1 Abstract This thesis with the subject "The forms of custody for underage children in the times after split-up or divorce of their parents" is dealing with possible types of arrangements of custody for a child after the break up of his parents. This topic is currently very live in the Czech Republic, as well as in other advanced countries, because the amount of divorces is rising. According to the valid legislation it is possible to entrust the child, after the divorce of his parents, to either the custody of one of the parents, shared custody of both parents, joint custody or, if deemed necessary in regards to the needs of the child, to the custody of another person. The aim of this thesis is to create an overview which will acquaint the readers with all options of arrangements of the custody for children after the divorce of their parents which are established in the section § 907 of Act no. 89/2012 Coll., Civil Code. The increased attention is paid to the shared custody because of several recent breakthrough jurisprudences of the Constitutional Court of the Czech Republic concerning this legal institute. Výkon a rozhodnutí ve věcech rodinněprávních / Enforcement of judgments in family cases

The issue of the enforcement of judgments in family cases is a topical issue in our society, since the various changes this legal area has recently experienced. The main change in the procedural field was the separation of so-called undisputed proceedings into a new Act on Special court proceedings, while the Civil Procedure Code remained a subsidiary act. This new Act also contains the sole regulation of the enforcement proceeding in cases relating to domestic violence and in cases of child custody, since these two areas are the most distinct from the enforcement of other pecuniary and non-pecuniary performance. In the first two chapters, the thesis focuses on the background of the enforcement proceedings as well as on its development, principles and functions. The second chapter ends with the outline of the enforcement in the Act on Special court proceedings. The third chapter deals with the enforcement of judgements in domestic violence cases, focusing particularly on the Police Eviction Instrument and the Special Preliminary ruling on the Protection against Domestic Violence. Their subsequent enforcement is then evaluated and analyzed. It is known that grandparents have already raised their grandchildren, without proven legal dependence, for many years, however, recently, there has been an increase in demand for grandparents in accessing Judiciary to regularize this situation, in reason of the need of a legal guardian, for various purposes. Therefore, the present work was carried out to investigate, from the perspective of the grandmothers, the place occupied by them, within the family context, after deferring judicial custody of their grandchildren. Specifically, it was intended to analyze the factors that propelled grandmothers to take care of their grandchildren, as well as to characterize their feelings and needs, from the transfer of the duties of the biological countries to the grandparents, in addition to a framework as a family structure after obtaining custody, identifying the gains and difficulties arising from this situation, and also describe the changes that a legal custody had in the lives of the grandparents, with this new legal situation. It is a research of qualitative nature in which 5 grandmothers take full-time care of grandchildren, aged between 42-64 years, of low socio-economic levels, residing in the metropolitan area of Recife and who have the legal document of guard of their grandchildren. The research was approved by the Judge of the First Court of Childhood and Youth of Recife. Initially, an analysis was made of the documents referring to the records of the selected families' cases, from the years 2013 to 2015, in order to analyze the initial petitions and technical opinions built by the professionals who work in the First Ward of Children and Youth of the region of Recife, in the Nucleus NIAP (Integrated Nucleus of Psychosocial Counseling). In a second moment, a Field Survey was carried out, where a socio-demographic questionnaire was used and an interview conducted semi-directed from a previously defined script, being analyzed according to the Thematic Content Analysis Technique. The data obtained in the present study show that as grandparents they came to replace deceased, chemical dependent or negligent parents. The grandchildren were raised mainly by the grandparents because, in most cases, they were already responsible for the children from birth. The reason that made the grandparents look for the Judiciary was the absence of the parents, however, what prompted the grandparents to activate the Justice System was the fear that their grandchildren were withdrawn from their lives, since there was no legal evidence of their care. It was also evident, in spite of the satisfaction in the coexistence with the grandchildren, there is an affective ambivalence when they are occupying the parental place, ceasing to be "simply grandmothers". They assume a very high responsibility burden, mainly because this charge is legitimized by a Power that goes beyond the family sphere. It is hoped to be able to contribute to broaden the understanding and visibility of this familiar configuration, as well as to provide subsidies for the work of professionals who deal with family members. / A crescente expectativa de vida tem proporcionado um prolongamento entre as diferentes gerações de uma mesma família, favorecendo uma maior interação entre avós e netos. Sabe-se que avós já criam seus netos, sem dependência legal comprovada, há muitos anos, contudo, recentemente, tem-se observado o aumento da demanda dessas avós em acessarem o Poder Judiciário para regularizar esta situação fática, devido à necessidade de regularização de um responsável legal, para diversas finalidades. Sendo assim, o presente trabalho teve por objetivo investigar, a partir da perspectiva das avós, o lugar ocupado por elas, no contexto familiar, após o deferimento da guarda judicial de seus netos. Especificamente pretendeu-se analisar os fatores que impulsionaram as avós a assumir a guarda de seus netos, bem como caracterizar os seus sentimentos e necessidades, a partir da transferência das responsabilidades dos pais biológicos às avós, além de compreender como se estrutura a família a partir da obtenção da guarda, identificando os ganhos e as dificuldades advindas dessa situação, e ainda descrever as mudanças que a guarda legal propiciou na vida das avós, com a nova situação legal. Trata-se de uma pesquisa de natureza qualitativa da qual participaram 5 avós que cuidam dos netos em tempo integral, com idade entre 42 a 64 anos, de nível sócioeconômico médio-baixo, residentes na região metropolitana de Recife e que possuem o documento legal de guarda de seus netos. A pesquisa recebeu a autorização da Juíza da Primeira Vara da Infância e Juventude de Recife. Em um primeiro momento, foi realizada uma análise dos documentos referente aos autos dos processos das famílias selecionadas, dos anos de 2013 a 2015, visando analisar as petições iniciais e pareceres técnicos construídos pelos profissionais que trabalham na Primeira Vara da Infância e Juventude da comarca de Recife, no Núcleo NIAP (Núcleo Integrado de Assessoramento Psicossocial). Em um segundo momento, foi realizada uma Pesquisa de Campo, onde foram utilizados um questionário sóciodemográfico e uma entrevista conduzida de forma semidirigida a partir de um roteiro previamente definido, sendo analisada de acordo com a Técnica de Análise de Conteúdo Temática. Os dados obtidos no presente estudo mostram que as avós vieram a substituir pais falecidos, dependentes químicos ou negligentes. A criação dos netos foi assumida preferencialmente pelas avós porque, na maioria dos casos, elas já eram as responsáveis das crianças, desde seu nascimento. O motivo que fez com que as avós procurassem o Judiciário foi pela ausência dos genitores, entretanto, o que impulsionou as avós a acionarem o Sistema de Justiça foi o receio de que seus netos fossem retirados de seu convívio, já que não havia uma comprovação legal de seus cuidados. Ficou evidente também que, apesar da satisfação na convivência com os netos, existe uma ambivalência afetiva ao estarem ocupando o lugar parental, deixando de ser “simplesmente avós”. Elas passam a assumir uma carga de responsabilidade bastante elevada, principalmente porque esse encargo é legitimado por um Poder que ultrapassa a esfera familiar. Espera-se poder contribuir no sentido de ampliar a compreensão e a visibilidade dessa configuração familiar, como também proporcionar subsídios para o trabalho de profissionais que lidam com as configurações familiares atuais.

En förändrad syn på barnets rättigheter i vårdnadstvister / A changed view of children’s rights in custody cases

Denna studies syfte var att undersöka hur barnrättsperspektivet diskuteras i domslut gällande vårdnadstvister samt hur stor vikt barnets bästa har i slutligt domslut. Även att undersöka om det finns några likheter och skillnader i motiveringen och domslutet sedan FN:s konvention om barns rättigheter blev en del i svensk lagstiftning. I studien har följande frågeställningar besvarats: Hur diskuteras barnrättsperspektivet i vårdnadstvister och hur stor vikt läggs vid barnets bästa i slutligt domslut? Hur har användandet av barnrättsperspektivet förändrats sedan barnkonventionen blev en del i svensk lagstiftning samt vilka likheter och skillnader finns i motiveringar och domslut i vårdnadstvister? I studien har åtta domslut från tidsperioden 2016–2019 samt åtta domslut från 2020–2023 analyserats genom en jämförande kvalitativ innehållsanalys samt ur ett barndomssociologiskt perspektiv och ett rättssociologiskt perspektiv. Studiens resultat har visat på likheter i tidsperioderna gällande hur stor betydelse ska tillskrivas till faktorer som vårdnadshavarnas samarbete och föräldrarnas förmåga att skydda barnet från en hotfull och skadlig miljö. Likheter gällande saknade diskussioner kring barnets anknytning och barnets delaktighet förekommer även i båda tidsperioderna. Resultatet har visat på utmärkande skillnader i tidsperioderna då det skett en ökning av barnperspektiv i domslut, både genom barnets inkludering och hur barnets åsikter beaktas och tillmäts betydelse. Resultatet påvisar även en reducering gällande diskussionen om barnets anknytning till föräldrarna efter att barnkonventionen blev del av svensk lag. Sammanfattningsvis pekar studiens resultat på en smärre förändring gällande barnperspektivet i de domslut som studerats, sedan barnkonventionen blev en del i svensk lagstiftning. / The purpose of this study was to examine how the best interests of the child are discussed in the judgment of the court regarding child custody cases and how much impact the child's best interest has in the final judgment. Also, to examine similarities and differences in the inquiry and final judgment since the United Nations Convention on the Rights of the Child became a part of Swedish law. The following questions were answered in the study: How is the child rights perspective discussed in custody cases and how much importance is given to the best interests of the child in the final judgment? How has the use of the child rights perspective changed since the Convention on the Rights of the Child became part of Swedish law and what similarities and differences are there in justifications and judgments in custody cases? In the study, eight verdicts from 2016-2019 and eight verdicts from 2020-2023 have been analyzed through comparative qualitative content analysis and discussed within the theoretical framework of childhood sociology and sociology of law. The results of the study have shown similarities in the periods regarding how much importance should be attributed to factors such as the cooperation of the guardians and the parent's ability to protect the child from a threatening and harmful environment. Similarities regarding missing discussions about the child's attachment and the child's participation also occur in both periods. The results have shown significant differences in the time periods when there has been an increase in the child's perspective in judgments, both through the child's inclusion and how the child's opinions are considered and given importance. The results also show a reduction in the discussion of the child's attachment to the parents after the Convention on the Rights of the Child became part of Swedish law. In summary, the study's results point to a minor change regarding the child perspective in the verdicts studied, since the United Nations Convention on the Rights of the Child became part of Swedish law.

Parental alienation is when one parent denigrates the other to turn their children against that parent, often after a separation or divorce. It is well-documented but poorly understood as a form of domestic abuse. This study explores how one Austrian and one Swedish father experience parental alienation in the wake of false allegations of sex abuse, how they perceive their emotional situation after the separation, how their interactions with their children have been affected and what economic impact this has had on their lives.  The study concentrates on white, heterosexual, agnostic men. It is based upon in-depth interviews, and analytically framed within the parental alienation theory. The analysis identified several core themes suggesting the need for better education and training on parental alienation, and strategies to enable effective change to public policies and family law.

Conflicted custody: the unfolding of a professional problem-determined system

With the maturation of the child custody investigative process, the role of investigators and the process of these investigations have come under increasing scrutiny. The investigators are expected to be objective, neutral, and professional while following procedures that conform to model standards. However, this assumption of a lack of bias has been largely overlooked in the literature regarding the investigative process. It is assumed that investigators should self-monitor to ensure that their stance is objective and neutral. Furthermore, this position of neutrality and objectivity is assumed to be intuitive and natural. By using a case study, this thesis investigates and describes the process of a child custody investigation predicated on a constructivist epistemology. It highlights the impossibility of any investigator to be objective and neutral in any investigation automatically, regardless of the procedures and methods employed. The thesis highlights the participant observer status of investigators. An aim of the thesis is thus to sensitise investigators to this inevitable vulnerability with the expectation that such an awareness may allow investigators to establish processes to render investigations consciously more balanced, considered, and transparent. A further aim is to describe a child custody evaluation from an eco-systemic perspective by contextualising the investigation in the larger ecosystem to which it belongs. This description includes the investigation as part of an evolving problem-determined system. An awareness of this wider and evolving context may enable investigators to approximate a position of objectivity and neutrality more effectively. It may also act as an inoculation against the ‘contamination’ of the investigator by the investigative system. L'influence des marqueurs identitaires du juge dans les décisions relatives à la garde des enfants dans un contexte post-rupture

L’« intérêt de l’enfant » est un concept fondamental en droit de la famille puisqu’il constitue le critère déterminant dans toute décision qui concerne l’enfant. Le Code civil du Québec énonce, au second alinéa de l’article 33, les facteurs qui doivent servir à le déterminer, soit « les besoins moraux, intellectuels, affectifs et physiques de l’enfant, son âge, sa santé, son caractère, son milieu familial et les autres aspects de sa situation ». Les auteurs qui s’y sont intéressés l’ont abordé sous différents angles. Certains se sont intéressés à ses origines et à son évolution. D’autres en ont proposé leur propre définition. En ce qui nous concerne, nous avons choisi d’explorer ledit concept en nous intéressant aux diverses interprétations qu’il reçoit de la part des tribunaux dans les décisions relatives à la garde des enfants dans un contexte post-rupture, et ce, à la lumière du genre et de l’âge du décideur. Le concept d’intérêt de l’enfant étant hautement indéterminé, son interprétation est laissée à l’appréciation du juge qui en précisera le contenu en référence à la loi et aux faits particuliers de chaque cas d’espèce. Or, dans les situations où, une fois considéré le contexte factuel et normatif, le juge se retrouve face à une situation « neutre », c’est-à-dire où la garde exclusive et la garde partagée sont tout aussi envisageables, peut-on prétendre que son l’inclinaison vers l’une ou l’autre de ces modalités de garde est influencée par des facteurs autres que le droit et les faits mis en preuve ? Telle est la question au cœur de notre étude. Reposant sur des théories reconnues et bien établies affirmant l’importance de tenir compte du contexte social et de l’expérience individuelle du décideur dans la démarche interprétative que le droit sous-tend, l’hypothèse que nous soumettons est qu’au-delà des faits mis en preuve et du droit, des éléments indissociables au processus d’interprétation, à savoir les valeurs, les idéologies et les traits caractéristiques dominants que sous-tendent le genre et la génération du décideur, influent sur la teneur des jugements qu’il prononce. Sans admettre que ces éléments suffisent, à eux seuls, pour expliquer le produit judiciaire, nous sommes d’avis qu’on ne peut qualifier d’improbable l’incidence qu’ils exercent sur celui-ci. Nous intéressant au processus cognitif qui préside à la réflexion des décideurs, notre thèse vise à cerner, à travers une analyse interdisciplinaire, les facteurs humains et les forces sociales qui structurent les expériences et qui sont susceptibles d’avoir un impact sur les décisions judiciaires. L’objectif de notre étude n’est pas d’établir un lien de causalité entre le genre et l’âge du juge et les décisions qu’il rend, mais plutôt de vérifier si des corrélations peuvent être établies entre ces paramètres. Désirant aller au-delà des perceptions traditionnelles véhiculées par la doctrine classique, nos travaux se veulent davantage une contribution au développement d’une conception non formaliste du droit plutôt qu’une démonstration que le profil identitaire des décideurs conditionne systématiquement et invariablement leurs décisions. Une étude de ce genre comporte certes des difficultés en ce qu’elle confronte le juriste à des concepts et des théories qui appartiennent à d’autres champs disciplinaires et qui, partant, ne lui sont pas familiers. La compréhension plus fine du processus interprétatif et des décisions qui en résultent en justifie cependant le bien-fondé. / The “best interest of the child” is a fundamental concept of family law as it is the decisive criterion in each decision concerning a child. The Civil Code of Québec enumerates, in art. 33 para. 2, the criteria that must be taken into consideration, which are “the moral, intellectual, emotional and physical needs of the child, [his] age, health, personality and family environment, and [the] other aspects of his situation”. Scholars have approached this concept from different angles. While some of them have expressed interest in its origin and evolution, others have articulated their own definition. In this thesis, I chose to explore the concept of the “best interest of the child” by examining the manner in which courts have interpreted this principle in cases related to child custody, and to what extent it is affected by the gender and the age of the decision-maker. Indeed, whenever a child is part of a conflict, regardless of whether it concerns custody or any other matter, his best interest constitutes the central element. Yet the concept of the child's best interest is highly indeterminate: its interpretation is left to the discretion of the judge, who will specify its content according to the law and facts of each case. But once the judge has considered the factual and normative contexts, he can sometimes face a « neutral » situation, for which he could consider sole and shared custody as options. Would it therefore be accurate to assume that the judge’s inclination toward one or the other option of custody is governed by elements other than the law and facts of the case? This is the main question of this study. Based on recognized and well established theories asserting the importance of considering the social context and individual experience of the decision maker in the interpretative process, the proposed hypothesis is that beyond the facts and the law, there are other elements that have a crucial influence on the process of interpretation (and on the content of the decision that a judge renders), most notably the identity profile of the judge (i.e., gender and age, including their underlying values and ideologies). Indeed, and although the values, ideologies, and dominant social characteristics are not sufficient in themselves to explain the judicial outcomes, I nevertheless consider that the impact that the former has on the latter cannot be denied. By examining the cognitive process that governs the reasoning of the decision maker, this thesis aims to identify, through interdisciplinary analysis, human factors and social forces that shape individual experiences and are likely to have an impact on judicial decisions. The objective of this research is not to establish a causal link between the profile of the judge and his/her decisions, but rather to determine whether a correlation can be established between these parameters. Wishing to go beyond traditional perceptions conveyed by the traditional doctrine, this thesis is a contribution to the development of a non-formalist conception of law, as a way of demonstrating the idea that the profile of the judge systematically and consistently frames his decisions. A study of this kind certainly faces difficulties, in that it confronts the lawyer with concepts and theories that belong to other disciplines, and which therefore may not be familiar. However, the deep understanding of the interpretive process and resulting decisions justify the importance of this kind of research.

The uses of psychoanalysis in law: the force of Jay Katz’s example / Los usos del psicoanálisis en el derecho: la fuerza del ejemplo de Jay Katz

This article samples possible uses of psychoanalysis in law from the academic work of Joseph Goldstein and Jay Katz. Both start to recognize the importance of psychoanalysis to provide a serious and courageous attention to the non-rational dimensions of the human being, we should be aware in the world of law. Starting from this premise, the author explores two possible uses of psychoanalysis in law: one represented by Goldstein, focuses on using «psychoanalytic premises to resolve legal disputes», for example by providing psychoanalytic information to determine the best interests of the child in cases of custody, while the other, represented by Katz, who seeks to «create an awareness of conflict where all of the actors had previously been locked in a mutually reinforcing fantasy that no conflict existed», as it occurs in doctor-patient relationship, in order to rethink standards that had been set by law under an illusion of objectivity and rationality. The article explores these two approaches through examples, linking two perspectives adopted by Freud throughout his academic work and taking a preferred position by the position of Katz. / El presente artículo muestras los posibles usos del psicoanálisis en el derecho a partir del trabajo académico de Joseph Goldstein y Jay Katz. Ambos parten de reconocer la importancia del psicoanálisis para prestar una atención seria y valiente a las dimensiones no racionales del ser humano, de las que debemos ser conscientes en el mundo del derecho. Partiendo de dicha premisa, el autor explora dos posibles usos del psicoanálisis en el derecho. Uno, representado por Goldstein, se centra en utilizar «premisas psicoanalíticas para resolver conflictos jurídicos», como, por ejemplo, al aportar información psicoanalítica para determinar el interés superior del niño en casos de tenencia. Mientras tanto, el otro, representado por Katz, busca «concientizar acerca de un conflicto en casos donde los todos actores se habían dedicado a reforzar mutuamente su fantasía de que no existía conflicto alguno» entre sujetos de una relación, como ocurría en la relación médico-paciente, con la finalidad de repensar estándares que habían sido fijados por el derecho bajo una ilusión de objetividad y racionalidad. The thesis is structured in three interdependent studies. The first study, already published, corresponds to a systematic review of literature on grandparents raising grandchildren within a period of ten years (2004/2014). The results showed that, although the number of studies on the relationship between grandparents and grandchildren has increased in recent decades, researches regarding guardian grandparents are recent and still scarce, especially when investigating the relationship of grandparents with other development contexts, such as the school of their grandchildren. In order to accomplish the ensuing empirical studies, Ecological Insertion was used as the methodological strategy. Participants were selected intentionally, over an approach to a primary school of the state public school network in the city of Recife/Pernambuco. Diversified instruments were used over a period of eight months, total time of insertion of the researcher in the field. The first five months corresponded to the period of attachment of the researcher to the context, in which naturalistic observations were initiated. In the last three months sociodemographic questionnaires were applied and semi-structured interviews were conducted with the participants. The second study analyzes the relationship between guardian grandparents and their grandchildren from a bioecological perspective. Six guardian grandparents and eight grandchildren who answered sociodemographic questionnaires and semi-structured interviews were included in the study. From the Thematic Content Analysis, the following themes were discussed: grandparents’ parenting; joint activities that involve grandparents and grandchildren. The results showed that grandparents’ parenting is a relational process that is developed over time and involves individual and contextual dimensions. On the other hand, the analysis of joint activities revealed that guardian grandparents and grandchildren are primary dyads that influence and learn from each other in sports, leisure and cultural activities, corroborating with studies that affirm that such activities favor the creation and maintenance of the bond between grandparents and grandchildren. The importance of the intergenerational approach was discussed through intergenerational programs aimed at favoring coeducational processes that benefit grandparents and grandchildren. The third study analyzes the family and school mesosystem from the perspective of guardian grandparents, grandchildren and teachers. Six grandparents, eight grandchildren and eight teachers participated in this study. Semi-guided interviews (with a script for each group), field diary and sociodemographic questionnaire were used as instruments. In the analysis of the results, the sociodemographic data and the records of the observations were articulated to the contents brought by the participants in the interviews. All interviews were transcribed in full and analyzed according to the steps in Thematic Content Analysis. The following themes were discussed: the relationship between guardian grandparents and school; the ease and difficulties in that relationship; the information and communication between the family and the school contexts; and the joint activities involving family and school. In all these dimensions the obstacles and the possibilities for the expansion of the potential for development of the family and school mesosystem were analyzed. It was evidenced that important aspects to expand the potential for development of the family and school contexts were put into action with the presence of guardian grandparents in the school context by establishing a direct communication with the teachers, expecting the collaboration of the school in the development of their grandchildren, and suggesting actions and interventions. These results confirmed the growing importance of grandparents for family, school, and society as they play the role of guardians of their grandchildren. / O presente estudo fundamenta-se na Teoria Bioecológica do Desenvolvimento Humano para investigar a relação entre avós guardiões, netos e escola no cenário atual, em que várias mudanças sociais repercutem nos papéis assumidos por avós ao criarem os netos, assim como no relacionamento que estabelecem entre si e com outros contextos de desenvolvimento. A tese está estruturada em três estudos interdependentes. O primeiro estudo, já publicado, corresponde a uma revisão sistemática da literatura sobre os avós que criam netos considerando o período de dez anos (2004/2014). Os resultados obtidos demonstraram que, embora os estudos sobre o relacionamento entre avós e netos tenham aumentado nas últimas décadas, as pesquisas sobre os avós guardiões são recentes e ainda escassas, sobretudo quando se investigou a relação desses avós com outros contextos de desenvolvimento, como a escola dos netos. Para realização dos estudos empíricos subsequentes, utilizou-se a Inserção ecológica como estratégia metodológica. Os participantes foram selecionados de forma intencional, a partir de abordagem a uma escola de ensino fundamental da rede pública estadual, na cidade do Recife/Pernambuco. Foram utilizados instrumentos diversificados ao longo de oito meses, tempo total de inserção da pesquisadora no campo. Os cinco primeiros meses corresponderam ao período de vinculação da pesquisadora ao contexto, no qual foram iniciadas observações naturalísticas. Nos três últimos meses foram aplicados questionários sociodemográficos e realizadas as entrevistas semidirigidas com os participantes. O segundo estudo analisa o relacionamento entre avós guardiões e seus netos, numa perspectiva bioecológica. Foram participantes seis avós guardiões e oito netos que responderam a questionários sociodemográficos e entrevistas semidirigidas. A partir da Análise de Conteúdo Temática foram discutidos os temas: Parentalização dos avós; Atividades conjuntas entre avós e netos. Como resultados, obteve-se que a parentalização dos avós trata-se de um processo relacional, que ocorre ao longo do tempo e envolve dimensões individuais e contextuais. Por sua vez, a análise das atividades conjuntas, revelou que avós guardiões e netos constituem díades primárias que se influenciam mutuamente e se coeducam em atividades esportivas, de lazer e culturais, corroborando com os estudos que afirmam que tais atividades favorecem a construção e manutenção de laços afetivos estáveis entre avós e netos. Discutiu-se sobre a importância da aproximação entre as gerações através de programas intergeracionais que visam favorecer processos coeducativos que beneficiam avós e netos. O terceiro estudo analisa o mesossistema família e escola na perspectiva dos avós guardiões, netos e professores. Participaram desta pesquisa seis avós, oito netos e oito professores. Foram utilizados como instrumentos: entrevistas semidirigidas (com um roteiro próprio para cada grupo), diário de campo e questionário sociodemográfico. Na análise dos resultados os dados sociodemográficos e os registros das observações foram articulados aos temas desenvolvidos pelos participantes nas entrevistas. Todas as entrevistas foram transcritas na íntegra e analisadas de acordo com as etapas da Análise de Conteúdo Temática. Foram discutidos os seguintes temas: Relacionamento entre os avós guardiões e a escola; Facilidades e dificuldades encontradas nessa relação; Avaliação das informações e da comunicação trocadas entre os contextos familiar e escolar; assim como as Atividades conjuntas realizadas entre família e escola. Em todas essas dimensões analisaram-se os entraves e as possibilidades para a ampliação do potencial desenvolvimental do mesossistema família e escola. Evidenciou-se que aspectos importantes para ampliar o potencial desenvolvimental dos contextos familiar e escolar foram postos em ação com a presença dos avós guardiões no contexto escolar, estabelecendo uma comunicação direta com os professores, com expectativas de contar com a colaboração da escola em prol do desenvolvimento dos netos, sugerindo ações e intervenções em diversos formatos. Tais resultados confirmaram a importância crescente dos avós para a família, para a escola e para a sociedade, ao assumirem o papel de guardiões de seus netos.
