O PMCMV, atual modelo de provis?o habitacional, segue os princ?pios e diretrizes que conduzem a concretiza??o desse direito? Como a A??o Civil P?blica (Lei 7.347/1985) pode contribuir para a constru??o de pol?ticas habitacionais mais justas e democr?ticas, j? que se constitui num instrumento de defesa dos interesses coletivos de uma sociedade? A fim de responder tais quest?es, faz-se uma revis?o de literatura acerca do conceito de direito ? moradia e ? cidade, bem como dos modelos adotados pelas pol?ticas habitacionais implementadas pelo governo federal a partir de 1940. Apresenta-se e cr?tica-se a estrutura adotada pelo PMCMV para a constru??o de moradias populares e, para tanto, utiliza a A??o Civil P?blica como um instrumento de avalia??o do PMCMV e de defesa do direito ? cidade num momento de intensa provis?o habitacional apoiada pelo sistema financeiro. Foi selecionada e analisada, dentre outras, a ACP n? 0012584-70.2011.403.6119, que tramita na 1? Vara Federal de Guarulhos (SP). A referida ACP foi proposta pelo MPF em desfavor da Uni?o Federal e da Caixa Econ?mica Federal enfatizando mudan?as nos crit?rios de sele??o dos candidatos do referido programa, tendo em vista a comercializa??o de vagas e a cobran?a indevida de taxas de inscri??o das organiza??es n?o governamentais respons?veis pela sua execu??o. Neste sentido, a ACP surge como um relevante instrumento de defesa do direito ? cidade aos benefici?rios do PMCMV. As considera??es finais t?m por objetivo assinalar elementos de car?ter pedag?gico, educativo, preventivo, relacional e de esclarecimento sobre a relev?ncia da constru??o de uma pol?tica habitacional que conduza a verdadeira justi?a urbana, ainda que por meio da sua judicializa??o, ou seja, da interven??o direta do Poder Judici?rio nos atos do Poder Executivo. / Through the observation of the distortions of the Minha Casa Minha Vida Program (PMCMV) present in the edification of projects in several Brazilian cities, this work seeks to answer the following questions: federal housing policies implemented in the country after the 1940s, moved toward the realization of the right to the city or just acted to promote empowerment of the private sector? The PMCMV, current housing provision model follows the principles and directives that lead to realization of this right? As the A??o Civil P?blica (Law 7.347/1985) can contribute to building a more just and democratic housing policies, since it is an instrument for defending the collective interests of a society? To answer the questions, we carried out a literature review on the concept of the right to housing and the right to the city, as well as the models adopted by the housing policies implemented by the federal government since 1940. It presents and critical to structure adopted by PMCMV for the provision of social housing and, therefore, uses the A??o Civil P?blica as an evaluation instrument of the PMCMV and defense of the right to the city in a moment of intense housing construction supported by the system financial. It was selected and analyzed some ACPs presented by the MPF because of the serious mistakes made in the aforementioned program. We also present some MPF recommendations to the government restores the right to decent housing to hyposufficient. Thus, given the absence of civil society in the formulation, implementation and decision-making in PMCMV, we highlight the importance of the MPF as a new actor political and ACP as a relevant rights protection instrument to the city to beneficiaries of social housing programs produced by the state. The final considerations are intended to show that the housing provision when formulated without the participation of civil society, even in democratic contexts, intensifies the struggle for urban land, leading to policy legalization process, ie, the direct intervention of the judiciary in acts of the Executive.

Na pr?tica, essa reprodu??o acontece com base em um modelo de organiza??o socioespacial do territ?rio marcado por uma expressiva desigualdade social relacionada ao processo de mercantiliza??o da terra e da moradia. Nesse contexto, emerge um impasse entre a escala do fen?meno - problem?tica habitacional em termos de d?ficit quantitativo e qualitativo ? e a escala de atua??o dos munic?pios, a quem cabe implementar o PMCMV. Considerando essa problem?tica, questiona-se como o Programa Minha Casa, Minha Vida estrutura a produ??o habitacional de interesse social na Regi?o Metropolitana de Natal? Admite-se como pressuposto que o Programa Minha Casa, Minha Vida estrutura a produ??o habitacional de interesse social na Regi?o Metropolitana de Natal a partir do estabelecimento de condi??es para o desenvolvimento de novas pr?ticas por parte de agentes imobili?rios, mediadas pelo Estado, relacionadas ?s escalas de opera??o imobili?ria e seus produtos, e de atua??o espacial dos mesmos. Nesse sentido, o objetivo ? investigar o Programa Minha Casa, Minha Vida (PMCMV), visando identificar a estrutura existente da produ??o de interesse social na Regi?o Metropolitana de Natal, suas caracter?sticas e principais resultantes. Aborda-se, portanto, o PMCMV relacionado ? produ??o habitacional de interesse social e aos agentes estatais e imobili?rios que participam do seu processo de implementa??o no per?odo de 2009 a 2014. Identificou-se o movimento de interioriza??o perif?rica da produ??o habitacional de interesse social protagonizado pelos agentes imobili?rios, os quais t?m atuado tendo como refer?ncia o espa?o metropolitano, enquanto que a pol?tica p?blica de habita??o se organiza em torno de a??es locais. Os resultados da investiga??o apontam para a ocorr?ncia de um processo de estrutura??o do imobili?rio na Metr?pole Funcional direcionado para as fam?lias de interesse social, engendrado pelo Programa Minha Casa, Minha Vida. / This thesis deals with current issues related to contemporary Brazilian housing policies focusing the housing Program called Minha Casa, Minha Vida. It was seen that social housing production has been guided by real estate agents and set on a capitalist logic that is throughly supported by the State. These views are enphasized in a metropolitan scale which enables socio-spatial reproduction of families in the metropolization process. In practical terms, this reproduction occurs based on a socio-spatial organization model of the territory that in turn, is set on expressive social inquality related to the the commodification of land and housing. Thus, a standoff emerges between the scale of the phenomenon ? - problematic Housing in terms of qualitative and quantitative d?ficit in the scale of operations of these municipalities; which are responsible for implementing housing programs. Thus, considering these issues, this work aims to enquire: How does the Minha Casa, Minha Vida program structure social interest housing production in the Metropolitan Region of Natal in Rio Grande do Norte in Brazil?. It is admited that this program is established and set on certain development condtions that foment new housing practises on behalf of real estate agents. These practises are mediated by the state and relate to real estate products and operation scales; considering their spatial performance Thus, the research investigates the Minha Casa, Minha Vida Program aiming to identify its current structure regarding social interest production, its mains characteristics in the Metropolitan Region of Natal. The work also deals with State and real estate agents; participants in the program?s implementation process. This is done considering the time period of 2009 to 2014. The study universe is delimited by the functional metropolis of Natal; formed by the cities of Natal, Parnamirim, S?o Gon?alo do Amarante, Maca?ba and Extremoz. As for methodological procedures, a qualitative research with semi-structured interview was realized with municipal managers, representatives of the Caixa Econ?mica Federal Bank as well as civil construction companies. There was also a documental analysis that considered the program?s legislation and secondary data on housing production. The research identified a movement towards peripheral internalization of social housing production on behalf of real estate agents that have considered this metropolitan space as a reference. On the other hand, it was possible to perceive that housing public policies are organized based on local actions. The research results point to the occurrence of a real estate structuring process in the Functional Metropolis of Natal that in turn, are directed to the families of social interest by the Minha Casa, Minha Vida Program.

Some of the main criticisms of the PMCMV fall on the minimum areas of the units, the adoption of typologies of standardized buildings in type "H" blocks, with low utilization of natural lighting and ventilation for all units, as well as the model of private condominiums , Aspects that contribute to the degradation of the dwellers? life quality. The current proposal has been developed to create an alternative project that allows the expansion of apartment type units and a better adaptation of buildings to the local climate, in order to promote an architectural quality addition to users. It uses as reference the building of the My House My Life Program (PMCMV) in the city of Parnamirim, Rio Grande do Norte, for families with income from 0 to 3 minimum wages. The first step of this paper presents a literature review about the flexibility applied to the architecture with emphasis on strategies of extension, supported by the study of previous architectural and project solutions, as well as identifies specificities of the local production of the PMCMV, through the evaluation of building ventures based on application of questionnaires for the residents as an assisting procedure for the architectural programming of the proposal to be developed. The definition of the proposal seeks to incorporate the revised and reprogrammed aspects, considering the local technical and constructive reality and flow ratio of the project with the environment. The final proposal presents an appropriate design concept to the local climate, housing units with variations of area to better serve the various profiles of beneficiaries, with the possibility of planned expansion, allowing them to stay for longer in the property, as well as integrated urban insertion to the surroundings with common spaces shared with the neighborhood.

A pesquisa apontou para a pouca efetividade da implementa??o do trabalho social pr?/p?s-ocupacional e da gest?o condominial nos empreendimentos do PMCMV na RMN. Ademais, as Secretarias de Habita??o dos munic?pios estudados possuem baixa capacidade t?cnica na elabora??o dos Projetos de Trabalho Social (PTS), escassez de quadro de t?cnicos qualificados em projetos de habita??o de interesse social, alta rotatividade de profissionais e fragilidades quanto ? forma de contrata??o das Equipes T?cnicas Sociais (ETS). Por fim, a pesquisa constatou que o trabalho social ? permeado por interesses econ?micos e pol?ticos em todas as fases de execu??o, por diversos atores sociais e pol?ticos. / This work aims to analyze the social work of the Programa Minha Casa Minha Vida (PMCMV), track 1, in the Metropolitan Region of Natal (RMN), in the cities of Natal, Parnamirim and S?o Gon?alo do Amarante. Methodologically, the study is a qualitative research, based on the dialectical-critical method, which evidences the perceptions of the main social actors that are directly related to the social work in PMCMV ventures. In this way, the following methodological procedures were used: bibliographic review, documentary analysis, analysis of secondary and primary data, semi-structured interviews, field diary and focus groups. Three projects were set up to carry out this research: the Residencial Villas do Planalto I, II, III, IV, in the city of Natal (Capital); The Residencial Ilhas do Atl?ntico, in Parnamirim; And the Residencial Ruy Pereira, in the Municipality of S?o Gon?alo do Amarante. In addition to the scarcity of studies in the area, the research pointed to little effectiveness of the implementation of pre/post-occupational social work and condominial management in PMCMV ventures in NMR. In addition, the housing departments of the municipalities studied have a low technical capacity in the elaboration of social work projects and a shortage of skilled technicians in projects of social interest housing, high turnover of professionals and weaknesses as to their way of hiring the Technical Teams (ETS). Finally, the research found that social work is permeated by economic and political interests in all stages of implementation, by various social and political actors.

Since the launch of the program named ?Minha Casa Minha Vida?- PMCMV in 2009, the main criticism to this model housing program are, especially, regarding to the solutions presented in projects developed for social housing, since it does not consider the needs of several user profiles, neither consider the changes in family structure that have occurred over time. How to develop projects for social housing that attend programmatic needs and dynamics of different types of users? Therefore, this work adresses the issue of social housing architecture, and aims the development of a social housing project, using flexible strategies, presenting as study universe the neighborhood named ?M?e Luiza? located in the city of Natal / RN. For such purpose, a literature survey was made addressing the concept of flexibility applied to social housing project as a way to build a theoretical background on the subject; development of reference studies of housing projects that use strategies and construction techniques applied to programmatic and functional flexibility of the building; identify the profile and demands of users served by PMCMV through the SEHARPE database; analysis of projective conditions necessary for the preparation of the architectural proposal; and the development of different housing typologies and types of flexibility strategies related to collectivity and sociability spaces.

Since 2009, PMCMV has been the main Brazilian federal housing program initiative and its Level 1 production, which is designated to families with zero to three minimal wages, was considered by this research as social housing. The selected time frame was from 2009 to 2014, addressing the first and second stages of the program. The territorial frame, denominated ?Campinas-Mogi Axis?, was defined by sociospatial relations discovered through the research, disregarding the political-administrative boundaries and not reducing the focus to the road that structures this axis. The starting point of the work was the hypothesis that the social housing produced by PMCMV increases urban sprawl, which, as observed in the study case, is stimulated by both public and private investments. To achieve the proposed objective, social history was adopted as method, aiming to comprehend reality through it and considering a variety of versions, other than the official ones. The research was also based on literature review about the studied themes and a study case. The analysis systematization, confronted with the literature review, was divided in two scales: regional (Campinas-Mogi Axis) and intraurban (study case), in this scale two social housing condominiums in Jaguari?na City were studied and revealed to be a great contribution in the urban sprawl phenomenon understanding. Finally, it was noticed that the PMCMV and territory management implications lead to a sprawl conducive scenario and to territory fragmentation along the cities, both in regional and local levels, leading to the proposed hypothesis. / Esta disserta??o trata dos investimentos do Programa Minha Casa Minha Vida em Habita??o de Interesse Social, a partir de diversos aspectos de gest?o regional, territorial, municipal, dos conjuntos e do programa federal, sob perspectiva socioespacial. O PMCMV, desde 2009, ? a principal iniciativa federal brasileira de provis?o habitacional, sendo que a produ??o para Faixa 1, destinada a fam?lias com renda entre zero e tr?s sal?rios m?nimos, foi entendida como de interesse social por esta pesquisa. Esse entendimento prov?m do fato de haver destina??o de recursos a fundo perdido e demanda fechada para essa faixa. O recorte temporal se colocou entre 2009 e 2014, abordando as duas primeiras etapas desse programa. J? o recorte territorial, que se denominou por "Eixo Campinas-Mogi", foi definido pelas rela??es socioespaciais encontradas, n?o se observando os limites pol?tico-administrativos, tampouco sendo reduzido ? rodovia que estrutura o eixo. This Program was created after the demand presented by the national entities of popular movements in Brazil and it differentiates from the others for having as a focus the cooperative and association work, with the intention of fortifying the "self help" practice and the popular organization. To realize a critical analysis of the Program, this dissertation begins with a historical reconstitution of the ways of housing provision, with emphasis in the self help building and popular participation. The capitalist development, through the housing production, is presented as a way to understand the relations between the agents involved in the current forms of provision. The analysis of the social agents gives clues to explain its current interlocutions. Some notes about the current scene present a compose the changes presented in the civil society and in the State toward the recent public politics for social housing and the popular participation. In the end a panorama of some Brazilian regions is presented, with different ways of utilization of the Program. A study of a more specific case was made in Embu das Artes city, SP, for having, until then, appropriated the Program on a more complete way. The field research had as intention to illustrate the arguments presented throughout the work, basing the critiques made to the Program. Critiques that in the end had been organized in three great axles: provision, interlocution between the present social agents and participation, always aiming at answering the question: changes in the scene?. / Esta disserta??o trata do recente Programa do governo federal para Habita??o Popular, o Cr?dito Solid?rio. Esse Programa foi criado ap?s demanda apresentada pelas entidades nacionais de movimentos populares e se diferencia dos demais por ser voltado ao cooperativismo e associativismo, com o intuito de fortalecer as pr?ticas de gest?o e da organiza??o popular. Para proceder a uma an?lise cr?tica do Programa, este trabalho parte de uma reconstitui??o hist?rica das formas de provis?o habitacional, com ?nfase na autoconstru??o e participa??o popular. Initiated the occupation of the central areas by trade and services, the expansion of the city were developed quickly and disordered, with occupancy of flood plains and hillsides, by sub-housing, despised by the population with higher purchasing power, initiating a process of social segregation. On the other hand, the intensity of activity in the cities attracted a population coming from Field, from the opening of new work fronts, in a period that industrial production gained strength. This population, largely formed by immigrants and no buying power to becoming the owner or renting a property near the job, had to resort to tenements as the only way to setting residence in the city. However, from the 1970s, the center began to show a decrease of resident population, thanks to to displacement of the financial activities for new centers, accompanied by the formation of new residential neighborhoods of higher income classes, leaving a large number of empty or underused buildings. In a first moment, the study sought to understand the current state of housing in downtown Sao Paulo, in a broad way, mapping and systematizing data on public and private initiatives aimed at increasing new housing or rehabilitation in downtown (understood as historical center and expanded). Then the study will gain interplay more analytical, order to show whether in fact there is an ongoing housing policy with the prospect of urban regeneration of downtown Sao Paulo. This stage also sought to understand the social reach of these endeavors. For such, has revised to the current literature on the housing issue in central areas and analyzed the nature of the plans, programs and projects proposed in the last ten years in the city of S?o Paulo. / Impulsionado pela economia cafeeira, o centro da cidade de S?o Paulo adquiriu o car?ter de centralidade j? nas primeiras d?cadas do s?culo XX. Iniciada a ocupa??o das ?reas centrais pelo com?rcio e os servi?os, a expans?o da cidade se deu de forma r?pida e desordenada, com a ocupa??o de ?reas de v?rzeas e encostas por sub-habita??es, desprezadas pela popula??o de maior poder aquisitivo, dando in?cio a um processo de segrega??o social. Por outro lado, a intensidade das atividades nas cidades atraiu uma popula??o vinda do campo, a partir da abertura de novas frentes de trabalho, num per?odo em que a produ??o industrial ganhou for?a. Essa popula??o, em grande parte formada por imigrantes e sem poder aquisitivo para se tornar propriet?ria ou alugar um im?vel pr?ximo ao emprego, teve que recorrer aos corti?os como ?nica forma de se fixar na cidade. With the enactment of the Statute of the City (2001), the creation of the Ministry of Cities (2003), the structuring of the National Housing Policy (2004), the National Housing System (2005) and the elaboration of the Housing Plans by the nacional, state and municipal levels, were established the conceptual and instrumental basis for coping with the housing problems in the country. The context created signaled a promising perspective to articulate the land issue to housing policy. Although there is a consensus that urban land is component and an essential condition for the succes of the actions that concretize such a policy, housing practices undertaken rarely deal with this component in the proper way, contributing to worsening socio-spatial inequalities, characteristics of urbanization in the country. This research aims to examine how the feasibility of such land for the production of housing is inserted in the design of housing policies formulated in this context. For the analysis, was chosen a territorial clipping the Metropolitan Region of Campinas, located in the State of S?o Paulo. Housing Plants were analyzed, formulated by the state and metropolitan levels, as well as the Local Plans for Social Housing (PLHIS) of six counties that comprise the region: Americana, Campinas, Indaiatuba, Itatiba, Santa B?rbara d'Oeste and Valinhos. To perform the analysis, three categories were chosen: the framework of housing issues, the land needs of the production of housing policy and strategies proposed action to acquire the land necessary to meet demands. The research showed many "nodes" that influence and characterize the approach to the topic of land in the housing plans, dicussing the obstacles that make the link between land issues and housing policy. / O Brasil evidenciou nas ?ltimas d?cadas importantes transforma??es no campo da pol?tica urbana e habitacional. Com a promulga??o do Estatuto da Cidade (2001), a cria??o do Minist?rio das Cidades (2003), a estrutura??o Pol?tica Nacional de Habita??o (2004), o Sistema Nacional de Habita??o (2005) e a elabora??o dos Planos de Habita??o pelas esferas nacional, estadual e municipal, ficaram estabelecidas as bases conceituais e instrumentais para enfrentamento da problem?tica habitacional no pa?s. O contexto criado sinalizou uma perspectiva promissora para articular a quest?o fundi?ria ? pol?tica habitacional. Apesar de hever um consenso de que a terra urbana ? componente e condi??o essencial para o ?xito das a??es que efetivam tal pol?tica, as pr?ticas habitacionais empreendidas raramente tratam deste componente de maneira adequada, tendo contribu[ido para agravar as desigualdades socioespaciais caracter?sticas da irbaniza??o no pa?s.
