Testing the Global Banking Glut Hypothesis

This paper presents VAR results on the recent economic history of the U.S and focuses on the dependence of U.S. macrofinancial variables on international capital flows. Both gross and net flows are included in the analysis. The results indicate that cross-border funding has affected the build-up in the U.S. housing market irrespective of how these flows are defined and measured. Both the savings glut hypothesis and the banking glut hypothesis are supported by these findings. However, net banking flows appear to explain the higher volatility in the increase in house prices as well as the mortgage loan boom. Magister Legum - LLM / This by implication would mean that the best way to prevent child abduction is to desist from international marriages and moving abroad.The modern reality is that relationships are being formed internationally. In the same breath, relationships are easily un-formed and the family fractured. The emotional impact of any breakup is usually tense, and it follows by implication that this will be exacerbated if a child is involved. For reasons that will be expounded on in the thesis, many caregivers, usually mothers have opted to abduct their children. Some have opted to apply formally to relocate. Relocation disputes are widely regarded as one of the most controversial and difficult issues in family law internationally. These disputes usually arise pursuant to a relational breakdown, when the resident parent (usually the mother) seeks to relocate with the children either domestically or internationally. This causes a significant impact on contact arrangements with the other parent (usually the father). Depending on the country in which they find themselves and the laws applicable to relocation with the child, mothers are faced with the decision to remove the child either lawfully or wrongfully. International family law jurisprudence has been developed over time to assist with custody and relocation disputes. ‘Much has been written on the Hague Convention – its flaws and its successes, its effectiveness and utilization. This thesis aims to look specifically at relocation disputes within the context of international parental child abduction; more specifically, it sets out to explore whether there is a link between those phenomena, and whether the Hague Convention is sufficient for dealing with relocation disputes. I hope to make a convincing argument that if there were an international instrument regulating relocation, there would be uniformity and consistency. People’s confidence in the legal processes would be restored, motivating them to apply formally to relocate and, in doing so, the incidence of child abductions would be reduced. / South Africa

Confronté à sa propre violence, voire aux forces de la nature, l’homme n’a cessé d’exprimer un besoin, celui d’être rassuré et protégé. Ainsi le droit à la sécurité est dès la création des sociétés organisées un principe primordial de leur existence. Depuis les attentats du 11 septembre 2001 la question de la sécurité préoccupe fortement l’actualité politico-médiatique. La mise en place de politiques de sécurité performantes est un objectif qui excite les foules, un facteur qui renforce l’exécutif. Cet objectif est caractérisé comme « besoin social impérieux ». Toutefois sur le plan purement textuel le droit à la sécurité n’apparaît pas d’une façon explicite comme norme constitutionnelle. La sécurité usant des techniques les plus avancées exige, sur le plan juridique, une adaptation du droit à l’ère numérique. Les systèmes de vidéosurveillance, les téléphones portables, la toile et les fichiers automatisés constituent les nouvelles armes de l’appareil policier. A ce titre le traitement des données représente le noyau dur des nouvelles orientations de sécurité. Toutefois l’utilisation des nouvelles technologies pour des raisons liées au maintien du bon ordre nécessite également un autre devoir: le respect des libertés fondamentales préoccupation manifeste du droit. Pour autant, la surestimation des politiques de sécurité et la prolifération des mesures sécuritaires sont susceptibles d’entraîner une certaine dégradation ou un affaiblissement du droit à la protection des données principe fondamental du droit de l’UE dès l’adoption du traité de Lisbonne. Face à ce défi, le droit cherche un juste équilibre entre vie privée et sécurité. Certes, l’équation est ancienne, mais ses modes de résolutions évoluent en raison des innovations technologiques, qui se rient des frontières et mettent à mal le principe de souveraineté territorial inhérent à l’Etat. Les droits nationaux, supportent également mal cette abolition des frontières. La comparaison, des ordres juridiques grecs et français, avec certes leurs différences, en sont de belles illustrations notamment dans le cadre de l’UE où la sécurité nationale en demeurant de la seule responsabilité des Etats membres crée des disparités entre les législations nationales. Dans cet environnement les AAI de protection des données des pays comparés se trouvent à la marge, captives dans des cadres juridiques précis. Seule le juge reste pour faire le contrepoids face aux abus des services policiers. Dans l’état actuel des traités constitutifs, la protection des données traitées à des fins policières par la juridiction luxembourgeoise est impossible. Ainsi la Cour EDH constitue la seule juridiction européenne dotée d’opérer une conciliation des deux exigences fondamentales: maintien de l’ordre public et protection des données. En effet, elle n’exerce qu’un contrôle de proportionnalité des mesures appliquées. Ainsi, l’établissement d’un juste équilibre au moins au sein de l’UE conduit in fine le droit à s’orienter vers la mise en œuvre d’une approche unique des politiques de sécurité à travers d’une éventuelle révision des traités. / Confronted by his own violence and the forces of nature, man has consistently expressed the need to be protected. Since the creation of organized societies, the right of security has been a fundamental principle of his existence. Since the attacks of September 11th, 2001, the question of security is being brought up constantly in the media. The implementation of effective security policies is an exciting objective, a factor that strengthens the executive power. This objective has been characterized as a "pressing social need". However, in the purely textual level, the right of security does not appear explicitly as a constitutional norm. Security using the most advanced techniques requires, legally, the adaptation of law to the digital era. CCTV systems, mobile phones, the word-wide-web and automatic archiving constitute the new weapons of the police apparatus. As such, data processing forms the core of the new security guidelines. Nevertheless, using new technologies for reasons related to the maintenance of public order also requires another duty: respect for fundamental freedoms, law's obvious concern. However, the overestimation of security policies and the proliferation of security measures may cause some degradation and loss of the right of data protection, a fundamental principle of EU law since the adoption of the Lisbon Treaty. Faced with this challenge, law seeks the right balance between privacy and security. Of course, the equation is old, but the ways to solve it evolve due to technological advances that laugh at borders and undermine the state's inherent principle of territorial sovereignty. National laws also handle poorly the abolition of frontiers. Comparison between Greek and French legal systems, albeit with their differences, is a beautiful illustration of this fact, notably within the EU where national security, remaining the sole responsibility of the member states, creates disparities between national laws. In this environment the Independent Administrative Authorities of data protection of the compared countries remain at the margin, trapped in specific legal frameworks. Only the judge remains to the counterweight police abuse. In the current state of the constitutive treaties, protection of processed data for police purposes by the Luxembourg court is impossible. And the ECHR is the only european court capable of providing a balance between the two basic requirements: maintenance of public order and data protection. Indeed, it only exercises a proportionality test of the applied measures. Thus, establishment of a balance at least within the EU ultimately leads law towards the implementation of a unique approach to security policies through a possible revision of the Treaties.

The masters thesis Payments and position of SEPA payments in payment systems deals with the transition of the national payment system to SEPA payment instruments in the Czech Republic, which is coming into force this year. Banks will have to fulfil requirement of interoperability and will have to be able to proceed payments in XML form. The theoretical part defines payments by the payment form and territorial payments in the first chapter. In the 2nd chapter, the legal framework with focus on new legislation affecting the completion and implementation of the SEPA requirements is described. The following two chapters are devoted to payment systems in the Czech Republic, European Union and telecommunication network SWIFT. The 5th chapter discusses about the SEPA project, with the main emphasis on the definition of SEPA instruments. The practical part is dedicated to analysis of foreign payment fees in selected banks with a focus on individuals.

The master thesis first deals with definition of business contractual relationship (sources, formation, freedom of contract) and indicates ways of resolving disputes arising from it within the Czech legal code. Through defining the concept of cross-border element the master thesis attains on how to resolve business disputes over contractual obligations at the EU level. Core topic of thesis deals with jurisdiction in commercial matters, the law applicable to contractual obligations, alternative dispute resolution as well as the recognition and enforcement of judgements or of different rulings. The last part of the thesis deals with a practical procedure which shows how to resolve dispute between domestic businessman and foreign businessman via legal proceedings.

Nontraditional Graduate Students' Satisfaction With Their Transnational Educational Experience

This retrospective, nonexperimental, quantitative study was designed to explore nontraditional students’ perceptions of satisfaction with their graduate education experience in a customized transnational educational context. This study was undergirded by theories and concepts gleaned from multiple disciplines. Disconfirmed expectations theory of consumer satisfaction derived from expectancy theory, which describes the motivations and behaviors of consumers who purchase a service but cannot fully evaluate the service until it has been consumed, provided the overarching conceptual framework for the research. This research analyzed data from 62 graduates of a customized, transnational Master of Education program in educational leadership. Participants responded to a quantitative instrument that contained 18 questions related to various aspects of the respondents’ educational experience. The qualitative component involved responding to six open-ended questions. Descriptive statistical analyses were conducted on the quantitative data. The analyses performed include frequency distributions, means and standard deviations, Cronbach’s coefficient alpha, and a correlation matrix for the dependent and independent variables and for the six subcategories. To examine whether differences in satisfaction with specified aspects of the program were reflected in differences in subscale satisfaction, t tests were also conducted. Conventional content analysis was employed to analyze qualitative data. Statistical analyses indicated that participants were satisfied with every aspect of their educational experience. This empirical study contributes to the knowledge bank of student satisfaction in a transnational context. When the particular and peculiar needs of nontraditional learners are considered when designing graduate level programs, institutional accommodations are provided, courses that are relevant to students’ needs are taught by instructors with relevant andragogical skills, the appropriate support systems are in place, and the overall goal is to provide education that is relevant to the personal and career goals of the students, students will be satisfied with their educational experience.

La dématérialisation des échanges commerciaux nécessite des règles fiscales claires afin de sauvegarder la souveraineté fiscale de l’État et préserver la sécurité juridique indispensable pour le bon déroulement de la vie des affaires dans le cadre de l’accroissement du commerce électronique. Il s’agit de mettre en exergue le droit fiscal interne et les règles fiscales internationalement acceptées, que ce soit en matière d’impôts directs ou indirects. Plus largement, ce processus de dématérialisation induit une révolution dans l’organisation de l’administration fiscale et des prérogatives qu’elle détient. Les adaptations des procédures de déclaration, de recouvrement et de contrôle fiscal sont incontournables et lesdites procédures s’en trouvent profondément bouleversées. Cross Border M&A - Friskt vågat, något vunnet? : En eventstudie om 85 stycken företag på Stockholmsbörsen-Mid Cap

Förvärv av företag sker till höger och vänster, i alla länder, branscher och kategorier. Motiven till förvärv må vara av varierande art, men det som är av betydelse för ett företag är vilket värde ett förvärv kan generera. Denna studie undersöker marknadsreaktioner vid olika typer och kombinationer av förvärv; däribland horisontella, vertikala och branschspecifika förvärv, med huvudsaklig inriktning på värdet som skapas vid gränsöverskridande och nationella förvärv. Detta görs i syfte att kartlägga eventuella överlägsna typer av förvärv. Klassiska teorier i form av effektiva marknadshypotesen och “random walk”-teorin i kombination med insiderhandel utgör den vetenskapliga utgångspunkten i studien. Metoden är en eventstudie, där den abnormala avkastningen vid dessa förvärv beräknas, för att kunna analyseras i förhållande till tidigare forskning. Vidare testas studiens hypoteser med hypotesprövning och samband analyseras med hjälp av enkla linjära regressioner som sedan tolkas. Resultatet visar på att gränsöverskridande förvärv ger den högsta genomsnittliga kumulativa abnormala avkastningen (CAAR), och vidare är horisontella förvärv att föredra över vertikala av samma anledning. Offentliga sektorn och tjänstesektorn ger de högsta CAAR sett till branscher. / Merger and acquisitions is happening everywhere; in all countries, industries and in all categories. The motives of acquiring other companies may differ, but what is truly meaningful is the value an acquisition can bring. This study deals with different types and combinations of acquisitions; amongst horizontal, vertical and industry specific acquisitions, with main focus on the value created in Cross Border and national acquisitions. The aim of the study is thereby to plot superior types of acquisitions. Classic theories like the Efficient market hypothesis and the Random walk theory will be used as a theoretical framework, along with the idea of Insider trading. The method used is an Event study, where the abnormal return is calculated at the announcement day of acquisition and is later analyzed in association to prior studies. Deduced hypothesis are then processed in hypothesis testing and correlations are being studied through simple linear regressions. The result show that Cross Border acquisitions give the highest value (CAAR) to acquirer and the horizontal acquisitions are superior to vertical ones for the same reason. The public sector and the service sector yield the highest CAAR when industries are being studied.
