Egskeidingsbemiddeling in Suid-Afrika : 'n vergelykende studie

De Jong, Madelene, 1963- 30 November 2002 (has links)
Text in Afrikaans with summaries in Afrikaans and English / For many years divorce has been viewed exclusively as a legal problem that had to be addressed by the courts in our adversarial system of litigation. Divorce, however, also entails social problems which are not addressed in our legal system. It appears further that our adversarial legal system tends to heighten the conflicting interests of individual family members at divorce and to encourage animosity and irreconcilability. In an attempt to ameliorate the harsh consequences of the adversarial legal system at divorce, two no-fault grounds for divorce were introduced to enable divorcing spouses to make the decision about the termination of their marriage themselves. This greater freedom that no-fault divorce afforded parties quickly led to a demand for a new system of dispute resolution at divorce. The Hoexter Commission consequently, recommended the establishment of a family court with a social component where mediation services are offered. In both Australia and New Zealand the introduction of no-fault divorce was attended by the establishment of family courts where mediation services are offered. In mediation the parties involved, with the assistance of an impartial third, may sort out and find solutions to all their divorce-related problems. It also appears that mediation has always played a prominent role in the resolution of family disputes in the indigenous communities of South Africa. Owing to financial restrictions, South Africa is still without a family court. So far, only the Mediation in Certain Divorce Matters Act 24 of 1987 has emanated from the recommendations of the Hoexter Commission. This Act, which provides for the institution of enquiries by the office of the family advocate to determine the best interests of children at divorce, professes in its title to have introduced mediation as an alternative system of dispute resolution at divorce. From the contents of the Act it is apparent, however, that it provides for mediation only in a very limited sense. Consequently, it is necessary to amend this Act to make provision for real, comprehensive and accessible mediation services for the public in all family law disputes. This amendment could best be achieved by regulating existing private and community mediation services and integrating them into the formal legal process. / Private Law / LL.D.

PATHWAYS TO DEMOCRATIC CITIZENSHIP: THE MEDIATING ROLES OF DELIBERATION AND POLITICAL EFFICACY IN THE EFFECTS OF OLD AND NEW MEDIA USE ON POLITICAL PARTICIPATION IN SOUTH KOREA

Park, Chang Sup 01 August 2014 (has links)
For more than three decades, citizen engagement in the political process in South Korea was strictly hampered by the harsh control of the public sphere by authoritarian regimes and mainstream media's failure to provide a democratic public forum. With the penetration of online and social media, the participatory culture of South Korea has significantly and qualitatively changed. During the last 10 some years, citizens actively used Internet media, such as online and social media, in mobilizing people for social and political causes. In recent elections, the use of Internet media has been considered one of the decisive factors of turnout and election results. The wide availability of information, the supply of unfettered discussion forums, and constant connectedness beyond space and geographical boundaries of the Internet are believed to work efficiently in leading citizens to the political process. However, unlike in Western countries, research to investigate the mechanism through which citizens engage in political affairs has been scant in South Korea. Drawing on the participatory democracy theory, this study examines how old and new media use in South Korea possibly change citizens' political attitudes and perceptions and how such changes subsequently trigger civic engagement in political affairs. Among various possible factors of political communication, this research pays special attention to the mediating roles of political efficacy and deliberation behaviors of the electorate during an election period in South Korea. A multitude of studies have proven that political efficacy is one of the most immediate attitudinal explanations of political action. As one acquires feelings of heightened political efficacy, one becomes more likely to get involved in the democratic process. Also, deliberation behaviors, such as political conversation and reflection on news played an important role in citizens' political life. This study explores how political efficacy and deliberation jointly affect the pathway that connects news consumption with political participation, drawing on prior political communication frameworks, such as the cognitive mediation model, the communication mediation model, and the O - S - R - O - R model. This study suggests a two-step mediation model which centers on the roles of deliberation and political efficacy in political communication. Particularly, the hypothesized model incorporates the interpersonal discussion component of the communication mediation model and the political efficacy component of the cognitive mediation model into one, in order to theorize a holistic information processing framework that channels the influences of news consumption on political engagement. The current study provides empirical evidence to the hypothesized model by carrying out two cross-sectional analyses and one auto-regressive analysis from the data of a two-wave panel survey that was conducted during the 2012 presidential campaign in South Korea. Findings reveal that political efficacy mediated the relationship between news attention and political participation. Political efficacy also played a mediating role between deliberation behaviors and political participation. In addition, deliberation behaviors mediated the relationship between news attention and political efficacy. Most important, the deliberation behavior and political efficacy jointly mediated the impact of news attention on political participation, supporting the hypothesized model of this study. Such results imply that interpersonal political discussion and intrapersonal reflection on political issues help citizens make sense of the information obtained from the media, and at the same time, boost the level of competence of their political beliefs. The results also suggest that deliberation and political efficacy play a pivotal role in connecting citizen's information seeking behaviors with political participation. The findings also show that, among diverse news channels, social media have the biggest performance power in explaining citizen engagement in the political process. In addition, the results of path comparisons demonstrate that the paths from news attention via online and social media to deliberation, political efficacy, and political participation were stronger in the Wave 2 model than in the Wave 1 model. The findings imply that online and social media are providing South Koreans a more effective pathway toward democratic participation than traditional media by motivating their deliberative and by shaping political attitudes. The present study makes a significant contribution to the understanding of the ways in which South Korean citizens take advantage of recent new media technologies to engage in political affairs. Considering that many South Koreans have long been excluded from the actual political process, this study's findings provide practical meanings in understanding how we can boost citizen engagement in the democratic process in this digital age. Additionally, the hypothesized model of the present research helps organize a large body of theories on news consumption and political participation in political communication. It also suggests larger social and cultural implications for a healthy democracy across countries beyond South Korea.

Attorney's attitudes to divorce mediation, with particular attention to the social worker's role in developing a collaborative approach

Folb, Susan Gladys 10 1900 (has links)
Recent legislation passed by the South African Parliament has sharpened attention on the importance of mediation in the process of divorce. Without the understanding and cooperation of the legal profession, and of attorneys in particular, there appears to be small chance that this will be adequately recognised and brought to fruition. The research reported in this dissertation reflects the results of an investigation of Cape Town attorneys working in the field of divorce. Their attitudes to and knowledge of the concept of divorce mediation are reported, and the prospects of collaboration between a social work agency and the legal profession in divorce mediation have been analysed. It is clear that some collaboration is achievable between the social work and legal professions in this area. A methodology has been developed and validated that is generally applicable, and which could also be used for investigation of other professional groups. / Social Work / M.A. (Social Work)

Instituto Oswaldo Cruz. This paper discusses the conceptions regarding the construction of body, gender and sexuality among young schoolchildren mediated by the juvenile female magazines “Capricho” and “Atrevida” in a non - formal education context . It has been sought to develop a non - forma l teaching activity regardin g sexual education applicable to science teaching. With the sexual initiation theme it has been sought to articulate the knowledge of students about body, gender and sexuality having both “ Capricho ” and “Atrevida” magazines as mediators of the activities . Such social - anthropological perspective benefits from theoretical references in the fields of communication and education in order to articulate the youngsters’ knowledge using those magazines in the classroom . With the adopted perspective , the school app roach , focusing on physiology and preventi on of ST Ds , seems potentially expanded as it c over s subjective aspects of juvenile sexuality . The references to gender and sexual orientation present in the critical reading of the magazines done by young sters indicate an imbalance between the images produced by the media and the subjective experience to be exploited in teaching practices . The results point in two directions : first to the importance of increas ing actions of this nature in school and the possibility of expansion and articulation from non - formal to formal education in science from the students' knowledge mediated by “ Capricho ” and “ Atrevida ” magazines in the construction of knowledge. The second relates to facing such theme , which is yet po orly debated in the school environment , but of increasing interest to the Brazilian society in terms of rights . The language used by the media encourages young sters interest in learning and shows how the use of such magazines contributes to educators in identifying knowledge gaps observed at traditional science teaching approaches

In the case of this second group conformation, their dynamics assumes the role of mediator instrument to the participants of the group. To achieve the goal above, the research used was influenced by the ethnography and took place in a Psychology class in the Federal University of Ceará (UFC), with participant observation during the entire semester and the video recording of four specific classes which were facilitated by the students themselves. The main theory used was the Historical-Cultural Psychology. Nineteen young adults of both genders students were both the discipline and research participants. In videotaped meetings, group dynamics were performed with various topics such as communication, competition and motivation. The examination of the video recordings were made through an interpretative analysis focusing on group functioning and characteristics that suggest evidence of the transition between the two functions assumed by the group. Theoretical analysis categories were the concepts of group and mediation. The empirical categories identified in the observation of the recordings was the relationship between competition and cooperation, and the awareness of the group process, observing the times when there was a transition between the group space interaction function to the mediating tool function. To this phenomenon was given the name of transition F1 - F2. The results indicate that the competition together with the cooperation in a group context favors the transition F1 - F2. Another factor that can leverage this transition arises from reflection and awareness of all the stages of group process.

Muller, Paulo Ricardo January 2015 (has links)
This thesis analyzes representations of the Angolan province of Cabinda as a place defined by multiple mediations and characterizations of its social, political, economic, and cultural vocation, constructed in disputes for its embedding in distinct colonial and postcolonial projects. Through the analysis of ethnographic material produced in fieldworks conducted in Cabinda, I observed the ways different interlocutors presented their “reality” by assessing and interpreting practices and symbols viewed as traditional. The imperative of disclosing Cabinda traditions stems from a discourse of “cultural desolation” in the province constructed in concur with the evincing of its colonial situation. However, different social actors use representations of Cabinda mediated by colonial views as sources for the recognition of the work of disclosing traditions made by ancestors. The argument of this thesis is that this “use” of colonial representations constitutes a postcolonial perspective on the concept of tradition.

Molina, William Fernandes January 2016 (has links)
This work sets out to study the Project “Young Mediators for New Spectators”, developed along with a group of students from Escola Municipal de Ensino Fundamental José Plácido de Castro, a primary school located in the municipality of Sapucaia do Sul, Rio Grande do Sul. The Project, which was carried out between the months of June and December of 2014, featured two stages. The first consisted of workshops geared towards students, which brought them closer to Theater language, theory and concepts. It also promoted their access to spectacles, through the attendance of several plays. Later, the students took over the role of advisors in workshops offered to the community, hence expanding their knowledge of Theater and becoming mediators themselves. The present study seeks to examine the peculiarities of the process of forming spectators mediated by young students, and also how occupying the role of mediators can contribute to their formation as scene observers and autonomous subjects. Through practices devised by the students, geared towards people with little or no knowledge of Theater, the project aimed to equip and sensitize the youngsters in order to stimulate their active participation in the theatrical event. In this text, the actions developed along the stages of the Project are presented, described and then analyzed. The teaching trajectory of the researcher also permeates the writing, which gives evidence of the references and methodologies presented throughout this research. It draws upon the studies of Flávio Desgranges regarding the necessary practices for a pedagogy of the spectator, the notion of the emancipated spectator of Jacques Rancière and his viewpoint about the possible education processes in the exchange of knowledge between subjects, and Jorge Larrosa's notes about the knowledge that stems from experience. This work describes the expanded experience shared in the Project “Young Mediators for New Spectators” as a way of contributing to proposals of this kind, and above all, to the theoretical reflexion and practice regarding theatrical mediation and the formation of spectators at the school and community level.

Faria, Fernando de Abreu January 2013 (has links)
The development of new technologies has caused the growth of the amount of information available in the world in exponential scale. Organizations coexist with the excess of data and information, often wasting or not leveraging the power they offer. There seems no doubt that information is a key asset in organizations, but the problem is that it is not always structured or stored in the databases. Much has been studied about corporate governance and IT governance. The IT department of most organizations is focused on the 'T' of IT, and it is natural due to the fascination that technology carries on individuals. But the essence of the term IT is not in the 'T' is in the 'I'. As a response to the inadequacy of IT governance to deal with information a new paradigm rises in governance issues, information governance (IG). Information governance puts back the information as a central issue for organizations. This work identified through the theoretical elements of the Agency theory, the theory of Resource Based View of the Firm (RBV) and the theory of Dynamic Capabilities, some factors that should compose an information governance framework (IGF). To investigate this issue was chosen the banking industry. Among the motivations for the choice of this industry, the fact that it is one of the biggest investors in IT in Brazil and in the world, it also has well defined business processes, and it is very dynamic in the adoption of new technologies and processes. In this context, the central research question was " What are the effects of information governance factors on value in banking?". To answer this question, the research was conducted in three complementary phases, literature review, qualitative analysis and quantitative analysis. In the first phase, a review of the literature was performed in order to identify the factors of GI. In the second phase, there was a series of interviews with senior IT executives at banks in Brazil, Hong Kong and the United States for the presentation and validation of the items and factors of IG, with the subsequent content analysis. In the third and last phase, we used data from a survey research conducted with IT executives from Brazilian banks to test the IG model, which involves multiple mediation between the variables, with the technique of structural regression modeling. The results showed that in the perception of the IT executives of Brazilian banks who participated in the survey, the factors of information governance - policies, systems (IS / IT) and structure - have direct and indirect effects on value. And the factors systems (IS/IT) and structure mediate the relationship between the factor policies and value.

Silva, Ronei Teodoro da January 2017 (has links)
Researchers who study productions logic and reception practices on the internet have some difficulties of relating cultural issues to technological (ANTOUN e PECINI, 2007; SCOLARI, 2008; KNEWITZ, 2010). In order to do so, it is necessary to bring together culture, politics and communications theories to the ones more focused on the virtual environment. We propose to know the configuration of the mediation on the web, analyzing the communication flow of movie reviews published on YouTube. As methodological approach, we combine Social Network Analysis (SNA) with the Mediation Map (MARTÍN-BARBERO, 2013). From this clipping, we discover an exponential communication flow, mediated by virtuals settlements that self-organize in large collaboration networks. The interconnection between interactors is guided by participation and connectivity logics according to which, simultaneously, culturally constructed social values are replicated, contents are remedied and previously established models are reappropriated. Relations are mediated by hegemonic processes from the assimilation and reification of practices, customs and rites.

Bianchi, Letícia Corrêa Bitencourt January 2017 (has links)
This research presents the results of a qualitative and quantitative study on the proficiency in Portuguese language reading of 9th grade elementary school, ascertained by the Brazil Examination (Prova Brasil), as well as on the teacher training adequacy indexes. The indexes are based on the results of eighteen schools in the city of Gravataí / RS, for the years 2013 and 2015. This research seeks to answer the following question: The indicators pointed out in Brazil Examination, an external evaluation tool, help the teacher to mediate with students in order to promote reading proficiency Portuguese? The main objective of this work is to raise the possibility of teacher intervention to mediate with students to improve the level of proficiency in reading Portuguese from the indicators of the Brazil Examination. The results of the Brazil Examination offer indicators to increase the quality in Basic Education, but these can only be instruments that help mediate with students for the improvement of proficiency if they are discussed and analyzed by the subjects involved in the educational process. The results of this research reveal reading indexes lower than 275 points from a scale of 0-400, having only in 2015 a positive result in two of the schools surveyed. The teacher training adequacy indexes indicate that less than 80% of teachers have adequate training for the subject they teach. Teachers are challenged to work with students with certain content when they do not have the specific training. From the analysis of the data, we reflected on the use of strategies that allow students to interpret and understand the written texts independently and on the need for teachers to have the appropriate training to the subject they teach. In order to compose this study, Vygotsky was used, as theoretical reference, in what concerns the interaction, mediation and zone of proximal development; Kleiman, reader-text interaction, linguistic, textual and world knowledge; Charlot, reading as social practice; and Freire, reading as social action and political act.
