A structured approach to the strategic positioning of asset-backed short-term finance : a South African perspective

The emerging financial industry of asset-backed short-term finance was investigated by this study. Literature indicated that banks, locally and globally, are forced by regulation and the use of information technology, to rely less on human judgement and more on programmed decision-making, when evaluating loan applications. This leads to time-consuming processes with non-standard loan applications and loss of opportunities for business persons. Asset-backed short-term finance is a market response to this tendency. Due to the emerging nature of this industry, no previous academic description of or investigation into this industry could be found – a gap in academic literature which this study aims to fill. The industry is strategically positioned in relation to banks by focusing on functionality for urgent non-standard loan applications (period between application and decision, and access to decision-makers) as value proposition, where banks are found lacking. Relatively high interest rates form the profit proposition, as firms in this industry have limited access to funds. Collateral is central as risk-mitigating strategy, forming a part of the profit proposition. The people proposition is essential, as the industry is distinguished by individualised decision-making. A survey among customers of this industry identified four clusters of potential customers: The first had no needs unfulfilled by banks, while the other three clusters were attracted by either functionality, or the evaluation of collateral in contrast to repayment ability, or a combination of the two. A survey among providers revealed hesitance to supply information and a low level of agreement on strategic matters – possibly due to the emergent nature of the industry. Plusieurs trillions de dollars d’actifs sous gestion : tel est le poids de l’industrie des hedge funds dans le système financier. Acteurs indispensables des marchés, les hedge funds sont pourtant des créatures méconnues. Réservés aux investisseurs professionnels ou qualifiés, ils ont longtemps tiré partie d’exemptions et échappé à une trop forte contrainte réglementaire. La crise financière de 2008 a bouleversé ce schéma et fait apparaître, en Europe et aux États-Unis, une même volonté d’encadrer davantage ces structures, par le biais de leurs gestionnaires. Aussi cette étude propose-t-elle une analyse comparée des dispositions introduites en la matière par la directive AIFM et par le Dodd Frank Act. Après un nécessaire éclairage sur cette industrie de l’ombre, elle examine les apports des deux textes, les confronte avant d’en dégager forces et faiblesses. Le traumatisme de la crise a fait émerger un double impératif : mieux protéger les investisseurs et prévenir le risque systémique. C’est à la lumière de ces deux objectifs que la seconde partie s’attarde sur le bien-fondé des réformes, leur portée réelle ainsi que leurs limites. Cette vue d’ensemble de la régulation applicable aux gestionnaires de hedge funds est également prétexte à une réflexion plus large sur la régulation financière, ses finalités, ses contours et ses défis. Nous concluons sur une feuille de route pour un acte II de la directive AIFM et formulons plusieurs propositions, en particulier l’interdiction totale de commercialisation auprès d’investisseurs de détail et la création d’une base de données mondiale du risque systémique. / The hedge fund industry manages several trillion dollars in assets. Though they are key players of the financial system, hedge funds remain mysterious creatures. Available only to professional or qualified investors, they managed, for a long time, to take advantage of exemptions and to avoid a heavy regulatory burden. The 2008 financial crisis profoundly changed perspectives and led the European Union and the United States to introduce new regulations targeting hedge funds, through their managers and advisers. This study is a comparative analysis of such regulations, brought about by the AIFM Directive and the Dodd Frank Act. After a brief overview of the industry, both texts are examined and compared so as to identify their respective strengths and weaknesses. Two imperatives emerged out of the crisis: increasing investor protection and preventing systemic risk. In light of these two objectives, part II discusses the validity of the reforms, their scope and their limits. This extensive analysis of hedge fund regulation also leads to broader remarks on financial regulation, its aims, contours and challenges. Finally, a roadmap for a revised version of the AIFM Directive is proposed and concrete measures are suggested, such as the total prohibition of marketing to retail investors and the creation of a global database of systemic risk.

RESUME La construction d un systeme financier sain et concurrentiel capable de mobiliser de facon substantielle des hauts niveaux d epargne et l amelioration des normes de supervision bancaire et financier pour assurer la stabilite du systeme sont deux des recommandations souvent faites par les institutions internationales pour permettre aux pays africains de participer pleinement a l expansion de la prosperite mondiale et a beneficier de la globalisation du commerce des services financiers.<p><p>Cette these essaie de trouver les voies et moyens susceptibles de contribuer a l amelioration et au renforcement de la supervision bancaire au Congo, et in fine [le secteur bancaire etant le plus important du systeme financier] permettre l eclosion d un systeme financier moderne et efficace qui rencontre les normes internationales.<p><p>Dans une premiere etape qui consiste en un etat des lieux du systeme financier congolais et en une analyse critique de la gestion bancaire ( chapitre 1 et chapitre 2 ); les analyses :<p>- ressortent les caracteristiques du systeme financier congolais ;<p>- soulignent les contraintes structurelles ayant entrave trois decennies de gestion bancaire ;<p>- evaluent les chances de succes des reformes mises en oeuvre par les autorites;<p>- proposent en des termes generaux, les ameliorations a porter au cadre reglementaire et de supervision du secteur bancaire afin de reduire les imperfections, de renforcer l efficacite et la stabilite du systeme dans son ensemble.<p><p>Dans une seconde etape, un menu plus restreint de propositions faites au terme de l etat des lieux du systeme financier et de l analyse critique de la gestion bancaire est passe en revue. Les contributions de la these dans cette etape consistent :<p>- en la proposition d outils concrets de supervision bancaire pour faire face a la carence d outils de gestion prudentielle preventive ;(chapitre 3)<p>- en recommandations pour ameliorer :la politique de provisionnement des creances et le fonctionnement des institutions de microfinance ;( chapitre 4)<p>- a degager dans une demarche d analyse strategique, les pistes susceptibles de contribuer a l amelioration de la sante et la solidite du systeme financier congolais apres evaluation prealable de sa competitivite (chapitre 5)<p> <p>SUMMARY<p>The construction of an healthy and competitive financial system able to mobilize high levels of saving and the improvement of the standards of banking and financial supervision to ensure the stability of the system are two of the recommendations often made by international institutions to help African countries to take part in the expansion of world prosperity and to profit from the globalization of financial services. <p><p>This thesis tries to find the ways to contribute to the improvement and the reinforcement of the banking supervision in Congo, and in fine [ the banking environment being most significant of the financial system ] to allow the blossoming of a modern and effective financial system which meets international standards. <p><p>In a first stage which consists in an overview of the Congolese financial system and in a critical analysis of the banking management ( chapter 1 & chapter 2) ;our analyses :<p>- release the characteristics of the Congolese financial system ;<p>- underline the structural constraints having blocked three decades of banking management ;<p>- evaluate the chances of success of the reforms implemented by the authorities ;<p>- propose in general terms, the improvements to be carried in order to reduce the imperfections of the banking supervision, to reinforce the effectiveness and the stability of the banking system. <p><p>In the second stage, a more restricted menu of proposals made at the end of the first stage is reviewed. The contributions of the thesis in this stage consist:<p>- in the proposal of concrete tools for banking supervision to face the deficiency of preventive prudential management tools; ( chapter 3)<p>- in recommendations to improve :the policy of provisioning bad debts and the management of Microfinance institutions; (chapter 4)<p>- in an evaluation of the competitiveness of the Congolese financial system and in the identification of ways which can contribute to the improvement of its safety and solidity by using a strategic analysis approach. The effects of financial liberalisation in emerging market economies

The aim of this research is to show the effects of financial liberalisation on emerging market economies, how these economies removed restrictions on financial institutions so that they can be globally integrated, and to show the flow of international finance in and out of a country. This research also illustrates how the financial system in these economies moved from being government-led to being market-led. The main finding of this research is that many countries failed to reap the benefits of liberalisation because of weaknesses in the regulatory structure, undercapitalised banks, volatile markets and contagion effects. The research concludes that the long-term gains of liberalisation certainly supersede short-term instability of liberalisation. Thus, for financial liberalisation to have predominantly positive effects, attention should be drawn to the importance of a more prudent regulatory and supervisory environment. Furthermore, financial liberalisation must be accompanied by a sound institutional infrastructure, proper conduct of monetary and fiscal policies, a reduction in corruption, and an increase in transparency. To cope with the global trend of liberalization and internationalization of financial services, the Government has undertaken the reform in the aspect of financial service system and enacted the “Financial Holding Company Act”. Under new current mechanism, a financial conglomerate can sell its products by means of cross selling. Not only it may benefit consumers with a “one-stop shopping”, but also may create a synergy in economies of scale to enhance financial institutions in global competition. The main theme of this thesis focuses on the managerial strategy and internal auditing in an insurance subsidiary under a financial holding company. It addresses in the first place the legal issues related to a holding company and a financial holding company. Then the author adopts five factors approach to analyze the business environment of an insurance subsidiary under a financial holding company. As a successful case for its' strategic alliance,the CitiGroup experience in the United States is also examined. In addition, to protect the interest of investors and policyholders, corporate governance and internal auditing issue is also explored. In the conclusion, it is observed that under the new era of financial conglomeration, an insurance subsidiary still needs to enhance its competition ability. It is suggested that the government should continue to reform the financial regulatory system and to require financial holding companies and their subsidiaries to implement a comprehensive risk management. Emotional appeals in UK banks' print advertisement

The unprecedented turbulence and uncertainty experienced in global economic and financial markets because of the 'credit crunch' has had a damaging impact on consumer confidence. Trust and credibility have been eroded as many customers feel let down by the banks suggesting the need for banks to rebuild constructive dialogue and long-term, meaningful relationships with their customers again. Though financial service, in this case, is considered a utilitarian service, based on the fact that money is needed to support people‘s daily activities, the present state of financial service has suggested the need for banks to appeal to consumers‘ emotions with the aim of improving their reputation. Also, the competition within the industry also could suggest the need to adopt an emotionally appealing advertisement strategy as emotions are known to play an influential role in building robust brand preference. This study builds on the communication theory, meaning transfer theory and consumer involvement theory, to understand the messages the banks are sending out and to elicit consumers‘ emotional reaction. One thousand, two hundred and seventy-four UK bank advertisements in nine national newspapers were content-analysed to identify the emotional appeals presented by the banks. The perception of these appeals and their associated meanings were sought through semi-structured interviews with 33 participants in London and Luton. The results of the analysis indicated that UK Banks are utilising emotional appeal in their advertisements to reach out to the consumers to convince them to upgrade their account, to open an additional account or switch their account. The most predominantly used appeals were relief and relaxation followed by excitement and happiness or satisfaction with the bank, and finally, security and adventure. However, variations were found in different financial products that employed emotional appeals. It was found that high-involvement products such as mortgages and loans used fewer emotional appeals. Both bank groups - high street banks, including the big four (Barclays, HSBC, Lloyds and RBS) and non-high street banks, such as the new entrants, supermarket brands, and online banks were using emotional appeals. However, it is acknowledged that the communication strategies between these banks could be different as the non-high street banks are more likely to repeat and publish the same messages across many newspapers, instead of publishing different emotionally appealing advertisements. Though consumers acknowledged these emotional appeals in the advertisements, they were more concerned about their relationship with the banks as they don‘t rely on advertisements to make a financial decision. Rather, recommendations from families, friends and associates and also branch location are more important when deciding on which bank to choose. The lack of congruency between financial services and emotional appeals in advertisements is also observed as customers are more likely to be persuaded by rational appeals however this study has not completely ruled out emotional appeals in bank advertisements as the use of both types of appeals is recommended. The study provides important theoretical and managerial contributions to understanding how the consumers understand meaning-embedded advertisements produced by the banks. Managers will be able to consider the implications of advertisements in enhancing their brand equity and building relationships with customers in anticipation that, by word of the mouth and established relationship, their bank‘s reputation will be enhanced. Limitations of the study and opportunities for future research are identified.
