A fronteira é uma área fragilizada; o trânsito livre de pessoas na região faz com que ela seja altamente vigiada, tanto para a segurança quanto o contrabando e tráfico. Essa facilidade de acesso no transito entre os países, traz um número de pessoas que fazem um trajeto longo, muitas vezes com risco de vida eminente, em busca de assistência médica, inexistente no seu país de origem. O pagamento dessa fatura é de responsabilidade do país que realizou o atendimento, assim como a estatística. Os gestores estaduais e municipais tentam contornar essa situação da melhor maneira possível, sem causar perdas financeiras no seu orçamento. A partir da experiência internacional de parcerias entre cidades de fronteira (transfronteirização), esta dissertação tem como eixo principal analisar o caso do município de Foz do Iguaçu, onde a problemática da política brasileira de saúde nas fronteiras se revela em sua potência máxima. O trabalho apresenta a situação do financiamento da saúde na fronteira oeste do Estado do Paraná, propondo um termo de cooperação na assistência e no financiamento. / The frontier is a fragile area. Free traffic of people in this frontier region makes it highly monitored as to safety and as to restrain smuggling and drugs trafficking. Facility of access within coutries, brings in a great number of people who travel a long way, many times, facing great eminent death hazard, in search of medical care that does not exist in their home country. When they are assisted, payment is due to the country responsible for health care Managers try to overcome this situation and avoid financial losses. Inspired by European experience of partnerships between neighbor towns of different countries, this thesis analyzes the situation in Foz do Iguaçu city, where the problem of Brazilian health politics in the frontier is revealed at its maximum. The work presents the health financing situation in the West frontier of Parana State, proposing a cooperation term for health care and health financing, which would allow treatment for this population by Brazilian health system.

Problematika osobní asistence u lidí s handicapem / Problems with the personal assistance for people suffering from certain handicap

Personal assistance (PA) is one of types of comprehensive care of people with health handicap, but it is very special, because client himself chooses type, extent and use of care. Without PA services, client would be dependent to live permanently in a treatment institution, where he would be nursed. At the beginning this essay informs readers about PA Tudory. On the first pages information concerning users and providers of this social service are elaborated. Further an author considers a new law Code Number 108/2006 Coll. about social services, valid from 1/1/2007, where the assistance is mentioned for the first time. On the other pages he describes changes, which the new law brings either for providers or users of PA. Mapping and definition of problems concerning this social service is a main intent of this essay. Autor tried to compare opinions of clients and their dependants with personal assistants´opinions, if each of mentioned groups understands problems equally or differently. Readers should among others learn what this profession means and make a picture how assistance runs and which person is able to pursue it. This essay deals with problems of PA and its mission is to show these problems. The main asset is in outlining problems of PA, considering respondents´opinions, who were users, personal assistents and families with health handicap and familiarization readers with personality of assistant and social service of PA. Asset of this essay is even bigger by enactment of the new law about social services and because of this, new problems in providing this services have arisen.

The topic of this thesis is the evaluation of investment efficienty in enterprises. First section summarizes common knowledge related to investments process and states methods used for analysis of investments efficienty. Second part evaluates economic efficienty of investments planned and implemented in the particular enterprise. The main sources for these data was the enterprise environment itself. Also factual and financial pros and cons of investment plannig are taken into consideration in this part of thesis, as well as financial assessment of particular investment having been contributed to the housing reconstuction. The thesis also analyses ways of financing and portfolio selection in view of the most considerable impacts on the final investment project efficienty.

Financování neziskových organizací v oblasti ochrany spotřebitele / Funding of non-profit- organizations in the area of consumer protection

This diploma thesis deals with analysis of forms of financing of a specific non-profit organisation in the field of consumer protection and preparation of proposal for improvement including its economic assessment. The work is focused on the TEST Civil Consumers? Association (TEST CCA). The first part of the thesis is made up of literary research. In terms of the actual thesis, working hypotheses were first determined, which were subsequently assessed on the basis of data gained during an interview with the Vice Chairman of the administrative board of TEST CCA, Mgr. Karel Pavlík, MBA, or on the basis of information gained from approx. 200 respondents by means of enquiry. When formulating proposals for improvement, I above all concentrated on the possibility of gaining further subscribers to the dTest magazine, which is closely related to strengthening of the financial independence of the association. I recommended holding a presentation of TEST CAA in shopping centres in individual regional cities in the Czech Republic. In my opinion, it would also be of benefit to publish adverts in the press.

Le droit des contrats publics a subi, depuis une trentaine d'années, une évolution sans précédent, en particulier dans le cadre des contrats administratifs. La multiplication des textes encadrant la pratique des contrats, dans le droit national et dans le droit de l'Union européenne, tend à présenter des notions et des régimes hétérogènes et désordonnés. Or, analysés à travers le prisme du financement, les contrats publics trouvent une cohérence, d'une part, et retrouvent leur essence, d'autre part. Le financement permet de comprendre les dynamiques économiques à l'œuvre dans le droit des contrats publics. Il s'agit dès lors d'observer les différentes techniques et modalités de financement complexes à l'œuvre dans les contrats publics pour arriver à la conclusion que les contrats publics s'en trouvent enrichis. Par ailleurs, le financement constitue le critère idoine pour structurer les contrats publics dans une dichotomie achat-public concession.Toutefois, l’interaction entre les deux notions ne se limite pas à une approche unilatérale. Les contrats publics permettent effet de saisir le financement. Il apparaît que le financement institutionnel, reposant sur les ressources fiscales et les emprunts contractés par l'Administration, ne répond que de manière insuffisante aux besoins d'intérêt général. C'est pourquoi le recours au contrat public est indispensable pour libérer le financement public, ce qui a pour effet de métamorphoser les contrats publics, au point d'être mis en mesure d'en dégager une théorisation. / The law of public contracts underwent, since around thirty years, an unprecedented evolution, in particular within the framework of public service contracts. The increase of texts framing the practice of contracts, in the national law and in the law of the European Union, tends to present notions and heterogeneous and muddled systems. Now, analyzed through the prism of the financing, the public contracts find a coherence, on one hand, and find their sens, on the other hand.The financing allows to understand the economic dynamics in the work in the law of public contracts. It is a question from then on of observing the various techniques and the complex financing terms in the work in the public contracts to arrive at the conclusion that the public contracts are enriched there. Besides, the financing establishes the appropriate criterion to structure the public contracts in a dichotomy public purchase – concession. However, the interaction between both notions does not limit itself to a unilateral approach. The public contracts allow effect to seize the financing. It seems that the institutional financing, resting on the fiscal resources and the loans contracted by the Administration, answers only in a insufficient way the needs for general interest. That is why the appeal to the public contract is essential to release the public financing, what has the effect of transforming the public contracts, in the point of being enabled to clear a theorization of it.

Novos instrumentos de financiamento do agronegócio brasileiro e uma análise das alternativas de investimentos para o CDA/WA / New instruments of financing of the Brazilian agribusiness and an analyses of the alternative of investments for the CDA/WA

O instrumento tradicional de financiamento é aquele utilizado pelo Sistema Nacional de Crédito Rural - SNCR e que possui como fonte o orçamento do governo, as exigibilidades bancárias, a poupança verde etc. Os instrumentos não tradicionais podem ser considerados os novos mecanismos com fonte de recursos privados e que pretendem substituir os instrumentos tradicionais no financiamento agropecuário. A Lei n° 11.076, de 30 de dezembro de 2004, oficializou cinco títulos de créditos que deverão ser utilizados pelos agentes do agronegócio para captarem recursos privados para o seu financiamento e aumentar o giro de capital dentro do próprio setor, além de dar nova redação à Lei n° 9.973, de 29 de maio de 2000, que dispõe sobre o sistema de armazenagem dos produtos agropecuários. Os novos instrumentos de financiamento do agronegócio são denominados de: Certificado de Depósito Agropecuário - CDA, Warrant Agropecuário - WA, Certificados de Direitos Creditórios do Agronegócio - CDCA, Letra de Crédito do Agronegócio - LCA e Certificado de Recebíveis do Agronegócio - CRA. O objetivo destes instrumentos é desvincular a concessão de crédito do sistema oficial e desenvolver um novo mecanismo de financiamento do agronegócio através de papéis lastreados em produtos depositados e títulos de dívidas agrícolas que deve ampliar o relacionamento entre o setor financeiro e o setor como um todo, devendo tornar o financiamento mais eficiente para o produtor e menos onerosos aos cofres públicos. Este trabalho define o cenário brasileiro onde estes novos títulos do agronegócio foram instituídos, apresenta as justificativas para a criação destes títulos e expõe os mecanismos atualmente utilizados pelo mercado para captar recursos da iniciativa privada, apresenta e discute a legislação desses novos instrumentos. E por último buscaram-se alternativas de investimento para estes papéis nos mercados físicos e futuros de seis produtos agrícolas de janeiro de 2005 a outubro de 2005: açúcar cristal, algodão, arroz, café arábica, milho e soja. Duas situações foram consideradas: especulações com o CDA e o WA, onde o investidor adquire o papel e especula com cada produto; e operação de spread, onde o investidor compra o CDA/WA (mercado físico) e trava o rendimento numa operação com o mercado futuro da Bolsa de Mercadorias & Futuros - BM&F, sem ficar exposto a variações de preço. No caso do arroz apenas a análise dos preços físicos foi elaborada devido à ausência do mercado futuro para este produto na BM&F. A partir disso, concluiu-se que a especulação com os produtos agrícolas não teve um bom resultado no período. Já as operações de spread do mercado futuro da BM&F com o CDA/WA ofereceram boas oportunidades de rentabilidade ao investidor que conseguiu captar o momento correto para a operação. / The traditional instrument of financing is that one used by the National System of Rural Credit - SNCR and that has as source of resource the budget of the government, the banking liabilities, the green saving. The not traditional instruments can be considered the new mechanisms which have as source of funding private resources and that aims as to substitute the traditional instruments of the farming financing. The Law 11,076, of December 30, 2004, officialized five titles of credits that will have to be used by the agents of the agribusiness to raise private resources to its financing and to increase the turn of capital of the own sector, besides giving new writing to the Law number 9,973, of May 29, 2000, which deliberates on the system of storage of the farming products. The new instruments of financing of the agribusiness are: Certificate of Agribusiness Deposit - CDA, Agribusiness Warrant - WA, and Certificates of Rights to Receive - CDCA, Agribusiness Letter of Credit - LCA and Certified of Receivable of the Agribusiness - CRA. The objective of these instruments is to detach the concession of credit of the official system and to develop a new mechanism of financing of the agribusiness through titles based in deposited agricultural products and titles of agricultural debts that must increase the relationship between the financial and agribusiness sector as a whole, and it is expected that the financing will become more efficient for the producer and less expensive to the government. This work defines the Brazilian scene where these new titles have been created, it presents the justifications for the creation of these titles and shows the mechanisms used by the market to raise resources from the private sector, presents and it discuss the legislation of these new titles. Finally, it was searched alternative of investment for these papers in the physical and future markets of six agricultural products using data from January 2005 to October of 2005: bulk sugar, cotton, rice, Arabica coffee, maize and soybean. Two situations had been considered: speculations with the CDA and WA, where the investor acquires the title and speculates with each product; and operation of spread, where the investing purchase the CDA/WA (physical market) and locks the interest rate in an operation with the futures market of the Brazilian Mercantile & Futures Exchange - BM&F, without being exposed to the price variations. In the case of the rice only the analysis of the physical prices was done because of the absence of the futures market for this product in the BM&F. From this, it was concluded that the speculation with the agricultural products did not have good results in the period. However, the operations of spread of the futures market of the BM&F with the CDA/WA had offered good opportunities of profitability to the investor who was able to operate at the correct moment.

O seu objetivo é compreender o sentido e o alcance dos esquemas especiais de financiamento e incentivos do setor público voltados às atividades de inovação nas empresas industriais brasileiras. Inicialmente apresenta-se um marco teórico e conceitual para a análise do financiamento da inovação industrial, entendido como objeto de investigação específico dentro do campo mais amplo da discussão do elo entre finanças e investimento e de seus principais determinantes. As características institucionais dos sistemas financeiros são consideradas fundamentais para a decisão das firmas de investir em inovação, ainda que os recursos próprios sejam reconhecidos como as principais fontes de financiamento das atividades inovativas nos países desenvolvidos e em desenvolvimento. Aponta-se que, a despeito das profundas mudanças no sistema financeiro brasileiro nas duas últimas décadas, o financiamento dos investimentos das empresas industriais no país permanece muito dependente das linhas de crédito públicas. No caso específico das atividades de inovação, há evidências de um padrão histórico de limitado esforço inovador por parte do conjunto das empresas industriais brasileiras e de um financiamento público de dimensão restrita. Na ultima década, contudo, houve uma ampla reestruturação do suporte público à inovação empresarial, que implicou a ampliação dos recursos e a diversificação dos mecanismos de financiamento e de incentivo às atividades inovativas. Its main goal is to contribute to the understanding of the scope and the effectiveness of government?s financial support for innovation activities of Brazilian industrial firms. Initially, a theoretical and conceptual analysis of financing for industrial innovation is developed within the framework of the literature on finance and investment links and their determinants. The specific institutional features of a national financial system is considered to be an important factor in firms? innovation decisions even though the most important source of finance for innovation is acknowledged to be firms? own resources in both developed and developing economies. A large part of the credit that supports industrial firms? investment in Brazil still comes from public institutions, in spite of the deep changes that took place in the Brazilian financial system during the last two decades. In the specific case of innovation activities, there are evidences of the existence of a historical pattern of weak innovative effort by industrial firms and the public support for those activities used to be of a lesser dimension. Public financing for business innovation, however, was the object of a strong process of change, expansion and diversification during the last decade, and the dissertation develops a systematic treatment and analysis of this process. O mercado globalizado e de competição intensiva no qual países e empresas estão inseridos, demanda destes uma busca constante por inovação. Entre os habitats de estímulo à inovação com diversas iniciativas pelo mundo, e também no Brasil, estão os chamados Parques Tecnológicos. Um dos grandes desafios para a implantação e operacionalização destes empreendimentos é a obtenção de recursos. Surge, então, a questão: Quais as perspectivas de financiamento que a organização gestora de um Parque Tecnológico dispõe para realizar as fases de planejamento, implantação e operacionalização dos elementos constitutivos e serviços oferecidos por este tipo de empreendimento? O objetivo deste trabalho é levantar as perspectivas de financiamento utilizadas nas etapas citadas nos Parques Tecnológicos: Tecnopuc, Pólo de Informática de São Leopoldo e Sapiens Parque, instalados no Brasil; Biocant Park e Taguspark, instalados em Portugal; e Parque Tecnológico de Cartuja 93, instalado na Espanha. Para tanto, foi realizada uma revisão bibliográfica a qual abordou inovação e sua implicação nos novos arranjos empresariais, parques tecnológicos e financiamento de parques tecnológicos, a fim de construir a base conceitual para a análise dos casos; ao final, apresenta-se uma análise comparativa das perspectivas de financiamento utilizadas por estes parques nas diversas fases de implantação. / The intense competition globalized market in which firms and countries are inserted, demand from them a constant search for innovation. Among the habitats to stimulate innovation that have several initiatives around the world, including Brazil, there are the called Technology Parks. One of the biggest challenges faced in the process of planning, implementation and operation of these complex enterprises is to raise the necessary funds. Then, a question emergens: what are the financing perspectives that the Technology Park management institutions have for the planning, implementation and operation of this kind of enterprises? As an attempt to answer this question, the aim of this research was to identify the financing perspectives used in these stages of the development of the following enterprises: Tecnopuc, Pólo de Informática de São Leopoldo and Sapiens Park, in Brazil; Biocant Park and Taguspark, in Portugal; and Cartuja 93 Technology Park, in Spain. For this purpose, a bibliographic research was realized in innovation and its implications for the new enterprise net configuration, technology parks and financing of technology parks, what built the theory base to support the analysis of the cases. In the end, it?s presented a comparative analysis of the financing perspectives used by these enterprises in the several stages of development.

A Constituição Federal de 1988 afirmou diversos direitos sociais, organizou a descentralização e conferiu aos municípios papel fundamental na implementação das políticas sociais. Para os setores de proteção social, como saúde e educação, a Constituição garantiu um nível mínimo de recursos que devem ser investidos, além de vincular a previdência social ao crescimento do salário mínimo. Aos outros direitos sociais, restou a arena da política para disputar seu espaço no orçamento público, como é o caso da habitação. Nesse sentido, considerando que não existem vinculações para o investimento na política de habitação, considerando o pequeno espaço restante para o exercício da discricionariedade e a centralização decisória no governo federal, a presente dissertação apresenta o investimento municipal na política pública de habitação em série histórica e a composição do arranjo federativo para o financiamento da habitação municipal. A pesquisa centra-se entre os anos de 2005 e 2015, período em que, em um primeiro momento, apresentam-se os investimentos em habitação de todos os municípios brasileiros e do governo federal, a fim de compreender a simbiose entre os investimentos dos dois entes e caracteriza-se o investimento municipal em habitação. Em seguida, são analisados os investimentos dos municípios de três cidades do estado de São Paulo: Mombuca, Osvaldo Cruz e Cubatão, para compreender em profundidade a relação federativa neste financiamento e despesas geradas na função urbanismo, de forma a complementar às de habitação. / The Federal Constitution of 1988 affirmed several social rights, organized the decentralization and conferred municipalities a key role in the implementation of social policies. For the social protection sectors, such as health and education, the Constitution has secured a minimum level of resources that must be invested, in addition to linking social security to the growth of the minimum wage. To other social rights, the arena of politics remained to dispute its space in the public budget, as is the case of housing. In this sense, considering that there are no bindings for investment in housing policy, considering the small space remaining for the exercise of discretion and decision-making centralization in the federal government, this dissertation presents the municipal investment in public housing policy in a historical series and the composition of the federative arrangement for the financing of municipal housing. The research focuses on the period between the years 2005 to 2015, where, at first, we present the housing investments of all Brazilian municipalities and the federal government, in order to understand the symbiosis between the investments of the two ones and it characterizes the municipal investment in housing. Next, the municipalities investments of three cities of the state of São Paulo are analyzed: Mombuca, Osvaldo Cruz and Cubatão, in order to understand in depth the federative relationship in this financing and expenses generated in the urbanism function, in order to complement those of housing

Este estudo analisa a ação do Poder Público no provimento de recursos financeiros à educação especial na gestão do município de Vitória, no estado do Espírito Santo, no âmbito do contexto de financiamento da educação básica, nos anos de 2008, 2009 e 2010. Partimos do pressuposto de que a garantia da educação às pessoas com deficiência, transtornos globais do desenvolvimento e altas habilidades/superdotação e a ampliação de sua oferta implicam intervenção por parte do Estado no intuito de assegurar os direitos dessa população no que tange ao acesso, à permanência e à qualidade de ensino nos sistemas educacionais brasileiros. Com apoio em Poulantzas (2000), entendemos o Estado como espaço público marcado pela correlação de forças entre classes e grupos que compõem a sociedade e participam dos processos decisórios na formulação de políticas públicas. Para o desenvolvimento do trabalho, foi realizada a pesquisa documental, por meio da consulta ao planejamento e execução orçamentária, aos demonstrativos de receitas e despesas, bem como aos documentos oficiais do município. No que se refere à gestão das verbas da educação especial, quanto à sua transparência, organização e padronização, observamos, nos demonstrativos de execução orçamentária, que as mudanças no padrão de financiamento da educação, com o Fundeb, não produziram significativas alterações nas formas de registros dos dados contábeis, nos órgãos oficiais, referentes às etapas e modalidades de ensino. Isso foi evidenciado pelas dificuldades que encontramos em visualizar as receitas e despesas destinadas à educação especial nas diferentes fontes de informação do governo federal, estadual e municipal. Os dados eram apresentados de forma agregada, o que impossibilitava identificar o que era alocado na educação especial. Assim, embora a rede de ensino do município de Vitória apresentasse matrículas nessa modalidade de ensino, os valores apresentados pareciam não corresponder às despesas reais com a manutenção da educação especial no município, por estarem agregados aos recursos de outras etapas de ensino. Nessa perspectiva, foi possível identificar que a educação especial integrava o planejamento orçamentário do município de Vitória. As receitas destinadas a essa modalidade estavam englobadas nos recursos totais dirigidos à educação no município, e os valores das despesas estavam subdimensionados, pois estavam agregados à educação infantil e ao ensino fundamental. Desse modo, o financiamento da educação especial sofre influência das correlações de forças políticas, econômicas e sociais em torno do fundo público, no âmbito do Estado brasileiro, representadas por diferentes grupos com interesses diversos, que, por sua vez, interferem na constituição de políticas públicas, engendrando implicações na consolidação de direitos de cidadania, entre os quais o direito à educação. Portanto, a concretização desse direito, ao público da educação especial, pressupõe políticas educacionais que garantam mudanças na gestão financeira, no âmbito da administração pública municipal, de modo a assegurar às pessoas com deficiência, transtornos globais do desenvolvimento e altas habilidades/superdotação educação de qualidade nos sistemas públicos de ensino. / This study analyzes the action of the Government in providing funds for special education in the management of the municipality of Vitória, state of Espírito Santo, within the context of the financing of basic education in the years 2008, 2009 and 2010. We start from the assumption that the guarantee of education to people with disabilities, global developmental disorders and high ability / talent and the expansion of its offer implies intervention by the State in order to ensure the rights of this population in terms of access, permanence and the quality of education in Brazilian educational system. Supported by Poulantzas (2000), we understand State as a public space marked by the correlation of forces between classes and groups that make up society and participate in decision making processes in the formulation of public policies. For development of this study, we make use of documentary research by consulting the planning and budget execution, the statements of revenues and expenses, as well as official documents of municipality. Referring to the management of funds for special education, as to its transparency, organization and standardization, we observe through the statement of budget execution, that the changes in the pattern of education funding with Fundeb had produced no significant changes in the forms of records of the accounting data in the official agencies concerning stages and types of education. This was evidenced by the difficulties encountered in visualizing the receipts and expenses for special education in different sources of information from federal, state and local government. The data were presented in aggregate form, making it impossible to identify which part was allocated for special education. Thus, although the schools of the city of Vitória present enrollment for this type of education, the amount we could verify do not seem to match the actual cost for maintenance of special education in the municipality because they were included together with the resources of other levels of education. It was therefore possible to identify that special education was part of the budget planning of the city of Vitória. The income for this type of education was totally incorporated within resources for municipality education as a whole. So, the amount of expenses was undersized and it was aggregated to early childhood education and elementary education funds. Thus, financing for special education is influenced by the correlation of political, economic and social forces considering Public Brazilian State Fund, represented by different groups with different concern. This point interferes in the formation of public policies and it causes implications for the consolidation of the rights of citizens, including the right for education. Therefore, in order to carry out this right for the audience of special education, its necessary to involve educational policies to guarantee changes in financial management within the municipal government, and also to ensure education quality in public education systems to the people with disabilities, global developmental disorders and high ability / talent.
