ray absorption fine structure (NEXAFS) techniques for operando investigation of the Ir, Ru - based anodes. For Ru-based systems, we observe the potential-induced irreversible transition of Ru (IV) from an anhydrous to a hydrated form, while the former is stabilized in the presence of Ir. Regarding single Ir-based anodes, the analysis of O K edge spectra reveals formation of electrophilic oxygen OI- as an OER intermediate. Higher stability of Ir catalysts supported on antimony-doped tin oxide (ATO) is related to their lower oxidation. This work demonstrates different OER mechanisms on Ir, Ru-based anodes involving anion and cation red-ox chemistry, correspondingly, regardless the oxide nature.

A medida socioeducativa prevista no ECA, em seu art. 120, refere-se à Medida Socioeducativa de Semiliberdade. Enquanto medida restritiva de liberdade, tem sido efetivada pelo Centro de Semiliberdade MÃrtir Francisca, unidade construÃda em conformidade com a diretriz do SINASE referente ao projeto arquitetÃnico e à proposta pedagÃgica. While measure restricting freedom, it has been carried out by the Centre Free range Martyr Francisca, unit constructed in accordance with the SINASE guideline regarding the architectural design and educational proposal. This study presents what is sought to understand how these principles and guidelines are being implemented in educationally childcare service in Free range Martyr Francisca Center. So problematized is the hybrid character of socio-educational measures, raising questions about their sanctioning and educational content as well as the subjective and microsocial forms of everyday life involving adolescents in compliance with socio-educational measures of semi-liberty in Fortaleza. Thus, this work is conceived as a process of evaluation, using the qualitative methodology, based on the case study method. Through it, one can understand the perceptions and meanings of social and educational services in the design of its most legitimate recipients: the socioeducandos and their families. The instruments used for data collection is consisted of: desk research, routine observations, semi-structured interviews, medical records and records in Individual Care Plans. Optimalizace stroje s permanentními magnety na rotoru pomocí umělé inteligence / Optimization of the permanent magnet machine based on the artificial inteligence

The dissertation thesis deal with the design and the optimization of the permanent magnet synchronous machine (SMPM) based on the artificial intelligence. The main target is to apply potential optimization methods on the design procedure of the machine and evaluate the effectiveness of optimization and the optimization usefulness. In general, the optimization of the material properties (NdFeB or SmCo), the efficiency maximization with given nominal input parameters, the cogging torque elimination are proposed. Moreover, the magnet shape optimization, shape of the air gap and the shape of slots were also performed. The well known Genetic algorithm and Self-Organizing migrating algorithm produced in Czech were presented and applied on the particular optimization issues. The basic principles (iterations) and definitions (penalty function and cost function) of proposed algorithms are demonstrated on the examples. The results of the vibration generator optimization (VG) with given power 7mW (0.1g acceleration) and the results of the SMPM 1,1kW (6 krpm) optimization are practically evaluated in the collaboration with industry. Proposed methods are useful for the optimization of PM machines and they are further theoretically applied on the low speed machine (10 krpm) optimization and high speed machine (120 krpm) optimization.

A MOT-based cost management competency index: formulation and testing of association with financial performance

This study examined the nature and extent of relations between Management of Technology [MOT] and cost management. It explores the roles of competencies and competency measurement in these relations and its associations with company performance. The problem statement asks how the MOT community deals with cost management, whether MOT-based cost management competencies can be isolated and measured, whether a tool for measurement can be created, tested and validated and indeed whether it can be used to assess relations between MOT-based cost management competencies and company performance. To answer these questions, a MOT-based cost management competency index is formulated, consisting of problem statements representing MOT-based cost management insights, knowledge and practices. Designed in the format of a typical research survey, the index is used to source data from sampled companies listed on the Johannesburg Stock Exchange [JSE]. Although too small a sample to generalise about the population, sufficient data is collected and processed with statistical software programs. A second set of variables, about financial performance of the responding companies, consists of Asset Turnover [ATO] and Return on Assets Managed [ROAM]. Data for these variables is sourced from their annual financial statements and processed into ATO and ROAM indicators. The combined research data set is used to critically describe statistical qualities of variables such as ATO, ROAM, MOT-based cost management competencies of company executives, their education and exposure to the executive management teams in their respective organizations. The research data is subsequently subjected to correlation analysis, as foundation for hypothesis testing. Among the relationships described by correlation analysis and warranting further examination with regression analysis, are associations between MOT-based cost management competencies and ATO and between Education and MOT-based cost management competencies. The former association is found to be not significant, having the research hypothesis rejected. A significant association between Education and MOT-based cost management competencies is indeed found. Utilizing regression equations yielded by the analyses, the predictive capacity of regression analysis is used to demonstrate results of interventions in those associations postulated in the research hypotheses. The study concludes that it achieved a qualified success in its first objective, which was to formulate a MOT-based cost management competency index, and to demonstrate its application as measurement and management tool on executive managers of JSE-listed companies. The study failed in its second objective, which was to demonstrate a significant association between MOT-based cost management competencies and financial performance of sampled companies. Critical perspectives on the data and the associations tested reveal important shortcomings in the research. These perspectives do though create opportunities for refinement of the MOT-based cost management competency index as measurement and management tool, validation of its status, and indeed demonstration of its business value to the MOT and business community in particular. In closure, the study was meant as a contribution to the discourse on a credo for MOT and the MOT body of knowledge, and it subjects itself to critical analysis by the research community so as to establish whether it succeeded in indeed making such a contribution. / Business Management / M.Tech. Introdução: A negligência é um fenômeno de incidência crescente na enfermagem contemporânea, uma omissão frente ao cuidado bastante naturalizada no cotidiano profissional, mas que constitui infração ética grave, pois viola os preceitos éticos e a própria essência da profissão. Este estudo abordou a negligência cometida pelos profissionais de enfermagem no exercício da função nos processos éticos julgados pelo COREN-SP entre 2001 e 2010 e nas falas dos profissionais condenados nos processos éticos de negligência com criança. Contemplou-se a negligência nas dimensões conceitual, semântica, jurídica e ético-profissional, com o intuito de elucidar seus contornos, distingui-la das infrações éticas análogas imperícia e imprudência e dimensionar a responsabilidade do profissional condenado por conduta negligente. Objetivos: Identificar e classificar os casos de negligência profissional julgados pelo COREN-SP no período de 2001 a 2010; analisar as justificativas presentes nos depoimentos dos profissionais condenados nos processos éticos de negligência com criança e reconstituir o sentido do ato negligente nos depoimentos desses profissionais. Métodos: Delineou-se como percurso metodológico a pesquisa bibliográfica exploratória da literatura especializada, realizada em duas etapas, e a pesquisa documental dos processos éticos nas abordagens quantitativa e qualitativa. A primeira etapa da pesquisa bibliográfica concentrou-se em publicações nacionais que abordaram a negligência sem definição de recorte temporal. Localizou-se um número reduzido de 13 estudos e constatou-se a inexistência de um conceito de negligência no campo da enfermagem, pressuposto do estudo. Na segunda etapa, ampliou-se a revisão das publicações nacionais para 19 estudos e procedeu-se a revisão dos 11 estudos internacionais encontrados, realizada subsequentemente à leitura dos processos. Utilizou-se como referencial teórico-filosófico as concepções de ética, deliberação e responsabilidade de Aristóteles e de Hans Jonas. Resultados: O estudo quantitativo abrangeu 482 processos éticos e forneceu dados para a composição de um primeiro retrato da negligência na enfermagem. Identificou-se 68 processos de negligência e 20 processos de negligência com criança, dos quais selecionou-se sete para o estudo qualitativo, realizado mediante a análise de conteúdo dos depoimentos, na modalidade de análise temática. Tal abordagem propiciou uma definição mais específica de ato negligente e subsidiou a formulação de seis categorias analíticas. Observou-se, nos depoimentos, a mesma naturalização da negligência presenciada no cotidiano profissional, dado que os profissionais não se referiram à conduta negligente como negativa em suas falas mesmo quando esta resultou em consequências fatais, tampouco expressaram qualquer manifestação de pesar pelo efeito lesivo do ato praticado, buscando sempre atenuá-lo por meio de estratégias discursivas. Conclusão: Concluiu-se que o ato negligente comporta sempre um componente de deliberação e de responsabilidade pessoal, o que permitiu definir negligência como o descumprimento deliberado do dever de atender a necessidade do cuidado e confirmar que, na qualidade de conduta antiética, a negligência efetivamente afronta a responsabilidade profissional que decorre do compromisso ético inerente à profissão / Introduction: Neglect is a phenomenon of growing incidence in contemporary nursing, comprising an omission regarding care, which is quite naturalized in professional daily life, but which constitutes a serious ethical breach, as it violates ethical precepts and the very essence of the profession. This study addressed neglect committed by nursing professionals in the exercise of their function in the ethical proceedings judged by COREN-SP between 2001 and 2010 and in the statements of professionals convicted in ethical proceedings of child neglect. Neglect in the conceptual, semantic, juridical and ethical-professional dimensions was contemplated, with the aim of elucidating its contours, distinguish it from analogous ethical infractions, malice and imprudence, and dimension the responsibility of professionals convicted for negligent conduct. Purpose: To identify and classify the cases of professional neglect judged by COREN-SP in the period from 2001 to 2010; analyze the justifications present in the testimonies of convicted professionals in the ethical proceedings of child neglect; and reconstitute the meaning of the negligent act in the testimonies of these professionals. Methods: The exploratory bibliographic research of the specialized literature, carried out in two stages, as well as the documentary research of the ethical proceedings in the quantitative and qualitative approaches were delineated as a methodological course. The first stage of the bibliographical research focused on Brazilian publications that addressed neglect without a definition of timeframes. A small number of 13 studies were located, and there was no concept of neglect in the field of nursing, which was the studys assumption. In the second stage, the review of the Brazilian publications for 19 studies was expanded, and the 11 international studies were reviewed following the reading of the proceedings. The conceptions of ethics, deliberation and responsibility of Aristotle and Hans Jonas were used as theoretical-philosophical references. Results: The quantitative study covered 482 ethical proceedings and provided data for the composition of an initial image of nursing neglect. A total of 68 neglect cases and 20 child neglect cases were identified, of which seven were selected for the qualitative study, based on the analysis of the content of the testimonies, in the thematic analysis mode. This approach provided a more specific definition of a negligent act and subsidized the formulation of six analytical categories. The testimonies showed the same naturalization of the neglect observed in the professional daily life, as the professionals did not refer to the negligent conduct as negative in their statements, even when this resulted in fatal consequences, nor did they express any manifestation of regret by the injurious effect of the act, always seeking to alleviate it through discursive strategies. Conclusion: It was concluded that the negligent act always involves a component of deliberation and personal responsibility, which enabled a definition of neglect as the deliberate failure to comply with the duty to provide the care needed and to confirm that, as an unethical conduct, neglect is an effective violation of professional responsibility, arising from the ethical commitment inherent in the profession.

We begin by analyzing the main characteristics of the administrative function, from the various points of view under the perspectives of the national and foreign doctrines, and through the history of social security as a function of the state. We describe the peculiarities of the public service of social security, the major objective of which to provide social protection according to the law is embodied and characterized legally through an administrative act. We present a list of the main characteristics of the administrative act, its elements, and the vices that can invalidate it. The study of the peculiarities of the administrative act for granting benefits is the next step. We also analyze the demand to present an initial application for the benefit, as well as the duty-power of decision of the social security administration and the legal consequences of its inaction or silence. However, we identified and this is the centerpiece of this research and dissertation that the accurate comprehension of the intellectual property rights in all aspects conducts to the conclusion of the adequate, effective and timely tutelage of these assets only occurs through the use of a differentiated judicial protection with preventive and inhibitory nature. In other words, protecting the intellectual property the competitive advantage of the holder also will be safeguarded in relation to the competition, to the personality rights of the creators and authors and to the values and attributes that are added to the holder who takes advantage of the intellectual properties as competition and business tools. To support this positioning, this dissertation is based in the national and foreign doctrine that more recently has recognized the existence of certain rights (also called new rights , among which are the intellectual property) whose outstanding feature is the insusceptibility pricing, making it impractical and inefficient conversion into money, especially when it is not possible objectively quantify it and also be unable to obtain full and adequate compensation for damage caused by the violation. Furthermore, we have identified many concrete cases in which the Brazilian Judiciary has not contributed to the desired primacy of the specific tutelage of the obligations by falling to observe that the freedom of choice and the individual freedom can be object of restriction, so that the rights of intellectual property are actually protected in appropriate, effective and timely way / Nesta dissertação demonstramos que os direitos de propriedade intelectual pertencem a uma categoria historicamente negligenciada por ordenamentos jurídicos de variados países, que sempre identificaram a possibilidade de monetização desses direitos e o uso da tutela ressarcitória como o mecanismo preferencial para resolver os conflitos deste segmento. Todavia, identificamos e este é o cerne da nossa pesquisa e desta dissertação que a exata compreensão dos direitos de propriedade intelectual em todas as suas feições conduz à conclusão de que a tutela adequada, efetiva e tempestiva destes bens apenas ocorre mediante o emprego de uma tutela jurisdicional diferenciada de índole preventiva e inibitória. Ou seja, protegendo-se a propriedade intelectual o diferencial e a posição de vantagem competitiva do titular também serão salvaguardados em relação à concorrência, aos direitos da personalidade inerentes aos seus respectivos criadores e autores e, ainda, aos valores e aos atributos que são incorporados ao titular que se vale das propriedades intelectuais como ferramentas de competição e de negócios. The relevance of the subject lies on the need of defining criteria for judicial review of discretionary administrative action, in order to secure and preserve both administrative decision-making and judicial reviewing powers. The working hypothesis is that due process of law provides a sound normative basis for a rule forbidding arbitrary display of powers in Brazilian law. This is so because due process clause requires in decision-making a kind of cognitive, volitive and argumentative process with the basic attribute of rationality. Thus all the limits imposed by the law on administrative discretion could be placed under the due process clause. Furthermore, due process could be viewed as grounds for a systematic exposition of vicious discretionary actions, including not giving reasons for action and poor correlation of fact-findings and legal norms. Robert Alexy's theory of legal principles was adopted as a landmark. Brazilian and foreign production on administrative discretion was taken into account as well, in an attempt to overcome the loopholes of legal positivism's description of how the law is applied. Whenever it was possible, we managed to use case study methods to uncover legal argumentation structures and the way fact-findings and legal norms correlate. As a result, we built a system of vicious discrectionary actions / O objetivo do trabalho é o de explorar as conexões normativas entre a cláusula do devido processo legal (CF 5º, LIV) e o fenôneno da redução da discricionariedade administrativa nos casos concretos. A importância do tema reside na necessidade de definir critérios sistemáticos para o exercício do controle jurisdicional dos limites da discricionariedade a fim de preservar as competências decisórias da Administração Pública e, ao mesmo tempo, assegurar a plenitude da revisão judicial. A hipótese geral é a de que o devido processo legal proporciona o fundamento normativo da proibição da arbitrariedade no direito brasileiro por exigir a adoção de um processo de cognição, volição e argumentação com o atributo fundamental da racionalidade. Desse modo, todos os limites à discricionariedade administrativa, cuja violação resulta em arbitrariedade proibida, podem ser reconduzidos à cláusula do devido processo. Além disso, o devido processo legal serve de base para a construção de um sistema dos vícios do exercício da discricionariedade administrativa, em especial dos vícios de ausência de motivação e de relacionamento defeituoso entre os elementos fáticos e normativos relevantes. Adotou-se, como referência, a teoria dos princípios de Robert Alexy, assim como a produção nacional e estrangeira sobre discricionariedade administrativa, no marco das tentativas de superação das lacunas do positivismo jurídico na descrição do processo de aplicação do direito. Empregou-se, sempre que possível, a metodologia de estudo de casos para revelar as estruturas de argumentação jurídica e o modo como se relacionam os elementos fáticos e normativos.
