Due to those findings, this study has as main objective to understand democracy, recognizing its importance, without forgetting to preserve human rights and human dignity, to establish the minimal humanistic bases for the model of a new society. Aim to reach the goals, a historical method and a compiling method utilized, with the association of different subjects in a way to presents a summarize panorama on several perspectives on the update changing on the readings of humanity. But, with the development of the presented ideas, the scientific methodology takes the place in directing development of the investigation searching coherent proposals to a conciliation between the inevitable global integration and the effective preservation of the dignity of the human being. The results concerning law indicate the need to overcome the old fashion debates with are just formal and superficial, with un updating of the comprehension on the role of the Judiciary Police in Brazil. It should, more than ever, helping strengthen the democracy and the commitment of the human being with their peers / Ao mesmo tempo em que a humanidade vivencia a dinamicidade das grandes e ininterruptas (macro)transformações, ainda não foi possível compreender e fazer valer, de maneira plena, os direitos fundamentais do ser humano, na qualidade de pessoa, única e singular. Em função dessas constatações, este estudo tem como objetivo compreender o sentido de democracia, reconhecendo sua importância, sem olvidar da necessidade de preservação dos direitos humanos e da dignidade da pessoa humana para o estabelecimento das bases humanistas mínimas do modelo para uma sociedade. Com a finalidade de atingir os objetivos estabelecidos, é utilizado, inicialmente, o método histórico e o método de compilação, com a associação de diferentes disciplinas, de modo a apresentar um panorama sintético das várias perspectivas sobre as atuais mudanças nos rumos da humanidade. Mas, com o desenvolvimento das ideias apresentadas, a metodologia científica passa a direcionar o desenvolvimento da investigação na busca de propostas coerentes para a conciliação entre a inevitável integração global e a efetiva preservação da dignidade da pessoa humana. Os resultados, no campo do Direito, apontam para a necessidade de superação dos ultrapassados debates meramente formais e superficiais, com a atualização da compreensão sobre o papel da Polícia Judiciária no Brasil. In this sense, the work examines the legal hermeneutics that should be used by the legislator in the formulation of social security legislation as well as the form of interpretation of the applicators of the law. Finally, it maintains that the existing social security conflict would only be remedied if there were a legislative reformulation that expressly stated in the Benefit Law (Law 8,213 / 91) the possibility of extending the additional 25% for other types of social security benefits, if there was proof of fulfillment of the requirements in the event of incidence of the norm (work incapacity and the need for permanent assistance of a third party) / O presente trabalho tem por objetivo demonstrar que a Previdência Social, ao ser regida pelos valores da dignidade da pessoa humana, da solidariedade social e da igualdade e diante das normas constitucionais da universalidade da cobertura e do atendimento (art.194,I) e da proibição da adoção de critérios diferenciados na concessão de aposentadorias no RGPS (art.201, parágrafo 1o), não pode restringir o adicional de 25% do valor do benefício previsto no artigo 45 da Lei 8.213/91 somente aos segurados aposentados por invalidez. Neste sentido, o trabalho examina a hermenêutica jurídica que deve ser utilizada pelo legislador na formulação da legislação previdenciária bem como a forma de interpretação dos aplicadores do direito. Finalmente, sustenta que o conflito previdenciário existente somente seria sanado caso houvesse uma reformulação legislativa que fizesse constar, expressamente, na Lei de Benefícios (Lei 8.213/91) a possibilidade de extensão do adicional de 25% para as demais espécies de benefícios previdenciários, caso houvesse a comprovação do preenchimento dos requisitos constantes na hipótese de incidência da norma (incapacidade laborativa e a necessidade de assistência permanente de um terceiro auxiliador)

To that end, seeks to know the way in which this benefit promotes social inclusion of disadvantaged people in order this is often the only income of the individual and his entire family. Therefore, we seek to determine whether this benefit reaches its main objectives, namely: to build citizenship, minimum social rights protect a sizable portion of the population - that otherwise could not exist - that contribute to minimize social inequalities, to promote the social inclusion of underprivileged and as well as affirming the fundamental principle of human dignity, according to Article 5 of the Federal Constitution. A pesquisa parte da harmonia desta teoria com os preceitos constitucionais vigentes nos países democráticos de Direito. O estudo aborda o Garantismo e a sua compatibilidade com a pretensão punitiva estatal; refuta a ideia equivocada de se tratar de uma excessiva proteção aos infratores da lei penal ao comprovar que, na realidade, deriva do princípio da dignidade humana cujo destinatário final é o ser humano. O enfoque dado ao Garantismo é o de vetor humanista ao processo penal visto que, compete a este impor os limites à atuação do Estado para alcançar a pretensão punitiva, sem prescindir da necessária preservação aos direitos, garantias e liberdades constitucionais e da observância ao princípio da dignidade humana. Para defender o posicionamento adotado acerca do Garantismo, foram escolhidos alguns aspectos sobre os quais lançamos um olhar mais apurado. The path taken by the Brazilian nation in search of Democracy led to the convocation of a National Constituent Assembly, whose work resulted in the Constitution of the Federative Republic of Brazil, from October 5, 1988. With the new Charter - called Citizen Constitution - the dignity of the human person not only gained the status of a constitutional principle, but as one of the foundation of the Republic, and this is a significant change, with deep and eternal reflections in the national life. This swerve and the special distinction that gives the protection to the rights of the human person, are consequences of what scholars call the "pendulum movement of History", which means, the natural and inexorable change of values prevailing in a certain society, from time to time, from one extreme to another, given that the social life is dynamic and the human being is always in search of a better way to live. But since past almost three decades, although already breathing democratic airs, Brazil continues to pursue the dream of social balance, and the solution to the existing disagreement, which embarrass the fluidity of social relations, pass, of course, through the correct interpretation that gives the scope of constitutional and infra-constitutional devices that incorporate the Brazilian legal system. Thus, already sees the importance of the theme. The paper is divided into three parts and, primarily, seeks to identify the theoretical premises that lay the foundation of the study, starting from a hypothetical deductive methodology with the objective to build substrate for a better understanding of the thesis. It is the Science of Law that gives focus to the paper, but interdisciplinary references are used, notably of History, Philosophy and Political Science. The final conclusions can be summarized in the following statement: The Principle of Human Dignity, in a wide perspective of equality, succors one who violates the Penal Law, have to succor each offended by this violation, under penalty of the commitment of the maintenance of social equilibrium , which reflects a critical to the leniency that, in Brazil, the delinquents are being treated / O presente trabalho analisa o Princípio da Dignidade Humana de uma perspectiva contemporânea, principalmente em função do papel por ele assumido enquanto fator de equilíbrio social, a partir do processo de redemocratização do Brasil, que ocorreu na segunda metade do século passado, depois de quase trinta anos de regime de governo militar. O caminho percorrido pelo povo brasileiro em busca da Democracia conduziu à convocação de uma Assembleia Nacional Constituinte, de cujo trabalho resultou a Constituição da República Federativa do Brasil, de 5 de outubro de 1988. Com a nova Carta - chamada de Constituição Cidadã - a dignidade da pessoa humana ganhou status não apenas de principio constitucional, mas de fundamento da República, e isto constitui alteração significativa, com reflexos profundos e perenes na vida nacional. Por meio de estudo bibliográfico e de investigação empírica (que deu voz a pessoas envolvidas na temática da inclusão laboral, sejam fiscalizadores da lei, agentes públicos, consultores renomados ou trabalhadores com deficiência intelectual) constatou-se que as barreiras atitudinais são responsáveis pela baixa efetividade das cotas para pessoas com deficiência intelectual. A partir dessa constatação, a pesquisa tece considerações sobre a necessidade de interpretação da lei conforme princípios do paradigma da inclusão social. Tais princípios foram trazidos para o ordenamento jurídico brasileiro pela Convenção da Organização das Nações Unidas sobre os Direitos das Pessoas com Deficiência e são um dos meios jurídicos capazes de mitigar os problemas encontrados, viabilizando a dignidade do trabalhador com deficiência. / By means of a bibliographical study and in depth investigation (which has given people a chance for expression in regards to labor inclusion, whether they are Law supervisors, public agents, renowned consultants or workers with intellectual disability), it has been certain that the attitude barriers are responsible for the low numbers in hiring people who are intellectually disabled. From this point on, this research shall deal with relevant considerations regarding the need for the law interpretation in accordance with the social inclusion paradigm. Such principles have been brought to the Brazilian juridical system by the United Nations´ Convention on the Rights of Persons with Disabilities and represent a juridical means able to soften the existing problems, bringing to those employees with disabilities their due dignity.

Le recours aux soins est chose quotidienne pour l'ensemble des individus. Ces derniers sont effectivement soumis dans leur quotidien à la contrainte médicale émanant du "droit-créance" à la protection de la santé prévu à l'alinéa 11 du Préambule de la Constitution de 1946. Néanmoins, parallèlement à ce développement de l'accès aux soins, s'est dégagé le droit subjectif à la santé qui interdit toute atteinte à la santé de l'individu. Ces deux acceptions du droit à la santé interagissent au point que la première devienne une véritable contrainte pour la seconde. Il est donc indispensable de trouver des solutions afin qu'un équilibre puisse s'établir entre ces deux conceptions. Le consentement aux soins du patient constitue valablement une conséquence de la conception subjective du droit à la santé. Consacré par la loi du 04 mars 2002, relative aux droits des patients, le droit au consentement ne dispose d'aucun rattachement à une norme fondamentale opératoire, pour l'heure. Il se trouve en réalité souvent atteint par le recours imposé aux soins. Cette étude s'attache donc à démontrer que le droit au consentement aux soins présente une effectivité relative et qu'il est alors indispensable de le rattacher à des droits fondamentaux préexistant / The appeal(recourse) to the care is daily thing for all the individuals. Families are old organizations. In Asian area, ¡§Domestic Violence Protection Act¡¨ is a new law that shoots up like a new sprout. When tradition meets modern laws; when old emotions and blood relationship meet rational laws, what kind of spark will be generated? And how many new social issues will it bring up? The harms caused by marital violence to a family include physical and mental torture suffered by family members, which might lead to high national and social costs. Owing to the changes in family functions and family structure, marital violence as a controversial issue has been regulated in the legislative body through legislation. However, if there is no limit to the ¡§intervention of laws in domestic disputes¡¨, family problems will be made public just like the ¡§Truman Show¡¨. Without privacy there is no dignity. The universal value of human rights would finally be stripped off. Once the private realm of a family is intervened, it is as if the Pandora¡¦s Box pops open. The basic human rights of family members, such as individual¡¦s privacy, minor children¡¦s right to family harmony, domestic violence victims¡¦ right over body and the right of freedom from fear, and domestic violence offenders¡¦ right to family life, right of migrating freedom, right of personal freedom, and right of property disposal, which has been deprived according to the protective order, as well as human dignity of each family member of the family in dispute and so on will be challenged. Whether the core of family system and family autonomy, or the right to family life, or the systematic protection of family should be precedent to the natural rights of the Constitution? Is it excessively intervened by the Domestic Violence Protection Act? This article discusses the intervention of laws in domestic disputes from the practical and law aspects: What conflicts exist between Domestic Violence Protection Act and domestic violence, and the possibility of reconciliation between them. It is also expected that the implementation of policies is able to protect the basic human rights of all citizens by adhering to the consistent constitutional spirit.

Le présent mémoire soulève divers questionnements face au traitement singulier qu'a reçu l'âge en tant que motif prohibé de discrimination, sous la Charte des droits et libertés de la personne du Québec et la Charte canadienne des droits et libertés. Ainsi, nous verrons que même si la discrimination fondée sur l'âge n'est pas à strictement parler « autorisée », elle est néanmoins souvent jugée acceptable. Tout d'abord, nous procéderons à une revue générale et synthétique des notions de discrimination et de droit à l'égalité, telles qu'elles sont prévues par les articles 10 de la Charte québécoise et 15 de la Charte canadienne. Ensuite, nous évoquerons un certain nombre de limites législatives qui ont été apportées à ces droits et qui peuvent constituer des obstacles importants dans la lutte effective contre la discrimination fondée sur l'âge. We will see that even though age discrimination is not strictly "authorised", it is nonetheless often held to be acceptable. First, we will synoptically review the concepts of discrimination and equality which emanate from section 10 of the Quebec Charter and section 15 of the Canadian Charter. Then, we will identify a certain number of legislative limits which affect these rights, and may constitute significant obstacles in the effective fight against age discrimination. By theorizing this gap with Neil Thompson’s theory of “thinking” and “doing” while shedding light to this gap with a postmodern flashlight, the study shows that the concepts of human rights, human dignity, culture and ideology are in need to be addressed and added to this discourse and certainly to the overall discourse of human rights.
