The thesis objective is to analyze existing situation concerning reporting of the aviation accidents or incidents in national level and according the outputs from the analyses to develop recommendations, how database system ECCAIRS can by used for reporting on the national base. The focus of the thesis is investigation and evaluation of the existing national situation / from theoretical point of view and practical point of view/ and develop recommendation. As source of the investigation ware used existing legislation documents and foreign experience. For collection of the foreign experience was designed special type of questioner. The questioners ware distributed to the pre-selected number of authorities represented pre-selected states. During all process of analysis and investigation situation was discussed with local Czech authorities too. International law / ICAO Annex 13 of the Chicago Convention and EU Directive 94/56 / ware considers as one of the basic sources for the information.

This dissertation is a historical biography of F.V. Engelenburg (1863-1938) and covers the period from 1889 to 1938, when Engelenburg lived and worked in South Africa. The study situates Engelenburg in the historical landscape of the Zuid-Afrikaansche Republiek during the late nineteenth and early twentieth century. The focus is mainly on Engelenburg’s journalistic career at De Volksstem, but attention is also given to his many other interests, including the development and promotion of Afrikaans and the Afrikaans academic culture, especially in the northern parts of South Africa. His work pertaining to the development of architecture, literature, aviation, the visual and performing arts, history, libraries, museums and educational institutions comes under the spotlight. His private life is considered as well in order to portray his versatility as a person. The chapters have been subdivided to highlight the variety of matters he was involved in, and a chronological approach has been followed as is customary in a biography. The study is based on archival research. In particular, Engelenburg’s private collections were used, as well as the private collections of some of his contemporaries. Engelenburg assumes a central place in the biography, with special focus on how he perceived and experienced conditions and everyday life in South Africa from the point of view of his transnational European background. His role as influential opinion-maker and political commentator on local and international politics is highlighted. His ties with political leaders and his involvement in government affairs are emphasised. The study also refers to his continued contact with his motherland, the Netherlands, and with the Dutch language. After the Anglo- Boer War, he realised that the languages of the future in South Africa would be Afrikaans (not Dutch), alongside English. His continuing support for Afrikaans as a language of instruction in schools and universities and the development of the Afrikaans literature, as well as his support for the standardization of Afrikaans helped to establish Afrikaans as an official language alongside English and Dutch in South Africa. Engelenburg’s active contribution to the work of the Zuid-Afrikaanse Akademie voor Taal, Lettere en Kuns (now the Suid- Afrikaanse Akademie vir Wetenskap en Kuns), helped to put the organization on a sound footing for future development. Self-rated health and respiratory symptoms among civil aviation pilots : Occupational and non-occupational risk factors

There is concern about the indoor environment in aircraft but few stud-ies exist on self-rated health (SRH) and respiratory symptoms among pilots. Occupational and non-occupational risk factors for SRH, respira-tory symptoms and other symptoms among commercial pilots were investigated in this thesis. One cohort study and one prevalence study were performed among pilots in one Scandinavian airline company. Fungal DNA, furry pet allergens and volatile organic compounds of microbial origin (MVOC) were measured on board. Cat (fel d1), dog (Can f1) and horse (Ecu cx) allergens were found in all dust samples and allergen levels were 27-75 times higher in aircraft with textile seats as compared to leather surfaces. The sum of MVOCs in the cabin air was 3.7 times higher than in homes in Uppsala and 2-methyl-1-butanol and 3-methyl-1-butanol concentrations were 15-17 times higher. Asper-gillus/Penicillium DNA and Aspergillus versicolor DNA were more common in aircraft with textile seats. One fifth reported SRH as poor or fair, 62% had fatigue, 46% overweight/obesity and 71% insomnia. Poor or fair SRH was associated with overweight/obesity, lack of exercise, insomnia, low sense of coherence (SOC) and high work demand. Re-covery from work was worse among those with insomnia and low social support at work. Fatigue was more common among young or female pilots and related to insomnia and high work demand. Pilots flying MD80 or Saab 2000 aircraft had less fatigue. Pilots exposed to environmental tobacco (ETS) on board had more eye symptoms and fatigue which were reduced after the ban of smoking (in 1997). Pilots with increased work demand developed more rhinitis, dermal symptoms and fartigue and those with decreased work control developed more eye symptoms. The incidence of doctors’ diagnosed asthma and atopy were 2.4 and 16.6 per 1000 person years, respectively. Pilots changing type of flight got more airway infections. Those reporting decreased work control had a higher incidence of atopy. Risk factors in the home environment included ETS, dampness or mould, window pane condensation in winter and living in houses built after 1975. In conclusion, SRH and respiratory health among pilots are associated with specific occupational and non-occupational risk factors.

Pour réglementer les activités de navigation civile internationale, aérienne et maritime, les États ont choisi d’agir au moyen de deux institutions spécialisées du système des Nations Unies. L’Organisation de l’aviation civile internationale (OACI) et l’Organisation maritime internationale (OMI) ont été investies du pouvoir de superviser l’élaboration de règles techniques applicables à ces matières. De façon générale, les règles adoptées par ces Organisations doivent, pour prendre effet, être acceptées par les États, sous diverses formes (tacites ou expresses, collectives, voire individuelles). Leur application est tributaire d’actes unilatéraux des États, qui agissent parfois collectivement, étant souvent amiablement contrôlés par l’OACI ou l’OMI. Derrière une apparente clarté, se dissimulent des zones d’ombre. Outre, la situation des tiers et des personnes privées, et les rapports entre l’ordre international et les ordres juridiques étatiques, la nature de ces institutions normatives interroge. Y voir des autorités normatives agissant sur le fondement de pouvoirs constitués serait, en effet, ignorer le jeu incessant de la volonté des États, qui, partout là où il étire les pouvoirs de l’institution, montre l’irréductible liberté contractuelle et constituante de ces mêmes États. Le degré de centralisation de ces systèmes s’effacerait sous le constat que leur effectivité repose sur la volonté même de leurs sujets, plus ou moins tenue par des nécessités techniques, ce qui n’est pas sans conséquences pratiques. / In order to regulate the international civil navigation (air and maritime), the States have chosen to act through two specialized United Nations agencies. Hence they confered the International Civil Aviaton Organization (ICAO) and the International Maritime Organization (IMO) the power to oversee the elaboration of technical rules relevant to this field. In general, the rules adopted by these organizations require various forms of States acceptance to be effective (i.e. express or implied, collective or individual forms). Their implementation depends on unilateral acts of States, that can sometimes act sometimes collectively. And the States are often amicably controlled by the ICAO or the IMO. Behind the apparent clarity, lay some gray areas. Beyond the situation of third and private individuals, and the relationship between international order and national legal systems, one can wonder about the nature of these normative institutions. These could be perceived as normative authorities acting on the basis of an established power. However, this interpretation would ignore the incessant game of States’ will. Whenever the will of the States stretches the power of the institution, the irreducible constituent and contractual freedom of the States appears. The degree of centralization of these systems would be blurred by the observation that their effectiveness depends on the willingness itself of their subjects, which is more or less held by technical necessities, and that would not be without practical consequences.

Návrhová studie letiště VFR / Design Study of VFR Airport

The final master´s thesis targets to create concept study of VFR airport.This airport should be build up in southeast part of Czech republic, in the vicinity of the town Valašské Klobouky. In this work there are explained essential terms and definitions refered to basic rules and law. There are explained also civil aviation law and requirements of L14 regulations. Aeroclub is submitter of this work. It establishes basic conditions for airport area searching. The length of the runway is influenced mainly by performance of used aircrafts. It was impossible to find any acceptable field in searched area. There is a posibility how to solve this problem. There can be build up a runway for take-off and landings of small aeroplanes. In the second part of this thesis there are defined basic requirements on these fields. These requirements are applicated on chosen field. At the end of this thesis there is propounded an option how to dislocate runway, taxiways, aprons, hangars and other buildings.

The master´s thesis targets to compile summary document for aerodrome certification by EASA requirements and to create methodology for application of these documents. Master´s thesis consists of three main parts. In the first part is described national legislation, which in general regulates condition for civil aviation. There is also specified current legislation, by which the conditions for aerodrome certification are set. The second part of the thesis involves EASA requirements in field of aerodrome certification. There is described organisation structure of agency, information about its emergence and field of occupation. The certification process is analysed in the main part of the thesis. Moreover there is demonstrated the probable schedule of the certification process in the Czech republic and the documents, that should be issued.

La redéfinition des conditions d’exercice de la souveraineté aérienne des États membres, par un transfert progressif de compétences au profit de l’Union européenne, ne peut être analysée uniquement en termes de dépossession et de réduction de leur puissance individuelle. Les compétences aériennes confiées à l’Union permettent l’affirmation de l’ensemble européen sur la scène internationale. Ce processus, mouvant et encore inachevé, se traduit par une prise en compte accrue de la spécificité européenne en matière d’aviation civile. Malgré des réticences certaines émanant aussi bien des États membres que des États tiers, l’Union s’érige progressivement au rang d’acteur de poids, capable d’influencer le contenu normatif du droit aérien contemporain, de la même manière que le font les puissances aériennes traditionnelles et notamment les États-Unis. Ces nouvelles tendances, révélatrices de la souplesse et de la plasticité de la convention de Chicago, permettent de dresser des perspectives quant aux possibles évolutions futures de l’ordre international de l’aviation civile. / The way in which the Member States have redefined the conditions regarding how they exercise their air sovereignty, by progressively transferring power to the European Union, cannot be viewed solely as them removing and reducing their individual powers. The powers conferred to the European Union in aviation matters are resulting in an affirmation of the international role of Europe as a whole. This on-going, and as yet incomplete process, may be seen in a greater recognition of the specific European aspect regarding Civil Aviation. In spite of the hesitance of Member States and non-member States, the European Union has progressively taken its place among the key players, able to influence developments in modern aviation law, in the same way as other established aviation authorities and especially the United States. These new trends reveal the flexibility and elasticity of the Chicago Convention and the potential future developments in International Civil Aviation.

Integration of unmanned aircraft systems into civil aviation : a study of the U.S., South Africa and Kenya

The rapid increase and popularity of Unmanned Aircraft Systems (UAS) in civil usage around the world is due to their versatility. With advancement in technology across the globe, there are UAS of different sizes and capabilities in the market. It is imperative to note that the use and operation of UAS have numerous merits and equally, potentially poses serious risks to aviation safety, unlawful interference with States’ security as well as invasion of the privacy of persons. This reality poses a challenge to integration of UAS into the civil airspaces of different States. Accordingly, the international community developed the Chicago Convention that provides the principal framework to address the threefold concerns. At the international level, however, there is lack of a unified system of regulation of UAS. Consequently, the Chicago Convention requires States to develop national institutions and legal frameworks to not only effectively address these concerns, but also create a delicate balance between national security and right to privacy. This thesis evaluates how the legal, institutional and policy frameworks for UAS in the US, South Africa and Kenya have addressed the current needs and challenges in operation and integrating them into regulatory frameworks for civil aviation. It follows that the three States have developed constitutional frameworks, legislation, regulations, policies and strategic plans as they seek to address the challenges that emanate from integrating UAS into the civil aviation airspace. This encompasses ineffective enforcement mechanism of regulations. The thesis maps out experiences of integration in the three countries, emanating from research goals including investigating the extent to which existing international regulatory frameworks address the threefold concerns. The study establishes that the common thread running through UAS regulation is each country’s unique issues and paths to integration. Additionally, that the approach for integration of UAS into civil aviation needs be gradual and pragmatic. For this reason, this thesis recommends the development of institutional capacity, coordination and funding, and increase in regional efforts to revamp UAS integration efforts into civil aviation. / Public, Constitutional, and International Law / LL.
