Keywords: democracy, humanity, violence, absolutism, discussion, decision Thomas G. Masaryk was a supporter of humanism and humanist democracy. Carl Schmitt criticized such conceptions. In this thesis I would like to show that their different attitudes are an effect of different foundational concepts in their political thought. Masaryk believed that political philosophy wasn't nothing else than zoology, if it hadn't morality in her foundations. Schmitt saw the starting point of every true political theory in violent characteristic of human being. For Masaryk the democracy is in the end a moral ideal, the humanity, by which human beings abandon all the violence and they resolve all their potential conflicts by the discussion. I will show in this thesis, that moral equality of human beings cannot be proper foundation of democracy and that Masaryk demands too much to make possible to realize his democratic vision. The democracy in Schmitt's view is an authoritative violent regime where the individuality should be totally suppressed and a political relevance of the morality too.

This essay concerns the temperance movements Blue Ribbon and White Ribbon inNorrbotten, Sweden. Their ideas about alcohol, industrialisation, family, humanity andproductivity. The period examined is 1905-1985, which nearly covers the whole of themovements history. Swedish and international research on the subject reveals temperancemovements had a negative view on the industrial society during the late 19th and early 20thcentury. The perceived problems were alcoholism and predatory capitalism. The family wasvalued highly both in itself and through its importance for the future well-being of the nation.The same results applies to Blue Ribbon and White Ribbon in Norrbotten. In addition greedwas seen as problematic, as well as lost productivity due to alcohol consumption. Humanitywas seen as very important, both within and between countries.

Les minorités religieuses représentent souvent une composante de la population et se caractérisent par leur différence religieuse qui peut les rendre vulnérables à diverses menaces. Assurer la sécurité et la stabilité des sociétés comportant des minorités religieuses impose l’adoption de dispositions spécifiques. La protection pénale représente ici le moyen juridique le plus efficace, à travers la dissuasion réalisée par les sanctions et les mesures adoptées. Cette étude vise à déterminer le fondement et la portée de ladite protection accordée à des minorités et ce, en établissant une comparaison entre deux systèmes différents devant la religion, le système religieux (libyen et égyptien) et le système laïc (français). Le Statut de la Cour pénale internationale en tant qu’axe complémentaire sera ici un élément neutre par sa position ni laïque, ni religieuse. Cette comparaison s’attachera à l’impact du système juridique adopté quant aux droits des minorités religieuses. / Religious minorities are often a component of the population and are characterized by their religious difference that can make them vulnerable to various threats. Ensuring security and stability of societies with religious minorities requires the adoption of specific provisions. The criminal protection, here, represents the most effective legal means, through deterrence achieved by sanctions and measures adopted. This study aims to determine the effectiveness of that protection extended to minorities in terms of foundation and reach, by making a comparison between two different systems in front of religion: the religious system (Libya and Egypt) and the secular system (French). The Statute of the International Criminal Court as a complementary axis, here, is a neutral element in its position nor secular or religious. This comparison will focus on the impact of the legal system adopted regarding the rights of religious minorities.

Thesis advisor: David Rasmussen / This thesis begins by analyzing three different philosophies on human rights. It looks to the foundations of these theories, but focuses primarily on the obligations that each system creates. It evaluates cosmopolitanism and two different institutionalist arguments, eventually settling on a tiered system of international responsibility as the strongest and most practical conception of rights. The second chapter of the thesis discusses the role of the International Criminal Court as a part of this tiered system, and as a means to promote human rights across the globe. This section evaluates the court by considering its historical foundations, its goals and responsibilities, and its actions over the past ten years. O presente trabalho promove uma fenomenologia da dignidade a partir da experiência de arte na velhice, a fim de estabelecer que tipo de estrutura uma vivência de arte deve ter para que seja de dignidade. Parte de uma compreensão da arte como técnicaprodutiva, haurida do diálogo com a tradição grega da antiguidade. Realiza primeiro um indispensável percurso de desconstruções, intrínsecas ao uso do método filosófico, e somente em seguida narra o aparecimento da dignidade na vivência artística de 12 pessoas maiores de 60 anos de idade. Empreende a descrição dos processos e dos conteúdos dessas experiências, promovendo a integração da estrutura essencial da dignidade pela prática hermenêutica que resulta na ultrapassagem de algumas inflexões contidas no debate histórico-jurídico da dignidade. Propõe uma relevante mudança na abordagem da dignidade a partir da interpretação da experiência de arte na velhice. Revela, por fim, a existência de uma humanidade-artística (inclusive através da imagerie), ressaltando os aspectos fundacionais, relacionais e produtivos do estatuto artístico no ser humano. / The present work promotes a phenomenology of dignity from the experience of art in old age, in order to establish what kind of structure an art experience should have for it to be of dignity. Part of an understanding of art as technical-productive, arising from the dialogue with the Greek tradition of antiquity. First made an indispensable course of deconstruction, intrinsic to the use of the philosophical method, and only then narrates the appearance of dignity in the artistic experience of 12 people over 60 years of age. It undertakes the description of the processes and contents of these experiences, promoting the integration of the essential structure of dignity by the hermeneutical practice that results in the overcoming of some inflections contained in the historical-legal debate of dignity. It proposes a relevant change in the approach to dignity from the interpretation of the art experience in old age. It reveals, finally, the existence of artistic-humanity (including through the imagerie), emphasizing the foundational, relational and productive aspects of the artistic status in the human being.

Este trabalho tem por objetivo a análise do princípio da humanidade no Direito Penal Brasileiro e as violações a este princípio que ocorrem na aplicação de uma sanção criminal. Serão estudados alguns textos internacionais que contribuíram para o desenvolvimento deste princípio, bem como as consequências de sua adoção no ordenamento jurídico brasileiro, com a análise das penas que são proibidas pela Constituição Federal. Serão analisadas, também, a pena privativa de liberdade, a medida de segurança e a medida socioeducativa, que são alcançadas por este princípio, de modo a verificar como ocorrem as violações do princípio ora em estudo em cada uma dessas sanções. Ao fim, serão apresentadas essas violações de modo a compreender o papel que cada um dos operadores do Direito tem de proteção à dignidade e aos direitos fundamentais das pessoas que cometem infrações criminais. / This paper aims at analyzing the principle of humanity in the Brazilian Criminal Law and the violations of this principle that occur in the application of criminal sanctions. Some international texts that contributed to the development of this principle will be studied, as well as the consequences of their adoption in the Brazilian legal system, with the analysis of the criminal penalties that are forbidden by the Federal Constitution. Will also be analyzed the penalty of deprivation of liberty, the involuntary psychiatric treatment and the socio-educational measures, which are reached by this principle, to check how the violations of the principle being studied occur in each of these sanctions. At the end, these violations will be presented in order to understand the role that each person has to protect the dignity and fundamental rights of the people who commit criminal offenses.

Syftet med studien är att analysera det självbiografiska verket Orange is the New Black : mitt år i ett kvinnofängelse (2010) författad av Piper Kerman utifrån dels ett intersektionellt perspektiv och dels utifrån Martha C. Nussbaums begrepp Cultivating humanity som handlar om hur vi ska utbilda människor till att bli goda världsmedborgare. Även teorier om genren självbiografi har tagits i beaktande i analysen. Metoden som studien grundar sig på är en kvalitativ närläsning. Studien visar att romanen berör de olika kategorierna etnicitet, klass och kön, och att författaren Kerman på ett hänsynsfullt sätt skriver om dessa. Att romanen behandlar dessa kategorier skapar goda möjligheter för att diskutera dem, då alla elever på ett eller annat sätt kan identifiera sig utifrån etnicitet, klass och kön. I studiens diskussion framkommer det att det vore gynnsamt om läraren i arbetet med romanen i klassrummet understryker att individen först ser sig som människa, och inte i grupptermer som exempelvis utifrån sin etnicitet, det vill säga att alla människor i grund och botten är människor med en gemensam och global samhörighet.

As práticas sustentáveis existem para direcionar e influenciar projetos, materiais, sistemas e tecnologias para que se tornem ecologicamente corretos, socialmente justos e economicamente viáveis. O telhado verde surge como uma solução projetual de extrema expressão junto aos conceitos de desenvolvimento sustentável. Considerando a falta de material técnico, o presente trabalho pode ser apresentado como uma forma de reunir as características deste sistema em um documento em forma de tratado, que expõe de forma didática um ou vários assuntos a respeito de uma ciência. Este estudo trata do sistema de Telhado Verde Extensivo em lajes planas com foco em edificações de pequeno e médio porte. A pesquisa foi elaborada em três partes: contextualização histórica - compreendendo o telhado verde como um elemento milenar mas com novos usos - tipos de telhado verde e composição do sistema - elencando o telhado verde extensivo como objeto da pesquisa - e características do sistema – explanando sobre os benefícios do telhado verde junto as práticas sustentáveis. A escolha do tipo de telhado verde entre "tradicional" e "laminar" pode ter maior influência no dimensionamento das estruturas, assim como a escolha do tipo de substrato e vegetação. A vegetação também depende da utilização prevista para o telhado verde, sendo a grama o tipo mais comum para se ganhar área útil. O telhado verde pode ser considerado um sistema sustentável, pois, pode colaborar no gerenciamento de águas pluviais absorvendo parte da água no próprio sistema, graças à vegetação, substrato e camada drenante. A vegetação do sistema também pode colaborar para mitigar os efeitos de ilhas de calor, diminuindo as temperaturas ao seu redor e melhorando a circulação de ar nas cidades. A temperatura também pode ser mais facilmente controlada pelo sistema de telhado verde, que funciona como um excelente isolante térmico, não deixando o calor entrar na edificação durante o verão e segurando o calor dentro da edificação no inverno. Essa característica faz com que os gastos com energia sejam consideravelmente menores. Alguns países, inclusive o Brasil, têm posto o sistema em evidência e já consideram a utilização do telhado verde de extrema importância. / Humanity has been depleting natural resources at an unprecedented speed being the construction industry one of the biggest responsible for it. Sustainable practices exist to direct and influence projects, materials, systems and technologies so that they become ecologically correct, socially just, and economically viable. The green roof appears as a project solution of extreme expression next to the concepts of sustainable development. Considering the lack of technical material, the present work could be stated as a way to bring the characteristics of this system into a document in the form of a treaty, that lecture one or more subjects in a didactic way about an specific science. This study deals with the Extensive Green Roof system in flat roof covers for small and medium size buildings. The research was elaborated in three parts: historical contextualization - understanding the green roof as being an ancient element in architecture with new uses – green roof types and components: listing the Extensive Green Roof as the object of the research – and the characteristics of the green roof system: explaining the system benefits along with sustainable practices. The choice of the green roof type between "traditional" and "laminar" may have a greater influence on the design of the structures, as well as the choice of substrate and vegetation type. The vegetation also depends on the intended use for the green roof, with grass being the most common type to gain floor area. The green roof can be considered a sustainable system because it can collaborate in the management of rainwater by absorbing part of the water in the system itself, due to the vegetation, substrate and draining layer. The vegetation of the system can also help mitigate the effects of heat islands, reducing temperatures around them and improving air circulation in urbanized areas. The temperature can also be more easily controlled by the green roof system, which works as an excellent thermal insulation, not letting the heat enter the building during the summer and holding the heat inside the building in the winter. This makes energy expenditures considerably smaller. Some countries, including Brazil, consider the use of the green roof system as being of extreme importance.
