“For better or worse” : domestic work and outsourced housecleaning services in Stellenbosch

Thesis (MA)--Stellenbosch University, 2012. / ENGLISH ABSTRACT: In the domestic work sector, the employment relationship between employer and domestic worker has undergone various transitions over the years. The first transition saw the transformation of a characteristically abusive master-servant employment relationship into a madam-maid employment relationship. During this transition, domestic servants moved out of masters’ houses and opt for live-out and part-time working arrangements. However, this transformation did not improve domestic work much, as the employment relationship was maternalistic in nature. Various authors documented how the personal maternalistic employment was not only emotionally draining to both maid and madam, but also that maids were still prone to exploitation by madams, as domestic work was not regulated by law. This resulted in a second transition, where outsourced housecleaning service companies transformed this personal maternalistic employment relationship into a triangular employment relationship between manager, domestic employee (former domestic servant/maid/domestic worker) and client (former master/madam/employer). The triangular employment relationship creates distance between clients and domestic employees as domestic employees are under the authority and supervision of a third person (the manager/owner of housecleaning service company). In this study, these general trends are analysed with reference to the evolution of domestic work in South Africa. While there have been many studies focusing on domestic work, few studies have documented whether this transition has transformed domestic work ‘for better or worse’ with reference to the growth in housecleaning service companies in South Africa. This study attempts to fill this void by analysing managers’, domestic employees’ and clients’ perspectives of two housecleaning service companies in the Stellenbosch area. Throughout this study, every transition is discussed in terms of nature of employment, employment relationship, working conditions and benefits for both client and domestic employee. The final chapter tries to answer the question whether housecleaning service companies are ‘for better or worse’ on both micro and macro level and the need for future research in this field of academic endeavour is spelt out. / AFRIKAANSE OPSOMMING: Die diensverhouding tussen werkgewer en huishulp het verskeie veranderinge oor die jare ondergaan. Die eerste oorgang sien die transformasie van 'n kenmerkende beledigende meester-dienaar in ʼn Mevrou-bediende diensverhouding. Gedurende hierdie oorgang, het bediendes uit die huise van die meesters beweeg na ʼn leef-uit en deeltydse werk reëling. Hierdie transformasie het egter nie huishoudelike werk verbeter nie, omdat die diensverhouding maternalisties in aard is. Verskeie outeurs dokumenteer hoe die persoonlike maternalistiese indiensneming nie slegs emosioneel dreineerend vir beide die Mevrou en bediende is nie, maar ook dat bediendes uitgebuit is deur hul werkgewers, omdat huishoudelike werk nie deur die wet gereguleer is nie. Dit het gelei tot 'n tweede oorgang, waar uitgekontrakteerde huisskoonmaakdienste die persoonlike maternalistiese diensverhouding in ʼn driehoekige diensverhouding tussen die bestuurder, werknemer (voormalige dienaar/bediende) en die kliënt (voormalige Meester/Mevrou/werkgewer) verander. Die driehoekige werksverhouding skep afstand tussen kliënte en werknemers, omdat werknemers onder die gesag en toesig van 'n derde persoon (die bestuurder) is. In hierdie studie, word hierdie algemene tendense met betrekking tot die evolusie van betaalde huiswerk in Suid-Afrika geanaliseer. Alhoewel daar ʼn aantal hoeveelheid studies oor betaalde huiswerk gedoen is, fokus min studies of hierdie oorgang, huishoudelike werk "vir beter of slegter" verander het in terme van die groei in huisskoonmaakdienste in Suid-Afrika. Hierdie studie poog om hierdie leemte te vul deur die ontleding van bestuurders, huishoudelike werknemers en kliënte se perspektiewe van twee huisskoonmaakdienste in die Stellenboschomgewing te analiseer. Deurgaans in hierdie studie, word elke oorgang bespreek in terme van die aard van indiensneming, die diensverhouding, die werksomstandighede en voordele vir beide die kliënt en die werknemer. Die finale hoofstuk probeer die vraag antwoord of huisskoonmaakdienste huishoudelike werk "vir beter of slegter” verander het op beide die mikro en makro-vlak en die noodsaaklikheid vir toekomstige navorsing in hierdie veld van akademiese strewe word uitgespel.

Labour legislation in Emfuleni's domestic worker sector: awareness and compliance

Thesis (M. Tech. (Labour Relations Management)--Vaal University of Technology / Sectoral Determination 7: Domestic Worker Sector was proclaimed by the Minister of Labour, Membathisi Mdladlana, and has stipulated the minimum employment conditions for the domestic worker sector since 1 September 2002. The purpose of this study evolved from the problem statement which clearly indicated the need for the assessment of awareness and compliance within the domestic worker sector. A detailed literature review enabled the researcher's orientation to the historical context of the sector as well as the need for transformation. Ultimately, the Determination's stipulations guided the assessment of both awareness (knowledge) and compliance (actions that correspond with legislative obligations) during an empirical review. A survey design was used to obtain responses from both domestic workers and employers of domestic workers, who were not necessarily in a direct employment relationship, within the Emfuleni Local Municipal District. Collected data was statistically captured and analysed. Desc1iptive statistics indicated that both employers and domestic workers have limited awareness with regard to the stipulations of Sectoral Determination 7. Results further indicated the difficulty in making a general pronouncement regarding compliance levels. It is suggested that compliance should be considered per individual stipulation of the Determination. The study concludes with the researcher's recommendation that more must be done to raise awareness within the sector amongst both employers of domestic workers and domestic workers. It was also recommended that more labour inspectors be made available not only to ensure the enforcement of Sectoral Dete1mination 7 (compliance) but also to facilitate the creation of continuous awareness.

Contract of employment and its impact on the job security of domestic workers

(Labour Relations Management)--Vaal University of Technology / When the South African authorities decided, in the 1970's, to recognize statutorily other Black workers who were engaged in other spheres of employment as employees, domestic workers were excluded from all Industrial Legislation. This resulted from the fact that domestic work, as an occupation, had been excluded from the definition of an employee. It is estimated that over one million people are engaged in this service, comprising eleven percent of overall employment in the informal sector of the South African economy. This significantly large sector of the labour market performs its work under some of the most oppressive working conditions and such exploitation is unchallenged, as it has been noted that some domestic workers do not sign contracts of employment with their employers on appointment, which can lead to insecurity in the domestic worker sector. The purpose of this research was to determine the efficiency of the contract of employment and its effect on the job security of domestic workers. Through a theoretical foundation, a number of studies have advocated that the contract of employment can be trusted to be the perfect instrument in securing jobs in the domestic sector. A survey was carried out for measuring job security. The research instruments used for data collection from 203 domestic workers, were interviews and questionnaires. The SPSS program was used to analyze the data. The results of the empirical study are presented and discussed in detail. Findings of this study revealed, that the majority of domestic workers don't have contracts of employment while a very small percentage of domestic workers do have contracts. Conclusions drawn, indicated that domestic workers who have signed contracts, enjoy reasonable conditions of employment and employment benefits than those without contracts. Recommendations based on this study are that the government encourages a very strong Trade Union Movement in the domestic sector services. The Commission for Conciliation Mediation and Arbitration (CCMA) and/or the Department of Labour facilitates annual workshops for employers of domestic workers. The CCMA, Trade Unions and/or the Department of labour facilitate training programmes for domestic workers. The government makes it a binding norm, for every employer in the domestic sector, to conclude a contract of employment with his/her domestic worker and furnish such employee with a copy of the contract, regardless of the nature of services rendered by employee. Ongoing research on many aspects of domestic workers will enhance better conditions of employment in making the lawmakers aware of other hidden agendas that require attendance in the domestic sector.

A pesquisa analisa o consumo cultural (especialmente de rádio e televisão) de um grupo de empregadas domésticas que trabalham na cidade de São Paulo. Por meio de um mapeamento das preferências culturais dessas trabalhadoras organizadas nos perfis românticas, descoladas e evangélicas , discuto a importância dessas mídias no universo estudado. Paralelamente, a partir da análise de representações das empregadas domésticas na televisão, em especial, por meio da uma análise compartilhada da telenovela Cheias de Charme (Globo, 2012, 19h30), avalio as transformações ocorridas na imagem da empregada doméstica na ficção e na vida real , explorando a passagem de trabalhadora pobre para consumidora da classe C. Nesse contexto, temáticas como trabalho doméstico, gênero, classe, cor, consumo e mídias são relacionadas. / The research analyses the cultural consumption (particularly television and radio) of domestic workers in São Paulo (SP). Through mapping the cultural preferences of these women workers divided in three profiles, romantic, up to date and evangelic I raise reflections on the importance of these media among them. In parallel, through the analyses of domestic workers representations in television, in particular in the telenovela Cheias de Charme (Globo, 2012, 19h30), I discuss the transformations on the image of these workers in fiction and in real life exploring the passage from poor workers to class C consumers. In this context, issues such as domestic labor, gender, class, race, consumption and media are interrelated.

Utilizando como principal corpo documental os manuais de prescrição de conduta (manuais de etiqueta, de economia doméstica, de puericultura e de higiene e saúde), o intuito é compreender a formação identitária a partir do uso de objetos e espaços, entendidos estes como indutores de comportamentos e hábitos corporais. / This work is an attempt to analyze the relations between servants and mistresses, in São Paulo, between the 1870s and 1920s, from ethnic, social and gender differences (re)produced in the household. Considering different kinds of manuals etiquette, housekeeping, childcare and hygiene and health we intend to understand how identities are connected with the use of objects and spaces in the house.

“All for the Family”: A Case Study on the Migration of Philippine Educated Nurses to Ontario through the Live-in Caregiver Program

Despite evidence that suggests that nurses migrate to Ontario through the Live-in Caregiver Program, no research has been conducted on this group of nurses in Ontario. This study addresses that gap utilizing the transnational feminist concept of “global care chains” in a single holistic case study design to explore the experience of nurses who migrate to Ontario through the Live-in Caregiver Program (2001-2011), and examine the diverse perspectives of stakeholders on issues of rights and obligations of these nurses. Fifteen live-in caregivers and nine policy stakeholders were interviewed, and an analysis undertaken of immigration and nursing policy documents. Findings indicate that familial discourses and perspectives on global social status shape these women’s decision to migrate from the Philippines to Canada, often via a second country (especially Saudi Arabia), as well as their subsequent Canadian experiences. Results are consistent with Rhacel Parrenas’ idea of ‘contradictory class mobility’ that describes the phenomenon of decrease in social status coupled with an increase in financial status among immigrant care workers. As professional women undertaking unskilled work, the nurses’ contradictory class status was reinforced by the emotional labour and domestic work they were required to perform. Furthermore, as temporary workers on a path to permanent residency, their professional integration as nurses was complicated by Canada’s immigration policy and the paradox between the government’s stated short-term goal (to address labour force shortage of live-in caregivers) versus its long-term goal (to ensure the integration of permanent residents). Within this policy paradox immigration policy makers emphasized the short-term obligation of fulfilling labour needs, while live-in caregivers and advocacy groups emphasized the long-term obligations of the Canadian government related to gaining permanent residence status. The lack of congruence between the Live-in Caregiver Program policy and nursing policy concerning internationally educated nurses, as well as prioritization of their familial obligations complicated the process of professional integration for this group of women. Recommendations arising from the study concern the need to bridge these policy gaps and address the shortcomings of the Live-in Caregiver Program to leverage the integration of this group of internationally educated nurses in Canada.

The development impact of the domestic workers skills development project on its participants

The Domestic Workers Skills Development Project, funded by the National Skills Fund, was designed to improve the skill levels of domestic workers in South Africa. It also was intended to address their historical lack of education and to advance their socio-economic circumstances. This study investigates the implementation of this project within the framework of community development. Basadi Pele Foundation, a Non-Governmental Organisation, was a participant in this project. The central question was how to empower marginalised women through skills development. This implies a learning process for domestic workers and all involved. Different learning theories are investigated to develop an understanding of how these illiterate adult women learned during this opportunity. The conclusion reached by this study is that a gender sensitive environment, created by government institutions and the NGO involved, enabled domestic workers to change their lives and circumstances; enhancing this project and contributing to its success. / Development Studies / M.A. (Development Studies)

Assim, através de um estudo qualitativo, proponho-me a discutir as interpretações e significados do processo de escolaridade e qualificação profissional vivido por essas mulheres, a partir dos pertencimentos sociais de classe, gênero, e raça, como estratégia na afirmação da cidadania e da construção dos vieses emancipatórios. Por se tratar de um estudo de egressas, procuro identificar nas suas trajetórias de vida, quais as mudanças e contribuições que essa prática educativa trouxe para a sua condição de mulher, negra, trabalhadora. A análise se concentra nas experiências de um grupo da turma do Programa, desenvolvido em Salvador, no bairro da Mata Escura. Assim, busco refletir, neste contexto, sobre como essa experiência de trabalhadora doméstica vem sendo conformada em face da articulação interseccional dos pertencimentos sociais (classe, gênero, raça) e as possíveis interconexões entre os sistemas de opressão e subordinação. Nessa perspectiva, arrisco-me a discutir sobre a necessidade das políticas públicas de Educação de Jovens e Adultos, bem como de Programas de qualificação profissional, que atendam as mulheres trabalhadoras, no sentido de romperem com as amarras do patriarcalismo e do escravismo, desconstruindo o lugar “doméstico” como um espaço da não cidadania, do não pertencimento e do não direito, e tornando assim num espaço visível. / ABSTRACT In this thesis, I seek to understand the reality of a group of domestic workers, graduating students from the Housework Citizen Prog ram (Elevation of education and professional qualification), developed by the F ederal Government, in the scope of the Ministry of Labour and Employment. Thus, thr ough a qualitative study, I propose to discuss the interpretations and meanings of the process of education and professional training experienced by these women, f rom the belongings of social class, gender, and race, as a strategy in the affir mation of citizenship and the construction of emancipatory biases. As it is a stu dy about discharged students, I try to identify, in the course of their lives, what cha nges and contributions that educational practice brought to their condition of womanhood, black and worker. The analysis focuses on the experiences of a group of c lass of the Program, developed in Salvador, into Mata Escura district. So, I try to r eflect in this context how this experience of domestic workers has been formed agai nst the articulation of intersectional social affiliations (class, gender, race) and the possible interconnections between the systems of oppression and subordination. In this perspective, I venture to discuss the need for publ ic policies to Youth and Adults Education, as well as professional training program s that meet women workers, in order to break out from the braces of patriarchy an d slavery, deconstructing the “domestic” place as a space of non citizenry, non m embership and non right, and thus turning into a citizen and visible space.

Para tanto, inicialmente, discutimos o desenvolvimento histórico do trabalho doméstico no país, partindo dos fundamentos da sociedade brasileira, da confluência de raça, classe e gênero na sua conformação e do debate teórico consolidado, com o intuito de perceber o seu quadro atual de exclusão social. Em seguida, enfocamos a constituição das relações de trabalho no Brasil e o papel que o Estado assumiu para a inserção do país no sistema capitalista e para a formação do trabalho livre como realidade ampla e concreta, com a finalidade de compreender como emerge na sociedade brasileira a temática da cidadania e os seus efeitos para a classe trabalhadora e, mais precisamente, para as trabalhadoras domésticas. Nessa linha, as teorias do reconhecimento, partindo-se de Charles Taylor, Axel Honneth e Nancy Fraser, surgem como substrato teórico consistente para compreender, de um lado, como se estruturam na contemporaneidade as desigualdades históricas incidentes sobre a dinâmica das relações de trabalho doméstico e, por outro lado, como enfrentar os seus dilemas para a desconstrução simbólica e material dessa realidade. Tais teorias articulam desigualdades de cunho socioeconômicos e valores culturais que reproduzem e tornam legítimas o reconhecimento denegado das trabalhadoras domésticas, razão pela qual o debate acerca do racismo institucional se faz necessário. Por fim, cotejamos as mudanças na sua inserção sociojuridica com a agenda de representação sindical, com o propósito de demonstrar como tal agenda se move pelo binômio redistribuição - reconhecimento, sendo que a inclusão incompleta das trabalhadoras domésticas é uma construção cujo substrato regulatório está no Estado brasileiro. / The current research has as its main axis the analysis of how the fight for the female domestic workers’ recognition, in the field of labor law, showcases the institutional racism of the Brazilian State through an incomplete inclusion. To do so, at first we discussed the historical development of domestic labor in the country, from the fundamentals of the Brazilian society, confluence of race, class and gender in its formation; and from the consolidated theoretical debate, aiming to notice its current state of social exclusion. Then, we focused on the constitution of the work relations in Brazil and the role that the State assumed towards the insertion of the country in the capitalist system and for the formation of free labor as a wide and concrete reality. The goal was to understand how the theme of citizenship comes up in the Brazilian society as well as its effects for the working class and, more precisely, for the female domestic workers. Thus, the theories of recognition, from Charles Taylor, Axel Honneth and Nancy Fraser emerge as a consistent theoretical framework to understand, on the one hand, how the historical iniquities that strike the dynamics of domestic labor relations are structured. On the other hand, they help us understand how to face their dilemmas for the symbolic and material deconstruction of such reality. Those theories articulate socioeconomic iniquities and cultural values that reproduce and legitimize the recognition that is denied for the female domestic workers – which is the reason why the debate about institutional racism is necessary. Lastly, we connected the changes in the sociojuridical insertion of the female domestic workers with their agenda of union representation, aiming to show how such agenda moves through the binomial redistribution-recognition. The incomplete inclusion of those workers is a construction whose regulatory framework lies in the Brazilian State.
